Read the "Guides" section for K-1 Visas here on VJ to get all the information you will need.

If you plan on bringing your fiance to the U.S. to live, your felony conviction is not of any concern. It is only if the immigrant has a criminal background.

You may find it difficult to enter Canada, though, if you have a felony conviction. There is a process you need to go through to be "rehabilitated".

As far as your fiance being "stuck in the U.S.", unfortunately she will not be able to leave the U.S. after entry with her K-1 Visa until either 1) she applies and gets Advance Parole or 2) she gets her Green Card. If she does leave the U.S. before either one of these two options, she will not be able to re-enter the U.S. without a spousal visa (meaning starting over from the beginning for a different visa).

So my parents are my cosponsors for my fiance, but when they filled out the i 134, they made a mistake and white-out'ed it and wrote over. all of their supporting material matches the info that was written over the white out. is this going to be a problem?


If you've already mailed it in, then there isn't really anything you can do. If they want any further information from you, you'll get an RFE. But, I would doubt it's going to be a problem.

If you haven't mailed it yet, you could always do another I-134 without the white-out.

Sorry to hear this is happening to you.

Unfortunately, as previous posters have said, it is impossible to get an expedite due to a wedding date. If that were possible, every person applying for the K-1 would just plan their wedding early in order to get an expedite.

Most of us here on VJ have done the process without a lawyer, and a lot of the people who did use a lawyer were sorry that they did. You should probably consider trying to finish the process yourself. Keep in mind that lawyers will tell you what you want to hear so they can collect their big fees.

Hope you get your approval before the wedding, but if not, you'll be out $3,000 and it could have been a lot worse.

Firstly, welcome to VJ!!! You will find a lot of useful information here as well as lots of very helpful people.

You definitely do not need a lawyer to get through the K-1 process. Most people here on VJ did it themselves, myself included. Read through the "Guides" and "Visa FAQ's" sections to get a lot of answers to any questions you might have.

Sometimes, even if a form has expired, you can still use older versions. Check the USCIS website, go to the forms section, then go to the I-129F, and it will tell you if any expired forms are still acceptable.

Good luck with the process and keep us posted as to your progress. It will feel like a very long process, but every day is one day closer to you being able to start your lives together.

I visited the U.S. after I had my K-1 Visa and did not activate it. That was in 2004, so things may be a bit different now. All I said was exactly what your situation is... I wasn't ready to move permanently to the U.S., but wanted to go visit my fiance in the meantime. I had no problems whatsoever, but I think if you try, and they say you can't.... all you have to do is turn around and head back home.

After the NOA2, your case is sent to the NVC.

Then the foreign fiance receives Packet 3 with information on what to gather, and information on the medical exam. The packet will give you all the information you will need to proceed, along with the consulate location where the eventual interview will take place.

If you provided photocopies of certain documents, such as birth certificates, they will want to see the originals at the interview. So, take the originals of all the important documents, along with a photocopy, and then they can keep the photocopy for your file and give you back your originals after they have seen them.

I recommend pictures too. I put about ten photos from various things we did together, including photos of her with my family and me with her family, and I have thousands, literally, and will bring them with me (fortunately they're all in digital format), or supply them if they're requested as further evidence.

I also included photos from our wedding where we had friends and some of my family in attendence. :)

There is no intent for her to stay or get married during this time. Since she's a Japanese national, she can come here just with her passport.


My wife and I were married in November (she's also from Japan) and a short time later she was flying back to Japan. It's okay for you to get married when she visits because the important part of that statement is that there is no intent to *stay* here during that time.

We went this option because when I spoke with an immigration lawyer about the options, she told me that if my wife should need to go back to Japan in the event of a family emergency, under a K1 visa she would need to get permission to fly back where as if she comes here as a foreign born spouse on a K3 or CR1 visa, that restriction doesn't exist.

This is important because my wife has two daughters from a previous marriage. One is already in college, the other will be entering college in April, that along with a rather large family (brothers and sisters with kids, plus her parents), being able to return to Japan without worry was paramount.

Keep in mind that I'm simply repeating what an immigration lawyer told me, so if the information is wrong, then the lawyer was wrong. :)

Su and I were married at the Thai temple today. Very small service, just two witnesses, 1 monk, and Su and I. We already had the excessively large engagement ceremony last month in Thailand "Whew!". What I'd really like to know is, is there any reason to notify the Thai embassy, or register our marriage at the Amphur when we return on vacation later this year?

I think she had her interview on Thursday morning, and she was able to pick up her passport on the next Tuesday. So 4 days but that includes the weekend.

Su's interview was a couple of weeks ago, it had a 7:30 am appointment time. If I remember correctly she was the second interview of the day, and she was out of the building within 90 minutes. I posted in this thread, and gave an embassy review about this if you're interested. Congratulations, this part is almost over.

Su may have been asked to interview in English because I wrote in packet 1 that she was capable of speaking both languages. The interviewer also asked which language she primarily used when communicating with me. Which she replied English. She told the CO that when she got confused I would speak Thai to her. Luckily we practiced the interview many times (all in English), and she was able to answer every question confidently without getting flustered. The CO spoke slowly and clearly for Su, so she was able to understand the questions.

Tea was supposed to go and pick up her visa today. The (insert expletive) Embassy didn't have the visa ready. She was told that the computer was down, the document person on Friday had taken a day off, and that the woman who did the interview was sick again.

I'm steaming mad, but I'm not sure if there is anything I can do. She had her visa interview rescheduled on Wednesday, and now she can't even pick up her visa at the appointed time. They are not being very professional over there.


Last week Su was told to pick up her visa on Tuesday the 20th (today in Thailand). It's gonna be a bummer if she goes all the way down there, and they don't have it ready. She doesn't live too far from the embassy but it's still a real inconvenience, not to mention a terrible let down. Hopefully they'll both have their visas very quickly.

Finally it's interview day for Su. She said that there where about a hundred people waiting, and all the documents we had were starting to get heavy. But in a few hours it will have all been worth it. I wished her luck and she told me she'd call back as soon as she was finished. Then she followed the crowd into the embassy. I wish I could have been there with her. Good Luck!
