K-1 Fiance(e) Visa Process & ProceduresI-129F Security Checks
Greetings to Everyone:

We'll we are at day 112 today, and since I myself or anyone at that will never really get a true answer as to the status of our cases at USCIS. I took it upon myself to email my local Congressman. So, they actually called USCIS CSC and this is what he told me:

I called the USCIS Service Center in California today. There was good news and bad news, to be honest.

First, though the expected timeline is five months, USCIS must be getting ahead of themselves because your petition had already gone to an Officer to be decided. However, your case has still not cleared the required background checks. It is not possible to approve an petition until the required background checks have cleared. I was told that you should not expect a decision for up to 90 days.

I know this is not good news and I regret that your case may be delayed, but if it helps you to understand the process, I have attached a document that talks about the background/security check process.

Please do not hesitate to contact me if you have any questions.

Best regards,

Special Assistant
Congressman Jay Inslee

Has anyone seen or heard of these "security checks" at USCIS? Are they random, or does everyone go through these security checks? Just wondering because I have seen many get approved at the time frame we are at.. Just wanted to see if anyone has any thoughts on this matter. Can it really be 90 more days???

Silly, yes.. my Birth Certificate only had print on the front also. But..... I copied the back and sent in basically a blank page, but i copied it anyhow. I am sure some would disagree but this is the USCIS and I did as they asked.

K-1 Fiance(e) Visa Process & ProceduresMedical Exam and Passing it

The doctor at the medical exam says that my girl has an irregular heart beat. Do you think that will cause any problem passing the exam?

I wouldn't think so since that is not something anyone could catch like a disease, but I don't know how perfect they expect your body to be.

I hope my experience will help you.

K-1 Fiance(e) Visa Process & ProceduresNOA1?

For sorting.

As I said, it's only been a few days and there was a public holiday in there. Be patient, you have months and months of waiting ahead!

Gotcha <3 Thanks tons (:

K-1 Fiance(e) Visa Process & ProceduresNOA1?

I wouldn't stress yet; after all, it's only been 3 business days since the petition's arrival at Dallas Lockbox. The case won't get processed there anyway. It has to go either to the California or Vermont Service Center (depending on where in the country you live), and then it's a week or two before an NOA, usually. I've seen it take up to three weeks with some cases on here.

Do you know why it gets sent to the lock box first?

K-1 Fiance(e) Visa Process & ProceduresNOA1?

It can be a few weeks for the hard copy, few days to a week "generally"for the e-notification.

Was your cheque/ check cashed?

What address did you send the package to? Did you send it registered mail or just normal mail?

** keep in mind, the 4th was a public holiday.

The check hasn't been cashed yet. I sent it to the Dallas Lock box, it says it was delivered already. i just haven't gotten an email or anything

K-1 Fiance(e) Visa Process & ProceduresNOA1?
So I just joined here so I'm really new (: But I just had a question about if there is a certain time it normally takes to receive the NOA1. We sent in the packet on June 27th and it got there on June 30th but were still waiting for it. I also sent in the E-notification and haven't gotten anything. I figure it could take some time but I noticed most people's took only a couple days. i'm pretty sure I didn't do anything wrong, but thought i'd ask anyways.

Thank you guys.

Olivia.

ConGraTuLaTions :) :star:

Each embassy has thier own requirements. You usually have to send I-134 affidavit of support. It would mean sending tax returns, pay stubs etc. Also you would have to send an updated letter of intent to marry within 90 days of your fiance entry to the us. Check the instructions for your specific embassy.

Yay thank you tons! <3

So Brock and I got our NOA2! Super excited! We didn't have to wait very long which is very fortunate <3 But anyways, I just had a small question. I've been reading the step by step guide on the K1-visa here >> http://www.visajourn.../k1guide#proof.

So just to double check, I'm sending all of the pay stubs and proof and everything to my fiance right? I don't have to send it to anyone. They will be sending me or him the interview information correct? I'm just a bit confused (:

Thank you!

understand, I am really starting to get frustrated. I will call again later today. Yes, I realize I do call them a lot, but it just seems odd that I get so many different answers. As you previously said a lot of these people are not fimilar with the electronic processing. I am going to stay "on them" to ensure that I am fully aware of the entire situation. So what you are saying is "final review" then "case complete" Correct?

Dazed and Confused for sure now.... I think USCIS and NVC got together on "how to confuse a petitioner" and also on the different words used to describe the stage of a petition.

Me ....... Again and again and again.....................

