Finally it's interview day for Su. She said that there where about a hundred people waiting, and all the documents we had were starting to get heavy. But in a few hours it will have all been worth it. I wished her luck and she told me she'd call back as soon as she was finished. Then she followed the crowd into the embassy. Wow! The Bangkok embassy is really on the ball. We sent in our Packet 3 two days ago, and already have an interview scheduled. We're only 10 days away from the interview. Su is very nervous, even though I told her we have all of our documentation in order, and I've been quizzing her on possible interview questions. I'd really like to know if she will be given a choice of interviewing in English or Thai. Of course, if given a choice, she'd rather use her native language.

I am trying to prepare the I-134 form to be ready for our NOA2.. I am finding it very hard to understand exactly what they are going to be looking for. We will be fine together here as far as money goes although my financial situation may look different than most. I am an apartment manager which allows me to work rent off so there is no "paychecks". I just started a new job here which I am independent and have only had one paycheck from that so far, and I work once a week at a night club.

I am trying to say that although I do make enough money to survive, there is not a lot of proof of it now.

My brother is going to co-sponsor Nora and he makes decent money and owns his house. After he fills out the I-134, should he also include a letter explaining that he will assume financial responsibility if ever she (us) needed it?

I am very confused with that whole process. If someone has dealt with a similar situation, I would greatly appreciate any advice. I just need to know the best way to present that situation to the USCIS..

I also have an ongoing IRS dilemma as a result of a previous employer filing me as an independent contracter when I was not. I set up a monthly installment agreement with the IRS as I could not pay it in full at this time. Does anybody know if that will affect the outcome?

I know they hate it when you lie to them. But there is NO reason to send people (who haven't done anything) back, so that's why I lied. Also, I will wait for my visa until I will enter the States again, but still there is a weird feeling that they 'remember' me (of course not my face ;-)) and look into our I-129F petition to see that we have already been a couple by then. Maybe I am worrying to much. I think now we did everything right and in a legal way. :-)

Hi everybody,
a week ago my fiance and I got our NOA2 and now we are starting to plan my arrival in the States. My fiance is living in Seattle and I have been there 2 times in 2009 (3 and 2 months). The second time I flew into Seattle I got in trouble at Immigration. The first question was whether I had a boyfriend in the States. I denied, because I have heard of a story where they send a girl right back home. They even called my fiance to verify that we are not a couple. He had a good intuition and denied as well. After 3 hours they let me in, but of course not without frightening me. Now, I would like to book a flight to Seattle (because it's most convenient), but I am not sure whether they might remember what happened last July. And now they can see in our petition that we have already been a couple.

I don't know what to do now. It would be so frustrating to get denied at the border, that's why we are thinking it might be better book a flight to another town. However, that would be more expensive and inconvenient.

What do you think?

Our NOA2 has an expiration date, and i know this is usually the case. But how does an embassy deals with?

i) Do they try and process the application before the expiration
ii) What about in case of APs since they can last for months


Is it common practice for embassies to extend the expiration dates?


The NOA2 is valif for 4 months after it's approval. Within 4 months your visa has to eb issued. What I have heard so far is that the Consulate/embassy is extending it automatically once it's getting close to expire. But I'd always contact the US consulate in your home country to find out more information. Although it seems to be that you have plenty of time to get your visa issued.

They schedule everyone for an appointment in Frankfurt on the day of the interview, but you definitely don't have to show up and sometimes it's not even possible to go to the appointment, for instance if you have your interview at the Consulate early in the morning.

Hi,
you can have your medical in Munich before the interview. Usually this is even more convenient than having it on the same day as your interview. The physician in Munich will send all the information to Frankfurt.

I'm sure others will chime in on your other questions, but I'll chime in on #6 since I'm currently dealing with that. :) I've been upfront with the vendors and venues I've visited. I told them a tentative date, but also added the caveat that it could change. I've been visiting various venues and gathering information and then sending photos/videos to my fiancé so he can see.

So far, everyone has been very understanding, either because they've dealt with similar couples in the past, or I've rambled enough describing what's going on. :lol: Definitely be sure to know their reservation policy and if you can, wait as long as you can before signing anything!

Joint sponsor will use the I-134 as well. The I-864 is used later on at the adjustment of status phase.

Is the scholarship money designated for tuition, books, fees, etc.? That can't be used toward the income. Stipend/scholarship for living expenses can be used.

Affidavits are optional and not very strong evidence. An affidavit from someone that has never met your fiancee would be pretty weak.

Assets (savings) can be used to make up income shortfall. They are valued at 3:1 in this case.

Plan to be held to the 125% income amount. That is the standard used for the I-864 in your future.


