K-1 Fiance(e) Visa Process & ProceduresEvidence of ralastionship
Sending your loved one money doesn't prove a legitimate relationship, we never used anything like that perhaps someone who has can give you more information.

Do you have Passport stamps & tickets they are excellent proof. You don't need to show any proof like that until the interview when did you file your K1? make a timeline because if you are not near the interview stage you have some time to send more emails, and record more chats etc;

My husband (then Fiance) bought me a new computer for Christmas one year and I also Blew the supply (no idea how I managed it!) but it completely ruined my 120gb hard drive, the HD was buggered.

I would guess it makes the chances of 'forgetting' to add a period of employment less likely. The general rule of thumb seems to be more is better. (information wise).

K-1 Fiance(e) Visa Process & ProceduresK-1 doubts
Looks good Carolina, I was confused as to weather my college education/course work jobs counted as employment also but I figured the fact that I was in full time education definitely counts.

Good luck!.

K-1 Fiance(e) Visa Process & ProceduresK-1 doubts
Carolina, I have had only 1 job in the last five years (since I am 23 my entire life has been college) I listed my college education there, they need to know what you have been doing, leaving gaps will no doubt get an RFE,.

I also listed my 'job' at a local nursery school that was part of my college course on early childcare development. I had no issues or RFE's with the K1 application, I hope this helps you out.

K-1 Fiance(e) Visa Process & ProceduresK-1 doubts
I have never had my passport stamped when leaving the USA, it is very normal don't worry.

Do you have entry stamps? They are an excellent proof to send to show you actually did use your flight tickets and got into the USA (past customs).

K-1 Fiance(e) Visa Process & ProceduresK-1 visa applied for-- now Islamically married
I have a friend who had an Islamic ceremony, and he had to change his visa to a Spousal Visa, he said they signed a contract and one of the conditions on it is if the other person breaches the contract , they can file for divorce.

I would say you both refer to each other as Huband/Wife now? and the USCIS will probably feel the same way.

K-1 Fiance(e) Visa Process & ProceduresWaiting for NOA2 - driving me crazy!!!
I'll never forget the day I got my NOA2, I was leaving the house to buy some fans because it was sweltering (hot) aye, it gets hot in Scotland..sometimes haha.

Anyway, I remember the constant checking of lists! Complaining is good! get it off your chest and what better place to do it than somewhere that has a tonne of people in the same position! it definitely helps to rant a little...even a lot!

Goodluck! I hope you all get your approvals soon!
NicoxcxFemaleScotland2009-07-09 22:16:00
K-1 Fiance(e) Visa Process & ProceduresProof of an ongoing relationship
I wasn't asked for a single piece of evidence during my interview (I am guessing that is what you mean). They rely on questions more so than written proof (though I sent all of my proof with my application).

Emails and chat logs are fine, if you use something like msn you can take screenshots of the chat with using you webcam (we used webcams and mics).

It isn't like you are in a high fraud country, it is Canada, across the border, Emails and chats will hold more weight than they would in another country.

Goodluck!.

K-1 Fiance(e) Visa Process & ProceduresPregnant and anxious....want my fiance here!!!
Go over all your documents and make sure you have included everything, including financial information, tax returns etc; make a checklist it will make the situation a whole lot less stressful.

Emails are a great source of proof, emails of you both discussing the baby are a must.

K-1 Fiance(e) Visa Process & ProceduresDuring that emotional, stressful time before the NOA2 comes...
I actually never thought I would get an RFE and I didn't, I don't know what it is but I never see any problems with our petition, not sure if that is a good thing or bad thing but for me it was never 'will i get approved? will I get an RFE?' I knew I would get approved without an RFE, but then again I sent an abundance of information and proof not needed lol.

He is flying to go back home this wednesday. I am really having a hard time with it. I am trying to stay strong. He has been in the U.S for one year. I am looking for some advice on how other couples make it work?

Buy an old house. Tear out all the plaster walls and ceilings, electrical wiring, plumbing. Install new hardwood floors, ceramic tile bathroom, insulation, wiring, plumbing, cabinets. Work your regular job 12 hours a day beginning at 6am, then work on the house until 12 midnight. 7 days a week. Live in the house while you work on it. Bathe in the lake. Eat sandwiches.

Write three emails every day, 3 phone calls. Visit him (her) 5 times during the process

You will be sweeping up the last of the mess when he/she arrives and you will be praying for AP at NVC so you have enough time to finish and prime all the new sheetrock. Worked perfectly for me except my tools were still on the porch when Alla arrived.

All that work and you didn't bother to get the tools off of the porch! laughing.gif tut tut!.

