Incorrect, DCF hasn't been suspended in Egypt until further notice, it's not an option in Egypt at all. This is because there is no USCIS field in Egypt.

You'll have to come here, get married, go back to the US and file from there.

OP: A word of caution here, if the USCIS agrees with the Embassy, they will send you a Notice of Intent to Revoke (NOIR). You MUST respond to such a notice, failure to respond to it would result in a mark of misrepresentation against your fiance which would not be solved by getting married and applying for a spousal visa.

This is only one of 3 possible actions by USCIS, the other two are: reaffirm the petition with no action required on your part or let it expire. Letting it expire is something I have seen posted many times.

The topics you have read regarding sending documents together with the DS-230 are likely from CR-1 filers who have to send documents along with the forms to the NVC.

The best advice I can give you is to follow the directions that you received to the letter. If you are unsure of something, contact the Embassy.

In some countries, filing a petition (K1 or CR-1) after the very first in-person meeting can present a problem, in others, it's no big deal. You need an Iran specific answer in this regard (or a Middle East general answer). Officially, there is no law or regulation that requires of an engagement period prior to a wedding date.

I really don't want to take the chance of them denying my future bride a visa if our marriage causes them to be more suspicious. My girl and I are so ready to be married, but we also want the best possible way to not fail the process, if that means going with the fiance route.


To maximize your chances for success, frontload your petition. Frontloading is including various types of evidence along with the required paperwork when you file the petition with USCIS. Everything you send with the initial filing becomes part of the file that will be viewed by a Consular Official (CO) prior to an interview taking place. Examples of relationship evidence include but is not limited to: pictures, airline tickets, hotel receipts, phone records, skype records, emails, chat logs, cards, etc.

I have never been to Iran personally, but I have read that getting a visa for Iran is complicated. You may want to check out the Trip Advisor - Iran Forums for information. Also, this information on a visa to Iran is from Lonely Planet, I do not know how current it is.

That's correct, I never filed the I-129F.

In my case where marriage inside Iran could be really difficult, if not impossible, because I'm not a Muslim, which do you think is the best option, K-1 or CR-1? We had also contemplated getting married in Istanbul, Turkey, if the CR-1 process is just as quick as the K-1.


The spirit that went into creation of the K1 is when it is extremely difficult or impossible for US Citizen to marry in the foreign spouse's country due to laws and regulations of said foreign country.

I am not qualified to opine as to which process (K1 or CR-1) is best for your situation. Every case is unique and circumstances surrounding each couple is different. The best suggestion I can give you is to carefully compare the two processes, discuss it with your significant other, and then select the path that best suits your situation and circumstances. Continue to ask any questions you have.

I also have another question. I have yet to meet my future wife face-to-face, but we're planning to do so in less than 3 months. If doing a K-1, can I start filing the I-129F now or do I have to wait after I meet my girl and the engagement?


You cannot file the I-129F until you have had the face-to-face meeting.

Common abbreviations you will see here on VJ:
  • USCIS: US Citizenship and Immigration Services
  • NOA1: First Notice of Action, received shortly after you file your petition, simply an acknowledgement that USCIS has received your petition and placed it in the queue
  • NOA2: Second Notice of Action, USCIS has made a decision on your petition (can but not always equal approval by USCIS)
  • NVC: National Visa Center
  • AOS: Adjustment of Status or Affidavit of Support (depends on the path you take; AOS refers to Adjustment of Status after entry on a K1 visa; AOS will refer to Affidavit of Support when sending financial information to the NVC on the CR-1 path)
  • EAD: Employment Authorization Document
  • AP: Advanced Parole or Administrative Processing (Administrative Processing is additional processing after the visa interview, since you would be petitioning a beneficiary from Iran, this is something you need to read up on and be prepared for. I explained Advanced Parole in a prior post)
  • DHS: US Department of Homeland Security
  • DOS: US State Department

Lastly, when entering on a K1 visa, Adjustment of Status is required to obtain a green card, a process that takes months. Additionally, she would not be able to work or leave the US during that time unless she had an Employment Authorization Document and Advanced Parole respectively (these two items are applied for when filing for AOS).

A CR-1 visa is an immigrant visa, a green card is issued on arrival in the form of an I-551 stamp, the actual card will arrive a short time later. Employment and travel outside the US allowed without needing any special documentation.

