thanks for every1's help. I finally got my packet together and mailed out a week ago. Had a question howver. In looking at the USCIS website the Laguna Niguel Center's timeline states that they are just now processing packets from April, 2006. Does that mean that it will be about 6-7 months before my packet evens get a touch or NOA or my check cashed?

Hi Tommy
the processing dates given on the service centre websites give a "worst possible scenario". Processing has speeded up recently so it should be much less than they are suggesting. The point of the dates on the website is to protect themselves from complaints as if there is a delay they can say they are still within the published times.
It's a good idea to start filling in your timeline here then it will be easy for you to compare how long other petitions are taking.

It certainly is possible to just get married and file for adjustment of staus if you can prove there was no intent to marry.

This won't work as she has a child from a previous relationship. She can't just move to America and marry you without written permission from that child's father to bring the child with her. If you do this and then try to adjust status the existence of that permission will prove that her intent on crossing the border was to stay in America. Without his written consent she can't bring that child to America and adjust the child's status. If she brings the child she could face criminal charges in Canada and is likely to be deported, then her criminal record will jepordise any future visa. Catch 22.

All you can do is wait and file when she is legally free to marry you. In the meantime she can make sure that she can bring her other child.

Her pregnancy has no bearing on the case at all. If that worked to speed things up I think a lot of people here would try it.

Waiting isn't the end of the world. We had to wait 2 years for my contested divorce to be finalised.
When we were finally free to apply my K-1 took 4 1/2 months.

:dance: I still feel slightly stunned but I had my interview in London yesterday and couldn't believe how easy it was. There was no need to show proof (photos, emails etc ) of relationship, a few simple questions about how we met and then was told "I am approving you for a visa pending on your medical" which I had the day before. Enjoying this time before the next round but at least I will be with my loved one.

The only real problem I had was a minor conviction dating back to 1979, I had to declare it on my application, but of course the police check came back clear because the offence was minor and so long ago.
Luckily I had forewarning of the problems this could cause from the experience of another poster on this site. By the time of my interview I already had copies of my letters to the Local District Court and the Procurator Fiscal's Office with their replies stating there were no records in existance. The Procurator Fiscal kindly added a paragraph to his letter about the trivial nature of the offence.
Best advice I can offer is read the guides and the posts here and be as prepared as a boy scout. Times I felt like all I was doing was tieing knots in red tape. This website is a great resource though. I could never have done it without the other members here.
Good luck with your application. I see you're headed to Buffalo. One of my best friend lives there, I actually got engaged while visiting him, Richard proposed at Niagra Falls then four of us headed out to Cataragus Reservation for a celebratory lunch.

Hi Rini,
First of all on the tabs at the top of the page you will see one marked guides.
If you click there you will find a step by step guide to the K-1 process.
His criminal record is something he needs to be honest about on the I-129F as the Embassy will have to be satisfied you know all about his past. The IMBRA forum here is good for more information.
His credit history is nothing to worry about, it's his income that matters.
You need him to send you the Affadavit of support for you interview in London, if his income doesn't meet the poverty guidelines he will need a co-sponsor willing to fill in another copy of the form. That is the I-134. You can also show the Embassy proff of any money you have that you will take with you but that is usually not required. The point is to prove that you will have financial support in the USA.
Read through the K-1 guides, look at the example forms, then I'm sure you'll have more questions.

Rida and I use phone cards, but more often we call each other through yahoo messenger. You can archive the calls you make. The call log tells you who the incoming calls are from, who your outgoing calls are to, the date of the call, the time the call was made and the duration fo the call. Best of all, no charge. You will need YM and a headset though. We talk for hours on end that way and we have a record to give during the interview. Hope this helps.


Maybe YM is next for me, after my 3.9 cents a minute card that is -clear as a bell. It seems important to hear well when deciphering a foreign accent and applying it to bureaucrat speak. I heard stress in her voice as we tried to work on the DS-230 Part 1 Biographic Data and letters of intent to marry/how we met.

I tried Skype and may again if I can find out how their records can be downloaded & printed. I just couldn't hear well. I tried a headset, a usb phone, Skype-in, Skype-out. Nothing sounded very clear. Never got customer support either, especially when trying to quit/stop the service charges.

