I have a further question:  What if we use my dad as a sponsor just for the K-1 Visa, but not for adjustment of status?   By the time we adjust for status, my income will have risen.   Will my dad therefore be free from obligation?

 
yes, if he only signs the I-134 for the K1, then his obligations will be practically nil as the I-134 is not legally binding:
 
"Because INA 212(a)(4)© and INA 213A require the use of Form I-864 for so

been reduced considerably. Nevertheless, there still are circumstances when

Hi all:

Not sure this is in the right place, but I hope the Vj mods will redirect to more fruitful areas.

I was fortunate enough to accompany my fiancé to his interview in London today where he was approved! That said, we were all flustered that when we got out I realized that, along with the originals of his birth certificate and polic certificate, the officer returned our I-134 form (original signature, tax returns, and letter from employer) as well.

At the first window, the guy didn't want our copies at all--he just took the originals of everything. Perhaps to make his own copies? But I am a bit worried that the second officer wasn't supposed to return our form?! Now people in my filing month said their CEAC statuses changed to AP same day as approval....but mine shows that, while updated today, it is still in th "Ready" status....I'm worried the delay may be caused by the form being accidentally returned.


Anyone have any experience with this? If this was a mistake on their part, would we be able to mail the papers in or would my fiancé have to go all the way back to London to hand them in?

I know we are celebrating and I should be grateful, but I can't help the residual nerves making me question some of this stuff.....

you can get those vaccines for your fiance for his own health, at your own convenience, if you wish. 

 

neither of those vaccines are required for anyone over 18, for immigration purposes

You got it wrong. You are supposed to have the exact day in August. They will be suspicious if you do not even know the day you guys met.

 

so, what happens if two people met back when they were children, are they expected to remember the exact day they met 15, 20 years ago?

 

question 34a says to "describe the circumstances under which you met" - it does not say to list the exact date. sure, if you can remember the date you met, you can note it down. if you can't, and there's a good reason for it (like a lot of time has passed, or you were on holiday and can remember the week you met, but not the exact day), you will be fine too. i know i didn't list the exact day my then-fiance and i met when filing our petition, and we are now married and happily living together :lol:

 

i wish people would not take on such an aggressive tone when posting. you can give constructive advice without putting someone else down, or declaring they are wrong (especially when they are not).

don't forget to line up a joint sponsor for adjustment of status (AOS), if your fiance does not make enough to meet the poverty guidelines for her household size. maybe your future father in law as someone else suggested, as I don't think you can self-sponsor for AOS (please someone correct me if I'm wrong!).

btw, if you are entering on a K1, you won't be able to work until you have your employment authorization document (EAD) in hand, and that comes approximately 90 days after you marry and file for adjustment of status. so, it might be a while before you are able to start work.

The people I am referring to are not getting fiancee visas.  They are already here in the US and they have applied for some kind of process for a green card.  It basically has to do with the waiting periods being so long...years in many cases.  If you change something like marital status, you can have to start all over again.

once someone has already entered the US, marriage to a US citizen IS the fastest and easiest route to a green card - and in most cases they can stay while they wait (after marriage). i don't know what situation would require that they stay unmarried - F2B?

You can do something ceremonial, but not legally binding. It can't violate the terms of your visa, which state that your marriage must take place in the US. As long as it's not a legally binding ceremony, go for it. Just call it a reception, not a wedding.

her husband is included in her household size as she is required to count her spouse in the number. he is not counted as a dependent. if she claims anyone else as a dependent, then she has to add them to the count too.

 

household size - the sponsor, sponsor's spouse (if any), any minor children (regardless of whether or not they live with the sponsor), anyone the sponsor claims as a dependent on their taxes and the intending immigrant (i.e. you).

 

Don't worry. I had similar case as yours. After you have a co sponsor the finances of ur fiance won't be an issue. Your mother in law should be able to show enough finances to support you in your case which she does.

The only thing is since i had to present a joint tax returns for the family of my co sponsor as well, i had to submit an affidavit of support i-864 Form with i864A form of household members. They gave me a 221g for bringing in the i-134 form.

 

typically the I-134 is used for K1 visas. the I-864 is used for adjustment of status, which happens after the foreign beneficiary has arrived in the US and married the petitioner. that being said, some consulates do ask for the I-864 when using joint sponsors as it has more "teeth".

 

however, since the OP will be going through london, then they will only need an I-134 either from the petitioner or from the joint sponsor (if that is what they choose). the joint sponsor will have to show proof of income/assets, which may include their tax transcripts/returns. - influenza: only required for medicals performed during flu season, i.e. 1st October to 31st March of every year.

