Hi All ...

Can't sleep .. I have all these reason in my head why the K1 might not be approved and NOW I've thought of something else lol!

I hope you don't mind if I run it past you all ....

When I move over to the USA and hubby (more forward planning smile.gif ) and I decided to try for a mortgage, say three years down the line .. will they check my credit history back in the UK? Due to the financial implications of the separation from my ex, my credit history is awful ... sad.gif I'm hoping to pay off the one credit card that I have at the moment, but it will be a struggle .... sad.gif

Any ideas?

hey, i am new to this website but i have done a lot of reading on it and it seems like the most helpful website out there. i have a few questions. i met my girlfriend online a few years ago and then in the summer of 2005 i came to visit her on the VWP and i stayed for the 3 months that we are allowed, i then returned to the UK for 3 months and then came back for a month to visit her again. after that i was in the UK for 2 months and then came back for 6 weeks to surprise her on her birthday, however i got serious questions the last time i i tried to get past the customs man at chicago. he gave me a real hard time, he asked me how much money i had, what kind of job i had in the Uk and my reasons for visiting and what i`ll be doing the whole time. this lasted for about 10 minutes of me just standing there talking to him. it scared the ####### out of me. i understand now that i was entering too much, i just naively thought that if i didn`t overstay the 90 days then i`m not doing anything wrong. my question now is though, how long should i leave it before i try and come back? i know that a lot of you have reported trouble at the customs when trying to visit your boyfriends or girlfriends. we plan to file for the K1 visa next year and are trying to worko ut how to see eachother at least a couple of times a year without me being turned away and sent back to the UK. so can anyone give me any advice? any similar experiences? i`m thinking that i won`t be coming back for about 6 months, will this be sufficient? if i come back in like 6 months and only stay for about 4 weeks? or do you think that this could still be a big problem? i am so confused by it all!!
any help or advice at all would eb so hugely appreciated.

Our petition was sent to Nebraska and was forwarded to California and yes I had the same concerns however I was approved in October but looking at the processing times for california on the usci website they were still processing March, so it seems that the times on the website are not accurate. :dance: I still feel slightly stunned but I had my interview in London yesterday and couldn't believe how easy it was. There was no need to show proof (photos, emails etc ) of relationship, a few simple questions about how we met and then was told "I am approving you for a visa pending on your medical" which I had the day before. Enjoying this time before the next round but at least I will be with my loved one.

The NVC sent my petition to London in late October, you can see from my timeline that I didn't wait long for Packet 3. If I was still waiting I would have been in touch with the Embassy by now.
I know K-1 timelines are different but I would still want to check.

I have recieved my visa interview pack.. and it asks for a long birth certificate, and must include parents names. My birth certificate doesnt, it only includes my name and date of birth, where do I obtain a long one ?


I don't reccomend using a pvivate company to get a copy of your long form birth certificate as you can get one yourself easily from The General Register Office.
It will only cost you £11.50 and you can order it by phone.

Thanks Laura. Can you also answer this for me: will we then have to file 3 DS-230's and have 3 medical exams and have 3 I-864's since the visa are not derivative? If the answer to this is YES, then I think (from what I understand) it would actually be less expensive to do the K-1 visa because the K-2 visa's would be derivative and the fees to change status would, realistically, almost be less than spending the extra fees for each CR-1 visa for the children (I think). Can you, or anyone else provide clarity on this?

I am very much not an expert on immigration visas as I am on here to learn from the wisdom and experience of others as I try to wend my way through the process. I cannot, therefore, answer any of your queries about comparative costs as the only visa route I have investigated is the one relevant to my own family. However, the beneficiaries do absolutely have to have separate medicals incurring their own separate fees (with one adult and four kids that is one of our biggest expenses) and the paperwork for the I864s has to be duplicated - from what I understand anyway - even though you are essentially replicating the information from one form to another. I do not yet know about the DS230s as I am still trying to determine that for myself. I would be interested to know if you get to the bottom of that. I am basically working on the assumption that - even though we are all one "case" - the visas remain one per person and, therefore, all the information has to be duplicated accordingly. Worst case scenario is that someone at the field office bins four of our copies because they only ever needed one but that to me is preferable than a delay because we should have submitted everything x5.