I wonder if sending money via Western Union would provide a solid record of an ongoing relationship, and evidence of support later too...
Other ways are cheaper, but this would buy a convenient record wouldn't it? (I never have used it)

Skype records can't be downloaded and printed, you just go to your call history and take screenshots, scrolling through them patiently, which you can paste into a file for printing. I printed 42 pages of records, each showing about 16-17 calls between us.

This hotel is 10 minutes walk from the embassy and not much more to the medical hotel
It's cheap, not well maintained, but the staff are friendly and helpful. The only meal they serve is breakfast, continental buffet with plenty of choice.
While I wouldn't use it for more than a night or two, it's certainly worth the money because of it's location.

With the I-129f you are only proving that the two of you actually met during the last 2 years. The proof of relationship stuff is needed later at the interview stage. I suggest you use the time well while you are waiting to make sure your numbers show up on each others phone bills, send each other some real old fashioned love letters, then make sure he has a selection of things like this to show at the interview.

Well i have been looking over the docs and things.. and i think this the correct approach.
I'm unmarried and my girl lives in UK. I'd like her to come over here to live.

and I want to start the process now. We've been corresponding for a lil less than
2 years and made several trips. for extended period.

Also I would like to get married over there.. i dont know if that poses a potential problem.
Also I might like to do that.. this summer say in July. Which would probably be before
they granted a visa.. i'm guessing. Would that change in status be a problem..

i'm sure theres other problems.. i have questions with to come (financial).
Just wondered if anyone had opinions on that...those few things.

Welcome to the merry go round.
If you want to marry here in the UK then you can't file for a K-1 Visa, you will have to wait till after you're married then file for a K-3. Look at the guides at the top of the page and work out what suits you best.
If you do decide to marry in the UK remember you will need a visa to enter the UK to marry. You are not allowed to just get married here. Those visas are not too hard to come by.
Good luck with whatever method you choose.
You already have a head start if you are in Philly as you get to file throuh Vermont (the faster processing centre)

We filed out I129-F when I was there. It's just as well we did as the entire petition was returned a week later as the idiot who opened it thought our signatures were photocopies so sent it back asking for original signatures. We printed the whole thing again and signed in blue ink making sure the pen left indents on all the paper.
We got our NOA1 about a week after sending it back.
It was great flying back to the UK knowing everything was underway.

You need to fill out the forms asked for in packet 3 and should have sent them to the Embassy with your checklist. The forms are online, sorry I don't know the link but am sure someone here will be able to help with that.
If you send the forms separately to the checklist put your reference number on them and take copies on the day of interview to be safe.
On the matter of sponsorship, take everything your fiance sent to and copies of same. I got a letter from my bank showing a 5 figure balance in my current account as well as the average balance over the last 12 months. The Embassy took that when they took my fiance's financial stuff. I also had a few bank statements but wasn't asked for them.

There was no skin test for TB during my medical in London last December.
There is no point doing a skin test on a vaccinated population, in fact if you have been vaccinated then the skin test can cause a very nasty reaction, I can only guess the Embassy here is aware of that so doesn't ask for it..

We've recently applied for the K-1 and everything should be fine in that department.
I was wondering if, after I get the visa, and if I wanted to do two trips to the US to move more stuff cheaply (those damned international movers are insanely expensive), I could enter the U.S. twice: the first time on the VWP, then go back to my country to fetch more junk, then enter the U.S. on my K-1.
I know the K-1 needs to be used within 6 months of issuance (right?), and that would not be a problem. Would what I'm describing be a problem?


If you are only moving a small amount of goods maybe excess baggage costs will be more reasonable.
I don't know what's available from your country but I found a company that picked up 7 bags from me the day before I left the UK and delivered them to my fiance by Fedex while I was waiting to board my plane at Heathrow.

What some of you do not understand is MY TRIP is already booked as of 1/19/2007. It is a non refundable thru cheapoair and asiaroooms. Total cost to go see her this time $1100 air $500 USD hotel suite. I am not just pissing that off. I will go and have already talked to two ladies who said they will show me around the sites. I particularly want to see the American vets cemetary there and the old 1500's churches, Rizal Park and the Philippine Cultural Center. The ladies I have talked to said they know where all these things are and would like to show me the area. Last time I was in manila I barely got out of hotel as it was connected to amall and plus we went to Bohol for three days to see her family.
So if you agree or disagree it is ur choice. But I am starting anew and will look for adventure as it presents itself.

