Both myself (K-1) and my daughter (K-2) had no problems entering the U.S. without actually activating our visas. We were just visiting my fiance and told the officers that we were not ready to activate our visas at that time.

We drove across the border at Blaine, Washington, we did not fly into the U.S.

The border officers are very uninformed in matters regarding to visas. I actually returned to Canada a couple of weeks after activating my K-1 visa to attend my brother's wedding. I had not married my fiance at the time and was allowed to enter the U.S. even after I had activated my K-1 visa.

I do NOT recommend anyone do this, I am simply stating what my experience was. It just goes to show you that they make up the rules as they go along. I was told I could return to Canada to attend my brother's wedding (a couple of weeks after I entered the US) the day that I activated my K-1 visa.

There are no visa interviews conducted in the U.S. They are always conducted in the foreign fiance/spouse's country.

I went thru the Vancouver Consulate to bring my daughter to the U.S. to live (she was a K-2, followed-to-join me). I needed a letter from my daughter's Dad giving his permission for her to come to the U.S. to live with me. But that was because her Dad and I had "joint" custody.

If you have "sole" custody, the letter is not necessary. You will need to provide the documents at your child's interview that states that you have sole custody, though.

I'm not too familiar with the waiver situation, but from reading the quote in your post, you did not apply for 2 K-1 visas, nor did you have one approved within the last two years (it was more than 2 years ago).

So, I would say you don't need to worry.

But, someone more familiar with waivers will certainly respond.

You do definitely have a bit of a different situation than most here on VJ. Your wife was brought to the U.S. with a K-2 visa, so her removal of conditions is really based on her mother, not on you.

My daughter was a K-2 and filed separately from me because she was not eligible at the same time I was (she followed-to-join after I was already in the U.S.).

I wouldn't worry about the way his signature looks. I worked for an optometrist who's signature looked like she just printed it. And also one of my good friends has the same kind of signature.

Your signature can look any way you like as long as it's what you use all the time.

As far as one of the signatures being different, not sure what you should do about that. I would probably be tempted to just cross out the U with a pen, like it was done by mistake.

But, not sure on that one.

I entered the US on July 31, 2004 and we got married August 28, 2004.

We had our wedding all planned right after our interview approval on June 10, 2004.

I would not even have bothered to move to the U.S. if I was not 100% positive that I wanted to marry my husband, so there was no need to "wait and see" after I moved here.

We had a beautiful wedding and had plenty of time to plan it before I even moved here, but I was only 3 hours away from my fiance and we visited every single weekend from the time we met until I moved here.

I had our AOS package all ready to go before we got married, so all I had to do was get the marriage certificate and add it to the package and we mailed it 2 days after we got married.

Unfortunately, many things that USCIS does doesn't make sense. They seem to cash the checks with no problems.... it's the processing of the case that they aren't so quick about.

Just have some patience and you should soon be receiving your NOA1, and then, hopefully, the NOA2.

If you have a case number, and they cashed your check, I would find it hard to believe that they had returned your package to you.

They must have opened it and taken the check out and also done some processing of your case in order for it to be given a number.

Unfortunately, you may have to wait the 45 days before you will be given any further information.

On the question about having your name on the mailbox, we have never had our name on any of our mailboxes anywhere we've lived and we have received all our mail from USCIS.

If you want to get both the K-1 and K-2 visas at the same interview appointment, then the K-2 will only be valid for 6 months.

So, you have two options:

1. Your fiance can come to the U.S. and marry you, then immediately send in the AOS and AP applications (if you have all the document prepared prior to your marriage, all you will need is the certified marriage certificate and then you can put the package in the mail.... we mailed ours 2 days after our wedding). Once the AP is approved, you and your wife could go back and pick up your step-daughter.

2. If your fiance is unable to accompany you to pick up her daughter, you could get certified letters from both her and the child's father stating that you have permission for her to travel with you to the U.S.

My daughter followed to join and both me and my husband went back up to Canada and brought her down to the U.S.

It is very humorous how people get the idea that just having a child with a US citizen can give you automatic US citizenship. I hear this all the time in conversations with people.

Unfortunately, having a child does absolutely nothing to speed up the immigration process. You will need to choose a process just like the rest of us.

We received an RFE for not having original signatures on the G-325A, but we had signed the attachments, so I'm not sure how picky they are about the attachments.

Hopefully, because all the other attachments are signed, that will be good enough.

Like the previous poster suggested, just have the signed attachment ready to return if you do receive an RFE.

Hopefully, you will be approved for your Canadian citizenship before you need to move to the U.S. because I am pretty sure you can only be out of Canada for a certain number of days per year in order to remain a permanent resident, and eventually get your citizenship.

We didn't have any long separations during our process... I only lived 2 1/2 hours from my fiance, so we saw each other every single weekend throughout the process.

But, when Sunday came, we were both very down and found it hard not to show it. The weeks were long, waiting for the next Friday to come.

I certainly sympathize with all of you who are separated by many miles and can't see each other regularly.

My daughter (K-2) followed-to-join me in the U.S. and I simply had her listed on my I-129F initially. Then, at my K-1 interview, I told them that she was not accompanying me to the U.S. at the same same as me, but would follow later.

You must have the K-2 visa in hand within one year of the K-1 visa, so make sure you allow enough time for the medical and gathering of all the documents.

My daughter's K-2 visa was valid for 6 months, just like my K-1 visa.

I don't know if I'm the only one that feels this way, but I wouldn't even feel like it was a "wedding" after I was already married. The wedding is the start of your new lives together, not something you postpone just to have a "party". You can easily plan a wedding in 3 months, especially if you start some of the groundwork before you even arrive in the U.S. So much can be done on the internet, etc.

Do you mean that you are worried about getting permission to move to the U.S. with you from the child's other biological parent?

Any errors in names, etc. can be corrected at the interview. Make sure you take as many documents with the correct spelling as possible.
