I posted this in the K3 forum but perhaps here would be a more appropriate place:

I just sent away for my police clearance at the beginning of the week and I'm going down to London for my medical next week. However, I was wondering if it would be wise to send packet 3 completed even though I don't have the police certificate yet and we're still putting together the I-134. I know this would speed up the process but I don't want to get caught out by getting an interview date too early.

That's good to know Yodrak, it takes the edge off my anxiety about the process.

I got an e-mail back from the embassy today giving me a link to the exact information I was questioning, now I'm going to have to wait for four days while I wait for a response which actually addresses my question.

I'm going to try one more time to see if anyone here has experience of this: Will it be alright, with regards to self-sponsorship to provide my wife's bank statements along with mine for consideration? My wife won't be filing an I-134 because she does not have a U.S-based income as we live together in Scotland.

I called the embassy about the issue of providing my wife's bank statements at the interview (without filing the I-134) and was told that most likely it'll be ok as she will be there but send an e-mail to make sure. I'm still waiting for a reply but I was just wondering if anyone else has had experience of doing this for their K3 (or K1 for that matter).

Another thing we need to decide with regards to the I-134 is whether we want to go with having a second sponsors (other than my father-in-law). As my father-in-law's girlfriend may be willing do this for us also. This is a bit of a dilemma for my wife and I as neither of us have met her since they've only been together for about 6 months. They do live together but we feel a bit uncomfortable allowing her to do this. Furthermore, I know that questions are sometimes asked about the co-sponsor(s) and I was wondering if anybody thinks that this would to tenuous a link to have someone as a sponsor.

Would the visa be flat-out denied if we just went with my father-in-law's earnings and our savings and just miss the mark, or would they allow us to then to furnish information on a further sponsor if necessary?

Thankyou both for your advice, it's much appreciated. Unfortunately, self-sponsorship will not be so straight forward for me as most of our savings are in my wife's bank account as we use my account for most active purposes. When we approached my bank about adding my wife to my account we were refused as my wife did not have a credit rating in the UK at the time. Admittedly this was quite a while ago but we decided against trying again as my wife got a very basic account which we never really touch and this made it easy to save money and consider it off limits. I wonder if, going down the self-sponorship route, they will accept bank statements from my wife without an I-134 being filed.

Well if the rate of exchange keeps going the way it seems to be heading, we should have that in about a week! :thumbs:

I'm almost 100% certain that it wouldn't be possible to set up an account from overseas; they'd have no method of truly verifying identity and I'm sure if it were possible it would be a huge target for fraudsters.

Over the cash/bank account issue, I still think it'd be hard to get around the fact that the actual question states "US bank account".

I'm hoping that the lack of strict guidelines will work in our favour as it would be extremely inconvenient and a financial set back for my wife to go back to the US just to open a bank account. Regarding the outlandish sum of money you mentioned, we've got savings, but we're not rolling in it, that's why we've opted to have a co-sponsor.

As my wife (USC) and I both live in my native Scotland my wife's father has agreed to be our co-sponsor for the I-134. However, as we have a decent amount of money saved our selves, my wife also wants to complete an I-134 herself. I may be mistaken, but I'm under the impression that it wouldn't be a problem to do this as the guidlines do not mention anything about current domicile.

I know that it wouldn't be possible to include any salary details as obviously my wife will be leaving her job once we return to the U.S. There is, however, something which I'm not sure of and I hope it isn't a problem; no. 8 on the form states:

"I have on deposit in savings banks in the United States:"

My wife's savings are all in her UK bank account and she closed her US account when she left to marry me. So, although I wish it was, it won't be an option to simply transfer the money.

I know most people's situations here differ to ours, in that the petitioner is usually already in the US, but any advice would be greatly appreciated.

I called the embassy this morning and was told that I would have to e-mail to be given a definite answer. I've done that, so all I can do now is wait and hope.

They took my case number and gave me specific information on when the DS-230 was received. I've also had e-mail correspondence with them (where they agreed that my wife can provide her UK bank statements without filing an I-134; as her dad is the sponsor) in which I provided my case number, whether they looked it up is another matter.

Good luck with your case too! Have you sent back packet 3 yet? If so, how long does it usually take the Kenyan embassy to grant an interview after receiving it?

