After entry with a K-1 visa, you have 90 days to get married. You can apply for a SSN 2 weeks after entry, or you can wait until after marriage. I waited until after we were married to apply for my SSN so I could get it in my new last name.

After you are married, you submit the AOS documents (I-485, I-765 and I-131).

The letters of intent are a pretty important part of the process. You will most likely receive an RFE for them before your case can be approved.

If I were you, I would have them all ready to go so that when you receive the RFE, you can just pop them in the mail with the letter that USCIS sends you.

We were waiting for my divorce to be final, and as soon as I got the papers, we sent our I-129F off to Nebraska.

I never mentioned the fact in our letter of intent, and it was never an issue throughout the whole process.

Apparently, a large majority of immigrants these days met on the internet. That's what I was told at my K-1 Visa interview. They did not frown on it at all.

I really don't understand why they would frown on people who meet through relatives or friends, though.

You don't need anything notarized to submit with your I-129F. Just make sure all signatures are originals, and you will need the I-134 notarized for the interview.

You will also need to show the originals at the interview of all the copies you submit with your I-129F.

I entered the US with my K-1 visa in July/04 and my daughter didn't come to the US with her K-2 visa until Sept/05.

As long as the K-2 visa is issued within one year of the K-1 visa, you will still have 6 months after issuance of the K-2 visa to actually use it.

You could get married, immediately apply for AOS/AP/EAD and then return to pick the child up after AP is acquired. If you don't get the AP approved within the valid 6 month period of the K-2 visa, you could always send your husband to pick the child up or perhaps have a relative in your home country bring the child over.

I did not renew my passport until it was near expiry. I just made sure I carried my certified marriage certificate with me at all times to show the reason for my change of name.

Having a passport in your maiden name does not affect the AOS process at all.

No.... for follow-to-join...the K-2 must be issued within 1 year and it has a 6 mos. validity... so entry can actually be delayed until almost 18 months after K-1 issuance


Exactly right.... I (K-1) entered July 2004 and my daughter (K-2) didn't enter until September 2005.

Anytime you don't have enough room on the USCIS forms, it's alright for you to add a supplementary page. Just make sure you always put your name and the form number you are attaching it to on the top of the page so that if it gets separated for some reason, they will know who's file it belongs to.

You most likely had all the required vaccinations as a child at school.

In B.C., you can contact your local Public Health Unit for your records. I needed my daughter's records for her K-2 visa, and they had all her vaccinations on record. Also, did your parents keep your vaccination booklet that gets updated at the doctor's office when you got immunizations as a baby?

The tourist visa you have applied for will only allow your fiance to come to the U.S. for a "visit". He will have to return to his home country when the visitor visa expires.

You will then need to apply for the K-1 (Fiance visa) so that he can return to the U.S. to get married and live and work.

If he mentions at his tourist visa interview that he is intending to get married and stay in the U.S. after his arrival, his visitor visa will most likely be denied.

Honestly IS always the best policy when it comes to USCIS and the borders, but now that the incident is over, there's not much you can do about it.

When I would come down from Canada to see my fiance (husband now), I would never volunteer any information, but if I was asked a direct question, I always told the truth. I was asked on one of my trips if I had ever heard of the Fiance Visa.... I told him that I had, and that we were just awaiting our approval. I said the purpose of my trip was just a "visit" and I was allowed in.

Make sure your fiance always has proof of ties to Canada, such as lease/mortgage documents, most recent pay stub, etc. to prove that he will be returning to Canada after his visit.

I visited the U.S. numerous times while our I-129F was being processed with no problems (by car, not plane). I always made sure I had my proof of ties to Canada with me, though.

Make sure your fiance always has her most recent pay stub, lease/mortgage documents and any other proof of ties to Canada every time she visits you and you shouldn't have any problems. There is never any guarantee, no matter how much proof you have, that anyone will get admitted into the U.S. It is completely up to the discretion of the border officer.

I was asked once if I had heard of the Fiance visa, and I replied that yes, I had, and that we had submitted it and were just awaiting our approval. I told the border officer I was simply going down for a visit to see my fiance.

Welcome to VJ!!! Hope you can find some answers to any of your questions and also provide some answers for other who follow you.

In the past, things were a lot different. Around 20 years ago, one of my friend's Mother moved to the U.S. to marry an American, and didn't require any kind of visa to do so. She just simply drove across the border with her fiance and her van loaded with her belongings. It's changed a lot since then (unfortunately for us!!!!).

So, perhaps the rules regarding SSN's were different 15 years ago as well, because I can't understand why your Mother would have been given a SSN just because she owned a home in Florida. My former in-laws owned a home at Mt. Baker (in Washington state) and they certainly were not allowed SSN's. They were always considered Canadians and were only allowed to spend 6 months a year at their home in Washington state.

Every single one of our (mine which was K-1 and my daughter which was K-2) cases were processed much faster than the dates on the USCIS website, right from the start of the process up until my own naturalization and my daughter's 10-yr GC. The dates are only a very rough estimate.

Once you get approved, you can start the paperwork at that time for the Aff. of Support. You can figure out if you will need a co-sponsor or not by checking the Poverty Guidelines on the USCIS website to see if your fiance earns enough to be your sponsor, without the need for a co-sponsor.

Both myself (K-1) and my daughter (K-2) had no problems entering the U.S. without actually activating our visas. We were just visiting my fiance and told the officers that we were not ready to activate our visas at that time.

We drove across the border at Blaine, Washington, we did not fly into the U.S.

The border officers are very uninformed in matters regarding to visas. I actually returned to Canada a couple of weeks after activating my K-1 visa to attend my brother's wedding. I had not married my fiance at the time and was allowed to enter the U.S. even after I had activated my K-1 visa.

I do NOT recommend anyone do this, I am simply stating what my experience was. It just goes to show you that they make up the rules as they go along. I was told I could return to Canada to attend my brother's wedding (a couple of weeks after I entered the US) the day that I activated my K-1 visa.
