IR-1 / CR-1 Spouse Visa Process & ProceduresNow what.....

Have you called NVC to ask about the interview date? As I know, the NVC schedules the date for the interview!

That would be true, but I found out that once your case is expedited, NVC ships off what they have and it's up to the Embassy to schedule your interview. I am grateful our package has been expedidted but I hate not being able to know when she can get her interview date, from what I have heard, you have to be dying to call them.

IR-1 / CR-1 Spouse Visa Process & ProceduresNow what.....
Good Morninig VJ,

Latest update, so my case was expedited to the Embassy on the 26th of August, I tried to log onto the NVC website and I got a sign in fail. I called NVC and they informed me that the case has been sent to the Embassy in KL on the 29th of August. Should I call them and ask for an interview date or just wait till I hear something? I want to run this thing into the ground. Any advice would be helpful:)

Congratulations :) If you can get all of your fees paid and paperwork turned into NVC before the second week of October, you stand a good chance of getting a November interview. I would do as everyone else has posted, get everything in order now, since NVC generally takes a few days to a week to review both packages. With your fees generated now, I project you should have all paperwork mailed off within the next 2 weeks, so you will be ok. The last day for November interviews is October 14th. Good luck and Allah bless.

The Embassy will only schedule the interview IF you have your case expedidted. NVC would do the scheduling if the case is being normally processed. Give it to Friday to see what happens....

IR-1 / CR-1 Spouse Visa Process & ProceduresCase Complete at NVC

Su...

it is a myth that interviews are only scheduled in the first half of a month for the next month...it is different for every embassy, so to make such a sweeping statement is misleading--it might be true for your embassy, but I can assure it is not true for Costa Rica and many, many more, so to suggest that is the "way it is" unfortunately isn't accurate no matter what you read here or what the NVC reps tell you.

No criticism intended, but I don't want to see folks hopes dashed on one hand, or needlessly raised on the other.

Not a problem. This was the information we were given when we contacted NVC. Since our case number was generated on the 12th of August we missed the deadline for September. The only reason we got an interview this month was due to expedition. I've spoken to NVC myself many times and that's the information they have told me every time. The only time the embassy will schedule it is if your case is expedited. As long as your paperwork is in and been reviewed you would make the cutoff. They even told me the cutoff of next month is the 14th of
14th of October for November. Sorry if this isn't the case.

P.S. This is Marvin, I like my wife's name in the front of mine;)

IR-1 / CR-1 Spouse Visa Process & ProceduresCase Complete at NVC

Do you mean all materials received by NVC, or NVC complete the case by 16th of this month?

I already send every bit of needed documents to NVC, electronically. Does that means it is a certainty my wife will get an interview in October?

NVC has to have all of the documents and have the case reviewed and closed by the 16th of this month. If I were you, I would call them to make sure the electronic copies are accepted. I overnighted my paper work as soon as my fees were paid.

THe way it works is, every month they schedule the appointments on the 2nd full week of the month. You have to have all your fees paid and all the documents into NVC before this time.

On AVR it says case complete but I jut got RFE for police clearance.....dont know what to do......hope its false RFE...

Give them a call, wouldn't hurt....

For all of you that cases are complete, NVC will give you interview dates this week, until the 16th. They schedule it for the next month. So as long as your paperwork and all of your fees are paid by the 2nd week of the month you will get an interview for the following month.

How did they get an Advisory Opinion from DOS? Doesn't the CO already know you were divorced from the up front paperwork?

That's the thing, my wife had all the paperwork with her, but she only had copies of my divorce decree. I think the CO thought something was fishy with her tourist visa and Immigrant visa being so close to each other. We thought the process would take 6-8 months at least, so it was a surprise when we made it through in 4 months. So he went in looking for something and the divorce decree was the red flag.

To All,

Mae sure you have the originals for your spouse at interview time, it could make or break you...

Divorce decree of USC here in U.S?

Yes, because my first wife deserted me while I was stationed overseas and she went back to Europe I had to get a Mexican Divorce. Good thing I paid extra for the Apostille and had the government stamp on it.

The interview was crappy because a couple of months prior she filed for a tourist visa to come visit and she was turned down by the CO. Bad thing was, the CO was the same guy who interviewed her for the I-130. So I can see why he was looking at my case funny. Once he saw the decree the red flag went up and we were put in AP. So they went and got an Advisory Opinion from DOS, after that she came back for a 3rd interview and was approved. But honestly, only a week and a half of AP isn't bad compared to most of the cases I see on here so I cant even complain.

Thanks for all of the comments:)

I just wanted to say thank you to all the people that gave advice to us during this journey. My wife went in today for the 3rd time and was approved. Our case was put in AP due to my divorce decree having some questions, but in the end it all worked out. We were only in AP for about a week and a half so I am grateful for that. She will pick her visa up on the 18th of this month. This sight really gave great insight and stories to help navigate the immigration waters.

Peace be unto all of you.