My husband submitted I130s for myself and my four children earlier this month. We put each set of papers into a separate envelope and filled out the payment forms for each of the five petitions but then parcelled all of the envelopes up into once parcel so as to ensure they were clearly seen to be one group. We had to contact the London Embassy because they had missed one of the payments but we had it confirmed then that they will be treated as one case. Our situation is a little different in that my husband (the USC) is the father of all four of our children. You will probably have to evidence that the father of your future wife's children is not a block to them relocating to another country. I obviously have not experience of that I'm afraid but I am still pretty confident that the USCIS will bundle the children's I130s in with their mother's one. Incidentally, I am pretty sure that my children will have to attend the interview with me so I think you should work on that assumption.

First of all, Congratulations on your pregnancy!

There are options to delay the immigration process. We will be likely delaying submitting the next round of paperwork after NOA2 so as to allow my husband's job application process to catch up with our immigration timeline. Your husband will ultimately have six months from the medical in which to arrive in the US once the visa is granted so you have more time to play with than you are perhaps aware of.

Thanks everyone for your help. This has got to be the most stressful thing I've gone through in my life!

So, I've already finished my taxes and the 2555 Foreign Earned Income Exclusion and will get that off ASAP. I'm wondering now if I should wait for something to come back, or if I should try to put forth the I-864 with my original plan with an explanation letter of the exclusion and how I qualify for it. My husband agrees that might be worth trying to send both I-864's and letting them decide which one they want. I can include an explanation letter there too. I also have a copy of the magazine I'll be working for with my article featuring in it. I also do have a joint sponsor who has already filled in the I-864 and does have his tax returns and a letter from his employer.

If I send this I-864 back and they are unhappy with the way I've done it or feel something's missing, will they decline it right away or send it back to be fixed? One of the websites I was reading suggested that at this stage they would send it back and ask it be fixed and sent back. Is this true?

Hello all,

I'm a little bit panicked so I'll get straight to the point. I could really use some help here. I'm American and my husband is British. I've been living in Scotland with him for the past 20 months on a 2 year visa which is due up in October. In February we decided to move to California so we started the whole process. Everythings gone fine so far. We are now at the I-864 stage. Here's where I'm having problems.

While living here in the UK I've been working making £14500 or approx $25,000 annually. As I was physically present in the UK for the full tax year and did not work at all in the US over the past two years I qualify for foreign earned wage exclusion so I didn't file taxes in the US. Anyways, I have accepted a job in the US making $65,000 annually and it begins in September of this year (or whenever we get clearance for my husband to move to US).

So when filling in the I-864 I was under the impression that the information they want is pertaining to what my salary will be in the US. After all, the whole point of the Affadavit is to prove that my husband won't be a charge on public funds once we live in the US. My previous wage doesn't reflect what I will be making. I have a letter from my employer regarding my new job and I've already given notice of quiting my current job. So, under my current income can I use $65000 and include the letter which will prove I could support my husband 125% over poverty line once we are living in the US, or would they want my UK wage which will be ending shortly after they receive the form back?

If anyone has any advice, it would be most appreciated. Many thanks!

I think there's a courier fee, but that's something like 13 GBP. Other than that, you shouldn't have to pay anything until removal of conditions if you get CR1 and if you get IR1 nothing until when/if your spouse wants to become a naturalised citizen.

EDIT - I just noticed that your profile says AOS pending. But your timeline shows that you're applying for CR1/IR1. Please clarify. I've also noticed that it says Armenia for the consulate in your timeline.

EDIT AGAIN - Okay, now I'm properly reading your post. You mean you paid the IV fee bill not the AOS fee right?


I've already paid the $70 fee and the $380 fee to the NVC so far. I'm sorry my timeline is a mess. I've been trying to figure out how to fix it for days and I have no idea why it says Armenia! hehe I've gone to the Controls bit and tried to figure out how to amend the timeline but I can't seem to figure it. I think all my brain power has been sucked up by these forms and process!

The stage I'm in just now is that I paid the $380 bill and have just received the barcode and envelope for sending the I-864 and supporting documents to the NVC. I should be sending them off tomorrow.

That's okay - I understand now. :)

After the $70 for the I-864 is paid and the medical exam is paid for, you'll only have the courier fee on the interview day. That's assuming the police certificate has already been paid for, but tha's only 10 GBP in the UK anyway. So all major fees are almost paid for now! :)

We have the police certificate, although when it came it wasn't what I thought it would be. All it was is a letter from the Police stating they they searched their records and found nothing on record for my hubby that needed to be reported. I did pay the £10 for it. Does that sound about right? I know my hubby had a propert disclosure from the police when he was teaching and it seemed more like a breakdown of years showing no convictions. They haven't sent me the wrong thing have they?

i just wanted to post an update on the progress of my hubby's visa process.
his interview was in london on july 11th. and it went absolutely fabulous!!!!! :thumbs:

he was asked about his convictions/caution (from 10 yrs ago) and if he'd ever do it again, to which he replied NEVER!
and that was IT! the immigration officer sped right thru them as if they were peanuts!

they basically approved the visa BUT needed more paperwork from me before they issued it! they needed my 2007 tax return, but since i've lived in the UK for the past few years i hadn't filed. so i received a letter from the IRS stating i did not file and also included my current proof of employment and income, and also proof i was working in the UK for the last year.

we hope this will satisfy them and they will return my hubby's passport and visa ASAP, so he can catch the next flight to omaha!

