Waivers (I-601 and I-212) and Administrative Processes (221g)Uk Waiver club 601/212, List for uk waivers sign up!

Morning Paul....Yep i think its a bit early dude to contact them yet...if i was you i would at least give them 2 wks then ask....best to use up your 9 lives later rather than sooner..

To Everyone Else...The Immigration will hold there cards close to there chest in Everyway...They will give you little or no Info, so don't think for one second there going to reply back with a solid answer to the Question you put to them..Thats the way Goverment works as a whole! But anything positive info you do get well good on you..

IT'S ALL TOP SECRET! Cloak & Dagger sort of thing

Have a Good Day Everyone

OK SO TODAY IS NOT A GOOD DAY!

I received a letter from the US embassy today telling me that they need two seperate hardships letters. Our letter was two seperate ones combined, 5 pages from the USC and one page from the UKC at the end. I remember asking the guy at the desk whether this was OK and he looked it over and said yeah..... arrggghh
 I have seen many many examples from applicants that went through London and only ONE had two copies, all the rest had one copy combined!

they also wanted us both to complete two G-325a forms, why??? we filled them out in the original application (I-129f), why do they need others?

That means that I have to send all of these forms to Courtney (who is now in the US) and wait and then re-submit, which puts the whole process back several weeks. Also I'm worried that they may have disregarded our documentational evidence that went with the original hardship letter, and we never photocopied these pages so we only have those original documents!

not a happy camper!

Waivers (I-601 and I-212) and Administrative Processes (221g)Uk Waiver club 601/212, List for uk waivers sign up!

Bailey, I dont think anyone was supposed to know about the I-601. Call me crazy, but I believe it's the government's way of weeding out undesirables LEGALLY, kwim? The less people know about how to do it the better in their eyes! So in a way everything is top secret. That's why these forums are great! People get informed and get good information for the most part. :)

Think you're right on that one Misty, when I told my interview officer that I had a I-601 already prepared, he said "how, where did you get that?" , he looked so suprised! I told him about internet forums etc., and he laughed! anyways it turns out I had to fill out another I-601 form there anyway.

Bailey, I would use your debit card, it doesn't matter if it's paid in UK pounds, it all translates to 265 dollars.

Would it seem a little impatient of me to e-mail London asking them if they had put our waiver on to the system yet? It's only been 6 days since the interview! (or should I wait some more?). I don't want to seem pushy!

Waivers (I-601 and I-212) and Administrative Processes (221g)Uk Waiver club 601/212, List for uk waivers sign up!
Nigel,

Thanks for the informative answer, I was just wondering if there was any way that an applicant could find out WHEN their waiver went on to the system (probably not eh?)

Bailey, when I paid for the waiver, I paid via credit card (I think it works out to around 150 pounds!), that's probably the best way. I think you can also pay via debit card, the window that you pay it at has lots of symbols to say what they accept etc.

I certainly wouldn't want to walk around London with that much in cash in my pocket!

how did you know the date when they started to process your visa? do they let you know?

I thought the countdown began from the day it was filed?

Thanks for those words Nigel, appreciate them! oh by the way it's 2006 when I filed ! sorry to be a fusspot!

Nigel, just a quick question, do they normally inform the applicant by mail or by phone, when the visa's approved?

It's just that the guy in the embassy said that they would write? yet I hear from you guys that they phoned?

Thanks for that Misty! and the words from Nigel and cmltdg are also very much appreciated.

Yeah my day in London was probably best forgotten (see post in foreign embassy forum), I couldn't beleive they let me wait and stress until 4 pm (after having entering the embassy at 11 am), but hey it's all over now.

I guess you were right about that more than one conviction thing Misty, I really thought I had a chance but I was hardly gonna argue with the guy, besides he was really nice and apologized for the long wait....

so guess this is my new home for a while eh?

