Hello everyone, new member here! I'm beginning the process to bring my fiance from Baja California Sur, Mexico to San Diego, CA and I have a few questions regarding translations. Do emails, chat logs, etc. need to be translated by someone certified or can I provide my own translation (I speak Spanish fairly well)? I know more important docs like birth certs, health exams, etc. will need to be translated by someone certified but I wouldn't think emails would need to be. Also, do I need to provide a signed and dated letter of intent written in both English and in Spanish (both copies being signed by my fiance)? Will this help at all to show she willingly signed a document she understood in her native language or will just an English copy suffice?

You know I panicked about this too before I sent my I-129F but I did all my own translations of every email and then just put a piece of paper behind each email I translated that said I was fluent in French and that the translations were accurate. I did that for every one that I translated, with a date and a signature. There is a link on this website under K1 visa guides, I believe, that show you how to do that. If you can't find it, let me know and I will send you what I wrote. As for the letter of intent, just have her sign the english one, they don't care about anything that's not in english so don't go to too much trouble. Let me know if there is anything else I can answer.

Thanks for the opinions everyone, I think I will stick to my original plan of giving in notice once we clear NVC, i feel that is probably the best rough 3 month marker given current time lines. But an informal chat to try and help them start looking for my replacement early may well do me some favours when looking for a reference, which would be nice to have (another reason not to just walk out I feel) especially when i am looking for work in america.

That is a long period of time for notice!! But I'm going to go ahead and say you should give notice after you receive your NOA2. We received ours on November 25th and my fiance has his interview on Feb. 18th, and that is also considering it took us a month and a half to receive his birth certificate so we didnt send the package 3 back until 6 or 7 weeks after we had originally gotten it. So, if you're sure you want to leave right after you receive your visa, go ahead and give notice after the NOA2. However, you could potentially be denied the visa and then you'd be out of a job but the likelihood of that happening is very very very low. So I think you're making the right decision.

They actually gave it to him a week before the interview so that was crazy. Anyways, ask for your birth certificate ASAP.

My 07 and 08 income was pretty high, but last year was pretty low cause I didn't really have to work. Hmm... I just started with them in January, so they're not on my tax return from last year. Do you think a letter from them would be enough? If they put down my salary and stuff? I know it's well above the poverty level. As for the contract end date, there isn't one. Since I work with an elderly lady, I guess it'll just be until her conditions worsens, or when she passes away which I'm sure won't be for a very long time. Should I still submit a co-sponsor form too just in case though?

It's the same number but it's 1-888 so on my cell bill, that's the number you'd see. It's not a card card that I could save, I just always reload it when I need to call. Our main communication 24/7 is yahoo messenger though. So should I still submit all my income stuff along with my parents or just theirs? Help please! I have a few questions and I'm sure they've all been asked before, but I think all circumstances are different.

Ques. 1- My fiancé and I don't have phone records because when I call the Philippines, I use a rechargeable phonecard, I never call directly. Also we chat on yahoo, but I never have time to use the computer at home and so we chat using our cell phones. So there's no chat records I can print out either. We email sometimes, post on fb walls, and send letter once a month or every month. Is that enough evidence for them?

Ques. 2- I'm a private/contract caregiver and I get paid in personal checks, can I use that as proof of employment? I make $3000-3500/month. I just started in January and so it wouldn't show on my tax return from 2009. In 2009 I didn't really work so I only filed like $5000, in 2008 and 2007 i filed like $30,000 each year. Since my income is ok this year, will last years low tax return have a big impact on the decision they make?

Ques. 3- Since I had a low income last year, should I still have a co-sponsor just in case? Can I use my mom and stepdad as co-sponsors? Their 2007 and 2008 returns are seperate, but 2009 is joint because they got married last year.

So even though they filed their 2009 return as joint, I just need to use hers? Because for the whole household it's the two of them. Because her and my stepdad both work so they're supporting the household. I live with them also.

I'm a private contract caregiver and make $3500/month since January. I get paid in personal checks from my client, so I don't have pay stubs. My clients son can make me an employment letter but it wouldn't be on a professional letter head, it would just be typed. THAT is the reason why I want to send my moms income also just in case they don't accept mine.

I'm planning on using my mom as a co-sponsor so how would I fill out the I-134 for her income? Her and my stepdad file jointly and so their incomes are combined for the household. Do I put their annual income or just hers? Do I have to fill an I-134 for my stepdad too?

