There is a form I-864P which outlines the poverty Guidelines.. If there are only the two of you, the 125% Poverty Guideline is: $17,500. For Alaska and Hawaii slightly Higher. If there are three of you then: $22,000. We have not received our NOA2 yet and i am sending to her, W2 statements, letter from employer, Last few pay stubs, most recent year of tax return and some bank statments and I am hoping that will be enough.

6. Yer in Seattle? Yer homed to the California Service Center (CSC ) - historically, it's a faster service center than Vermont for the USCIS initial processing.

Other stuff.
NEVER EVER SEND IN the original white books on INITIAL SUBMITTAL - only send in photocopies.

Your timeline states 'BeiJing' for the consulate - are you filing a DCF'd I-130 ?

After reading the latest Review on Guangzhou, it is really hard to determine who is really getting the blue and white slips. Are they K1 or CR1 or Work Visa's, student visa's etc... Hard to tell. But as it was pointed out in the review, Thanks toshkan, if we have all of our documents, all will be good. I do plan on going to the ACH the day before to ensure that they know of my presence and even maybe to elaborate about my wife’s pregnancy with our first child…. Good or bad idea? Question for Toshkan: How much of the photos, emails, phone bills, chat sessions etc.. did the consular officer really look at?

I’ll be leaving next week for Guangzhou.. I’m confident but yet still nervous :wacko: because of the stories coming out of this Consulate.

Ok, I’ll remove the DVD from the packet of evidence.. And I’ll be sure that the wife keeps the yellow books safe. Maybe she will bring and not show to anyone unless asked for.

Difficult to find a flight to Beijing to Guangzhou this time of year, why? No idea ??? I do plan on going to the ACH, Why? We'll just to let them see my shining Smile :D and to reaffrim the fact that I am here supporting my wife for the interview.

We'll My friend and his wife had their interview Yesterday in Guangzhou, they did pass but he had an issue that I would like to pass on to everyone. Maybe this is a known issue at Guangzhou, but here it is:

Because it is only him and his wife, he used the I-864EZ form for the AOS (affidavit of support). There were no issues at the NVC concerning this nor were there any "flags" concerning the use of the form. However, come document turn in day. Still no issues or flags from the US Consulate Guangzhou. But then the actual interview day is here for them and they get the "blue form". Reason: Use of the I-864EZ form is not authorized. To make a long story short, he was able to get the correct form and resubmit it that morning and his wife was granted the visa.

So, I just wanted to let everyone know on this forum that regardless of how many people are on your I-130 - CR1 / CR2 Visa Application. Use the full length / long form of the I-864: Affidavit of Support.

In addition, she will be asked to fill-out a separate DS-156K form during her medical. As for the DS-157, she has to submit this to any BDO branches together with her visa processing payment (131 $).

Lastly, all 3 forms with 2 copies each should be submitted during her visa interview in USEM.

I have been searching and researching a lot...
I really hate to bring an old post back to life, but I'm still a little confused about something..
To recap, the quoted post says
you get NOA2
USCIS sends it to NVC
NVC sends it to USEM
USEM processes it
I can call the number when i feel it may be processed and schedule an interview if all is well.
Prior to the interview fiance has to take care of all the requirements..

What I don't get is when does she send in DS-156 DS-156K and DS-157.

There's no mention of that and searches seem a little ambiguous.
Does she bring those forms to the interview after she has paid the fee at BDO? or does she mail them in and have them processed prior to scheduling an interview..

There's tons of info on the site, and links that point to all the forms, but I'm just a little confused about submitting those forms in particular. I Know that the afidavit of support form goes with her to the interview, but the other three, I'm a little confused...

I will keep searching though, but I hope someone could just post up a clear simple answer...

During my medical, I was never asked about the NOA1 and NOA2 but rather they looked for the USEM letter bearing the MNL case. The letter will serve as her key in entering SLEC's premises.

I decided to take my medical ahead of time even without the interview date confirmation with the embassy because I wanted to give allowance for possible delays that could have occurred in between. Gladly, it all worked out fine.

I'd just like to let everyone know that today is the day that I got my "rude" e-mail from the London USCIS dept. that I have been waiting for!! :D

So they said it was put on their system today, I guess I can kiss goodbye the 2nd of February as the date that I should be waiting from, even though that was when I ORIGINALLY submitted the waiver in London in person......

still it's on the system anyway..... :thumbs:

is it me or does even good news on this forum at the moment sound strange.... because of what Tom and Mary are going through....

no one knows how Liam managed to contact the embassy and get back in to see them when he had his problems? i feel we deserve to talk to the supervisor who arranged for us to be allowed to file the waiver. the matter of the wording of the charge was supposed to have been already sorted. we did not expect that part to be an issue.