Talked to my fiancee tonite after trying to get a hold of her for three days. I called her at work and was able to talk. She said go to YM and I will tell you what is bothering me.
We meet in Ym and she tells me. " I have had a change of heart and do not want to move to USA." She says, " I am scared and do not want to follow through with it." Now bear in mind I have made plans, purchased tickets, got hotel room suite and am going to the Philippines in 25
days to see "my fiancee."
Needless to say as you can see by our timeline the ####### was totally knocked out of me. Have you ever tried to cancel internet flite and hotel tickets bought thru a broker of said things?
I am just floored. I simply wrote her an email and said I hope you can look your 5 y/o daughter in the eyes when she is 12-15 and tell her you did what you thought was best. Nerissa and I have been talking about this for 4 years and now she does this.
I have no idea how she could do this to me.

I am still going to PI in March. I saw for myself that there are millions of beautiful ladies there and who knows. End of chapter, start a new one. My life is definetly a chapter book.

I actually just got back on 16th June from an 89 day visit. My next visit on the 28th of July was supposed to be for six weeks but I was thinking about reducing it to just four.

Does anyone think that cutting the visit down to just a month would make any difference? Or don't they care what length of time you're there as long as you leave within the 90 days?

There's about six weeks between my visits .. I'm hoping and praying that it will be enough ...

So ... what do you think my chances are? Should I just be upfront and explain the situation, show POE the K1, tell them it's my last visit and that I'm going to miss my fiance like hell once the K1 is filed and hope to appeal to their better nature? Or should I just forget about the visit altogether?

Has anyone else been refused? Or have had a history of several visits to the USA and still been allowed in?

I just wanna let you know what I have heard from the embassy officer.

Even though you are denied entry at POE, it won't affect your K1.
Illegal activities such as overstaying VWP will affect K1 later. So, make sure to leave on time.
Also, be sure not to be involved in anything illegal which can affect your case later.
Then, you should be all alright. good.gif

As everyone else say, bring lots of evidences to show your tie to your country.

Some people on previous topic advised not to tell the officer at POE that you are coming to the U.S. to see your fiancee. She advised to say that you are going to see your best friend or somebody.
I am not sure and I cannot tell you anything with regard to this because you are supposed to be honest with the POE officer.

Yes, Nao - I heard that too, which was good news. I have never overstayed the 90 days so I should be OK on that score. One visit, I admit, I came close - 89 days I think it was. I counted them 10 times on the calendar to make sure that it was right before I booked my flight! As for being involved in anything illegal .. geez I'm a 47 year old grandma wink.gif I live a quiet life innocent.gif

Evidence is going to be the tricky part. I think I could get a letter from college approving my holiday but telling me that they expect me back on whichever date. I can also take my bank statements with the standing orders for my rent money every month too. I thought I could maybe ask my son to write a letter saying that he is my landlord and that he is expecting me back on whichever date - even if it doesn't help, it certainly won't harm.

I have never told the POE Officer that I am coming to see my fiance - I always tell them that I'm visiting friends. I don't think ommitting the fact that my fiance is also my friend is a lie, so I guess I'm ok on that score too ...

Basically, they want you to be spending more time in your own country than you are in the U.S. The VWP is meant for visiting and that is what you're doing.

There is no need for you to tell the POE officer anything. If he/she asks you are visiting. If he/she asks who you are visiting then you can explain your BF. Do not offer up anything you aren't asked for specifically and do not lie. There are literally thousands of posts on VJ about visiting. Bring plenty of proof showing ties to your own country... mortage/rent proof, utility bills... a letter from your employer...etc. That is what they will want to see.

There is always the chance that you could be denied at entry but many people spend time together with no problems.

Thanks for your quick reply! Yes, I've been a visitor all right! I started out visiting for two weeks and over the years it graduated to three months on my last visit. I'm just scared the fact that I'm going back again so soon will raise a red flag with immigration - it will only have been six weeks since I left the USA ... ah sheesh .. what you do for love .. heart.gif

Showing proof won't be that easy - I actually live with my son and pay rent, but there is no formal documentation of this. All the utility bills are in his name. I AM in the middle of a diploma course at a private college, that's why I've been able to visit so much because the course is so flexible .. so I guess I could get a letter from them verfying this.

Usually I just tell them that I am visiting a family of friends .. if they ask who, then I give them my fiance's details. Well, he has a family .. and he is my friend ... so they can't say I'm lying can they?