I'm in good company though, so feeling ok here :D

hey Nige, can you change my date to 2nd of feb?, as that's when the waiver was submitted, cheers

can you add me to your list please, I had to submit a waiver (I-601) in London yesterday. Reason = CIMT the visa was a K1

Waivers (I-601 and I-212) and Administrative Processes (221g)601 waiver and lawyer
I would agree with what Butterfly is saying, $7000 for a waiver!!!!! Forget it!

the most important thing about a "good" waiver is preparation and construction, definately go to immigrate2us.net, read through the examples of approved waivers, that's all you need! and that's what we did. All the sucessful waivers I've read never paid one cent to an immigration lawyer

do not waste any money on that!

United KingdomLondon Interviews 2006 (NEW)
Hi everyone,

Just a quick message to say "good luck" to everyone who are having an interview next week. I too have my K1 scheduled on Thursday in London, and I'm sure that I am not alone to say that I'm pretty nervous about it

I have a few more reasons to be than others though, as I have two previous convictions and whilst I am sure they don't constitute CIMT and where more than 10 years ago, the interview could go either way!! which is a very nerve-racking thing to deal with (I have a waiver prepared)

That leads me on nicely to say that I just want to thank everyone on this forum for all the help and advice over the last few months, including pax, nigel, munchkins and Liam. Forums such as these are sooo useful and everyone is so incredibly helpful and considerate, I wouldn't have gotten this far without VJ!!

anyway guys, I'll keep my fingers crossed for all of you (I'm heading down to the capital tomorrow to spend a few nights with friends), please keep your fingers crossed for me too!!! as I really need "lady luck" to be shining on me

US Embassy and Consulate Discussionfeeling so deflated
I've just kissed goodbye my fiancee from London Gatwick airport, she goes back to the states today, and I feel like cr#p............. :crying: , if you pardon my French.

I have so much admiration for the couples in this forum who have had to spend long periods apart from their loved ones, because of the visa process. Myself and Courtney have been lucky and she has spent the last six months in the UK, while our K1 has been processed..... still it doesn't stop me missing her like crazy now.

I only thank god I have a few days two pick myself up for the K1 interview in London (Thursday), because at the moment I would probably look suicidal to a consular officer! :hehe:

Seriously though guys.... I ADMIRE YOU PEOPLE WHO HAVE TO BE APART FOR SO LONG AND ARE STILL SO STRONG INSIDE......... you deserve all the happiness that you are despertaley waiting for

US Embassy and Consulate DiscussionA few questions for people how are going through or who have gone through London...
I know it's a bit late now as you already have your photo's, but 15 pounds!!!! wow, that's a bit steep isn't it?

I went on to the internet, got on to www.paspic.com and downloaded a pic from my laptop, it only cost me 5 pound for three U.S. style photos including postage, and they arrived at my house the day after!!

simple!

US Embassy and Consulate DiscussionA truly upsetting day in London
Hey guys,

a few days back home makes the world of difference, I'm feeling much more up beat now and pretty postitive about the whole situation.

I'd just like to thank all the guys (including pax, munchkins, cassie and richie) for all their good words of support!

As fas as ktmman's word's......... well I don't think they deserve answering to be honest, I'm not quite sure what his problem is............. I will just say that I had researched whether a previous conviction I had was a CIMT, and had concluded that "in my opinion" it wasn't (from the US dept. of state's official guidelines)..... and so that gave me a glimmer of hope.

I hope my message did not come over as "woe is me, please I am more special than others"....... as that wasn't intended, it was wrote the next morning and feelings were still running high.