Also, if my income is enough would they bother looking at hers? I just want to send hers along with mine just in case.

Hello Everyone!

I'm a newbie on this site, I just have a question that I hope you guys won't mind answering/helping me with if you have any information. My fiance tried to schedule an interview appointment online 2 days ago after making the necessary payment at the bank for the visa. He was able to schedule one for June 28, 2011 but he thinks he scheduled it under "Immigrant Visa" and I know K-1 is considered a Non-Immigrant visa. So, my question is, should he cancel that appointment and re-schedule it under Non-Immigrant instead or it doesn't matter? We just wanna make sure that he doesn't get sent home on the day of his appointment because the appointment is considered invalid? Please suggest! thanks for your time :)

I am the USC and I just realized on NOA 1 & 2 also on the NVC letter with case number.. my fiancee's second name is not included but on the G325a forum it is correct. We already have an interview date set. Will this cause any problems?

What I mean by "second name":

e.g.
First name: John David
Middle: Henry
Last: Smith

John David Henry Smith*
(*not really my fiancees name, just using this as an example)

But what it says on the NOAs and NVC letter:
John Henry Smith
(David, the second name is not included)

All my fiancees nbi, cenomar, passport, ds-forms, etc has the second name. I don't know what to do.. I'm so worried.

So, my fiance was approved on December 27th. We've been waiting for the visa to be delivered to his house at Marikina City and yesterday (Saturday, January 7) he wasn't home and it just so happens the visa came that day, his cousin was home but they needed my fiance to authorize and show ID. They told the cousin that they will deliver again tomorrow (Monday, January 9). My fiance will be home all day to make sure he doesn't miss the delivery.

Well, my question is.. do you guys think it's safe for me to buy a plane ticket now? I know he still has to go get the CFO sticker and what not. I was going to have him fly over to Seattle, WA (POE) on January 22 or 24. I think I'm just a little paranoid and thinking about the "what ifs". Like what if they don't deliver the visa on Monday or some kind of mistake happens and he's not able to fly out..

I just need someone to let me know that its okay to purchase the ticket or to actually wait till visa is in his hands.

for fiancee's kids, dont list it in your i134 because they are not going to come together with your fiancee. i have the same situation, and we didnt list my children in my fiance (now husband's) i134.

the date you submit, is when you signed your form.


another questions are for g-325a:

for parents info, does it have to be mother maiden name, not the current last name right? (better list your mother's name as listed in the birth certificate)

for applicant's last address outside of US for more then 1 year, so if I've lived outside of US like 10 years ago, do I have to remember that address and exact dates? (provide as complete if possible).

strongly not recommended. you will have to file for adjustment of status BEFORE your K1 visa expired. If you got married 2 days before your visa is expired, you will have to at least 3 days until your marriage is recorded and you can order a certified marriage certificate to be attached to your i485 application, and the application needs to be accepted by USCIS before your visa expired.

As for SSN, better apply now when your visa is still valid, and later after you got married you can report for name change. later after you received your greencard, you need to report your new status too. good luck !

Once you enter the US with a K-1 Visa and get married within 90 days of entry, the K-1 visa is no longer valid (it is a "Fiance" visa, and you are no longer a "Fiance").

As long as you have applied for AOS, you are fine. You will get your Green Card and won't have to do anything for 2 years, at which time, you will apply to have your conditions removed (which gives you a 10-yr Green Card).

You can apply for the 10-yr Green Card three months before the 2nd anniversary of your 2-yr Green Card expiring.

I didn't even start my divorce proceedings until after I met my fiance (husband now). I had been legally separated for 6 years from my ex when I met my fiance, and only went for the divorce from my ex after my fiance and I met and decided to be together.

My divorce was only granted 3 months before we sent in our I-129F. We never had any problems as a result of this.

If you are thinking of your fiance coming over to the US on the VWP, and then getting married, that part is fine. But if you are thinking that just because you are married that she will be able to stay in the US, that part is not fine. She would have to return to Hungary and get the K-3 or CR-1 Visa in order to return to the US to live. Getting married on a visit here would make the K-1 Visa invalid because it is a "fiance" visa and she would no longer be a fiance.

If you sent your application in last December, you should be getting your approval very soon. It's hard to wait it out, we all know just how hard it is, but you will soon be approved and can be together for the rest of your lives.

A big proportion of members here on VJ have done the visa process themselves, without the use of a lawyer. As long as you do your research, fill out the documents correctly, and send the required documents, you will have no problems. There is so much information available here on VJ in the "Guides" and "Visa FAQ" sections and you will find the answers to all your questions there.

