I have heard in a couple of places about the possibility of self sponsoring yourself for the K1 visa. i have only heard people mention it but i can`t find any official information on it, can anyone help me? anyone done or can anyone point me in the direction of how to find more information about it?

- had been here 5 years and on a temporary work visa - and the London embassy told them they weren't eligible.

Interesting to hear that it had been changed from ILR to LLR at one point, so that's probably good news. I'm going to send in my application this week and try for DCF. I've decided to take the embassies webpage at face value (they really should make it clearer) and post back when I find out what happens.

Maybe some of you could give me your opinion or experience on this.

I've been in the UK for two years consecutively, and am currently staying on my leave to remain spouse visa (good for two years but expires in 4 months). I had planned on filing DCF and the field office's website says I am eligible as long as I have permission to legally reside here and have been here longer than 6 months. Yet I've read other posts with people saying they've been denied because they didn't have indefinite leave to remain.
Contacting them has been useless, they just repeat what the webpage says.

Maybe someone here knows better than I do?

And if I do send it to them, would they wait until they got around to processing it to tell me I can't? and then take the payment anyway (that would be really mean) :blink:

Hi all

I am really impressed with some of the time and dedication you guys give to this forum, so many thanks for the countless hours and information. It's been an eye opener. Here is my situation:

I am an Irish citizen, living in the UK for nearly 7 years and plan to marry my Amerian fiancee next year. We first met last year, and since July she has visited me here twice, and I have gone to the US once, always on vacation. Now, I am planning on moving to Canada to go to school in September 07, just until May 08, when I would like to move to the US.

Some questions I have about this are:
  • Do we K1 or K3?
  • And where should we legally get married? We are planing a ceremony in Ireland next March 08, but are quite happy to marry this summer (07) in the US, before I move to Canada, if that would be quicker to process.
  • If I have to have an interview at the US Embassy in Dublin, will my UK residency for the last 7 years, and the fact that I am moving to Canada now make that impossible, or at least difficult? (Reviews say the embassy is fairly flexible with dates, and quite helpful, which would be great?)
The factors which are most important to me, the primary ones you might consider if giving advice:
  • ability to work as soon as possible after moving to the US next year
  • being able to go to my sister's wedding in Scotland, November 2008
  • keeping it as cheap as possible - I hear some petition fees are hiking to potentially $600 each this summer (yikes)!

Good morning all .....

The docs arrived this morning. God know's what the poor postie thought - I just about knocked him over in my haste to grab the envelope ... rofl.gif

Steve's wedding ring also arrived ... so that's another thing ticked off my list ...

All I need now is for someone in the DOS to tell me this morning that an interview date is on my file ... kicking.gif

Steve has worked at the same place for the last 32 years smile.gif - he turns 52 this month. We're a little bit older - I was 48 at the end of last month.

He earns way more than the 125%, so I'm not worried about that. I just don't want to get to the interview and not have what I need to be approved. As I said, he's just sent me the information for the taxes he filed for last year, so do you have any idea what years transcripts he should request? 2006 and 2007 or 2005 and 2006? Geez .. I'd better go and find the number for him to call - he's been running about all week ... I try to make it as easy as possible for him ....

as for the tax information, you would still have time, if you even need them. tax transcripts or tax returns do not need to be submitted in original form, therefore, if you , steve, (the USC) can get them before your interview date you can scan and email or fax them to your UKC (moira) to have for the interview. i havent read through your timeline, so im not sure how much time you have. and i dont know what you are providing or your situation, so you may or may not want to have them for prior years.

Ok ... he posted off the following to me today. The taxes that he filed last year, a letter from his place of work for the last 32 years, a letter from his bank and his last four pay slips ... would that be enough? It says on the information that you only need to provide tax returns if you are self employed and he's not ... I thought putting in the one year's as an added "extra" would be enough with all the other evidence of income ...

I just noticed that you got everything notarised ... the one that Steve filled in didn't have a section for that. We have a letter from his work and also his bank - but neither of them notarised .... Do we NEED to get any of it notarised?? OMG I hope not ... he just sent it all off to me in the mail today ....

We also only have the paperwork for the taxes he did last year - he's in the middle of doing this year's and they won't be ready in time .... should I get a transcript for the year before too? Aaaarrrrggghhhhh!! I thought I had all this sussed out already ....

