Hey just wanted to hear how May filers at CSC are getting on? I got my NOA1 on June 3rd so am keen to know how close I could be to my NOA2. So far best i've seen is someone who got NOA1 on May 12th!

While it is annoying having to wait a little longer for Visa you are just think your just about done with USCIS for a little while and look on bright side your fiance will be with you soon smile.gif London are fast with Administration so it wont be too long smile.gif

Congrats on the Visa approval, I understand how you feel, I read a posting saying that the old version of police report was ok till August, but I decided to get the ACPO one in case, im glad i have now. From what I understand it takes about 10 Days to arrive.

I too had to go get a new Police Certificate since i did get the old version back in January but now they changed it !
If you want you can have super fast certificate at the cost of £70 and have it in a couple days smile.gif

You should order 2 police certificates when u apply for it that way u have 2 ...i guess they are valid for a year so no need to get police clearance twice just get it done in one go.

As far as i know NVC are a different entity and have set requirements for the visa ...silly i know cause it's the same for me sinc ei am the UK ad ny husband is USC so i have to send my original certs...birth , marriage , divorce decree and police cert i have to get from UK so im ordering 2 one for the interview and 1 for me t take incase NVC lose anything ...costly and a lot of hassle for us folks ! however it is a requirement and i guess we just have to do it.

I have 2 of each documents except my divorce decree which im gonna get from the courthouse here in UK then i will be all set for when i need to send off my docs to my husband in US so he can forward to NVC.
Also remember to send passport style photos of each person moving with you and a set of copies of all the documents they ask for along with the originals.

Hi and how nice you have your fiance with you smile.gif As far as i know you don't need the Fiance visa if you plan to get married in USA however if you do get married in US your fiance will definitely have to return to her country and then you file the I-130 form and then the long wait is gonna start for u both. either way you go fiance visa or spousal visa u will both have to spent time apart in your own countries till you have all paperwork completed and approved. I do beleive you can visit your wife ( if you get married) as u will be the petitioner and have more freedom to come and go.

No law says you can't get married to a non US citizen/ permenant resident but it is illegal for your fiance to stay over her return date.

I am sure if i got it wrong then nice ppl on here with more knowledge will correct my comment. I am scottish and got married to american August 2007. we got married in Naples, Florida but i returned to UK so here i am waiting, going throught this process. It's been 3 months since we filed the I-130 and still no word but there is a backlog. I will be going out on K3 visa so im waiting paitently ...I hope to be in USA by July 2008 smile.gif

As far as i know there is NO word of the cancelling of K3 filing !!!....My husband filed I-130 for me in October 19th 2007 we got NOA1 Jan 14th and receipt in the mail on Friday 18th Jan...He filed the I-129F for K3 the following Tuesday 22nd Jan 2008.. He called USCIS yesterday and he was told we were in the system and even got to talk with Immigration Officer where upon he asked how long before the processing of I-129F would be comeplete the immigration Officer told him worst case it would take 4 months on average it takes 3 months. My hubby is in Florida and I am in UK so we are looking to go K3 and hopefully our file will be going to NVC around April or May at the latest then it will go to London.

I dont think you have to worry about your I-129 date though, as they are aproving both applications together now

Hi everyone smile.gif

I have been tracking our files online USCIS.... My husband filed our I-30 back in October 2007 but with backlog it was registerd online Jan 14 th 2007 although im sure they work off the honored date of Oct 2008. Our I-129F was finally filed Jan 25 2008 because we had to wait for the NOA1 of our I-130 before we could file the I-129F. While we do have an attorney handling our files i still keep close check on the happenings. There has been some movement and it has shown updated date changes on both files. The I-130 is now dated 6th march 2008 and the I-129F shows 24th Feb 2008.

My question is what's the chances of our I-129F being approved April this year ?

I will be going out to USA on K3 as we did only file 1 I-130 for myself but my son will be coming with me he is 12 yrs of age so he falls under the I-129F with me and since it's supposed to be a quicker option for us to be with my husband we opted for K3.

Let's hope i get approval soon cause i have not seen my husband since August 2007. Work commitments are holding my hubby in US although i am praying he can get to visit me here in Scotland around April but im not holding my breathe because he just started a new job.

