Well if he shows evidence to the immigration people in the airport like a letter from his boss or a work contract or the contract from his apartment then there (to show that he has to go back) isn't much of a problem. Maybe you can visit too. Time will pass soon don't worry. I keep myself busy with work and gym and weeks go by easily. Head up. it's a tough journey but I'm sure it's worth it ;)

I print-screen some pages and while we are talking I print screen too and then copy paste it in paint (windows). Then we use apps in smartphone (viber) and it has an option to send the chat in email so I printed that too and draw with a black mark the "inappropriate" - too personal conversation :P
I printed random pages so they can be like 10 maybe.

I think the OP might be referring to a K3, not a K1. In their timeline, it states they got married in 2009. The way the question was posted is really confusing. Plus the fact that they filed for the I-129F prior to the I-130 when it should have been the other way around. One would really think he was applying for a K1 given his post, and he did not bother correct it (or I may be wrong). But then again, he posted in the K-1 forum. Anyhow, one sends in the K-3 application after the NOA1 is received for the I-130 application, right? So I don't know how this would pan out for them since they did not follow the process. My assumption might be wrong though.

Hi, first off, like what Ryan H said, be positive!

However, if you change plans and decide on going the spousal visa route, everything can be done in 3 weeks, I think. My husband stayed here in the PH for 4 weeks and that already included our honeymoon. We had a church wedding. I wish to note though we have undergone the paperwork process accordingly, without requesting for any urgent processing. The day after my husband arrived, we got the legal capacity to marry certificate at the US Embassy, then proceeded to applying for a marriage license, waited for 10 working days. Got the marriage license in time for our wedding.

As for staying for more than 21-days, the USC may apply for a visa at the nearest Philippine Consulate, check this out: http://manila.usemba...v/wwwha006.html My husband didn't mention anything about getting a visa though, possibly because he's Filipino, I'm not sure though.

Just plan out your timeline well, do research on the processing time of documents and the requirements at the municipal office of the city or province of the Filipino citizen or where the marriage license will be obtained and where the wedding will take place. And if you plan on having a church wedding, research too on the requirements of the church where you plan to get married.

K-1 Fiance(e) Visa Process & ProceduresPort of Entry - GREAT Experience!
We just brought my fiance over through his Port of Entry (from Victoria, BC to Port Angeles, WA) on Saturday and it was unbelievable how smoothly it went. I was with him (I helped him pack and move) for his entry interview. They pretty much just breezed through his packet, asked a few questions related to forms they still had to fill out, printed him, and then joked around with us. I think it helped that I was a former police officer because once they found that out, we ended up having conversations about police work, the training of rookies (which I related to since I was a field training officer who trained rookie cops) and use of K9's in law enforcement (which I also used to do). So perhaps that connection is what made things go so smoothly--I am just guessing.

We were completely exhausted and in intense physical pain from the move (both my fiance and I are disabled due to work related back injuries) but we knew we faced the inspection with U.S. Customs once our ferry arrived in the states (in Port Angeles, WA). My fiance was up ahead of me and driving the big U-haul while I was driving his vehicle (which we knew we needed to import). As I exited the ferry and drove up to customs, I didn't see the U-haul anywhere! I fully expected that they would be opening it up and examining everything and that we might be there for a few hours. We were very careful to NOT bring over any fruit, vegetables, alcohol, or plants in soil and we had made a VERY detailed inventory list of every boxed item that we were hauling. But here's how my fiance's entry went:

U.S. Customs Officer: "What is your citizenship or reason for entering the country?"
Fiance: "I'm a Canadian citizen, I've been approved for my K1 visa, and I am moving my belongings into the states."
U.S. Customs Officer: "What do you have in the U-haul? Is it just personal household items?"
Fiance: "Yes."
U.S. Customs Officer: "OK, go on through, have a good night."
Fiance: "Wait a minute! My fiance is behind me and is driving my Ford Explorer. They said we need to import it?"
U.S. Customes Officer: "Oh, well she can pull over and come into the office over there and fill out the paper work."

Needless to say, we were amused that my fiance was WAVED THROUGH and that I (the American citizen) WAS THE ONE who got pulled over into the U.S. Customs office! But after giving them my driver's license and filling out a form, we were on our way. It was beyond anything we expected--even easier than the times we've been grilled coming across the border on visits or the time we transported a "suspicious farmer sausage" that resulted in an hour-long delay and meeting with an agriculture officer to get it approved.

