Hi Jon

a) If you get married in Oz you will still have to file your CR1 (I-130) in the States and it seems to be taking anywhere from 6 months to over a year to complete this process. You would certainly need to think of it taking you about a year with quicker than that being a bonus.

cool.gif Marrying on the VWP is not illegal if your then wife leaves before the 90 days are up. It is only illegal if she stays and tries to Adjust Status from the VW. As for her visiting on the VW after you are married it is a total gamble. Some get through the POE with no questions, others get the third degree. Since she is planning to immigrate to the States it might be harder to prove enough ties to her home in Oz.

c) Yes you can get married while she visits in January, but she will then have to go back to Oz before the 90 days are up to wait out the rest of the Visa process.

d) If you're looking for the cheapest route then it will definitely depend on the cost of flights and the importance of your new wife being work authourised immediately. If she needs to be able to work as soon as she arrive then you need to look at the CR1 route. If you don't mind her not being able to work for a few months then depending on flight costs the K1/I-129f might make more sense. On the K1 you will have the AOS to pay for ($1010 + medical costs of approx $400) on top of the K1 costs and just one flight. On the CR1 you will have 2 flights but only the CR1 costs (approx $900 + medical costs which vary depending on country, in the UK it costs £180), but the benefit will be that on the CR1 your wife will be work authourised the day she arrives as a PR.

Either route could potentially take about a year. The K1 can be filed immediately so the clock can start as soon as USCIS receive it. The I-130/CR1 route can only be filed after you get your marriage cert back so you can't start the count down until after the wedding.

We used the CR1 route. I will admit that it hasn't been easy to spend the first year of marriage apart, but we get nearly 2 years off before having to deal with any more immigration forms (removing conditions will be next for us) and no more money to fork out.

No matter what advise the rest of us give, only the two of you can decide what route will be best for you. Whatever way you go will involve several months of waiting.

Don't know why they told you that, other than that's there official processing guestimate.

We spent 5 weeks and 5 days between USCIS approval and NVC case complete, so it shouldn't take 2-3 months if they now have everything. We sent our info 20th June and it showed on the system 24th June then our case was completed 1st July (so about a week from showing on automated system as received and case completed. I then had my interview a month later on 1st August.

From our experience I'd say you might just possibly get it through on time, which would definintely be good as it'll save you from having to AOS once you get stateside.

For the benefit of others reading this, if you live in the UK please DON'T use the K3, it won't save you any time and will just give you more headaches and expense once your stateside. We filed K3 too, but we got stuck in the receipting blackhole at the end of last year when they started transferring from filing at service centers to the Chicago Lockbox. Because we had to wait nearly 3 months after filing the I-130 before we could file the I-129f our I-130 was approved before the I-129f so we didn't have to worry about which one got to NVC/Consulate first. Honestly the days of the K3 getting you to your loved one quicker are over for now.

Hope you get the CR1/IV1 to the consulate in time.

Please speak to your lawyer before crossing any border. If you leave the US while your AOS is pending you may invalidate the application and have to start all over again. You cannot travel without advance parole if you want to continue your application.

Also you may need to check if your chosen airline will allow you to travel so late into your pregnancy. Is a short job really worth the risk of having to stay in the UK until your baby has a passport and you have a visa?

Yes, each one is their own principal applicant. As far as I know with the I-130 (CR1/IR1) route there is no such thing as an accompanying or following to join family member. Other visas may have accompanying children that derive status, but not the immediate relative visa.

Hi Dave

Personally I would get yourself a second copy, as it's only another £5. NVC do say on their web instructions that they recommend this as you need to send them the originals (or certified copies) and they can't guarantee that these will make it to London with your file, in which case you have to provide originals (or certified copies) at the interview. If you only get one copy and it gets lost it's another £35 to reapply. With this whole immigration process it's definitely better to be safe than sorry. I also got second copies of my birth and marriage certificates from the Registrars office to send with the DS230. They cost me £13.50 each and it only took 10 minutes, as both were registered at the same office where I live.

My husband filed our I-130 5th Nov 2007 (received 9th Nov 2007) and we were approved 19th May 2008. We are currently still at NVC, our DS230 and I864 both should be received at the NVC today. While I understand your concern, and admire your stand in trying to get the unjust situation resolved I would rather not give my case number out to a complete stranger.

Our case is a first marriage for both of us, with nothing in either of our backgrounds to hold us up. In fact my husband works on defense contracts and has already had security clearance through his job for over 20 years.

Please feel free to use our timeline as an example, but we would rather keep our case number to ourselves, especially when we still have a ways to go yet.

oh well it friday kicking.gif and that means chinese take out, ben and jerry's cookie dough ice cream (all fellow UK-ers with a similar need to console one's self, Ben and Jerry's is £1.89 a carton in morrisons) and a bottle of zinfandel! Going to watch Pirates of the Carrebean too....makes me smile (I like pirates!..at least the romantic idea of a pirate!)

We will all get there in the end......just the end seems oh so long long away!

Never been to England before, it should be fun when I attempt to find my way to the London embassy !

When I was in the states, that is when I realised how much of a tan I didnt have!, there was even a guy selling DC maps at the subway who said to Steven "I know your american" and then looked at me and said "but where are you from" I didnt even speak blush.gif .