Anyone in the same boat as myself ...waiting on Approval of I-129F for K3

I understand your frustration I am also waiting on NOA2 approval for K3 and we filed Oct 18th 2007 ...it is strange why USCIS say on thier website that they process in "Date Recieved Order"...seems so strange we 2007 Filers are sitting somewhere. I called London way back last Nov just to ask if i could travel to see my husband but unfortunately i can't because i would require a B1 visa and they told me it would be hard to prove strong ties to UK now i am married...it's a long story but nothing criminal just awkward anyways they told me instead of waiting on CR1 i should file for K3 because they are taking approx 5 months and would reunite me sooner than waiting on CR1 (I-130) but here i am still waiting on USCIS to approve me ...Long wait i have not seen my hubby since August 2007

Hang in there it has to be dealt with sooner or later smile.gif No consilation i know but there are a few of us out there Waiting so ur not alone and just think when u get NOA2 it wil go much faster !

I would say you would have to report ANY marriage even an anullment because the marriage did take place so u have to show the paperwork proving it was anulled.

Nope my I-130's were not Yellow !!!!! we printed off the I-130 forms off the website and are they yellow! NO NO NO! someone is trying to scam u to make a quick buck!!!!

Like i said we hired an Immigration Attorney of Law, he was not a consultant he was for real but we found we could do this ourself and save the $$$$because he really didn't bother with relying e-mails or even chasing our file when we asked him to and was dead against us filing an I-130 for my son , i guess if we went ahead with K3 he would have been getting more $$$$ when it came to AOS which to be fair is his job but we have managed fine without his services smile.gif
So it's up to you just be careful if you are gonna get an attorney make sure he is who he says he is cause there are a lot of Consultants out there that use the words Immigration Attorney but are not really lawyers anyways it's up to you but make sure u understand the process so you can keep track of things.

Opps ...forgot to say...An attorney does NOT speed up any processing !!!! Beleive me i know it sounds like a lot of paperwork but its not really, you can do this yourself plus it is good to know how to do it. It gives a better understanding of what your filling out.

proof of a bonafide marriage is..... e-mails, photo's of you together( your wedding pics) and with family members helps to,if you have that , letters written as sworn statements from family members or friends that know you both saying u have a bonafide marriage, joint bank accounts, joint credit card statements, Life insurance showing your husband is benificiary, lease in joint names really anything that you can have your husband on is great it shows commitment as husband and wife.

When you file K3 or for I-130 remember to send copies of everything listed...marriage cert , Full birth Certs, etc...do NOT send the Originals at this stage because they may get lost or not returned.

My husband and i hired an attorney to file the K3 for me and my son but i seen a lot of K3 applicants getting both I-130 and I-129F approved at the same time so in reality the K3 is not faster somy husband filed an I-130 for my son just in April this year which has joined up with my I-130, mine was filed Oct 2007 so we are going the I-130 route which is a lot easier in the long run. We no longer use our attorney to be honest we have done mostly everything ourselves all he did was check typos and posted it ( the K3 that was) The I-130 we did ourselves so really you can do this yourself. The people on this website will help you because there are many people going through the same thing and all are glad to help out.

We have had confirmation from Vermont Service Centre saying that my I-130 wil get adjudicated in 2 to 3 months and my sons will be done same time as mine. My son is a minor (12yrs)
Anyways...while K3 is an option for you it will only cut the time of about 2 months and then when u arrive in US you have to adjust status which is fine if thats what you want to go through....it makes sense to just file I-130 and not have to deal with extra costs and long waiting before you can work or even get a driving license but it's entirely your choice which route you take.
This process is not easy and can be frustrating ! I have not seen my husband in 9 months so be prepared....I don't see me getting approved till August at the earliest and then i will have to wait 2 or 3 more months before i get interview in my country which will be US embassy in London.

My advice would be to go the I-130 route it is better in the long run smile.gif

If an individual has been married more than once and divorced, for instance twice shoud the individual submit two divorce decrees with the I-130 and must all of the copies of supporting documents be certfied and notarized or regular copies will do? Please reply!



