ps, if you've got the I-130 approved, I'd suggest you run with it ..... if you bang on with Lotopatience's shortcuts for NVC you'll be done in 4-6 weeks and I understand the interviews are quite quick out of London following that ..... you'll then have a greencard.

I am going CR1 route and my hubby filed in Oct 2007 i see yours was filed in 2008 and yet you have approval which is great cause i don't like to think of people waiting a life time for approval. anyways was wondering what Senator did you send a letter to to get your case actioned ?
Jeff and i have spoke with Congressman and we are told 3 more months for adjudication yet i see CR1 approvals beyond our date of filing .....what can we do ? Hope you can help
I am in Scotland and my hubby is in Naples Florida - our files are at Vermont Service Centre ...we need some advice in what to say and who to speak to to get our case adjudicated.

You have to file an I-130 for each of them ( 1 for your wife and 1 for your step-daughter) but file both petitions at the same time. you can got to the USCIS website and there you can find out which service centre your state is covered by.

Thanks to you all smile.gif It certainly has been a long wait smile.gif Originally we had attorny that filed K3 ( i was not keen on K3) for us but it was never moving and i was not comfortable with not filing an I-130 for my son so we told attorney we were going to file I-130 for my son he was not too charmed about it but thats okay cause we are so glad we did. We stopped his services and carried on ourselves.
My I-130 and I-129F was filed 19th Oct 2007 in April 22nd we filed I-130 for my son along with a cancellation letter for the I-129F ( which we did ourselves) so now we went CR1 route which is better in the log run and the fact K3 was taking forever... so it has worked out for us. there was no delay in getting approved because of the late filing of my sons I-130 ( he is 12yrs of age and a minor)

Just so every one knows it can be done if anyone changes there plans from K3 to I-130 I know for a fact both I-130's are together as i have e-mail proof and will be on there way to NVC where i hope the process to go faster smile.gif

I hope to be with my hubby by Sept smile.gif

I was getting very depressed waiting, Now the news of approval has lifted my spirits , I havent seen my hubby in over 10 months a couple more wont hurt.

Coming out of Vermont is such a nice feeling smile.gif I too was at Vermont but got Approved on 26th June now we are at the last leg of NVC ...I will be sending in my DS-230 's for my son and myself this week so hopefully i will be case complete in a couple weeks if all goes well smile.gif our files were on the NVC system on July 2nd so it only took a week to get out Vermont to NVC.

NVC are so much nicer to work with compaired to USCIS but im sure USCIS they have thier reasons as to why they can't answer hardly any questions.

If you follow the Fast way to go through NVC it should save you atleast 1 - 2 months time smile.gif

I am from Scotland and got married in Florida as my husband is from there. It was not our original plans as we did plan to get married here in Scotland at christmas time last year but instead we went and got married in Florida in August last year. it is possible for you and your fiance to get married in Scotland ( just remember scottish law is different to English eventhough we are both UK) also its easier to get married in Scotland cause i checked it out. First off I was told my husband ( USC) would need to get permission from his state that he was NOT staying just visiting for marriage it takes 4 weeks to get paperwork and then i would have to pass this paperwork on to Scottish authorities and then it takes 2 weeks to get marriage license which allows us to
get married in Scotland ...ofcourse thats easy but all the same you will still have to go through I-130 but then it would go through London which means its faster approx 6 months so u it's worth calling the Scottish Authorities and the State where your USC lives to find out the timescale. Either way you both have to wait for final approval and visa. It is said that Scotland is one the easiest countries to get married in. I wish i had stuck out and waited to get married in Scotland knowing what i know now but unfortunately for me my husband had some family setbacks which would not allow him to be here at Christmas so we took the second option.
Where in Scotland is your fiance from ?

If you send in a home made passport pic it may not be good enough and so not to hold up any processing i would definitely go to a professional Photo Store and have it done. The cost is not a lot of money and well worth it and it's safer.
Make life simple as possible when your dealing with USCIS ...that's just my thoughts smile.gif

We would still be apart and as I understand it we would have been apart for even longer because a K3 looks like it takes about 3 months longer, on average, to process.

After arrival in the US and the filing of AOS there doesn't seem to be any difference in the process... am I missing something? As long as you don't mess up the paperwork there's no reason it should take any longer to get permanent residence after your POE on a K1 or a K3 right???



You made your choice to go K1 and that has nothing to do with anyone but you and your fiance ...you both know what u want and that's eacother smile.gif So hang in there and get through the process with the faith that you and your fiace are gonna be very happy together smile.gif...besides you don't need to prove that to anyone ...you already know it smile.gif

I myself (in my past ) went out to USA on K1 visa a few years back ...i dated my fiance for 4 years before i married him...i was very happy and lead to beleive he was too, after all he ( the USC) surprised me and flew to UK and proposed. Unfortunately it didn't work out after just 8 months me being there, things were falling apart ...he had another agenda sad.gif another woman

I lost my life savings ...my home ...my job and came back to UK penniless and homeless with my son, at the time he was 7 it was awful and it completely devastated me because i was not aware of the goings on.
I vowed i would never trust another man but hey nearly 6 years on i am re-married to another American whom i adore and is nothing like my x so it's amazing how things can change...like i say the first 3 years i was bitter and angry at what my x did ...used me... but as time went by i realised i was stopping myself from being happy and that NOT all men are like that so here i am going through K3 yet another thing i never thought i would go through but i am and i am very very happy so Don't let others bad experiences dobt your decisions because people are individual and we all have had our problems at some time in our life smile.gif

I am going through this and im not looking forward to my interview because of being married to American before, i know this....I am honest and truthful and i love my husband very much im hoping the consular officer will see that for himself smile.gif

I am aways happy to see approvals whether it be K1 or K3 or I-130 but what really gets me is married couples should be priority to fiance .....I myself am married and awaiting my approval for K3 ...we filed back in October 2007 and just got NOA1 in January then we were able to file our I-129F again we got our NOA1 end Jan for that....why is it there's a heck of a lot approvals are for K1 and we married people are left behind ...seems so unfair sad.gif


I know our approval will come but it's rediculious that a lot K1's are getting approved in a matter of weeks...i am glad tho that thye dont have to go through the pain of waiting months on end like some of us on here!