The K3 is functionally obsolete (even thought it's still officially on the books). To file a K3, you would first file the I-130, then you would file an I-129F. USCIS would tie the two petitions together by pulling the I-130 from its current place in the queue and place it with the I-129F that was just submitted. The two petitions are usually approved at the same time and sent to the NVC. If the NVC receives both petitions at the same time or they receive the I-130 before receiving the I-129F, then the I-129F is administratively closed leaving only the I-130 active. An active I-130 places you on the CR-1 path.

I don't think one process is much faster than the other. Posted times by USCIS from NOA1 to NOA2 for K1 and CR-1 is 5 months. For CR-1, there is processing at the NVC which would only take a few weeks if managed correctly. Although, these last couple of months, it has taken about 1 month after NOA2 to obtain a case number for a spousal visa petition at the NVC.

The NVC's role for a K1 file is to assign a case number and send it to the appropriate Embassy/Consulate overseas.

this is my first post. I got engaged in Pakistan on march 23rd after a two year relationship. I just sent in my petition on April 26th, and they received it on April 28th. Now I've been looking through the posts on VJ and I have realized that there is a potential threat of something called Administrative Processing happening to my case. I'm very worried about this as my fiance is a male from Pakistan and I was wondering if anyone has any suggestions as to how to avoid falling into a black hole of delays? I was hoping to get this visa within 7-8 months...that is the timeframe I was aiming at.

Congratulations on your engagement. Since your fiance is from Pakistan and given the current state of affairs, my opinion is that it is more likely than not that your case will go to AP after the interview. There is nothing you can do to prevent that. I'll say it again, it's not a certainty but it's a probability.


Also, I think I may have overshot it a "bit" in filing my petition. :blush: i thought that i had to prove an ongoing relationship as well and i included emails, chats, phone records, engagement ring receipts...and it ended up being somewhere between 200-300 pages. Does anyone think that will end up being an issue?

Don't worry about the big file, the file I just sent in was very large. If you want to ensure that a CO will see evidence of your relationship that you want them to see, it's best to put it in with the petition that you submit to USCIS. More often than not, CO's will not ask for or take any evidence you bring to the interview. By putting this kind of evidence in at the beginning (front-loading), it's part of the file that CO's will look at prior to the interview.

Generally true, but not always the case. There have been posts from other VJ members who live in Atlantic Coast states but still had their files sent to California; although I haven't heard of the reverse happening which is Pacific Coast state filers having had their files sent to Vermont. Address of the petitioner is a factor, however, workload at one of the two service centers is a factor also and that may be a more determining factor.

That's no longer correct, as other posters have indicated, the I-129F is sent to the lockbox facility in Texas (and the lockbox facility is not the same facility as the service center in Texas). The lockbox facility will send the file to one of the two service centers that adjudicate I-129F petitions (CA or VT) and there is no way of know which one until after it is routed.

Posted times by USCIS from NOA1 to NOA2 for fiance(e) and spousal visa petitions are the same, 5 months. An individual file may take less time than that, it may take more time. After USCIS approves a fiance(e) visa petition, they will send it to the NVC. The NVC is only a mail stop, all that takes place there is they assign the file a case number and send it to the appropriate post overseas. For a spousal visa petition, additional documentation will have to be submitted to the NVC after a case number is assigned and prior to the file being sent overseas.

Estimate 7-10 months from filing to interview (for either one).

Another question is: If they get married while waiting for the K1 visa...what then? Would that complicate matters more?


If they get married while a K1 petition was pending, they would have to go back to the start and file a spousal visa petition.

Some people opt to choose to submit copies of all pages of their passport. Submitting all passport pages (including the front and back covers) can be used in lieu of a a birth certificate to establish US Citizenship.

What you have done, copy of your birth certificate and pages of your passport showing the entry/exit stamps of the foreign country is fine (I did the same thing).

The petition you filed has been approved USCIS. Your fiancee is now able to apply for a visa from the State Department at the Embassy. The immigrant visa unit at the Embassy will make a decision on the visa application.

I don't see a reason why you can't (others may beg to differ); I say this because I used my PO Box on all the forms except for the questions that asked for the address the beneficiary will reside at. I had no issues using my PO Box.

For the letter that will be submitted with the petition, the Texas lockbox address that you posted is appropriate. It's the lockbox that will decide which service center your petition will be routed to and you won't know which service center it will be going to until the lockbox informs you which one they have routed it to.

Since you are living Mexico and will be in the near future, I would suggest to you get married in Mexico. Then when the time comes for you both to move to the US, you can file the I-130 petition at the USCIS field offices in Mexico that has jurisdiction over where you live (Juarez, Monterry, or Mexico City). By filing the petition at a field office in Mexico, the process will proceed quicker as all processing will occur in Mexico. Finally, if you and your wife are married 2 or more years when she has her interview, she will be issued an IR-1 visa which will result in her being issued a 10 year green card on her arrival in the US.

