Thanks for all the advice guys!

I do have a joint sponsor and included his I-864 with the original packet so hopefully they will be okay with that. We're actually getting held up at the NVC right now, as for the second time they have sent out a checklist saying there is missing information for the I-864. I'm calling the NVC tonight to speak with an operator. I want so badly to give them the information that they want, but I just don't know what they want!

Well, I was surprised to read a thread that mentioned that, during the interview, future income does not qualify for the I-864 of the sponsor. I've been living in the UK for almost 2 years with my husband on a 2 year visa, so I've been working here. I was instructed by the NVC to use my current income on my I-864 here, but this income will end at the end of this month since we are moving back to California. I do have a job that I've accepted in the UK and it starts immediately upon my entry into the country. I have letters from my employer to prove the job is permanent and the income I will have.

If future income doesn't count, how do American sponsors who have been living abroad temporarily ever prove support? If you've been living abroad and are moving back, all income is future income because you haven't moved yet. I'm just getting a little worried now because we were anticipating our case to be completed in the next week or so and sent to London, and we certainly don't want to get bad news at the interview.

We are fighting Carolyn's 'domicile ' issues and NVC say that if they release our file, it is up to London Embassy at the interview to decide...

Obviously it would be hugely beneficial for her to be there and answer their questions

Is it allowed ?

I can only tell you my experience on Tuesday August 7th. I arrived at the Embassy with my husband (USC). I knew other people had previously gone in with no problem, so he was there to help me carry bags :lol:

The lady checking details said that the London Embassy had a new policy as of August 7th that USC's were no longer allowed into the visa section unless they were there to help for medical reasons or translation reasons. USC could wait in the consular section but not in the visa section.

While I was waiting for my interview, I saw one couple who had tried to risk it anyway and so UKC and USC were there together. After a couple of hours, the USC was spotted and asked to leave the building.

Someone else was told their USC wife wasn't allowed in even though she had come to sign something for her husband. They were told to do whatever signing was necessary in Grosvenor Square and for UKC to go in alone.

Hubby told me that he could spot lots of USC's in Grosvenor Square gardens who were in the same situation, not knowing how long it was going to take, and so all watching the Embassy entrance for signs of the UKC's.

Now that was my experience, but I think someone yesterday was allowed in with USC. Maybe it's worth a call to the extortion line to see what they say??

If they do kick up on domicile then Carolyn will fly back alone and rent a place then send the rental agreement direct to the embassy to release the visa


so a fail at the interview is a recoverable situation, but if the NVC wont give on the domicile thing then that will stop us for months as carolyn needs to give notice on her job before she can go back alone and get a rental agreement in the U.S. and then the NVC has to start up their process from there

Everyone on VJ has been agreeing for the 3 years I have been reading posts, that the domicile thing is rarely an issue - but the NVC are fighting us hard - this is even though Carolyn has 'limited leave to remain' in the UK and petitioned for my immigration to the U.S. 2 months and 2 weeks after she arrived. She runs all her affairs in the US and uses her U.S. checking account and U.S. credit card and U.S. driver's license in the U.K. and has all her furniture in store in Wisconsin awaiting her return and we showed them the storage receipts.
They are saying she has gone and has no connection with the U.S. - they have disowned her - like they did to Charlie Chaplin.

London refused to take our case as DCF because Carolyn is 'temporary' in the UK - and told us to file in Nebraska - but the NVC say she is not domiciled in the US

Between them, they dont accept that she is anywhere

oh well - never mind - I think I will have anice cup of tea....

I had the same issue with the London Embassy. I've been living in the UK since Oct 2005 on a 2 year visa. They wouldn't take our case cuz it was a temporary situation, but then the office in the US wouldn't take it either as they said I was living in the UK.....frustrating!

We also have to prove US domicile, although they haven't mentioned any concerns yet. I sent in a copy of my visa showing it expires on Oct 12 and so I need to leave the UK by then. I've also already accepted a job in the US, so maybe that's why they haven't said anything yet.

To be honest, I'm not sure at the moment as I'm in the same boat. Mine was sent from NVC to London on Sept 5th and I haven't heard anything yet. Most people on this site did their filing through the London office directly which is why it's a little bit different of a timeframe. You will probably hear from them in the next couple weeks, but I doubt she will have to wait until Christmas. You are near the end of the process now.

I bank with HSBC as well, so now I'll know to get that sorted early on. What I was planning on doing was just going into the bank and doing a bank transfer to our US account. I know there will be a fee involved but not sure how much.

I'm looking at flights at the moment...(just to get an idea of prices and options)

Now, I know the POE thing can sometimes take a while. If we were arriving at LAX at 14:20 and our connecting flight departed at 17:45, do you think that's leaving enough time for POE stuff to get done? it's a little over 3 hours.

She's right. Bring as much proof as possible of the immigration process and that he intends to return to the states. Before I had my visa, I came to visit my "boyfriend" at the time. We ended up going to New York together for a few days, where he proposed. So I entered the UK once, before New York, then again on the way back from New York. Immigration viewed this as two entries even though they were less than a week away. I did get a little hassle but they eventually let me through.