To the OP...Find something to get caught up in. For me it was photography and years later I am standing with a Diploma in the subject all because I entered into a long distance relationship! my now husband also got caught up in fixing up our now house, focus on the good!.

I would say if saying goodbye to someone you would soon be spending the rest of your life with is the worst moment of your life, you are VERY lucky.

K-1 Fiance(e) Visa Process & ProceduresK-1 Petition already filed for US -- can we have a marriage ceremony in both countries?
QUOTE (NewYorkSydney @ Jul 24 2009, 07:30 AM) <{POST_SNAPBACK}>
Hey Smizzy

I am in the same predicement as you. My fianance is from NY and I am from Sydney Australia. We would like to have a wedding service here in Australia but understand that we need to marry in the US first.

We are planning on having a civil ceremony in the US first and then applying for advance paraole to have a wedding service here. I sort of feel that if we leave it to long it defeats the purpose of having a wedding here if too much time has lapsed so that is partly the reason we want to apply ASAP for an AP document.

Can anyone tell me if we are ok to do this?? Has anyone else done this? blush.gif

This is the path most K1's take although it would be considered renewing your vows. We always planned to renew our vows and do the whole big wedding in Scotland very soon smile.gif .
NicoxcxFemaleScotland2009-07-24 15:57:00
K-1 Fiance(e) Visa Process & ProceduresK1 Change of Address
Change it with USCIS, all we did was called up (mid petition) and gave them the new address.

If you can receive mail at the new house safely then I would go for that option and put the new house address down.

K-1 Fiance(e) Visa Process & ProceduresGetting photos together
We sent 6 photographs and I of course took other photographs with me to the interview but not duplicates of the originals, they already have those photographs in front of them at the interview, so I took some other photographs of those trips for example our trip to Edinburgh. Didn't have to show any of them.

NicoxcxFemaleScotland2009-07-27 22:32:00
K-1 Fiance(e) Visa Process & Procedurespictures--photos
I agree. If you have no photographs for your initial petition then make it a priority to get photographs for your interview.
I wasn't asked for a single shred of evidence at my Interview, it was all questions and dates.

NicoxcxFemaleScotland2009-07-27 22:26:00
K-1 Fiance(e) Visa Process & ProceduresFirst meeting evidence
I agree, if you haven't met in person your chances of her obtaining a Visa are incredibly Slim.

The 'meet in person in the last 2 years' is to protect both you and your lady.

To the OP, we also sent in tickets to shows we went to and our entry tickets to Edinburgh Castle, everyday things. Sounds like you have a decent amount already.
NicoxcxFemaleScotland2009-07-30 22:27:00
K-1 Fiance(e) Visa Process & ProceduresWedding Arrangements
I was asked about our wedding plans, told them civil ceremony in the USA, bigger wedding back 'home' in Scotland. It will have no effect and like was mentioned before, Civil Ceremonies for K1 are very commen.

Tsaria, the London embassy (also the one I used) do ask about wedding plans but they are pretty easy going prove you have a bonifide relationship and engagement that is the most important aspect to them at the interview stage.

As long as you plan to marry legally within the time frame you will be fine smile.gif plus personally the thought of planning a huge wedding around dates I had no idea if I would have my visa for was definetly not appealing to me!. Just take plenty photographs in the rare case AOS needs an interview and hell, who wouldnt take photographs of there wedding day!

K-1 Fiance(e) Visa Process & ProceduresYahoo! Messenger archive as one of the proofs
QUOTE (JeremyR @ Aug 7 2009, 12:02 AM) <{POST_SNAPBACK}>
I didn't actually include any email or chat content, per se, just records of when and how we talked. I created a big long list of our Skype phone calls from my history showing who started the call, what time/date, how long it lasted and whether it was a video call. That ran to many pages.

I did much the same with emails; who sent & received it, date/time and subject line. Also many pages. There were probably about 30-40 pages in total that we included with the I-129F (although I realise it probably wasn't looked at until the embassy stage). The CO just leafed through a couple of the pages and that was that - he was satisfied with *how* and *when* we communicated rather than what was said so don't think you need to include pages and pages of transcripts or the text of emails (although a couple of selected highlights might not go amiss).

Yes I had a similiar interview, CO skipped threw the pages and was asking me about dates and times more than anything mentioned in the chat logs. I sent in Portions of msn conversations with my application because at the time I thought they were needed but apparently not but my interview was very short perhaps because I sent all of my engagement proof in the initial K1 application?