My soon to be wife told me today that I will be needing a document showing that Im single and not married I live in California how do get this document or how do I go about this. do I go to the civil registry in my county to ask for such a document? All your comments will be appreciated.

Thank you in advance

I think everyone has covered what I was going to say, I had to get a Single Status Affadavit before I could marry my wife in Malaysia. I received this document from US Embassy in Malaysia about 2 weeks before the wedding. Just contact the embassy either in her country or yours and it should be easy to obtain.

K-1 Fiance(e) Visa Process & Procedures2nd NOA, processing times..?

Holy smoke, I know I just filed our K1 pkg, however I was checking out the next steps in the process and the 2nd NOA, acknowledging K1 petition approved, the processing time for this step is 5 months alone? It seemed to not matter whichever service center, except Nebraska, (not sure what their times meant)...., but I've talked to people who were bringing their Filipina finace here and I know one guy said the whole process was 4 months...there were some 5 month folks...seemed 6 was sorta common..?

I mean it is what it is, but didn't think just that one step was 5 months. Too bad living near DC doesn't help or I'd just drive the 50 mins downtown and take care of it, if I could, lol.

The problem is, there is no set timeline. I've seen cases here that get processed in under three months, some take up to two years, each case is different. Seems to be a mixture of luck and timing on when you file as well. Praying also helps if all else fails....

K-1 Fiance(e) Visa Process & ProceduresVisa denied

Hi I am engaged to a girl in Malaysia, we are getting married in May. I have been to see her twice and am going again in about a week. However she has not yet been here to the USA to meet my family. We tried to get her over for the holidays but her visa got denied. We tried to get a "tourist" visa since we are not getting married in the U.S. Should we try a "fiance" visa instead? Can we, even though we are not doing the marriage here?

any advice would be much appreciated!

-Val

Hello Val,

The biggest question is where you will be getting married. My wife just went through this process and it wasn't that easy. She was denied for a tourist visa twice when she wanted to come visit me while the CR1 was processing, I guess the big thing would be where would you be getting married. If you need some more information PM me.

Good luck.

K-1 Fiance(e) Visa Process & ProceduresImmigration Attorney

I've been working for several months without a day off, and I am still very unsure about doing the paperwork myself for a K-1 Visa. I've decided to hire an Immigration Attorney. I did a Google search and found several at prices ringing from $995 to $2495. I'm not certain who to use or who to trust. They all promise results.

If anyone can make a recommendation for an attorney, send it in a PM or email me at Hangernaid@gmail.com. I know this site is not for commercial purposes and I don't want to have a thread deleted by violating any rules.

I appreciate the recommendations.

Jim

I second the motion of everyone on here so far, the ONLY way you should get an attorney is if there was something unique about your case(ban, multiple marriages to foreigners, etc)other than that, it's pretty much straight forward.

I filed my CR1 paperwork before I found this site, but even then I had no hang-ups whatsoever until the interview part(a oversight on my part). You can ask people on here for help and they will be glad to assist you, save your money and time.

Good Luck:)

K-1 Fiance(e) Visa Process & ProceduresAttorney Representation - What Good Is Having One?

If a case has red flags, a GOOD family-based-immigration attorney can be very well worth the investment. To flatly say "You do not need an attorney" is something that NOBODY here can state with any assurance, without knowing every intricacy of another couple's situation.

+1 si man,

If you have a straight forward case with very minor to no issues, an attorney might not be the best route to go, for the petetion, it's pretty easy to follow the guides and be successful. When I got back from our wedding in Malaysia, I was as lost as a blind man in a dark room trying to find a black cat that wasn't there. One of the men from our Mosque gave me the number to his immigration attorney. He wanted to charge two thousand dollars as a start, and other charges as it went forward. I'm glad that I filed by myself. The people on here are very well versed, ask and you shall recieve...

I don't believe that a lack of general travel history (on the part of the USC) will cause a consular officer to look poorly on a case.

I do believe that in high fraud countries, a brief travel history (again on the part of the USC) TO THAT COUNTRY can set off bells for a CO.

In cases of high fraud consulates, I would theorize you should go there at least twice. I was lucky that my ship pulled into Malaysia 3 times so I got to see my wife on the government dime:)

Don't most single men anywhere in the world hand out compliments fairly easily whenever they cross paths with a pretty woman, especially Europeans? This isn't something that one would need to actually travel to Europe to understand, it happens everywhere.

It's usually very easy to determine if someone is genuine when they profess their love for you, more importantly it's fairly easy to know if you should or shouldn't feel the same way about that person due to the factors surrounding your relationship. These are gut instincts that we all have, and when they kick in, we need to listen to them. One does not need to have travel experience to Italy to know whether or not that cute Italian guy or woman really loves them, it's in your gut.