We'll it's Tuesday. I called the NVC at 0710 and was told that the documents are still in "final review". These two words are starting to get to me.. Any help if I ask to talk with a supervisor? Can they get these documents moving faster? or is it a waste of breath...

We'll with all of that being said, I just called. Now I was told that both cases are Completed and we are now awaiting in line for an interview date.. Does this sound correct? Gosh.. this process can drive a person insane.. At least the NVC has more information than USCIS..

But Really... I am glade I called because the operator told me that one case is waiting on another case and then the other case waiting on the other case.. make sense?? we'll It didn't to me either, but then.... So they are going to get another supervisor to ensure all things are done..

Yes, I am going to call again in about one hour and bug the living ####### out of these people.... Let's go folks. Pull your head out of your @$$ !!!

no - sorry - 'final review' is precursor to 'case complete at NVC'.

case is compeleted as far as needing any documents - this is not a normal timetick, at all.

Case Complete is Case Complete - Done is Done, Complete is Complete.

Not arguing semantics here, at all.

All documents were sent / including adoption at the time of the I-130 Submission. They (USCIS & NVC ) has had these documents since begining.. I am sure that might be a hold up..

Dan

Ok.. it's about 20 minutes later since my last post.. I called and I asked if the case is in Additional Processing. She said NO...... It is in final review and should be done shortly.. We'll when i call this afternoon, we shall see. But as of this Moment she said the case is compeleted as far as needing any documents and that the case is in Final Review.. Not Additional Processing...

We'll makes me feel a little better.

re: adopted child. Did you note in the I-130 paperwork and DS-230 paperwork that she's adopted? Show copies of adoption paperwork on initial I-130 submittal?

An 'adopted Child' going with 'Mother' receives more scrutiny at Guangzhou, as it's a popular scam for immigration - so the ConOffs pay more attention to any adoption paperwork.

I will start looking again today about airfare, I hope I can find somethiing. But until I have a real date for the interview, hard to get a good pricing. The company I work for has a travel department and they maybe able to help me out, but only when I have a date to be there. I plan on being there about 2 days before the interview. Becuase of our great corporate America, I will be taking time off without pay.. SUCKS.. Great Corporate America !!

As far as the stepdaughter goes, yes the wife has a lot of photos and she is actually an adopted daughter of my wife. So, on the adoption document there is NO Father Listed, Only her as the mother. Thus meaning she has sole 100% custody of the Child.

On another Note I called this morning to NVC, said case is still in "final Review" Now how long is this going to last? Can't login anymore, no more documents required. Was told should hear by Friday an interview date. But I am going with your prediction of either Tuesday or Wednesday of this week..

Not much Else I can really do from here. Just keep dialing those numbers and start preparing for the interview. Now I am sure you are asking.. prepare what? we'll I am gathering my "check list" to ensure that I have all documents for the interview. On my Last trip to see the wife in April, I took everything. I am now just print all recent emails, chat logs, etc. New Pay stubs, even a new employer letter. Do not know what else I can do... Any suggestions? Oh Panic maybe :o

Thanks as always..

Is there a difference between "final review" and "addtional processing" Just curious. I was told two different things when I called today. One said "final Review" another said those bad words "AP"...

Now this worries me.. If AP, then it could be another 50 Days... then another 30 for Interview... Just Freakin great........ So maybe another 3 months.. puts wife at 7 months pregnant.. getting close if this is the case..

The best prices I've ever gotten were from Asian American ticket agents IN the USA. There should be some there in Seattle, grab a Chinese Newspaper, a Viet Newspaper, and a Korean newspaper, study the ticket agents ads there. You may not be able to read much, but you'll know it's an airline ticket agent, and can read the phone number. If you get stuck on this, come on over to chinafamilyvisa.com and study the posts there on air tickets - we've listed the agents that we've used.

orbitz and cheaptickets usually have a time window, as well, a week before any jump date, where the price drops for about 3 hours. China Southern has a good jump from LAX to CAN, but you'd need to get to LAX first from Seatle. I hate LAX because of the Bradley Terminal, but always have good luck with China Southern on that leg of my jump.

Now that we are just about through NVC, I was thinking about starting another thread.. NVC - Interview, what do you think?

I have a few questions about this:

  • Does My wife need to mail the DS-230 Part 1 & 2 ?
  • Does My wife need to sign and mail to the consulate OF-169?
  • Does my wife need to mail to the Consulate the EMS Label ?
  • Does My wife need to mail her interview appointment letter also?

The reason I ask is that my wife was told that she needs to mail to the consulate these documents, does she? If so when? If not then just bring with?