I believe the rule is that he can stay in the UK up to 90 days with just a passport as a visitor as far as I'm aware (if I'm wrong someone correct me). There is nothing to indicate that he can't come visit to see a spouse so shouldn't be a problem. As for the criminal record, they never asked me about that in the 3 times I entered the UK with my US passport. I would say he should be honest if asked but not put forth additional info until asked.

I can't believe they sent that message! Geez! I had actually sent an email to the NVC once to ask a question about our AOS, and I wasn't thrilled because the response came 2 weeks later and all they said was that they didn't know how to answer my question....but that's 10 xs better than what your reply from the embassy said!

Alan, is there no way we can speed things up at all? Would they respond to letters sent to ask for expedited cases or are we just to wait? I'm actually the American half of the couple and my visa expires on Oct 12, so I suppose I'll be flying alone as well. It's just so depressing.....I've been keeping myself super busy so I won't have to think about it.

It is a big deal for us. I don't think I've ever been through something as stressful as this visa process! Everyday I wait with held breath to see if anything will come in the post. I just hate the uncertainty of it all. Even if the date is far away, I would rather know now so I can start shipping things and buying flights. My visa here is up on October 12th so looks like hubby and I will be separated, even though we started the process way back on 30th January.

When did you start, by the way?

Please let me know if you receive a letter from them, as you are a few weeks ahead of me.

Hiya ladies and gentlemen,

Just a quick question as I'm a bit confused about the process. My husband and I have just gone through the NVC process as I filed I-130 with the states and not directly to London. Now the automated message says our case is complete and was mailed to London Embassy on 5th September. Now I've heard conflicting information about what I should be expecting next.

Will I receive a Packet 3 with information to return, or has that been done through the NVC? Will I receive a Packet 4 next with the interview date and info on scheduling the medical? Has anyone here went through the NVC process before going through London for a IR-1 or CR-1 visa?

Also, I had another quick question....(I'm full of them tonight! hehe)
NVC just sent my case to London a week ago. My husband and I were hoping to move to the states by 12th October as that's when my visa expires for the UK. Do you think (in all honesty) that there is any chance we will be able to make that deadline? That's one month from today! ahhhhhhhhh

Actually, we did come the other way, moved to the UK after we got married just over two years ago. I've been living here in Scotland since Oct 2005 on a two year visa. If we decided to stay I would need to get my permanent resident thing this month as my visa is soon to expire. Honestly, the process of coming here to the UK is much easier and faster. We did it just two years ago and it took us about 60 days from start to finish. I'm sure it can go faster as well as I think they have expedited scenarios/options.

I love Scotland. I think it's absolutely gorgeous and there are so many wonderful people here. The reason we chose to go stateside, where my family is from, is because the area we are moving to has such low living costs its unbelievable. We are going to be able to get a 3 bedroom detached house for the same price we were paying on a 1 bedroom flat in Glasgow. Aside from that, we both have career opportunities there that will provide for a better standard of living.

I think you need to decide what's most important to you and make your decision based on that, not the process. Believe me, I'm very frustrated with this US immigration process. They make it so difficult for people trying to immigrate legally! We've been working on it for 8 months and still not done. But you need to think long term and make your decision based on that.

He did tell me that an interview has been scheduled for us on October 18th at 9:30am. So there ya go! We got an interview date now! Well, to my extreme disappointment today I received a Packet 3 sort of letter, which was a huge shock since we filed through the NVC and not through London. We should have just received Packet 4 with the interview date, info for the medical and such (like Andy2006 and SayWhat). But for some reason I get a letter asking us to gather the needed information and how to set the medical. But that's all there was in the envelope. There was no checklist. There was no other forms or lists of what I needed to gather. Can anyone shed some light on this please?

Would be greatly appreciated.

Hi Alan,

I'm so sad. Got a letter today and it is what a Packet 3 cover letter would look like. It says they are pleased to inform us that they have received the approved visa petition. It asks us to gather the documents we will need in support of our application and says "these are explained in the enclosed package of forms" but there were no forms included! The only thing included is the instructions for the medical and questionnaire (by the way we just scheduled the medical for Bentick Mansions at 9:15 am on wed Oct 3rd).

It say when we have notified them that we have all our documents (I'm assuming this is where a checklist would come in) and they have completed processing our case they will notify us of our interview date. Again, we didn't receive a checklist or forms or anything so not sure what we are supposed to do. I'm gonna find a way to call them cuz this is crazy. I should have just gotten Packet 4 like you guys.

We went to the local doctor yesterday to get a MMR jab and she gave a letter stating the two recent jabs that I have had. Is that enough for the inoculation report? She advised that the visa people would request a copy of the medical certificates.

and all the people who have NVC completed dates after mine think they are flying mid october.... oh dear the suffering humanity.

Carolyn found the letter from London Embassy dated last January which said 'We will not accept your petition as we regard you as TEMPORARY in the UK and your residence continues to be the U.S. and so you should file in Nebraska.

Then the NVC who say - your domicile is in the UK and you cannot be a sponsor unless you are domiciled in the U.S.

Can you wonder I went crazy some time ago ?
