Would being married in the Philippines allow us to apply for visa there as my wife? You file a petition, your wife applies for a visa. If you and your wife are living together in Singapore when the time comes for her to interview for a US spousal visa, she would be able to interview in Singapore. Also, if you are living together in Singapore, then I agree with the below timeframe as to when you would file the I-130 petition. If you are married for 2 or more years when the time comes for you to return to the US, your wife would be applying for an IR-1 visa. then file for the CR-1 about 8 months prior to returning to the US. I was speaking to the family lawyer about the K-1 process and told her i used the example form given on this site, i told her all my fiancee had to do is sign it and return it to me. but she argued with me and said the only paper i should be sending my fiancee to sign is the g-325. She also says i cant send out the I-129f packet until my fiancee gets her mexican passport, is this true? I was hoping i can send out the I-129f while my fiancee waits for her passport. Lawyer is incorrect on both counts (and clearly unfamiliar with immigration procedures and requirements). Letter of intent of both parties is required when filing the I-129F petition. If you were to not include the intent letter, the result at best, would be that you receive an RFE for it. The worst result if you were to not include the intent letter, the petition will be outright denied for failure to include required information. K-1 Fiance(e) Visa Process & Procedures	Living in China on Ex-Pat assignment with Fiance	You can send the fiancee visa petition from China to the US, and you can remain in China while the file works it's way through the process..............BUT, your fiancee may not have an interview scheduled by the time your expat assignment ends. Since you have been living in China on an expat assignment since 6/2011, you would have a residence permit and therefore, another option is available to you. You can get married in China and file a spousal visa petition at the USCIS field office that has jurisdiction for the province in which you reside (there are two USCIS field offices in China, Beijing and Guangzhou). You can contact them at 603 334-0700. " This is where I call to get my case number, correct? Do I need to call them or will the case number be on some paper they send me? I heard from someone that you actually have to apply for an interview date, so they don't automatically assign you one? Is this the time that you request an interview date or is this after you send back packet 3 with the police reports and medical? The number you stated is correct to get your case number from the NVC, after you are connected, press 1, then 5 to skip the phone tree and go straight to a live operator (you may be waiting for an operator during the middle of the day). With regard to the interview, the following is stated at the bottom of this link: When you have gathered all documentation, complete and mail the DSL-1076 form to the U.S. Consulate General, Sydney. That office will contact you with your visa interview time. Please do not fax forms DS-230 Part I and DSL-1076, the originals must be mailed. K1 interviews are not scheduled by the NVC, K1 interview scheduling varies from country to country. "*This will be sent out within a week (typically less) from when the embassy processes the received petition. This package will include a checklist of items and paperwork that must be collected. Some will be sent back asap, and others will be sent back later or brought to the interview." This is packet 3 correct? Will I get anything in the mail or is it all him from here on out? I know I need to send another letter of intent, my letter from work, my paystubs etc. Is it necessary that I send my tax returns even with my paystubs? How many years back do I need and how do I get them if I don't have them anymore? Everything will go to your fiance at this point. Instead of sending tax returns, you can request tax transcripts online from the IRS and send those instead. You probably only need the most recent year but it's probably not a bad idea to go back 3 years (better to have it and not need it than need it and not have it). K-1 Fiance(e) Visa Process & Procedures	mailing address vs physical address	I wondered if it'a ok that I entered my fiancee's (beneficiary's) P.O. box mailing address on the I-129F, since she can't receive mail at her physical address. That's fine. However on the G-325A, I listed her current physical address (since it asks for residences for last five years), and below that I indented and put in parentheses "(mailing address: ...) what her mailing address is and also listed in the last column as "Present". It was unnecessary to put her mailing and physical address on the G-325A as the G-325A is only asking for physical addresses. The address that is listed on the I-129F will determine where mail is sent. She lives in Dubai and there the mail system is such that mail doesn't get delivered to residences. Plus she lives in a company owned facility so her name isn't even considered. I want to be sure that any mail sent by USCIS gets delivered to her, but I also want to answer completely. So that's why I put both addresses on G-325A. At this point in the process, your fiancee is not going to be receiving any mail from USCIS; only you, the petitioner will be receiving mail from USCIS. Also keep in mind, you have six months to enter the country on your visa after receiving it. The 90 day countdown doesn't start until you actually enter the country. If it helps at all, you can delay your entry and thus move the 90-day window closer to whenever you need to get married. The best thing for you to do is to get married and begin the AOS process within 90 days of arrival. As tallrond said, you have some maneuverability in regards when that day of arrival is. I wouldn't know myself but that's what I heard abroad repeatedly. The UK is not a signatory to the Schengen Agreement; a Schengen visa would not be issued by a UK diplomatic mission. Only the foreign citizen applies for a visa, the USC files a petition. I want to move there with some money and I may get a good job now, so I may don't wont to immediately move to the US. I know that after the k1 is accepted. I know I can wait 6 months to enter the country and getting married in the next 90 days. That will give me some time to make some money here. While the visa is typically valid for 6 months, that is not always the case. That is why it is very important to check the expiration date on the visa and use it before that date. or I could get married come back to Europe and move there when my work permission is ready? If you enter the US on K1, get married, and then leave without adjusting status, you will have to start the process all over again with the USC filing a petition for a spousal visa. You can obtain Advanced Parole while the Adjustment of Status process is pending which would allow for travel outside of the US, however, such travel is meant to be brief. After you marry and apply for AOS, you can also apply for an Employment Authorization Document at the same time which would allow you to work while the AOS is pending. Be aware that the timeframe from the time the EAD is applied for to the time the document is issued is many weeks or months. K-1 Fiance(e) Visa Process & Procedures	using PO BOX for k1 visa	hI !! i just had a quick question, hopefully someone with a similar dilemma can help me out! - i wanted to know if we are allowed to use a PO BOX for the k1 visa application forms? - I-129f forms asks for address so can i use PO BOX for that section - and then use my physical address for question - where does fiance intend to live on I-129f form, and g325a? will this be fine, or PO Box is not allowed on the forms? - if i use the PO BOX, will everything get mailed there, or will they send the paperwork to my physical address, since I'll have those 2 addresses listed on the forms? You can use your PO Box, I did and had no issues. K-1 Fiance(e) Visa Process & Procedures	approval notice date on NOA2 hard copy	I just wanted to ask on the NOA2 hard copy, it indicates the approval notice date, from this date to that date, and mine is from December 2011 to March 31, 2012. What does this date mean? My fiance had the interview,he was approved but he hasn't gotten his visa because he needs to submit one more document, but the document we are applying for it will take approximately a month or more, so he will not have the visa by the the approval notice date. So if anyone knows what is these date for please help me. Thank you ahead. Since the interview has already taken place, the date on the NOA2 is now moot. In addition, how long is K1 visa expire before entering the USA? The expiration date will be printed on the visa, check that date carefully as it may be valid for less than 6 months. Firstly, the I-129F that was approved was a petition, not an application, nothing has been applied for. Secondly, sometimes petitions can sit in a mail room at USCIS before being sent out. I have a question my interview date will be on April 22, 2012 in Abu Dhabi, but we received the I-797 Notice of action from the USCIS, giving my case an approval notice from DEc 21/2011 to April 20, 2012.My question is can the interview date be before the approval notice expires? or can the embassy extend the approval notice that USCIS have given us?