Thanks Anh!! The scholarship money is a stipend so I guess I could use that toward income. It's almost $23K (not including benefits like health insurance which is $3K+) which is not enough for three people. Do you think I would need to meet the guidelines for 3-person household even if his son will not come until almost a year later?

Hi everyone! First, thanks for everyone in this community. The information I get from here is priceless!!!

I just received our NVC case number today and now preparing I-134. My problems are:

1. I'm a doctoral student (3 more years to go) and my "income" which is a monthly scholarship is about $1000 shy of meeting the 125% poverty level for three people (my fiance has a son that will follow later), although my income for the past few years, including last year, is way above the 125% poverty guideline . I've read somewhere that the I-134 only requires 100% poverty guideline. But it seems to make sense that the consul will have discretion whether to require 100% or 125% since I will be required to meet 125% poverty guideline when adjusting status. Can I use my savings to offset the $1000? Is it going to be $1000 * 5 (years)?

*Should I also include the value of my health insurance, travel allowance and tuition waiver?

2. Will it be a better idea to submit I-864 even if they won't ask for it so I can have my fiance's sister as a co-sponsor?

3. I visited by fiance 5 times since June 2011 when we first met. Would it make a difference if I will be present at the interview? I've read the San Salvador portal and there is not much information since it's a small country and not many are on VJ. I read one where the consul asked for the wife of the beneficiary. It will be financially and logistically difficult for me to go since I am currently working for the summer and I have a comprehensive exam for school end of August that needs extensive preparation.

4. Regarding the third party affidavit, are letters from my closest colleagues (friends) acceptable? They have never met my fiance in person but they've been introduced through Skype as I am often on Skype with my fiance here at my office.

5. Should I submit receipts of the wedding rings? They are inexpensive rings from amazon.com. We have a very limited budget and thought we'd rather save the money for our future baby. Just wondering how consuls perceive inexpensive wedding rings.

6. As for wedding plans, ours will be a simple picnic wedding, hopefully in September. We want to get married right away before school starts back up end of September and so I could add him on my health insurance asap. How did you all handle reservations and preparations not knowing when and if your partner will get a visa.

7. Oh, and one last thing. I am divorced. Am I required to submit an original copy of my marriage certificate from my previous marriage? Or is the divorce document sufficient?

What are we to do now??? The San Salvador embassy just called my fiance to confirm his interview date and told him he needs to bring his two children (one 21 y.o. and 16 y.o.). Problem is, they are in Mexico in the custody of their mother. .

We are going to ask tonight if they can or would like to come but if they are not able to attend (as they are not interested in joining their father), will this be a basis for denial?

I mean we can't make them go to the interview especially that they are living in another country and he doesn't have custody. :( What do we need to do so this doesn't become a reason to deny him?

Also, I would have posted this in regional forum but since San Salvador is small country, there's not much activity for us here so I'm just hoping others could enlighten me on this. This is so stressful for me!

Okay, I SCOURED the forums before asking this so hopefully I'm not asking a question that's been answered 10 times before. It such a tiny technicality I'm a little embarrassed to ask, but I'd rather post this now than a cautionary tale 6 months from now!

On I-134, Section 7, it asks for my employer's name ("Name of Concern") but my company's name is too long to fit here. An example: if the company's name is Happy Hippy Dog Food Company - I can only fit "Happy Hippy Do-". No more space.

It says in the instructions that if more room is needed to attach additional pages, but I assume they are referring to needing more space to list dependents, etc.

My gut tells me I should write "See attachment" then attach another sheet referencing the question with the full company name given, then sign and date the additional page. I wanted to see what the VJers thought, though?

I actually was just in the same position as well, but was told to handle it differently. :wacko:

I am currently awaiting an NOA2 for a I-129F and my fiance, the beneficiary, just moved from one apartment in London to another (I am the petitioning USC). When I called USCIS to ask how to handle the change, they said that I should write a letter to my service center (in this case it is the CSC) including my NOA1 receipt number, my full name and the beneficiary's full name. They said I should detail the change I want made, including the old address and the address we want to change to.

They also mentioned that when he is approved for an interview with his embassy he needs to bring supporting documents to the interview for the change.

I called again and this lady took my information and submitted the expedite request. I think the first rep didn't know what she was talking about. Now my question is, should I submit the evidence (doctor's letter) now or wait until they ask me for them?


Other expedite posts have suggested that you are sent a form requesting additional information, and you submit the information along with a copy of that form.

Try doing a forum search for "expedite", and you can see what has and hasn't worked for some people. It will also give you an idea of whether or not your medical reason is going to be valid for an expedite (for instance, pregnancy isn't a reason for expedite). Good luck!

I'm confused...