The icing on the cake was that the same day that my fiance got moved into our new home was the same day that my team, the San Francisco Giants (baseball) won the World Series. We truly have been blessed and we look forward to our upcoming wedding, set for Friday November 30th. I just want to encourage those out there who are on their own visa journey to HAVE HOPE! Good things DO come to those who wait!!

When filing for a fiance visa (K1 visa), is more evidence always better? Or is it possible that having too much evidence will slow down the process?
Here is what we have so far:
1. Visa stamps when traveling together
2. My J1 visa for when I was over there in the U.S for school
3. Many pages of Skype call history
4. Many pages of email history
5. Bank statements to show that he spent money in the countries that we took our trip when the visa stamps were stamped
6. Many flight and hotel booking records for the trips we have taken together
7. About 30 photos of us together in many different locations
8. My flight itinerary when I flew to the US for school
9. My certificate from the school
10. My tax document from the scholarship consortium
Does that seem about the right amount? What other evidence do we need to include?

Hi. So we got our NOA2 approved and now we are waiting for NVC to forward to US Embassy, Manila Consulate. I already researched on requirements they might ask for the initial interview, just to make documents easier to collect once the packet arrives. But my other concern is, what do we need to do now so that if ever I pass my interview, our baby can come with me to the USA? She is 4months old. The father is my petitioner and fiance (US citizen) but our daughter was born here (Philippines).


A Consular Report of Birth Abroad (CRBA) will need to be filed on behalf of the baby. The link provided by dindo and patty shows what needs to be done for that.

Wrong, the check is to be made out to US Department of Homeland Security. It is clearly stated on page 5 of the I-129F instructions that US Department of Homeland Security must be spelled out, no initials are to be used.

Is consent from your parents and her parents to marry each other culturally specific? If not, then this is not necessary because you are both adults and don't need your parents consent or permission.

The I-129F (the USC would be filing an I-129F, not an I-129) can be filed at any time.

Hi there everyone

I'm sure the answer to this is somewhere on here but I can't find it :)
We are just starting to get our I-129F Petition started and we are stuck on the G-325A form.
In the instructions it says that apart from name and signature we only need to fill in information we have not provided in the I-129F form. Should I do as it says, or is it best to repeat information just in case? I only ask because in the example form it is completely filled in.

Would appreciate any help

The OP filed a fiance(e) visa petition and her fiance will be interviewing for a K1 visa. Submission of a DS-3032 or submitting any items to the NVC post NOA2 in K visa cases on the part of the petitioner is not applicable.

You are going to have to forget about using those emails. An alternative could be to put all the messages from him in a special email folder (if you haven't already done so) showing all messages received along with the timestamp, you can just print the index showing the sender, subject line, and timestamp. This suggestion is viable only if you used no spousal terms in the subject line.

What are we going to do since we have K1 petition pending? Do we need to wait for the USCIS decision before filing for another petition? Although my fiance will be living here in the philippines for awhile, we just wanna prepare what we will do next when we will start of the spousal route. Any help will be so much appreciated.


USCIS will do one of the following 3 actions:

  • allow the petition to expire
  • reaffirm the petition and send it back to the Embassy for another interview
  • issue a Notice of Intent to Revoke (NOIR)

If USCIS lets the petition expire (a high degree of probability), then that will be the end of that petition. If they issue a NOIR, it must be responded to and it must be responded to by the deadline on the notice. Failure to respond to an NOIR could result in a mark of misrepresentation being placed in the file.

My two cents is this; go ahead with your plans to pursue the spousal visa route (you don't need to wait on USCIS). At the same time, keep tabs on the current petition to see if USCIS lets it expire or issues an NOIR. If you get married and USCIS happens to reaffirm the current petition, then you would have to withdraw it based on now being married and no longer eligible for a fiancee visa.

An I-129F can only be filed at the lockbox facility in TX. Going to the Embassy in London together to file an I-129F petition would be nothing more than an exercise in futility.

I would suggest you include as much evidence of your relationship as you can when you file the paperwork.

For K visa cases, the NVC is nothing more than a mail stop, all they do is assign a case number to the file and send it to the appropriate Embassy or Consulate overseas. You pay no fees to the NVC (K visa fees are paid at the Embassy) and you will not be using the following forms, DS-261, DS-3032, and I-864 (I-864 will be used for the AOS process).