K-1 Fiance(e) Visa Process & ProceduresChange last name after wedding
Your marriage certificate gives you the legal ability to change your last name to your husbands, or hyphen it. It is up to you to contact the required people and change it. All of my british stuff, bank accounts etc; are in my maiden name, all of my US stuff married name, both are legal. When I get around to changing my name on my british accounts all I need is marriage certificate.
NicoxcxFemaleScotland2009-08-20 15:17:00
K-1 Fiance(e) Visa Process & ProceduresQuestion about photos
Yeah, it is way to easy to forge dates on the front of photographs. I would imagine they want you to print the date, where it was taken and who is in the photograph on the back of the actual photo? surely they want proof you both met in the last 2 years? those images cant be reshot.

Did you send photographs with the original petition, my images had no dates (I dont like them on my photographs, a little tacky in my opinion) but I did put the date, place taken and who was in the image on the back.

Good luck, I hope you have an easy journey after this! smile.gif
NicoxcxFemaleScotland2009-08-24 19:13:00
K-1 Fiance(e) Visa Process & ProceduresDo you think age difference would be a problem?
Age is irrelevant, I am sure they(CO's IO's) have seen many many age gap cases. We are in the 21st century, this sort of thing is very common.

I don't think an age difference is a reason to gather tonnes of info of a bonifide relationship, I think EVERY case should have tonnes of proof of a bonifide relationship.

It is ofcourse consulate specific, the amount of trouble it(age gap) would cause, I wasn't asked a single question about the age gap between me and my husband.

Try have both parties present for the interview, again, I would say this is a great idea in all cases, even if to only offer your foreign fiance/e some support.

I also agree Haole you should para phrase your posts better.

Will vary from country to country.

For example, London was very Lax on Paper evidence and focused alot more on vocal evidence threw questions, times, date etc; (never even looked at my evidence)

I wouldn't print out entire emails, I just took a screenshot of the inbox page that listed dates and my SO's email address and printed one or two that weren't to personal. You have plenty proof.

K-1 Fiance(e) Visa Process & ProceduresPosting Safety at VisaJourney

To those that do PM for immigration advice

The risks

No single member has all the correct information. No single member is knowledgeable or has experiences in all areas of immigration. By relying on a single member in a PM for an answer to a immigration issue you risk getting wrong information that can't be corrected by other members like it would if posted in the forums. Immigration can change like the wind, policies/rules change, information upgraded, etc. Other members may also have direct experiences that differ than what is commonly known. Consulates also vary in their requirements.
When questions are asked in PM's and answers given it also takes away the opportunity for others to learn. This is afterall a site for sharing information and experiences.

Questions you should ask yourself

How important is your immigration process?
Who is responsible for my immigration process?
Should I rely on one members opinion given as advice in a PM?

To those that feel they are ridiculed....This is a message board, other members cannot hurt you. They are words. Wade through the ####### that is often thrown around, until you get to the posts that are helpful and that do not judge. You OWE that to yourself. By reverting to PMs you HIGHLY RISK misinformation that CAN'T be corrected, which CAN screw up your case. What is more important....avoiding some hurtful remarks or finding the information that WILL help you.

Speaking for myself I prefer to ask and answer in public, that way if I am given wrong information or if I miss something in an answer there is a good chance it will be corrected.
I feel it is important though that some people may not feel comfortable sharing information in public, when I asked a question way back about my adoption certificate I had many private replies from people who didn't want to state the fact of their adoption in public, I wouldn't slam all private replies.

Relief ... yes. These have been the longest two years of my life!! If someone had told me three years ago that I would go through a marriage breakup, meet an american man on the net, fall in love with him and turn my whole life upside down - I would have said they were mad! But here I am .. marking off the days until I can be with him for life .. heart.gif

I know it's a long journey and we have lots of things to deal with before we can finally be together - but I hope it will be easier now that I've found VJ - just talking to people that have been in the same situation makes the whole process seem a little easier ... THANK YOU!!!!

K-1 Fiance(e) Visa Process & ProceduresDivorce
Hi All

This is probably a stupid question, but we want to get things right ...

I am applying for my UK divorce in 9 days time (wooo hooo!) It will take approximately 2 months for me to get my final decree.

We are hoping to send off the I-129F application as soon as I can get a copy of my decree sent to my fiance in the USA. Will the lack of time between my divorce being granted and the time my fiance files be a problem for us?

I've waited two years for my divorce and we really don't want to hang around ...

Thanks in advance ...

K-1 Fiance(e) Visa Process & ProceduresOngoing Evidence of Relationship after filing I-129F?
Hi

Let me see if I understand this correctly:

It would be better to include a letter stating that we will not be able to visit each other during the visa application process because of the reasons I have given?

And also to include letters from family etc to confirm that my previous marriage was well and truly over and that my fiance and I began our relationship after this had happened?

I had previously thought that our application was pretty straightforward! We have visited each other a total of 13 times in the last two years so have plenty of proof of a relationship in my mind. But, I certainly want to avoid those red flags if at all possible.