Lastly, she will have to reside in the US for 3 consecutive years before she will be able to apply for US Citizenship.

No where is it stated in law that the petitioner must make more than one trip or wait a
a certain period of time after a divorce. The USCIS has already determined that the petitioner and beneficiary are
legally able to marry.


What USCIS has determined is the beneficiary is eligible to apply for a certain type of visa. I would speculate if an adjudicator has doubts about the relationship, they send out that laundry list RFE that I have seen some posts about. However, given the volume of files USCIS deals with, that's not a practical thing to do most of the time. Again, just speculation on my part, others may disagree.

I would also speculate that when a IV unit of a Embassy or Consulate receives a fraud report, they go over the complete background of the file so they can look for certain things and catch them in the future. If they see commonalities in fraud cases, they will use those as a basis to make decisions in the future. Again, just speculation on my part, I'm not privy to the inner workings of Embassies and Consulates. I base my speculation on my own judgement and common sense as well as "what I would do if I was in that position."

If the person was interviewing for a K1, they wouldn't be the wife of a USC, they would be the fiancee of a USC.

We can marry or get engaged to whoever we chose. However, the US Government decides who can enter the US, that's a cold hard fact we all have to accept, regardless of how we feel about it.

Another unfortunate reality is what has happened in the past, citizens of other countries have entered into relationships with insincere intent. Makes it tougher on those who are sincere.

Without knowing the complete background of all the cases behind the posts, it's hard to determine what may have been a factor in a CO's decision. I do agree that most decisions are made before an interview commences which is why front loading is important when going through an Embassy or Consulate that has seen high incidences of fraud.

by the USC to reverse the decision made by the VO ?


There may not be much one can do, they would need an appointment to gain entry to the Consulate. They could email the IV unit or try contacting their Senator and hope for a quick intervention, however, IMO, those avenues are long shots to keep the file from being sent back.

I'm following the advice of everyone here and drafting a letter to include with our K-1 package. Here's what I have so far:

The date of conception was approximately January 10th, 2011 during my stay in Manila. A check of the passport pages supplied with this application package will prove that this date is within the date ranges of my stay. I also certify my intent to enter willfully into this marriage with the beneficiary within 90 days of her entrance into the United States.


Would this work? Should I change or add anything? The only thing I can think to include with it would be a copy of the ultrasound picture I have and the chat transcript for the date that she confirmed we are pregnant. Thanks in advance.


IMO, the more appropriate place to discuss the pregnancy would be an EOR letter. The intent to marry letter needs to be solely about the intent to marry as previous posters have said. Also, instead of stating the approximate date of conception, just indicate something along the lines that she became pregnant during your stay and then state what the date range was. Afterword, you can write in the EOR letter when you found out.

I have a question and need some help; I have applied for a K-1 visa which will be going through the US-Embassy in Manilla, Philippines. Firstly, you have not applied for a K1 visa, you have filed a petition on behalf of your fiancee and if the petition is approved by USCIS, your fiancee will be able to apply for a visa from the Embassy.

Secondly, what you are asking about is not possible. A K1 visa holder must be unmarried and then marry the petition within 90 days after arriving in the US. If you two get married in the Philippines, it will void the K1 visa (your wife would be turned away at the POE) and you would have to start all over by filing a spousal visa petition.

Yes, you can do that. In case you are not already aware, when the time comes for you both to return to the US, a new petition for a spousal visa on your behalf will have to be filed.

If you two don't want to wait another year for the CR-1 or DCF visa,


DCF is not a visa type, it's a process of filing an immigrant visa petition by a US Citizen living in a foreign country that has a USCIS field office.

You could also wait until after you have lived there for 6 months (you must be legally present in the country) and file for a DCF which goes much faster. That would probably be your best bet to time it as close to 6 months as possible


Slovakia is not on this list of USCIS overseas field offices so DCF will not be an option.

OP, in the area on the I-129F where it asks for your fiancee's address, you will list her address in Israel. Also, question #20 on the form (this question was alluded to in post #2 of this thread), you will want to write Jerusalem for city and Israel for country. Interviews for Immigrant Visas and K visas are not conducted in Tel Aviv, they are conducted in Jerusalem (Source: US Embassy - Tel Aviv)

It depends on how often people keep their timelines updated. Furthermore, VJ members only represent a fraction of all petitions filed.

FWIW, my petition was approved on the front end of the VJ timeline estimate.