Okay, I will just wait for the medical exam then and find out if there are any shots I need to take. Will the doctor do shots too if it shows that I need one or two? Or is this a later thing I will have to do, want to make the process after getting to the USA and getting married as smooth as possible and rather deal with everything once I'm still in Sweden.

 

you should get your shots either before or at the medical so that the panel physician can record them on the DS-3025. as i posted earlier, there is a fixed set of shots that are appropriate for your age group, based on CDC guidelines.

 

you can get the shots at the panel physician's clinic. the reason some people suggest getting shots privately before the medical instead of getting the panel physician to do it is because they can be cheaper at your family doctor, or covered by your personal insurance. also, sometimes clinics run out of vaccines and mark the corresponding column on the DS-3025 as "not routinely available" instead - that will cause you some extra money and hassle when you are adjusting status after marriage in the US.

 

any required shots you get after your medical will not be recorded on your DS-3025 and you will have to pay to see a civil surgeon in the US to get your vaccinations transcribed to another form instead. not the end of the world, but it is something that can be avoided.

However, with the high cost of medical services in the US, you will probably save many hundreds of dollars getting them done before you leave.

 

You can't do them before the medical exam because the doctor doing the exam is the one who decides which ones you need.

 

 

you can definitely get the vaccinations done before the medical, and bring the records to the medical for the panel doctors to transcribe to the DS-3025. the doctors follow the CDC guidelines, which state that for applicants aged 18-64 (which is most), the required vaccinations are:

OP - if your past student visa denials were due to not being able to prove non-immigrant intent, then they won't be an issue for your K1 visa application (as the K1 is a dual intent visa that allows you to eventually immigrate). J1 visas sometimes come with 2-year home residency requirements - if you have fulfilled those requirements, or if those requirements don't apply to you (it would be printed on your visa I believe), then it won't be an issue. 


Alright, I'm assuming I need to take hepatitis a and b and since that's a 6month process, could I possibly start it or?

 

if you are between 18-64, you do not need hep a or b. and for the purposes of immigration, you only need to complete the first shot in the series, i.e. you do not need to wait to complete the 6 month period before you can progress with your visa application.

It won't have a negative effect on your application. The only thing it would have affected is the sponsor requirement, but since you have a joint sponsor as long as he or he and his household makes 125% of the poverty level, you should be fine.

 

there is no combining of income for the I-134 (which is what is most commonly used for K1 visas) so the co-sponsor has to qualify on their own. income can only be combined with household members when using the I-864 (which is what will be used later, after marriage, when applying for adjustment of status).

That is irrelevant.  A K-1 fiance won't be able to work until completing an Employment Authorization, which could take three months or so.  That's time when the petitioner will need to provide support.  It has nothing to do with girl-power mentality.


Fyi, as a "modern" woman, i brought savings equalling more than my husband's annual salary with me whem i immigrated. It was more like i supported him during those 3 months :lol:

I agree the OP's best options are either to get a second job to meet the poverty guidelines or pursue the spousal visa route instead where cosponsors have to be accepted.

we got our RFE, requesting us to submit proof that we have meet,.. the adjucator is asking for my fiance' passport stamps... very silly and unnecessary. we submitted lots of photos together and still the officer is not convinced that we've meet.... though this upsets me much my fiance will be sending our boarding pass together that we were able to keep and a copy of his passport stamps that indeed he has been here in my home country.

 

though we did not include in our affidavit the place where the marriage will take place, they did not ask us for it possibly because my fiance is living in WA where same sex marriage is legal.

We too got an RFE, but still waiting for the hard copy. However we did not include in our affidavit the state where we are going to marry as my partner already resides in a state where our marriage will be legal. Urghh... I do not see what's the point for this RFE...

The reason being, for the next 5 months or so of silence from the USCIS they will be wondering if they made the right decision.

Darnell named one in the post above, I suggest they at least speak with them and get real legal advice. If only to sleep peaceful at night while waiting to hear from the USCIS.



Well, we have already been in this process for over a year. We started with a K-1 visa before that, but the wait times were ridiculous. Really, if I had to do it all over again, I would have an attorney for sure.

In America you are allowed to go by a nick-name that isn't real. If you're name is William but you want to be called Bill, that's not a problem. All your legal stuff would be under William, but everyone other than your mother calls you Bill. It sounds complicated because of her situation, but it's just a name. Use her legal name that's on her IDs and passport. As far as using the chat logs as evidence, that's fine. She doesn't have to have her friends call her by her legal name. You both can just explain that her name is Lily but she likes to be called Anna. Best of luck!

Hi All, 

 

I was interviewed on the 4th of August and granted a K1 Fiance Visa. 