I'm not quite sure if Liam contacted the embassy or if they contacted him? He doesn't seem to be on the vj forum much at the moment but he is probably busy organising weddings and stuff in the US. Maybe Nigel can give some inout on this one??

I spokt Liam a lot before he was approved (as we had similar situations) but I think getting a phone number to speak to ANYONE in the embassy will be a difficult one.

I have heard that getting a your congressman involved in the states does really help! would that be an option?

I think it is terrible that the people that make decisions on these waivers do not attempt to get ALL the facts on waiver applications before making a decision that can effect peoples lives.... it is just terrible.

I'm sorry but I've completely gave up trying to send a mail to the londonconsular@state.gov address. I did what you suggested and sent them a mail from another mail address that I have and even wrote very clearly in it "please reply to this mail" but as usual nothing! :angry:

so I guess I'm just gonna step back from this one........

I'll probably mail the uscis address again late next week maybe, at least they have the manners to reply!

I seriously have to occupy my time in other ways here

I wish they were as good in replying to my mails as the London uscis office, who again replied to my mail 5 mins after it was sent today with:

Hi, everybody, I guess I've been quiet because really, what do I have to say? I'm just sitting here waiting, trying to plan a wedding and a life, wondering if it's ever going to happen! So today Caspian gets a call from the embassy -- three weeks mind you from the time we sent our application back! -- to tell him that they need a letter from me saying that the main hardship letter is mine and I'm aware of the circumstances for him needing a waiver -- as if after two years together and blood, sweat, and tears poured into this letter, I wouldn't know!!@! Sort of defies logic. However, the really good thing was, the guy who he talked to let me email it to him today and he said he would submit immediately. So, I guess we're being "put into the system" tomorrow officially. Guess we're not getting married in June, are we?
We were also wondering about the G325a and so he asked the guy and the guy said, no, I've just taken them from your 129-F petition and made a copy! Which, in my opinion, is what they should have done for you, Paul, in the first place! You know why it is so frustrating? It's because it seems like they just keep moving the goalpost, you know? We all have heard slightly different information from different employees there and it makes it very confusing!


Mary, my heart goes out to you. This process is like nothing else, huh? Hang in there. You will hear something and it will be good news! Maybe in a couple months when you and Tom are setting up house in Michigan and I'm losing heart, you'll be telling me the same thing, huh? :D Anyway, take care of yourself.

My heart goes out to you! What the hell is wrong with London processing these waivers eh? You come all prepared with the right documents "or so you think" and then they tell you 2 weeks later that you need to do some more things that they couldn't be bothered to tell you in the first place.

Seriously, someone is takin the p#ss here!

I guess at least Tiff, there is some consistency now as that's exactly what I was told. However, I didn't get a call, mine was a letter and I have no reassurance that my file will be put on the system yet, even though I sent back the forms 2 weeks ago! However, you now have the utter joy in having to wait 2-3 weeks for London just to open your letter!

Sorry Nigel but I've already e-mailed both the londonconsular and the londonuscis offices, I know I should
have waited but am really annoyed that londonconsular NEVER reply to any of my e-mails (and I don't have a junk filter on my e-mail).

all in all a frustrating day for me?

I know myself that I decided to take the weekend off from the forum, because I was checking it so much, sometimes twice a day, which is really overkill. It also makes the waiting seem even longer, and I'm only at the start compared to these other guys!

Mary and Tom and Jpkeswim, please please try and be positive! I know that's easy for me to say, but remember the pass rate that London has for waivers! They're just f*cking with your minds. sorry to hear about your waiting aswell. It seems that this whole forum is counting down the minutes and hours until they get their precious "approveds" and documents, I really hope things come together for both of you really soon...... and on that note I hope things are equally sucessful for Mary and Tom. It must be terribly frustrating for you both.

I think I will have to agree with Misty and Pax that my letter is sitting in a pile unopened at the embassy, it's so blo#dy frustrating that they take so long to open letters. I really thought we could file on the 2nd of Feb, and due to an error by a consular officer it now looks like a whole month has been wasted for my waiver.

I guess I'll just wait a few weeks and e-mail the consular address again because they certainly aren't e-mailing me.

Just a quick question, is the london.uscis dept. in the same building as the london.consular???

Eeeeeek.

Yeah, e-mail the London Consular address. First, verify that they received those additional materials and that your file is now complete. Then ask if it's been forwarded to USCIS yet and, if not, when it will be.