I'm just scared I guess ... it's only a few months now until we get to file the K1 after such a LONG wait - I just want to spend some time with him before that happens .. hopefully things will be ok ..

I'm concerned that when I go back to the USA with my fiance at the end of July (for four weeks), after his week long visit to Scotland, that I won't be allowed into the country.

This will be my LAST visit to the USA on the VWP, as my divorce should be granted mid September and we'll be applying for a K1 visa as soon as this becomes final. As I will be doing all the paperwork for the petition, I will be bringing the "almost" completed K1 to the USA with me - all that will need to be added are his documents. I will leave the package in the USA and when I return home and after my divorce papers come through I am going to send them to him so that he can enclose them with the rest of the petition and then send it off. Once he has sent the papers off to the lock box, it means that we're not going to be able to see each other for months as he can't come over to Scotland to visit me because of his work. Plus, he's a brilliant guy but he's not very organised .. smile.gif .. so I would rather make sure that his docs are all in order so that I can relax!!

So ... what do you think my chances are? Should I just be upfront and explain the situation, show POE the K1, tell them it's my last visit and that I'm going to miss my fiance like hell once the K1 is filed and hope to appeal to their better nature? Or should I just forget about the visit altogether?

Has anyone else been refused? Or have had a history of several visits to the USA and still been allowed in?

Any help would be appreciated .. thanks

Thanks for that. There is only going to be the two of us in the household and he earns around $50,000 a year so we should be ok ....

I'm going over to visit him soon and want to get all his paperwork to bring back with me. Is this form something that he can fill in and sign while I'm over there and give to me to bring back to Scotland? Does it have to be notarised in any way? I know he has all his tax stuff that I can take copies of and I read somewhere about a letter from his employer too ....

I'll have a look on the forum to find out exactly what I need ... I want to have everything on hand and ready to send of to the Embassy as soon as possible ... oh geez ... so much forward planning to do ... smile.gif and we haven't even applied yet .. aaarrrrrggggghhhhhh!!!

I just had this horrible thought after reading about the DS-2000 and needed someone to tell me quickly lol!!

Hi All,

I've been trawling the site in preparation for my fiance putting in the I-129F forms - just to get a heads up on what's required ...

One thing that I came across - DS-2000 "Evidence Which May Be Presented to Meet the Public Charge Provisions of the Law"

I'm really concerned about this as after paying for all my visits, I will have little or no money to take over to the USA with me. My fiance is more than financially able to provide for me for the three or four months that it will take to get the work permit through so do I NEED to have money??

I'm a poor student, but intend to get temp work in the UK as soon as my diploma comes through and for as long as it takes for the K1 to be approved.

Any advice or thoughts appreciated.

When I moved the USA I had the opposite situation, but which might be beneficial to you. When I applied for a mortgage here, I found that my UK credit history was null and void over here. I had a very good credit history in the UK, but even though Equifax (for example) are an international company, they have different records and different credit scoring methodologies in the UK and the USA.

My reason for mentioning this is that you *might* find your credit history have to start from scratch when you live in the USA. Once you get a SSN and start to get credit you should be able to get a good credit file.

Please don't quote me on this because I don't know this for sure, but I certainly felt like being born again when I came to the USA to live smile.gif Its a little frustrating but at the end of the day its a different culture/country and people are identified by their SSN (differently to the UK system) so it kind of makes sense why it is all disjointed.

I am not sure if significant credit problems are reported internationally though.

I checked the internet to find out if UK credit reports were shared internationally and found a site called Myvesta. It states that because of the Data Protection Act that UK credit reports are not shared with other countries. They also advise that if you have a good credit report, that you should get a copy of it before moving to another country.

So, it looks like I'll be starting with a *clean slate* kicking.gif kicking.gif kicking.gif

We won't be trying for a mortgage for at least three years, we need to get all our ducks in a row financially, but hopefully by that time I will have built up a decent score ....

Can't sleep .. I have all these reason in my head why the K1 might not be approved and NOW I've thought of something else lol!

I hope you don't mind if I run it past you all ....

When I move over to the USA and hubby (more forward planning smile.gif ) and I decided to try for a mortgage, say three years down the line .. will they check my credit history back in the UK? Due to the financial implications of the separation from my ex, my credit history is awful ... sad.gif I'm hoping to pay off the one credit card that I have at the moment, but it will be a struggle .... sad.gif

Any ideas?