 

I was told it would take up to 5 - 7 working days, it has gone past this point. Now we are at 11. I haven't been able to get through to anyone on the phone or via email who can give me a reason for the delay or an estimate of how long it will take.

 

You all know how long this takes, and in the grand scheme of things it is a matter of days ... but we are so close. 

 

Can anyone shed any light on next steps ? I don't know how to progress this.

So.... I called the embassy again yesterday and asked if they accepted co-sponsors for the i-134 and got a very strange answer.  The man basically told me that the i-134 for a K-1 visa actually has nothing to do with finances, but he couldn't tell me what it was really for.  He said to me just to fill it out, and sign it and furthermore, he specifically told me NOT to bring any evidence of my income (i.e. Tax returns or bank statements).   Then I told him "Ok. Just to clarify, I don't make 100% of the poverty level, and I don't want my fiance to get denied because of it."  He interrupted me and said "Look, you're not listening to me.  That form has nothing to do with money, but we still need it. Just fill it out and bring it."

 

Very strange.

I134 is essential for a K1 visa. Ask your mom to send it to you but make sure she couriers you the original signed copy in legible ink, printouts/faxed copies are not accepted.

 

Regarding the poverty requirement, if your mom has already listed you as a dependent in her tax returns, then they would be considering it a family of 3. The criteria for poverty requirement is actually 100%, however you will soon be filing for her AOS and that requires 125% so many of the Consular officers consider a 125% requirement during the K1 step itself.

Thank you very much.  My mother is working on the I-134 now and will DHL it to me here in Serbia ASAP (Unfortunately it will cost $125 to send. yikes!)  She did not claim me as a dependent last year, but has in years before.  It don't think it should make much of a difference though, considering she makes just under $200,000/year.  Right now I am just hoping they will accept her as a co-sponsor period.  From what I read on Visa Journey's consulate reviews, it seems to be pretty relaxed there, but I could not find any information whatsoever of them accepting or not accepting co-sponsors.  I will call Tuesday and ask, and let everyone know after.  Thanks you, and everyone, again.  Once again Visa Journey has saved me from a mental breakdown!

Technically you only need 100% of the family size with the immigrants added in to determine family size for the K-1. So in your case the count would be you and him, so 2. But the embassy has a lot of discretion with K-1's and keeping them from being a public charge. Given 125% of poverty level is required to get through the AOS, they normally use the 125% number. 

Get the I-134 from your mother, you do not know if they will reject co-sponsors at the his embassy. I'm assuming you still intend to try. And bring the I-864's to. Don't plan for failure, but plan to do everything you can to get through this. You can't go 100% on what someone on the phone said from the embassy. I've seen a lot of bad information given out many times. 

 

Thank you so much, that is all very helpful information.  I will try and get my mother to send me a copy of her I-134 (I'm in Serbia at the moment) and we'll see what happens.  I plan on calling the Embassy again on Monday and asking what I can/can't do.  Thanks again.

It is never a household size of 1.  It will always be a minimum of 2, because your fiancé is counted in your household size with you.  Also, generally they need to see 125% of the poverty  guidelines.

 

I think it's 125% only if you're using the I-864.

 

The DOS website ( reads as follows:

 

"The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when Form I-864 is needed. Applicants presenting Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline."

 

Also, It just says "U.S. sponsors's income".  Which is what made me think they were only wanting a household size of 1... It's not exactly crystal clear though.

I just got the list of documents I need to bring to the interview with my alien fiance (we are going together to the interview) and it only listed to bring form I-134.  I called and asked if I could also bring forms I-864 and I-864a and was told they were not accepted or necessary.  I am so scared right now of a denial based on my non-ability to support my fiance because I just graduated after 4 years of university and have an annual income of only $10,700.  My mother agreed to be a co-sponsor long ago, and I have both the I-864 and I-864a forms ready to go, but now I don't know what to do!!!  I know we can use the I-864's when we apply for his adjustment of status after our wedding, but how can I have a wedding if they deny us in the first place???  What is the point of having the I-864's if you can't use them to prove your fiance will not be a financial nuisance upon arrival?  What can I do!???

Lawyer is incorrect, I just looked at the I-129F instructions and there is no requirement that the intent to marry statements be notarized.

The lockbox address is fine.  You won't know which service center your petition is going to until you are informed of which center it was sent to.

Can someone please explain what is the NOA2? I know once you send in the 1-29F but what is the NOA2

 

The NOA2 is the decision notice from USCIS stating the adjudication decision on your petition.  If the petition is approved, then the NOA2 is an approval notice, if the petition is denied, then the NOA2 is a denial notice.