I looked at the link and (If I didn't read it incorrectly) it tells me to write a letter asking for an expedite, and attach the evidence.

However, I just got off the phone with USCIS and they told me that I should fill out a form (I-907: Request for Premium Processing Service), but there's a $1225.00 fee with it.


It's my understanding from the USCIS site that Premium Processing Service only applies to employment-based applications, not marriage/family based. I'm assuming your application was for the K1 visa, considering you posted here, which is marriage/family based and so wouldn't be eligible for the PPS.

Whether with the petition or in materials for the interview, present NOTHING that's redacted or blanked out. Someone recently posted, or I heard about it outside of here, that a CO issued a 221g (formal hold on visa-issuance) until a couple presented the unredacted version of an e-mail that they'd presented in which a line had been blacked out. Fortunately, they had it and the original text was nothing untoward, and they then got the visa.


We followed the step-by-step guide here on VJ (found here: http://www.visajourn...content/k1guide) and it says "The following items will not typically show proof of having met in the last two years however will show proof of an ongoing relationship: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also)" so we blacked out a few things in emails and letters. But we shouldn't have blacked out anything?

Okay, wow, good thing you mentioned you wife/husband thing! We often call each other wifey and hubby. :P

And the chat logs are unnesscary? I understand it's not really needed for the 1-129f petition, but I read on the RFE thread (or it may have been another thread) you won't be able to introduce new evidence later (for the interview), possibly. We don't have any msn convos saved from the beginning (I am saving them now, though, as we've been talking more on msn of late because of his work) and I'm using the chat logs to help establish we had a relationship and that it is still ongoing.

I'm just so worried we'll get someone who looks at it goes, "If you don't have enough for a novel, I'm not convinced!" :P

I've been reading up on a lot of the pinned threads and other people's threads, but there seems to be conflicting advice here and there regarding "front loading", I think it's called?

And jups, I plan on taking a lot of pictures, especially with the family :) I'm a bit of a pack rat when it comes to receipts, so I'll be sure to hold onto those.

Well, since this is my first time preparing the paperwork, I am feeling a bit overwhelmed and would be eternally grateful for any advice or help!

I've read the gov site, googled, and read as many threads as I could from this forum, but I may have missed a few things and I'm just too darn slow sometimes -

1. Should I leave spaces on applications blank (when not writing "none"), or is filling every blank space with "N/A" ok? Do they find that annoying?

2. I make only 16k a year and have very little in my savings (due to the trip I made to see the fiance.) Will they deny our request because of that? He intends on getting a job as soon as he can, and my parents are giving us about 3k (dollars) while his parents are giving him 10k (euros). But that's not until after things are approved, so I won't be able to prove we have access to that.

3. Proof of an ongoing relationship - we never e-mail, chat on the phone, and barely chat on MSN - we use skype video to talk (it's free). I'm not really sure how to go about proving our ongoing relationship. Our MSN convos consist of "Are you awake? Get on skype." And that's it.

4. Pictures of us - are mostly up close, because we took the pictures ourselves. Will this look bad, without much of a background to look at?

Any help is greatly appreciated! Thank you in advance.

dates on photos really mean nothing, you can set the date stamp for anything you want anyway. Tey know this. Besides, if the photos look like the two people in the attached passport photos it is pretty good evidence you have been together recently.

It sounds as though you made a spur of the moment "visit" and did not consider the logistics of living in the EU and petitioning someone from the EU. Not having adequate records as a result. Intineraries are not acceptable because they are not proof of travel. He also COULD have received a passport stamp for entry if he stood in line for it. He passed through the "EU citizen" gate and waved his passport at them...probably in a rush to hug you. Bad choice. Unfortunately we are in relationships where we have to DOCUMENT everything and I do not get to throw away relatively benign mail like invites to parent/teacher conferences with both our names on them because I need them for "evidence" and this continues until the Removal of Conditions is completed. When you say you met a German in Holland you have to show you were BOTH in holland at the same time.

Your only option is to respond with what you have explain it again attach photos again. Dig up any other receitps or even the baggage ticket off his suitcase if he has it. If that doesn't work you have two options...visit him and file again, this time keeping good records OR he can come here on the visa waiver program you can get married and file a CR-1.

If your case is denied trying to appeal it will usually take longer than just filing a new petition.

Thanks for assuming, but it wasn't a spurt of the moment visit. And no, he didn't wave his passport at them... he didn't even bring it.


Guess what folks? I didn't submit any new evidence. I just sent in a letter. It's been approved. Maybe a little bit of holiday spirit? ;)

They want proof you have been together in the same country. They do not care which country. I met Alla in CZ Republic. But I included HER passport stamps as well to show SHE was in CZ Republic when I was.