I know that there are many people out there that are in a much worse situation than me, and my thoughts and prayers go out to them all (see previous post from me about how much I respect them)........

thankfully idiotic comments like ones from the last poster are always in a minority on this forum........ best wishes to everyone else and thank you guys once again

:D

US Embassy and Consulate DiscussionA truly upsetting day in London
I must admit when I woke up yesterday, I has positive thoughts, despite my situation with my visa....

and my positivity kept me going.......

it kept me from not having a panic attack on the most crowded tube trains I've ever seen (and being claustrophobic that isn't easy) going to the embassy...

and through the zero temp when waiting outside the embassy, when it proceeded to snow slightly (ask Tom to confirm this one, it was bloody freezing)

it also kept me going when I had to wait an hour to hand in my documents.....(after entering at 11 am)

however the positivity started to dwindle after this..........the waiting and waiting was endless. I can't remember when I stopped listening or looking at the board telling people to go to booth no. x. I watched one after one immigrant visa applicant (that arrived after me) handed their pink form and then go out the door with happy smiles, only to sit and wait and stress....

this continued until 4 PM, THEY MADE ME WAIT 4 HOURS IN THERE AT THE END OF MY TETHER. I realise that there are a lot of applicants, I have been there before to get a tourist visa.... but why so long??, it was cruel to make someone wait so long without not knowing how things would go. I sopke to another man who had been waiting since 1 pm and he had three young children with him, and the poor things were so tired and upset.

anyway after having been called I spoke to a nice man who spoke positively and this raised my hopes..... until they all came crashing down and he said that I would need to submit a waiver. I asked him why and he said that my previous convictions constituted CIMT and that I HAD TWO of them, and if there is more than one involved then this applies (any other person in the same situation should remember this)

By this time I didn't have the energy or strength to disagree with him and that I had checked in the US dept of state official guidelines which state that having more than 1 conviction does not necessarily indicate a visa deniel etc...

and so I paid my money and handed over our waiver......... I'm sorry if this sounds sceptical guys but I really wonder some times if there are "border line" cases and that they say you need a waiver just for the revenue it generates.

anyhow just when I thought "get me out of here" the guy then had to take my fingerprints. This was the low point of the day.......... it made me feel so like a criminal......... and it unearthed feelings and thoughts that had happened from a previous matter that happened a long time ago and should have stayed buried in the past, where they belonged. It didn't help matters much when he said it was standard procedure.

and so at 4.30pm I walked out of there absolutely broken..........

I'm sorry If this message sounds so down guys, it was just a terrible day, and it helps to share things you know. I know things didn't go too bad, just plan B eh? I mean we had a good waiver (hopefully) prepared and I'm putting this in the back of my mind now for a while............ i just wanted him to say "approved" so much it overoad my rationality.

It great news to here about Tom, and I hope there are many more approved's to come... but for now I'm gonna have to go to "pending"

good to luck to everyone out there, I'll be taking a "backseat" for a while

best wishes to all VJ members

US Embassy and Consulate DiscussionUpdate from London on timing
Guys,

I can understand your frustration with the waiting, especially with regards to London... but try and be a little patient.

London does send out these "standard" replies that always exagerate the actually time that you will have to wait.

I share your frustration at the fact that London takes 2-3 weeks just to open a letter! I too am waiting for them to open a letter of mine!

BUT I think you don't really need to add the 4 weeks onto the 8 weeks that they say, normally 8 weeks is a max. time, you should normally get a letter through relatively quickly ( I got mine within a month) and then the interview date can be a month after that date, so not too long between correspondance of some sort!!

Hang in there guys, this whole process is a waiting game! :clock:

I understand you're worried that it's sitting in a pile somewhere unopened but you are just gonna have to sit and wait for them to get in touch with you..... even though you feel like your in the slow lane in a traffic jam and others are speeding past to their interview dates!

K-3 Spouse Visa Process & ProceduresCan a denied tourist visa be a problem at K3 interview?
A tourist visa and a K visa are two different things. My husband was denied a tourist visa last year because the consul felt that he was more qualified for an immigrant visa. So we applied a couple of months after the denial via DCF. And now my hubby is the US with me on an IR-1 visa. star_smile.gif During his interview he was asked about the denial for teh tourist visa he applied for once. Then the consul just asked him why and then that was it. They were more concerned with the documents pertaining to our application for the IR-1 visa. Good luck!