I myself have been married previously( more than twice) so when i sent off my documents for my hubby to send to USCIS i submitted copies of Divorce Decree's not the originals ....keep originals for your interview.

As long as you send copies it will be fine all they really need to see is that you were divorced legaly before you married again.

My husband and i were originally going K3/K4 route but in April this year we felt better to file an I-130 for my son because the waiting time for K3/K4 is just about the same as filing I-130 so my husband filed for me in October 2007 but like i say he filed I-130 for my son in May 2008. Our files are at Vermont Service Centre and we know they are together and that they will get adjudicated together according to an officer at vermont, i have the e-mail to prove it so now both my son and myself will be going CR1 and not K3/K4 as originally planned. So do it now and dont waste no time.
going I-130 route is far better in the long run smile.gif

When your filed gets expedited it is basically it is adjudicated and all goign well approved at the service centre your at then it will be passwed to NVC to go through the rest of the process and then onto the Embassy in your fiance's country.

If you dont mind me asking on what grounds did you get your file expedited ?

My hubby's Senator said we had strong grounds for applying to get our case expedited since our situation has drastically changed in the last 3 months. Hardship for his 15yrs old son and financial hardship. Just wondering why yours was granted and how long did u have to wait to hear the news ?

I have e-mailed the London Embassy on a few occassions and yes u will get an e-mail saying they deleted it but Don't worry they will have your e-mail trust me smile.gif Lond are pretty good smile.gif i have experienced the same thing ...you may also get an e-mail saying they received your e-mail and will take 4 days to reply sometimes you get a reply sooner ....what i will say is Don't send your e-mail more than once as it will get deleted so what your experiencing is normal responses from London Consulate ...all very confusing i know but hang in there u will get a reply. I would call the embassy and let them know your request im sure your file is there and they will be able to make sure your request is carried out.

I know its a long wait!!! ..... My husband (USC) filed I-130 for me (UK) in October 18th 2007 and it took 89 days for us to get NOA1 because of the backlog ...shocking isn't it !

I know they are catching up but not sure how long u will have to wait for NOA1 no harm in calling USCIS.

Our I-129F was filed on Jan 22nd 2008 god only knows how long we shall have to wait for that ...LOL... the officer told my hubby 3 to 4 months as i am going out K3

Good luck and hang in there USCIS are not gonna be backlogged forever.

I went through K1 years back and i guess the info doesn't change. I also went through US Embassy in London and the info you say you have is more than enough infact when i think about it I only gave them about 4 photos a couple e-mails and letter from my parents stating it was a true relationship etc... The interview was short maybe only 10 mins as there was a lot people waiting to get seen. The questions were simple but i guess they want to make sure what u have in you previously submitted was true fact. It was easy and nothing to worry about so just to put your mind at rest ...have an enjoyable day and dont worry, you meet ppl all in the same boat it will pass quickly smile.gif

I am pretty sure while you have a K1 in process you do stand a high chance of getting denied entry...I personally would NOt take the chance because it will affect your visa as u have no strong ties to UK also i know that the Consulate in London do NOT look on this lightly! I asked a Consulate Officer in London if i could travel to US while the visa process was ongoing he said NO i had to remain in my own country so if it were me i would NOT even try to enter USA at this present time, it's not worth it because getting a denied entry will cause a lot probs in the future beleieve me i know i have been through it !

I am currently compiling all the paperwork necessary for the K1 visa application. I am in Scotland and my fiance is in Denver.

Can anyone give me an idea of what is required in the friends/family affidavit letters of support or perhaps a copy of a letter?

How do you get these letters "notorised" and roughly what is the cost of notorisation.

First of all I have to once again say how great VJ and all its members are. I have been looking for the answer to this question for a while now and I am a policeman here in Scotland. ACPO is just all the chief constables of all the forces in NI, Wales and England and ACPO(S) is just the same for Scotland. The reason for 2 different is that Scottish law is different from the rest of the UK however both do the same job.

Thanks william wallace for the link to the application for the police certificate, been a great help. Hopefully i'll get my NOA2 in the next 3-6 weeks and can make it to the US to be with Courtney before christmas. Positive thinking will hopefully work lol