If the above statement were true, then no one would get scammed. You used the shell game as an example, think about it. You have to bait the person first before you pull the wool over the eyes. No one is going to try and rip you off on the first try, they have to suck you in to make the real money, the first one is free then it gets harder as you keep playing. Same thing with romance scams, these guys don't email women asking for money right off the bat, they lure them in with sweet talk and other things, and most of the time it's a small amount first just to get them comfortable first. I dated a Japanese woman whose ex-husband was from Camaroon, she showed me the emails he sent while they courted. Now I could see why she fell in love, he tailored them to her writing style and talked to her in the manner that she wanted to hear. Once he got to Japan, it was a wrap, he is now over there without her and its sad becasue she has a kid with him he never sees or take care of.

I agree that it should be easy to see it coming when it comes to love but let's be real. Everyone has been heartbroken at some point in their lives, it happens. Your gut takes a back seat when the heart is driving the bus, or even worse, when your libido is in charge, then it's cruise control until you crash into a wall. If a man or woman is looking for companionship and next thing you know someone is online or IRL in your face fufilling your every wish and desire, it's hard not to fall completely and not see clearly.

I guess I can see the travel aspect of it better because I travelled so much and got to see first hand how the cultures intertwined. How would you know what is right in wrong in a country you have no knowledge about? I had no idea how bad the Nigeria scammers were until I spend the night in Tokyo and saw how they conducted business. And with the compliments from pretty ladies? If I stayed in St. Louis my whole life and then got hit up on the internet by some woman I might be leary, but if she were really good, then I might get taken, it's all in perspective. That is what they mean about cultural norms. You wouldn't know it unless you studied up on it or saw it for yourself.

I originally asked for clarification on the issue, which I have received. I personally don't see the connection, and don't necessarily agree with it, but I can see how some might. You clarified it by stating it was a very small part by itself, but when combined with other issues, it could cause further scrutiny. That much, I can agree with.

It's all in the perspective you put it in, if you have never been overseas or even travelled within the lower 48, you might be more subsectible to a scam in the broadest sense of the word.

I've spent 12 years being stationed overseas, 3 years in Germany, 3 in Sicily, 3 in Belgium, and the last 3 in Japan. Being on a ship in Japan, we hit several different ports in a lot of different countries, you could tell the rookies from the vets by where they went to hang out, how they interacted with the locals, and how they reacted to certain situations. It's like going to a bar in the PI, we had a guy fresh from the states, 22 years old never been overseas before. We had to drag him out by his britches since a bar girl had him thinknig he was "the one." If you've travelled enough, you tend to know where to and not to go, and what not. But common sense goes a long way, listen to your gut, it's never wrong.

Anything a person chooses to disclose or not answer about their significant other is their right to do so. Just like it's a person's right to share an opinion, but it's not your right to attack another's belief system.
And I wouldn't respond to what I've read here, because it looks like an attack, but she has logged into VJ.
KAL take what you need and throw the rest away.

From what I have read, no one is attacking her, especially not myself. People are trying to give her insight into her situation, if something isn't adding up and someone is bringing that to her attention then where is the harm in that?

No one is saying having religion is a bad thing. Heck I prayed to Allah every day 3 times a day when my wife was going through this process back in June. She is from a MENA country and I knew it was going to be a challenge. But with HIs grace, I made it through the entire process in 4 months, which I believe is practically unheard of. Now even though I give HIm his praise, it was I who called USCIS and NVC all the time, I kept my fingers on the pulse of my petition from conception to completion, and I made sure I followed the instruction to the letter. I didn't go "oh Allah has my back" and filed a petition with my fingers crossed and no documentation or proof of our marriage. From what I read, she tried to file hardship, but under what conditions? If there is a medical or financial reason for it then maybe, but I can't see them granting it under the notion you can't live without someone you have never met in the flesh.

The advice given here is what scammers typically do in most situations, the effects forum is practically overflowing with the same stories, met online, big age difference, met once and married, then it goes down hill from there. Now there are always exceptions to the rule, and everyone thinks this falls under their situation but as adults I know this is more not than often. If she falls into the above category, I see nothing wrong with people who are trying to stop a good person from going down a bad road giving their opinions. In the end it's her choice, I pray she makes the right one...

Wouldn't it be hard to determine what is meant to be if one did not follow the instructional guidelines of the petition? KAL now understands that USCIS does not make exceptions and perhaps that was just 1 of the lessons she needed to learn. As she said she was trying to be obedient to her spiritual leader (I personally would be asking him for a refund). People are quick to say the person on the other end is scamming especially if they are Nigerian. Scammers aren't country specific.

KAL you should know if this is the man for you. If you are not sure, pray about it, ask for a sign, and wait for it. Your pastor and no one else can do that for you.

I think the people here were trying to help her with the I-129 first and foremost, the scamming part came after hearing that she and her fiance have never met. I agree that it isn't country specific, but Lagos isn't the hardest country to get through for no reason either. The scams coming from Nigeria are the 3rd largest export industry in Afica, I had to look it up.

And more to that point, it's unusual that the OP has answered pretty much everyone except the questions about her fiance. She hasn't been back since another member pointed this out a couple of pages back. People on VJ generally want to look out for each other and this was concerning for the ones reading the thread, the single-minded "God will take care of everything" thought process, not ever meeting, or even being out of the country, this would raise suspicion from any country...