I'm in the same boat as you. I've been working in the UK the last two years and didn't know I had to file either. I was just completing my I-864 and decided to check with IRS and was stunned. Anyways, we are sending off our tax filings to the IRS today and also sending copies of those with the I-864 today to the NVC and hoping by the time we get to the interview it's all good.

I stupidly left my x-rays at the embassy, I had to submit additonal documents to them last week and in my cover letter requested that they send my x-rays along with my visa, they haven't sent the x-rays, is this likely to be a problem?
Has anyone actually been asked for them at the POE?
I don't want to be worrying about that on my flight, and not knowing if after all this I might get turned back :(, yet I don't know what to do, I cannot seem to get an answer from anyone at the embassy by phone or email, eeek

Just as an FYI, the automated system won't tell you that they have generated the DS-230, you actually have to talk to a real person and ask them if they have mailed it to you. If they say yes, then wait about 2 weeks for it to arrive.

They won't send you the actual form, they'll send you a coversheet with the http address of where to find it to download it. Also, they will send these instructions to whoever the choice of agent is.



Oh, so much like the I-864 with the directions. I see. One thing I was curious about. Many people seem to call the NVC for updates on what's happening. Is there a certain number that we can call to find out the status of our case?

Just wondering if any of you had troubles at the Medical. As I understand it, my immigrant hubby needs to get all vaccinations done so he can provide proof of this at the medical. Is that right? We have a list of 12 vaccinations and anticipate the medical in about 1 month, and now we're having trouble with National Health Service and getting him into an appointment as soon as possible. I just wanted to know if any of you have been through this and have any advice as to any possible problems with the medical that we should prepare for.

It appears that in order to get the CR-1 visa for my future Indian wife (Oct. wedding), I would have to be in the U.S. throughout the entire process. I want to be sure about this. I am new at this whole thing. I have seen that there is a direct petition at the New Delhi Embassy if I have a long term visa and residence.

Is there a way that I could be in India short term during the process working or whatever? If not, is the direct petition a way to be living out of the U.S. and complete the steps for her to apply for the CR-1 visa?

Just looking for a way to be with her instead of being separated waiting for the visa! :crying:

I have done the whole CR1 visa for my Scottish husband while living with him in the UK. I have a two year visa, so have technically been here temporarily. And Yu is right that you must maintain US domicile, with either a job, bank account, house of residence, and especially tax returns.

Just thought I'd share an amusing little tidbit here! I sent an email to the NVC about two weeks ago with a question about the I-864 (before I started asking many of my questions here! hehe). After two weeks of waiting, the NVC sends me an email saying they just don't know the answer. I had to laugh at it. I'm emailing them, asking them what they want, and they wait two weeks to email me back and tell me they don't know what they want????

It seems funny yes, but what they want exactly about what did you ask them?...they are overworked on there, so in my opinion, if the question is vague, they might answer vaguely.


Yeah I know what you mean. Actually, I thought my question was pretty focused. I explained the cirumstances in a clear way. I just thought it was kinda strange to receive an email reply after so long with no answer, and I also wonder, if they don't know the answer to that question, what they are going to do with my I-864 when reviewing it.

I see you already sent your ds0230..(in a few days i'll do so also) .so i assume you found the answers to your questions...we also e-mailed them being new at the nvc, but hubby could talk to them on the phone...we never got the answer by e-mail but we got it when he talked on the phone...well sort of...so it seems it works better live! good luck with your petition!...


Well, we didn't actually get the answer until the NVC sent the I-864 back and said we need to fix it. That happened on Friday and we're sending back the corrected version along with support they requested this morning. Another delay, which was what I was trying to avoid. What I'm now learning is that they don't want long explanations or extra info. They just want exactly what they ask for and I think the rest gets sorted at the interview.

Good luck on your petition as well! We're just hoping the rest of the process goes smoothly.