Just wish there was a reason behind it ?

I am sorry that the postal service has let you down but for future reference it is ALLWAYS best to send Important Documents
(especially when dealiong with USCIS ) via Fedex so that you have a signature and date they were recieved...We sent our files to USCIS using fedex and we didnt have any problems so Good luck in your quest with USCIS ...it's a tough one for some on here sad.gif

I went through K1 a few years back and like you went to London prior to applying for the K1 to see if i could get a visitors visa just so i could go spend a couple months with my Fiance but i was Denied the visitors visa because they dont look lightly on visiting a fiance if your VWP was not valid, i had a denied entry so that didnt help ( i didnt show strong ties to UK at the time i entered USA eventhough i had return tickets and had no intention of staying over my time they still denied my entry) ...you must be prepared for a denial but who knows you might be lucky ...i wasn't

U must get a visitors visa if your planning to go see your B/friend because of your denied entries but if you have already filed for K1 the chances might be very slim on getting a visitors visa, u can check this with the american embassy before u go on a long flight over there only to be denied again at POE

denied entry will not stop u from getting your K1 ...if and when u do go send your papers to USCIS make sure u kept your original documentation of denied entry and sent a photo copy of it to USCIS along with your K1 paperwork because the info about your denied entries will be on the System and i bet everytime u enter US they pull u up for questioning ... i know i been through a denied entry ( didnt show strong ties to UK was the reason) and beleive me it gets so tiresome having to answer the same questions so i know the process at POE, even when i got a B1 visa i was still pulled up and questioned.... but as long as u have a travel visa things should be fine ...If they issue u one.

hey guys I have my interview date on November 10th in London i'm so excited, I only had my medical yesterday. I sent an e-mail to the American embassy in London a few days ago asking if they could notify me of my interview date so I could make arrangements for Courtney to fly over and come to the interview with me and got the usual reply that they deleted my e-mail without reading it. Today I got a reply from the embassy letting me know my interview is on Monday 10th November 2008 and that they have sent me out written confirmation of this.

I've also now booked flights to the USA on December 13th so I'll make it over in time for my birthday, christmas and new year, the timing couldn't have been better. I booked through Delta and am flying through JFK as my POE so that I can try get my temporary work visa stamped in my passport (fingers crossed). It's such a relief that we are nearing the end of what is only the first stage of this process but the rest will be so much easier as we will be together when applying for AOS.

Hey guys. Had my interview at the embassy and I got approved! It took me nearly 5 hours ha ha as the computer the woman was working on broke whilst she was half way through my case! had to get IT guys in whilst I stood about. They had to create me another 2, yes 2, case numbers and files to try get me through the system. In the end it worked out and I got the all important approval. Such a relief. only 33 days til I fly to the US now!!!

Hey guys i'm leaving for the US tomorrow morning flying from Edinburgh to JFK then JFK to Denver. This first impossible stage of the process is almost over. Hey I leave tomorrow morning and i'm so excited. I fly Edinburgh to JFK then JFK to Denver. Can't wait to see Courtney and never have to leave again.

Thanks guys!! I was approved 'pending medical'!! i had my medical last thursday and it wasnt gonna reach the embassy until the day after my interview. Overall it was a good experiance....apart from the four and a half hour wait for the actual interview! ill post my review tomorrow. im soooo tired!!

Congrats Stuart! I was number 5003.. I got there at 7:30am this morning. The whole process only took around 1.5 hours, did you have to wait a long time? By the time I left, the embassy was pretty crowded.



what time was your actuall appointment? mine was 10am so I got there at 9am and didn't leave til about 2pm lol although they did have problems with the computer when they were doing me! so to speak.

I don't care tho if it took all day, I wasn't leaving til they said the magic words "you're approved" rofl.gif

My appointment was at 8am! I had to leave my house at 6:30am, which I haven't done since I was 17.. haha. I got in to the embassy at around 8am, and left just before 10am. At the first part of my appointment, the computer wouldn't work as well. Had to grab everything and go from cubical 01 to 14, stopping of at 12 to pay the fees. What did you think of the giant envelope with the x-rays? It raised a few eyebrows when I sat down to wait for the interview. Maybe the onlookers thought I was a special agent? Well, probably not lol. I was trying to look out for you, but I couldn't recognise you from your forum picture. Congrats too, I agree, the words "you're approved" are worth any amount of time.

wow that was early. i was cubical 1 too when it broke so must have just been that computer. how dumb are they that they continue to use a broken computer hours later after first discovering it was broken then looked shocked as if they didn't know lol Yeah I had to stand at cubical 1 for an hour whilst they tried to fix the computer with everyone looking at me carrying the brown envelope with my xrays. Must have looked very official and important. I was sitting up next to the courier service whilst I was waiting. How quiet was the place? nobody wanted to talk or make any noise, so many nervous people in the same room was really funny. Thankfully thats over for us now biggrin.gif