I will continue to talk to my fiance using YM calls, messenger, emails, cards etc over the whole visa process .. I thought this would have been enough along with our numerous visits to prove we have a bona fide relationship!!

Now, to find out that a recent divorce will throw up a red flag too .. aaarrrrgggghhhh !!!!

Deep breaths lol .... smile.gif

It could be a huge red flag! Please strongly consider including evidence in your I-129f submission that will diminish it as a concern when the consular officer reviews your package before your fiance's interview -- using your explanation above, and with verification from others. Better to prevent fires from starting than to put them out once they erupt. Good luck, and stay in touch!

K-1 Fiance(e) Visa Process & ProceduresOngoing Evidence of Relationship after filing I-129F?
Hi everyone

Thanks for your input.

I have updated my information so that you have the details you need.

TboneTX - I am still LEGALLY married, BUT have not lived with or indeed spoken to the man I already consider MY EX for well over two years.

In Scotland, you can apply for a divorce after the first year of separation and this will be granted if your ex agrees and signs the papers. Because I was the one to leave my ex, he dug his heels in and refused to sign the first year papers so I had to wait ANOTHER year. Divorce can take a long time here unfortunately ...

So you see .. I was never "together" with my (now) fiance WHILE I was living with my ex. I didn't even meet my fiance until a few months after my ex and I separated.

We didn't rush into things and were "together" for a year before getting engaged. Do you still see this as a problem? In all honesty, I just see it as moving on with my life ...

Thanks again .. have a great weekend all ...

K-1 Fiance(e) Visa Process & ProceduresOngoing Evidence of Relationship after filing I-129F?
Hi

My fiance will be filing the I-129F petition as soon as my divorce becomes final in September/October.

We have been together for two years and we have several visits to each other under our belts, but have decided just to wait out the visa time without any further visits to each other. I need this time to finish a college course and to hopefully get a temporary job to help out with the K1 financial implications. My fiance has used his holiday entitlement for this year and so he will be unable to visit.

My question is this ... how do we SHOW an ongoing relationship without visits? We will have the usual YM chat logs, phone bills, cards etc up until my interview ... will this be enough?

Sorry if it's a stupid question, just getting antsy here and thinking about the possible things that could go wrong!

Have a good day ... biggrin.gif

K-1 Fiance(e) Visa Process & ProceduresI'm smiling in my passport style photo. Will I get an RFE?
I've had 7 addresses in the past 5 years, and there is only room for 6 on the G-325A form. I see that there are 4 forms where I have to fill out the same info over and over again. What the heck am I supposed to do? Should I file a separate page for each form with my oldest address from 2004?
[/quote]

Hi there!

I just finished filling in my G-325a. biggrin.gif

Put all your information in on the first page and then check the next three pages - it will automatically copy the information from the first page for you.

If it were me, I'd just list all my addresses on a separate sheet of paper - starting from my present address and then work backwards. We did this with some nformation for the I-129F and just put "see additional information sheet attached" in the space for the information. Remember to put the relevant heading on the additional information sheet. Maybe something along the lines of ...

G-325A, Biographic Information
Supplemental Information for Applicant's residence last five years.

If it were me, I'd make four copies of the additional information sheet and put one behind each of the four copies of the G-325a.

Paranoid at getting an RFE for not having enough copies? Me? Never!! rofl.gif

Hope this helps and good luck!!

I do have so many pictures of me and my fiance and now I don't know how many pictures do I need to send them..
Could you give me some ideas?

Thank you.

I sent in about 20 pictures. I made copies because you may not get the pictures back. good luck!

Were those "pictures" your primary evidence of meeting in the past two years? I hope not.

Yes it was!

No passport stamps? No boarding passes? No receipts in country? Really?

Pictures are secondary evidence. I asked about primary evidence.

We are sending copies of passport stamps, boarding passes, flight itinieraries etc. We are also including copies of receipts for purchases made in the USA and Scotland along with the corresponding bank statements which have the purchases highlighted. I also made a cash withdrawal from an ATM while I was in the USA and sent them a copy of the receipt from that too.

The pics we're sending have us posed at easily identifiable landmarks such as Sears Tower, Wrigley Field, Field of Dreams etc. I'm just hoping that will be enough!

Good luck to you on your journey ...

Yes I remembered getting a leaflet on my way back home last time. I've saved the site to my favourites already lol. I'm a great "forward planner". I'm not sure if my planned visit will be January or February now - there might be issues getting time off from my new job, but as soon as I know I'm going for sure, I'll check the website BEFORE buying my ticket.

Thanks for your support everyone ... it has been and always will be, much appreciated!