My husband and I filed through direct consular filing in the Philippines. So I got to stay with him through the whole entire process except during his interview when I flew back to the states about 3 weeks before. What I showed as proof of my domicile was: copies of my passports showing that I traveled to the United States back and forth, my unexpired driver's license, pics of me holding latest newspapers with teh date visible, my plane tickets and boarding passes. I can't remember if we submitted more things. good luck!

jhcruz18, that was a good one. heheh I never heard this before. How exactly you proofed that you leave in the US with that photo??

my sister loves to take photos. so she acutally got the headline and date in the picture with me. smile.gif by the way, the consulate in the Philippines did ask my husband for documented proof that I was in the states. If you look on the Manila US embassy website, it is actually one of the things that they might ask to prove domicile. hehe I flew into seattle two days after the elections. so i took pics with newspapers with President Obama on them. smile.gif

i forgot to add, I took pics of me in places around Seattle too. The space needle, seattle public library and the United States Post Office. smile.gif

OK, I understand but next time you should specify that it was proof of presence in the US and not for living in the US. smile.gif LOL!!!

Hey everyone!
Just sharing more good news this morning! I sent an email to the Guatemalan Consulate yesterday asking if our case was already here and I got an email in response saying our interiew is scheduled for NOVEMBER 19, 2007 at 8.30 a.m.. smile.gif YAAAAYYYYYYYY!!!!!!!!!

They also sent me a link for the requirements and forms I need to have completed for the interview! I never got Package No. 3, I'm guessing the Guatemalan consulate does not send a Package 3 and I just need to bring all the documents for the interview.. that's kinda different for what I've read around here... my fiance says that it probably works different here. I'm going to call them this morning again just make sure.

The e-mail says I need to go to the Consulate to pick up my appointment letter... that is totally different don't you think? I hate it that there aren't any other couples in my consulate in VJ sad.gif

I'll just call them to be 100% sure because this is all so new to me.

Anyway, I'm super excited!!!! kicking.gif

WOW! I am so EXCITED for you! kicking.gif kicking.gif Congratulations you're almost there!

I think that my problem at the border is more that it is obvious that the boys are not Mila's kids. They ask and I am honest, however when my ex goes with her @#%$* live-in, they have the appearance of one big happy family. We really like Toronto, the varied culture, and the Russian markets are fantastic. We discussed moving out of the Buffalo area, my work will let me live anywhere, but the proximity to Toronto keeps us here.

When Mila and I cross by ourselves, no issue and no real questions. We met in Canada and both have a lot of friends in Southern Ontario.

Gary and All;

I know i've written to some off line about this but my Fiancee has a 15 month old, the biological wants nothing to do with her or child since the day he found out she was having a baby. The US Embassy wants a letter for either missing parent, in this case the local govt will actually look for him and take a long time and she wants not to even talk with this person or else she feels that there will be a problem. Good point is that she made up the middle name and the last name on the birth certificate is hers. So the fathers name on the birth certificate is not a real person. According to the US Embassy In Kiev, they said all that they need is a "Thank you for your inquiry of March 10, 2009. The name of the document is "??????? ??? ??, ?? ?????? ?????? ????????? ?? ???? ??????". In English the document is called the way we wrote you in the previous emails.
If you have any other questions you can contact us via email."

then they said this

Thank you for your inquiry of March 10, 2009. This is the only document we require in this case.
We hope this information will be helpful.

Sincerely,
Public Liaison Unit
Consular Section
U.S. Embassy,
Kyiv, Ukraine

The other way is to get a Ukrainian court to give her sole custody and in this case I have no idea how that would work. We have many months to wait for the interview and that is why i had her start now on getting one of these two options.

It appears that we are not going to have any issues, but wanted to throw this out there in case anyone else has had a similar issue at the Kiev Embassy.

Thanks