Repeat everything you already sent and send proof HE was there and a letter explaining it AGAIN. If you have met at any other time PRIOR to filing thew petition, you could provide THAT proof. It only matters that you met At least once within two years of the filing. It does not have to be the first meeting

Our first meeting is the only meeting prior to filing. We submitted every single piece of evidence we could find. Although he paid for a lot of things, it was in cash. And they said I didn't date the photos... I dated them on the back.

I was going to suggest to send your fiance's passport copies showing his entry into Holland, but now I see that this is not possible. This is difficult... So, you have not been to Germany? Is there an official record that your fiance could obtain in order to prove he was in Holland during the time of your visit? Otherwise, I do not know how else you could provide official proof of your meeting... I have not read any "rule" as to visiting the beneficiary's country specifically, but for European beneficiaries it does pose the problem of the open EU borders. Mmmhhh... I thought I would never be thankful for the fact that my fiance cannot get out of his island and has never been anywhere else! But, it does make it easy for me to show my entries to the DR, where he is from. I hope you find a viable solution to respond to your RFE.

I gave them his boarding pass with his name and the date on it. I really don't understand. Pay nearly 500 bucks, wait five months... I am so upset but I'm just going to resubmit everything they asked for and hope I can get it done before the 16th, which may be difficult if I need a Dutch translator.

I was so angry I forgot to mention at the top of the RFE, all foreign language documents must be translated. I doubt I could hire someone by the 16th to translate everything (bus tickets, restaurants) I sent. Is there a way to get an extension? Most of those receipts were in English, anyway, very few were in Dutch, or is that something they just put at the top of every RPE?

Never used a car. Used the trains/bus. Provided copies of that.

And provided copies of the boarding passes (both of us) and the luggage receipts.

Oh, you betcha! I coped every single receipt, including hotels (most of them showed there were two guests), and all travel tickets. And there is no passport evidence of him; you don't need a passport to travel from Germany to Holland, just your Euro ID or whatever it is called. So the only evidence we had of that was his ticket. Which is dated. I highlighted it for them. They apparently did not see it.

They said flight itineraries are insufficient evidence.

Has anyone suffered this kind of situation before

So, after five months of waiting, I finally get a RFE.

I submitted a complete color copy, front to back, of my passport. They're telling me my intinerary was insufficient and that I did not provide a proper passport copy. Which is fine, but I already submmited my boarding pass and the complete color copy, including sticky notes that indicted which pages were stamped with regards to my entry/exit into Holland... they want proof I've been to Germany. I already explained I was on a trip to Holland when I met up with him, so he flew in from Germany to hang out with me. I typed out an explaination why this happened in decent detail.

They want proof I've been to Germany, which I haven't. Is there some sort of stupid immigration rule we have to meet in his country? The only proof we have of him being in Holland are our pictures (again, already submitted) and his ticket, which is dated (I even highlighted it), but they claim it's not dated and we can't use it.

I'm just so angry right now... and slightly unsure what to do. My plan now is to do everything they ask, including adding evidence of our recent visit, add more photos, but I'm afraid I'll get this bullcrap again.

How do you recieve your first notification that your case has been moved to the NVC? Will I see an update on the USCIS status page (from Intial Processing to Testing/Interview)? I see that others can post dates but I do not know where they are found.

After that, how do you track the progress through the rest of the system (like when it arrives at the consulate)

Once the case is moved to the NVC you can no longer track it on the USCIS website. I called the NVC to ask when they received it and when I called they told me they had received it 2 days before and had sent it out to the foreign spouse's country's embassy that morning. It goes really fast once it's at the NVC. That is how people get their dates, by calling.

Hello everyone, new member here! I'm beginning the process to bring my fiance from Baja California Sur, Mexico to San Diego, CA and I have a few questions regarding translations. Do emails, chat logs, etc. need to be translated by someone certified or can I provide my own translation (I speak Spanish fairly well)? I know more important docs like birth certs, health exams, etc. will need to be translated by someone certified but I wouldn't think emails would need to be. Also, do I need to provide a signed and dated letter of intent written in both English and in Spanish (both copies being signed by my fiance)? Will this help at all to show she willingly signed a document she understood in her native language or will just an English copy suffice?

You know I panicked about this too before I sent my I-129F but I did all my own translations of every email and then just put a piece of paper behind each email I translated that said I was fluent in French and that the translations were accurate. I did that for every one that I translated, with a date and a signature. There is a link on this website under K1 visa guides, I believe, that show you how to do that. If you can't find it, let me know and I will send you what I wrote. As for the letter of intent, just have her sign the english one, they don't care about anything that's not in english so don't go to too much trouble. Let me know if there is anything else I can answer.