A lot of people who did use lawyers reported that the lawyers made costly, time-consuming errors that probably wouldn't have happened if they had done the process themselves.

It can also be frustrating to wait to hear any news from a lawyer, rather than dealing directly with the process yourself.

The choice is yours, but you are definitely capable of doing the K-1 or K-3 process on your own. Just do your research, and ask any questions you have afterwards here on VJ and you will get lots of help.

I agree with pushbrk with respect to the fact that the whole process is very time-consuming, whether or not you do it yourself.

If you have to provide all the information and documents for someone else to do it, you can just as easily do it yourself. Plus, there have been a whole lot of people who have used lawyers and regretted it afterwards. It's so much easier to know what has and has not been done if you do it yourself.

Your fiance will have to apply for Naturalization, and after becoming a U.S. citizen, he can then petition for you to come to the U.S. with a K-1 Visa (Fiance Visa).

Depending on which office he would be going through for his Naturalization application, it could take up to 18 months for his approval. I applied on September 13, 2007 and am still waiting for my approval and interview.

It may be a long haul for you to get to the U.S. permanently, so you may have to visit until he becomes a U.S. citizen.

I was not asked for any proof of a booked wedding at my interview. They did, however, ask me the intended date of our wedding.

Lots of couples haven't started any wedding plans by the time their SO arrives in the U.S. They want to do the wedding planning together.

Don't stress about that part of it. Just present as much evidence of a bona fide relationship as you can.

My daughter changed her mind too after I got my K-1 Visa, so I may be able to give you some information.

I need a little more information first. Have you had your K-1 Visa interview yet? Did you put your son's name on the I-129F application, even if you didn't indicate that he would be wanting a K-2 Visa?

Here's how our situation went:

I went for my K-1 interview on June 10/04. At my interview, only my daughter (at that time, she was 16) was eligible to follow-to-join. My two other children were too old. One of the people who I spoke with at my interview told me that I should indicate that my daughter may follow-to-join so that I didn't close the door on the possibility down the road. So, I did so, but still didn't think my daughter would come to the U.S. to live. My Visa was approved that day.

In early 2005, my daughter decided she wanted to come to the U.S. I emailed the Vancouver consulate to ask what I needed to do to start the K-2 process. They told me to fax Form DS-230 Part I to the consulate and to start collecting the necessary documents (such as police certificate, long form birth certificate, permission letter from her biological Dad giving his permission for her to move to the U.S. to live with me, and passport photos, etc. As well, I had to book her medical exam to be done in Canada.

After I had all the necessary documents, the consulate scheduled an interview for her. The interview was very simple and they basically only asked her why she hadn't come with me at the time I moved to the U.S. She told them she wanted to finish high school in Canada, and that was all they wanted to know from her.

She was approved the day of her interview (May 26, 2005) and moved to the U.S. on Sept. 5/05.

The K-2 Visa must be obtained within 1 year of the K-1 Visa. I made it by the deadline by just 2 weeks (my K-1 was obtained June 10/04 and her K-2 was obtained May 26/05).

Like the previous poster said, the beneficiary's (which is you) financial situation will not affect the K-1 process. It is the petitioner's (your fiance) which is important.

He must have income which is 125% above the poverty guidelines in order to sponsor you on his own. If this is not possible, he will need a co-sponsor, such as a parent, other family member or friend who is willing to do so.

You might also want to consider getting through the K-1 process before your fiance goes back to school. He could possibly start looking for a new job right now knowing that his current job will end in July. Then, once you are approved and move to the U.S., you can apply for AOS, get your work authorization, and then you could support the two of you while your fiance goes back to school.

For me, the goal would be getting to the U.S., then figuring out how to make your lives financially better after that.

What your friends are going to do is not legal. You cannot enter the U.S. with the intention of marrying a U.S. citizen and remaining in the U.S. afterwards.

If they decided to get married spur of the moment while she was in the U.S., that is fine, but to plan it ahead of time, with the intention of bypassing the legal immigration process, is not a good idea. If they are questioned at their AOS interview and cannot prove that their marriage was spur of the moment, and not planned ahead of time, they could get a 10 yr ban put on them.

For me, the stress and subsequent end result would deter me from doing it the illegal way. The legal way may take a little longer, but at least I wouldn't be looking over my shoulder all the time.