Be aware that if those were sent on the 15th, you may be looking at another 2 weeks before they get around to opening them. :(

When did you file your I-601 waiver, and how?

The London Consular unit has the responsibility for issuing visas. The USCIS office has the responsibility for adjudicating waivers. If USCIS London does not have it, e-mail the Consular unit and verify that they've received it and will be passing it on to USCIS.

If you mailed your waiver, you might remember from your initial visa process that London sometimes takes 2-3 weeks to open and process mail.

well initially I filed the original I-601 on the 2nd of February (the day of my K1 visa interview) in the London Embassy. However they sent me a letter asking for two seperate hardship letters and two completed G-325a forms that were sent to them via special delivery on the 15th of February.

So I'm really confused as to what my filing date will be? the 2nd of Feb? or whenever they get round to eventually opening the letter that was sent on the 15th??? :hehe:

Paul I would keep trying...like I said if you email them again and dont receive a response, then I would fax them and ask it that way and maybe ask them to call you or something? I cant understand why they havent responded...It never took over a day or two for them to respond to me. I even slipped up one time and emailed them twice in one week to see if they had it. :blush:

Rebecca, I dont think there is a waiver needed for a one or two day overstay..

I am still waiting with you guys but just for a different thing! MY PASSPORTS! Grrrrrr....still didnt come today! I cant get out of this bloody country until I get them!



I was the person rebeccajo was refering to in her post-my fiance was denied entry last March-he had overstayed 2 days on the vwp. Although our case now seems to be under "administrative review", I was trying to find out if he would need a waiver(Rebeccajo being the brilliant person she is posted the question). I didn't think it would be an issue with a 2 day overstay, but with our luck-ya never know :blink:

I will assume he will be ok & I guess I will have to prepare myself if they do want him to file one.

I'm no expert but from what I've read on here about overstays and waivers I would agree with Misty. i can't see an overstay of a few days being a problem. From what I've read they normally "forgive" overstays of less than one month with future visa applications. I really don't think you need to worry about submitting a waiver.

Misty, do you think I should wait till the end of the month and send them an e-mail then? I remember Nigel telling me to wait a few weeks before asking them whether it had been put on the system yet.

Misty I e mailed the london.uscis one insted of the londonconsular@state.gov. I HAD sent previous ones to the consular address with no luck, so now I sent a recent one to the DHS and STILL no reply.

I echo bailey's words! It's easy to get down about this and feel that the worst is going tp happen, but take good heart from what people say here (especially Misty and Nigel) they've been through this sh#t and they feel like you will get a positive answer soon! chin up dear! :thumbs:

Yes it is alot more expensive to live there. That is why I decided to stay here and keep my job. If we would have known it was going to be so long I would have moved over there. He wishes I would have now. We had our hardship all prepared when we were at the interview. My letter was about 4 pages and his was about 5 and then we had about 10 people write letters for us supporting our situations. Our lawyer wanted us to do that, he said it would help the case. I really don't know. For instatnce we had my doctor, my work, his work, his brother and sister in law ( they live in the states ) and my mother and my sister, to name a few. Each letter had to support me and why they should let John come back to the states....I hope all this works out. I keep praying!!! I don't think I really slept last night either......and then he hasn't called today....

My letter was two pages and his was one page. We didn't submit any supporting evidence. I asked about that at the interview and they said it wasn't necessary. Now I see everyone else submits evidence :(

This would be easier to handle if he really had been guilty of what he was accused of... he would take responsibility for it and I would support him in that. It just feels so unfair that he is paying twice now for something he was never guilty of in the first place. And I have to pay for it as well.

... feeling sorry for myself today as Tom works his third day in a row of 16 hour shifts... with another one tomorrow. If only we could hear something this week so we could thoroughly enjoy the holiday he has taken next week. We need that. He is so much more patient than I am but it's getting him down too. He needs to know if he can give notice at work.

Yeah I did my PhD in a marine lab 5 miles north of Oban (Dunbeg), and so I guess you now know that I'm a marine biologist! I had to go to a fish market and sample sharks every month (as part of my research), but the fish market was five hours drive north. It had to be the most beautiful drive I have ever taken, up north of Oban, past Glencoe (stunning), up along side Loch Ness (wow, even more stunning), and then cut back north and up to Ullapool and in to the amazing scenery of Sutherland up to a small village called Lochinver. I was so lucky, I drove this journey and saw the most beautiful scenery through all seasons and weathers, it was some of the most beautiful landscape I have ever seen!

I was really surprised to hear that a consular officer told you that you DIDN'T need to submit evidence to support your hardship letters?!!