Thanks again, oh -- You think I should start this new thread? maybe it can help others out.

So, We had No REF, Nor any "Check List" emails in this process requiring extra time. Unable to login into any portals, wife case complete.. So I hope that we will get our interview date by Mid Week. I do hope it is about 4 weeks out.. why? I am going and need to buy a nice expensive airline ticket to Guangzhou. No Cheap flights this time of year. I did find Eva Air, from Seattle to Taipie to Guangzhou.. Nothing open to Beijing that is cheap.. Any ideas about air fair at last minute ??

Caveat / Nota.Bene.: I monitor this stuff, as much as is possible, but with NVC going wonky for March, April, and into May, it's been getting strange
1.
non-EP (paper) - When ya call NVC and ask, they will tell you. DOS hotline also knows this - but only after it's left. Once it's left NVC - DOS knows all the rest of the timeticks.

EP - Appointment Letter Sent timetick. The casefile is sent out via SAFEFILE. SAFEFILE is almost instantaneous.

2.
non-EP (Paper) - timetick at DOS - 'casefile opened at GUZ', but prior to this, is 'NVC Out', then 'arrive in Guangzhou via DHL', then 'off to warehouse', then 'GUZ retrieve from warehouse' then 'GUZ open casefile'. This takes anywhere from 2 to 6 months, between 'NVC OUT' and 'Casefile Opened at GUZ'. Sure, it's 3 to 5 days via DHL from NVC to the warehouse, but then it sits, following a FIFO inventory processing for casefile retrieval.

EP-Casefile sent via SAFEFILE, but - prior to that, you already know the interview date. Usually A P4 packet is sent out, but many times not, as the contents of the P4 (appointment letter, medical forms) are available prior, electronically. IMO, this really is a timetick ya don't have to worry about, as the appointment letter comes in to yer email - and GUZ has instant access to the casefile from the SAFEFILE system.

errata - did you 'front load' the bonafide marriage evidence in the I-130? That stuff is tossed, not go along with the casefile INTO SAFEFILE during NVC processing. Well, not tossed, exactly, as it stays in the paper casefile, which then goes to storage in the USA- so be sure to not only REPLICATE that evidence packet, but bring it up to date, to show on interview day.

Remember my prediction for 'appointment letter sent'?

Actually, being brain dead and so much happening,,,,,, :bonk: Sorry My Friend I do not remember your predication, can you enlighten me again ... ?

Thank You ... If you lived closer I'd buy you dinner !!! :P

How do you know that your case has left the National Visa Center? Especially with electronic Filing? How do you know when your case reaches the US Consulate in Guangzhou?

I realize that we are now waiting on the National Visa Center to get us our interview date in Guangzhou, but just curious about these two things.

Dan - nope - not babbling ...

Cool - you got 'case complete' today - spot on with my prediction.

Your information and advice has been extremely valuable and I greatly appreciate your time and effort. IF anyone else has a new "stepchild" to contend with, you really need to file the I-130 at the same time as you do your wife's. This way the two petitions are "married" from the beginning to the end. I've read post here where people did not do that and thus interview date problems, etc.... If going to Guangzhou China, and filing an I-130.. DO ELECTRONIC PROCESSING. Get Adobe PDF you really need it, no matter how you file for ALL petitioners.

Now that I am through this stage.. Just one more thing to start asking about........ "The Interview" Or as some call it "The Interrogation" . I have been reading "horror" stories coming out of the US Consulate in Guangzhou China.. I've read some of the K1 embassy reviews, but I am sure that CR1's are looked at differently.. SO what can I expect.??

Darnell: Thanks Again.. But It isn't over yet..

Dan - crystal !!

OK - you've 'got more stones', then , in my book, for pushing 2 casefiles through NVC, concurrently, utilising Electronic Processing. There's another member here - who did an IR-5 for her mother (coming from China) and a K-1 visa for her fiance (coming from Dominican Republic) concurrently. Interesting stuffs !

Another member here did a delayed I-130 submittal for the stepdaughter, but also filed I-129F for K-3/K-4 visa - and they came to USA for a bit, went back to China, then he finished up the subsequent NVC EP processing. See http://www.chinafami...?showtopic=1951 for his timelines.

Small errata - when you were paying the AOS fee - did you pay 70 x 2, or just 70 ? Usually, if the two casefiles are together, it's only 1 fee for AOS, between the two casefiles.

GoGoGadget MacBook !!!