I also was attacked by mosquitos, we never see mosquitos here, I went to the pharmacist and he said "omg, didnt you have protection" but Steven never even told me they have a crazy ####### mosquito thing in Maryland!

No more will I stand out against the tanned americans!, not until I speak anyway, there were alot of "whats" on my first visit.

What is everyones favourite thing about the USA? or your SO's country, or your own. Or all 3!

I fell in love with Ice Cream cake!, when I had my first one in The States I was amazed, alot of "a Cake, made out of...Ice cream, no way" !

Bex do you mean literal sunshine ? because Scotland is unusually sunny and it is great! and my football team are playing in Manchester on Wednesday I want to go so bad biggrin.gif .

I always told my SO that I wanted to be there for Christmas, we of course filed in march (forms were lost) and then April, I will have my fingers crossed I can spend Christmas with him in the States, 60 seems a little quick for an i-129F , but if 60 days was my approval, I would be absolutely ecstatic, but then have to remember an Approval isnt the end of this journey, and what is it they say, it's the journey who makes you who you are.

Like Bex said , this leads to a new life and like everytime I see Steven after long intervals you cant explain that feeling, just thinking about seeing him at the airport , and knowing I am not going to have to say goodbye at the airport , just thinking about it makes me all gooey inside! (I am such a girl) biggrin.gif

I also wouldn't trust VSC's timelines.

One would think $455 would buy you semin decent service, or atleast pay the wages of one guy to do your entire form for you biggrin.gif

I am guessing they would be looking for evidence for every year? or atleast it would help tell your story alot easier, as to how to bung it down, I have no idea, being very indecisive by nature I am hopeles at that kind of stuff! I am afraid to look at how much we have spent travelling to and from each other, I dont regret it, but when you are no millionaire it certainly gives you a bit of a shock!

I dont see any reason why they would put it off, the fact that the asessesor isnt even answering the phone is ridiculous, I guess its just a case of keep calling and go up on tuesday and hope its there, which I am sure it will be.

Good luck!, I know you have both been waiting a good while to get these papers sent off, and we will have a good reason to celebrate when that happens! hopefully on Tuesday!

We sent about a forests worth of trees biggrin.gif so we clipped ours together, so that different sections were easily seen (G325A formas etc) , I am also nosey as to what everyone sent tongue.gif , we sent copies of all the obvious things, engagement ring reciept, plane tickets, tickets to shows, hotel bills, couple of very very very carefully selected emails!, cards, phone bills, old reciepts from gifts sent.

and photographs of course!, we have 4 1/2 years of history to put in that file, and it was helluva bulky, I cant even begin to imagine how we would manage to shorten 10 years of history!.

I am the Beneficiery, so I am from Scotland biggrin.gif, but my Fiance is from Maryland

This may be a silly question, but we rarely use cheques here, I haven't had a chance to speak to Steven, would he have to check his bank (Bank of America) to see if the cheque/check has been cashed? or is it sent back to him?

Well after finding out our originals didn't make it to VSC (i'm still wondering where all that paperwork has gone!) we resent a duplicate package, and know for sure it got there.

So I am officially a fellow April Filer, I look forward to going on this journey with you all!.

Woah, lot of negative comments in this thread let's not shoot the poster for venting.

Say there is 30 guys, they have to process 2000 K1 visa's so they divide the workload, some of them work quicker than others, take less time off than others some possibly take cases home so unless a single person is adjudicating EVERY file there is no way USCIS could possibly process files in the order they receive.

Planning can be done during the process, I knew my now husband for 4 years before we walked down the Aisle, The visa (K1) took about a year from applying to actually entering the USA but we planned, we debated weather to have our big wedding in the USA or Scotland (we had a courthouse wedding here for legal reasons leaving big wedding/Vow renewal for Scotland)

Talk about the future or the process will drive you crazy. Update your timeline to get an estimated approval date.

Len says it all the process is not fair, it is what it is. Without Negatives there wouldn't be any bloody positives.

I also didn't see anything in Danu's post saying you were Lying, this site may save you alot of heartache try to be nicer when replying to members posts smile.gif .

You can call USCIS for an update but unless you fall outside their 'processing times' which is now listed as 5 months, they cannot really do anything for you. We frequently call the USCIS help line the 'misinformation line' for a reason.

Where did you see that it's now 5 months? Is it for I-129F? I checked out earlier and it's listed as "November 25, 2008"...which tells me that they are not meeting their target timeline(s). Thanks for your kind words.

November 25 2008 is telling you that they are currently adjudicating November 2008 K1 applications being 5 months away from march (your date), VSC is usually quicker our application took around 3 months and USCIS site always said they were over 5 months behind so that is pretty useless.

Calling is usually useless, they tend to be like automated machines and tell you to 'wait', like we all haven't been waiting long enough already biggrin.gif.

Its like going to the Supermarket. All these lines, you choose one and you end up getting stuck behind the people who don't know how you use the DIY checkouts so you end up standing there whilst the lines around you go 100 times faster and people who arrived after you are already finished checking out.

Now if USCIS had 1 person adjudicating every case it would be fair one line means no skipping but it would take forever (ofc) .