Don't get me wrong I certainly don't want to stress you out anymore, besides if they wanted it they would have asked for it as a RFE wouldn't they?? I just think it's so weird when we hear all these stories about officers saying one thing to one person and then something completely different to another.

Maybe it's like Misty and Nigel say, and they just want to keep us "completely in the dark" about these things, as we're not supposed to know.

Anyway Mary, take heart from what Nigel said, 98% is a pretty good approval rate eh?

I still think they'll pass most people and just do this to collect the revenue, but I'm a born synic :yes:

I have an update on my situation. I received Courtney's G-325a form and seperate hardship letter yesterday and so I quickly popped them in to an envelope (with mine) and rushed down to the post office and sent the letter special delivery........

so the London Embassy should receive them today. I sent a covering letter asking if they could send me a quick e-mail just to confirm that they have ALL the necessary documents to process the waiver now, however I don't know if they will bother to mail me!

So I guess now it's just a case of waiting til the end of the month and then sending an e-mail asking them if my case is "on the system"? :unsure:

I don't have a clue what date you should put as the filing date eh? (it would be nice to think that they had started to process the fingerprint stuff with the FBI already, but I just can't help thinking that my application is stuck at the bottom of a very big pile! :( )

Mary, I really hope you get a chance to see a bit of Scotland, it's a very beautiful country. I lived in a small town on the west coast called Oban for 4 years (doing my PhD up there) and I saw some of the most beautiful scenery ever!

and I echo Pax's comments, Edinburgh is a great city (especially when the fringe festival is on), but then again so is Inverness, Glasgow, Stirling etc.

I love Scotland (shame about the weather and midgies though eh?) :D

Hey does anyone know how long the embassy takes to get back to you via e-mail (if they do at all?). I sent them one a few days ago with all my details in the subject header but still no word. God I hope they've kept the original documented evidence submitted with that original I-601 on the 2nd Feb., or I'm down sh#t creek without a paddle! :unsure:

Thanks for the good advice Nigel,

I e-mailed the embassy yesterday and explained very clearly to them NOT TO THROW AWAY THE ORIGINAL DOCUMENTATIONAL EVIDENCE submitted with the original I-601, so hopefully they should keep this with them.

Nigel I have already "beefed up" my hardship letter to 3 pages and so hopefully that should be OK, Courtney's one was 5 pages and was fine. Mary and Tom: that's interesting that they said the same thing to you about the G-325a forms, why they need this info at this time completely baffles me!

Nigel, I will do what you say about the cover letter, hopefully Courtney's forms will be back with me again early next week and so I can send them off straight to the Emabassy then (special delivery?)

Also just one point I should mention that we didn't include in our original hardship letter and that SHOULD be included. Always start the letter of with the paragraph "I/we are aware that the UKC was denied a visa because of CIMT/ overstay etc. under the Immigration Act etc. " see the first Paragraph of Misty B's waiver on immigrate2us.net for the exact wording.

We didn't include this paragraph and were also told that the US fiancee NEEDS to show in writing that he/she is aware of why the visa was denied.

Most of you probably have included this, but it is important in a hardship letter.

Paul, I am so sorry to hear of this, hard enough for you without additional paperwork, can you not scan any paperwork to Courtney, saves loads of time.

At the same time as I can understand you being totally p*****d about this, one good thing will come of it for all those who will go after you. To make sure we have that extra page. Know that does not help you in anyway, but at least you know that they are working on it. keep you chin up Paul, you will get there :thumbs:

still pis#es me off that they ask for two G-325a forms to be filled in, they have four copies of biographic information from the original I-129f application.

To Everyone Else...The Immigration will hold there cards close to there chest in Everyway...They will give you little or no Info, so don't think for one second there going to reply back with a solid answer to the Question you put to them..Thats the way Goverment works as a whole! But anything positive info you do get well good on you..

OK SO TODAY IS NOT A GOOD DAY!

I received a letter from the US embassy today telling me that they need two seperate hardships letters. Our letter was two seperate ones combined, 5 pages from the USC and one page from the UKC at the end. I remember asking the guy at the desk whether this was OK and he looked it over and said yeah..... arrggghh
:angry: I have seen many many examples from applicants that went through London and only ONE had two copies, all the rest had one copy combined!

they also wanted us both to complete two G-325a forms, why??? we filled them out in the original application (I-129f), why do they need others?

That means that I have to send all of these forms to Courtney (who is now in the US) and wait and then re-submit, which puts the whole process back several weeks. Also I'm worried that they may have disregarded our documentational evidence that went with the original hardship letter, and we never photocopied these pages so we only have those original documents!