Only Needed to pay the $70.00 Fee Once. Because they are concurrent "Married" cases as the NVC puts it. That is why the wife's case was waiting for an interview date because since the files arrived at NVC they are married together because the I-130 petitions were associated as when I submitted my wifes case, my stepdaughter was on the form as a family associated with her case. NVC has actually been pretty good about this. As of 1230 PST, both cases are done and now we are awaiting a interview date from Guangzhou, but the NVC DOES setup the interview and will forward an email to me with the dates..

I am babling or does it make sense?

Both....... the Cases Where submitted at the sametime and proceeded throught USCIS at the sametime as well as the NVC. You could look at my wife's case as a "single" case for anyone else. Becuase the processes for her's was the same as the stepdaugthers.. As Long as the Petitioner submitted both I-130 at the same time at USCIS, as I did.

Does this help?

There is stepdaughter, also?

If the two casefiles 'travelled together' into NVC, there is HIGH probability that the interview dates for both casefiles will be on same day.

Sorry, this is first I've read of 'stepdaughter casefile'.

I'll repeat my #1 piece of advice, here -

There are no staples to be used for NVC Electronic Processing. ;)

Yes there was, the cases are in parelle, and do not understand why you would tell me No Staples to be used,, confused on this comment. yes, the cases will be interviewed on the same day as they were holding up my wife's case until this was done. Now done.. So now interview date. As far as timing goes with the NVC, They received 13 April 2010 and final Review done by 7 May 2010. 25 Days From date of GUZ Number to this.

NO - please relax - you've been told (already) that the case is complete, by a NVC worker.

IF the checklist SOLELY lists the DS-230, yer golden.

BTW, check the date on this 'checklist' - compare it to the 'sign in failed' date on the online payment portal. Im' guessing these two dates are waaaaaaaaay different.

We'll..... I tried to log into the payment site for the stepdaughter, got that wonderful message saying

"Sign In Failed
•Please be advised that the case that you have attempted to access is not eligible for further processing by the National Visa Center at this time. Please click on the Contact the NVC hyperlink if you believe that you have received this message in error."

Getting closer to getting an interview date... I hope. So with this said: Is there any real time frame that we should expect a interview date? I was told by our "buddies" at NVC that it is usually 30 days out. We'll just about to interview date.. WOW, this has been a long road...

Wondering once NVC sets the interview date at GUZ, is there anything else to do? Just gather more pay stubs, etc? Also does GUZ do any further "Checks" once the case has been set for an interview date?

Thanks as always..

Dan

yet another update, odd and got me nervous they sent me a "Checklist email" indicating that I was missing the DS-230. Got really nervous, called and said to ignore it becuase they have everything they need. So, should I really ignore? I mean maybe I should send to NVCElectronic@state.gov and tell them that I just confirmed that they said they have everything. Any thoughts?

A page or two ago you mentioned to ask for a supervisor, you think I should still do this? With the wife's case there were no RFE's or Checklist, I did ask about this. But I will ask again about this tomorrow.. Also, when the case is complete what should I get from NVC? Anything? or next will be an interview email? Just wondering how we are notified that the case is actually completed..

Thanks again, as always.. Just think this could be one of the longest running post.

I did call and asked is there any additional processing of the case, they said NO.. But for some reason I do not feel that warm fuzzy feeling. I think during my calling spree tomorrow I will bring up these words again to them. As normal I talked with another woman and she said the NO Word when I asked about Additional Processing. So, now we are getting closer to that letter for appointment. Oh, by the way the last women I spoke to said that The NVC DOES setup the appointment for the wife's interview. SO maybe the lady before that was not very knowleable about the electronic processing... So, I think I'll ask again tomorrow to confirm..

Yes I like to confirm things, especially with the US Government. Until the wife has visa in hand, I'll keep confirming all things.

Thanks
Dan

A page or two ago you mentioned to ask for a supervisor, you think I should still do this? With the wife's case there were no RFE's or Checklist, I did ask about this. But I will ask again about this tomorrow.. Also, when the case is complete what should I get from NVC? Anything? or next will be an interview email? Just wondering how we are notified that the case is actually completed..

Thanks again, as always.. Just think this could be one of the longest running post.

sorry - that answer about NVC setting appointment for GUZ - you already know the answer - scroll back a bit :D

It's in Chapter 12 of the Novel ;)

Did you ask, in the exact phrasing I gave, about AP? If not, try it, at least once.

ya - re-verify that 'additional processing' thing, this way.

Call NVC, ask specifically 'Is my case in AP' ? or 'Is this casefile going through additional processing?'