A little about US tax returns. What is essential is

Form 1040 (has two pages) that has a signature on the bottom of the second page. If you don't have much but a little income and no investments then that could be your whole return. You could have a 1040A or 1040EZ instead of Form 1040
Any Schedules that are part of the return. That will vary by person but could include Schedule A (Itemized Deductions), Schedule B (Interest & Dividend Income), Schedule D (Capital Gains & Losses), Schedule C (Profit or Loss from Business), Schedule EIC (Earned Income Credit), Schedule SE (Self Employment Tax) etc. The top of the form will name the form.
Other Forms with numbers. Like I had a Form 2555 this year- Foreign Earned Income Exclusion (for Nick's UK earnings) Those will clearly be marked Form XXXX in the top left corner.

A note on Turbo Tax returns. The program generates a lot of extra pages that one might want to keep for their records but are not part of the tax return. I just looked at mine and if I let Turbo Tax print all their extra stuff, it says it is 73 pages.

What I mailed to the IRS is 6 pages with W2 form stapled to the front.
Form 1040 (2 pgs) Looks like this
Schedule B (1 pg) Looks like p. 2 of this
Schedule D (2 pgs)
Form 2555EZ (1pg)
(If people e-file, they probably have a paper copy printed for their records of the forms and schedules)


Some things Turbo Tax will generate that are not part of the return.

Any thing called "Worksheet" or "Smart Worksheet" (and there will be alot of those that I never even print)

Hope that helps some of you understand what makes up a complete tax return. And if your fiance would just order tax transcripts free from the IRS, then you don't have to send anything but the transcript, which also does not require a signature.

and sdp, i think its a good exercise in patience. its interesting to see what i resort to when i cant control anything in this process. the one thing i can control is being as prepared as possible, so i research. a lot. Exactly!! I have learned so much from the kind people on here. If I don't hear anything within the next two weeks then I'll be calling the USA to find out what's going on! I have heard of people being given their interview dates from DOS before they get their packet four from London, so it's certainly worth a try!

Oh, I know what you mean about research ... sometimes my brain is so full of visa information that I find it hard to focus lol. I've learned to take deep breaths (thanks Bob and Patricia!) and just keep myself busy ...

If that's the case, looks like my plan is set -- I've bought my train ticket in advance and everything (cost me a gross £20ish but I can't really complain as I'm about 40 minutes away). The website maybe has old information or perhaps is referring to other pharmacies of the same chain instead, and if other embassy-goers had earlier appointments than me, I think it's safe to say that it's okay! I can't sleep tonight - I have been checking out flight prices and hotels for London ... I think Mum and I will stay at the Lincoln House - looks really nice and central for both the Embassy and the Doctor's ... The flights are cheap and cheerful going from Prestwick into Stanstead, with an Express bus into the city ... it will be a dawdle ... laughing.gif

All I need now is my interview date and I can make all the arrangements ....

***SIGHS**** I wish I was a patient person ... all this would be soooo much easier ....

Since you're a new immigrant, it's a nice touch to be able to say you have a criminal background check from your home country that you can provide to them.

Congrats on receiving packet 3 smile.gif Yes, before my fiance emailed the embassy he called the the embassy and asked for the email code. If you don't include that code in the subject/body of your email, they delete it and your email will not get acknowledged. The charges for calling the embassy (1.20 GBP/ minute) are ridiculous, but it does not take longer than 2 minutes to get the email code. My fiance called them as soon as their office opened: 8:00 AM. The phone number to get the email code is:
For Operator Assisted Visa Information call 09042-450100 (this is NOT a London number. It does not require any other prefix or dialling code.) Service available Monday through Friday, 8.00 a.m. until 8.00 p.m., and on Saturdays from 10.00 a.m. until 4.00 p.m.; £1.20/min; only available in the U.K., within U.K. may be unavailable from some business telephones and mobile networks.

Hi Moira, you also need to send Forms DS-156, DS-156K and DS-157 (all in duplicate). If you go to the website it says in Packet 3 and SCROLL down the page (don't click on the 'jumps' because they send you to an old page) there is a box called 'What Happens next' which is very useful. You can do steps 1 and 2 in one go if you have all your documents ready (or think you will soon) and booked your medical. The date of your inteview will be affected by what you put in the 'Date of travel' box I think - apparently usually about a month before that - but really who knows??! Good luck!

Thanks for that. I read all the information and think I have a better grasp of what I need to do. I guess I'm panicking a bit and trying to do everything all at the same time. I should just slow down, take things a step at a time and do things properly!

Marm's post put the whole "date of interview" thing into perspective for me. I'm not so worried about the date of interview now ... I'm just looking forward to being able to relax while I'm waiting for the date to arrive!!