AP, at this stage, sucks, and there's NOTHING you can do about it.

Just called and they said case is complete. No mention about Additional Processing, but I think i will call one more time for the day. I am going to drive these people crazy, but heck. What else do they have to do? I'll write what they say.. Yes this thread turned out to be a novel... But maybe, just maybe it will help others. Also this one person said that NVC DOES NOT setup interview dates for Guangzhou, True ? or Not? I'll ask that question too..

We'll off to the telephone.

Just a side note.. It appears that when I call NVC, the Ladies who answer are always more helpful than the men who answer.. Do not know why I am saying this, I guess nervous energy.. I need something to do while at work.. heck I am rambling.. Going nuts I think :bonk: This is not just a "Journey" it's like a trip down some really bad rapids in a really long river that has only calm spots along the way and when you get to the end.. Calm seas.........

Been looking at prices... like double the price from my recent April trip. Got a ticket for 800.00 but now, looking like 1,200 - 1,500. Any ideas to go for a cheap last minute ticket to Guangzhou? I do hope that we can get a interview for mid - late June or at the latest, first week of July. That puts the wife at 5.5 months pregnant. Back to Wuhan? From what I have seen China has it's issues too, but if I had to I would live in Guangzhou. Not really bad but not the best either.

At this point, i just keep calling and calling everyday, about three times a day because things seem to change rapdily with the Electronic processing..

Just called .......... Again.. I was told that my wife's documents are considered "Case Complete" Now what? Will I get a happy email soon? BUT.. she said the bad words "Additional Processing"? I have bad feeling about this one. But it doesn't make sense. To say in one sentice "Case Completed" and then two minutes later to say "Additional Processing" Should I worry?

Take care and thanks
Dan

Oh - my apologies if I seemed snarky, recently - I've been prepping for the Wuhan jump, and now it's time to go. Mostly my stress these last 12 hours were about packing family gifts, and I've not slept at all.

couple that with yer need for speed on yer pregnant lass - and we might just start an argument :D (lord I hope not ! )

ya - I did some forecasting on 'what' and 'when' in yer thread here... I'm thinking I'll be 'spot on' or 'really close'.

I think it's great yer taking off to be there at the interview.

Now from what NVC said, the interviews are scheduled approximately one month out, sound correct?
Ya, NVC is vetting what I've already mentioned to you.

the appointment date could be anywhere in a 3 to 5 week window from the 'appointment date set' time tick.

As Always thank you. I've posted on the other guys thread about my experience so far... Just trying to pass on my experiences.. We'll called this afternoon and I was told my a nice lady named Lily that my wife's case is still in "final review" and should be done by Friday. She also told me that if there were any issues that I would have heard by now. With that said, i guess by next week we may have a interview date? Maybe? Hopfully? At anyrate that is the report for this afternoon. You know, I've read somewhere that some people got through NVC in only 12 days.... I find this difficult to believe, why? we'll it takes almost 10 days just to get a response from the NVC on the electronic filing.

Just a comment, we'll thanks for reading.. More to come............... :star:

Reading the OF-169, page 3. It says to sign and return before you will be given an interview date. Ok, since we are doing electronic processing we will get the interview date. Do you know if the wife will have to turn in this signed OF-169 at the interview? Should I just make sure she has one?
OF-169 is NOT FOR I-130 petition sent to Chicago Lockbox.

Yer I-130 petition was sent to Chicago LockBox.

Stop studying the OF-169 - that's for K-1/K-3 visas, and DCF'd I-130 petitions.

review http://guangzhou.use...and_packets.htm
specifically the IV Appointment Packet (“Packet 4”) section. That section is the ONLY SECTION that applies to yer lass. Seriously !

There is no 'packet 3' for you - you did NVC Processing, instead. Ignore IV Instruction Packet (Packet 3) - that's specifically for DCF'd I-130's - yer not ONE of those.

No, I'm not gonna bonk you with a rubber mallet, I swear !!

As of this Morning, our case is still in final Review. Or I should say, cases. I can elaborate if necessary. But I will call this afternoon after my lunch to get an update. I know it probably is useless, but it makes me feel better. At any rate we are still going and still waiting. Now here is a concern: Say they get this done by next week, for conversation purposes we will say the 14th of May 2010. Now from what NVC said, the interviews are scheduled approximately one month out, sound correct? Every hear of anything faster? or Longer? why do i ask you wonder... Now I'll tell you. I am going to go to be with the wife for the interview. I have clearence from work and just need to arrange finances around this...

We'll that's it for now..