We got packet 3 on October 13th, the delays in the process were completely our own fault, I contacted the embassy in mid to late February and they must have processed the DS-230 around the 15th of Feb. I hope they would've contacted us on receipt of the DS-230 if there was a problem however I'm a prolific worrier and I can see them being so busy as to not have the time to look that deeply into it.

We took a long time to send back the initial forms that came with packet 3. Therefore, before doing so, I called the embassy (twice!) to make sure that we hadn't missed the window of time in which everything can be sent back within. I was told that there was no set time and that it would still be ok. I even called a week after we sent the DS-230, etc to make sure they got it and I was informed that they had (no problems mentioned).

Today, I was looking through the documents we've received over the period of the K3 process and noticed this on the NOA2:

"Notice Type: Approval Notice Valid from 09/22/2006 to 01/22/2007
Consulate : London"

!!!!!!!!!!!!! We sent back packet 3 this week and I had my medical at the end of February. Now I'm really worried that because of the expiry date on the NOA2 and our tardiness in getting things sent back we're going to be told at some point that getting the K3 is not an option.

I'm going to call the embassy tomorrow to see if I can find out for sure, but I wanted to ask on the forum to see if anyone here can provide any insight on the situation.

My father-in-law is filling out the I-134 The only other person who stays in his household is his girlfriend. She has a job and helps towards the mortgage. Would she be a partial dependent or not a dependent at all?

I e-mailed the embassy last week and asked them if it would be ok for my wife to supply proof of savings without filling out an I-134 as she works in Scotland. They told me it would be fine and also reiterated the information the sponsor (my father-in-law) will have to supply. I'm not sure if this counts as a special arrangement but I found it more like a confirmation of the status quo.

Not necessarily for a K visa. A K visa applicant may not need any sponsor at all, although most do. And when they do it need not be the petitioner.

As your wife will be your primary sponsor anyway, she is required to fill out the affidavit of support, whether or not she has a US income.

Yes, that's what my wife and I are doing. Here's some advice I was given.

Vamos,

Do a search when you can on self sponsorship in London.

Whilst there is no hard and fast rules regarding the I-134, it is a totally different fish. For one there is no joint sponsorship ruling as there is for the I-864. All one needs to show is that the applicant wont become a public charge. This can be done in London with self sponsoring. Check with others from London for the specifics as the search function is malfunctioning so I am unable to link to the relevant information.

"Bank statement showing present balance of applicant's account, date account was opened, the number and amount of deposits and withdrawals during the past 12 months, and the average balance during the year."

I've managed to obtain the first two requirements in a statement from my bank but they've told me they can't provide the other information. They've said that if I work out the average balance and amount of transactions myself, they'll stamp it for me. Quite a lazy response to the request methinks. I'm not sure if a document created by me but stamped by the bank would be sufficient for the embassy. Has anyone else had the same problem with their bank and ended up just providing bank statements (which is what I'm think of doing)?

My wife and I are flying down to London tomorrow as our interview is on Thursday. I was just checking over all the documents we need to take when I looked at the photo format specifications at the end of Packet 3. I've really been complacent as I've had two normal UK-sized passport photos ready for this purpose since my medical (I used one from the same batch for it too). Now I know that my photo is not the right size and I don't have time to change it! Does anyone know if they are extremely strict with the photo policy? If so what will happen?

I hadn't actually considered the fact that the I-134 is used in conjunction with non-permanent visas and thus tried to make sense of the question in relation to our situation. I'm using too much energy trying to be compliant than actually thinking logically about this.

Of course there's the option to contact the embassy directly on the matter. I'm simply trying to get advice from those who have gone through similar situations before speaking to someone on the phone who doesn't care about my situation whatsoever and may or may not be giving the correct advice.

Back home now, thanks to everybody for the replies. I really appreciate the advice given on the forum, it gives us somewhere to turn to, especially in times like these.

The good news is that our family friend has absolutely no problems with being our sponsor and will get things ready as soon as we point her in the direction of the I-134 form.

I'm fairly optimistic as what I gather from the information on the blue form is that the visa is there for us as long as we can provide the further information requested.

I wish I had had my wits about me during the (I think less than 1 minute) interview as I should've asked if it would be ok if the I-134 is faxed to us; instead of mailed. Does anyone have experience of this?

I'm also wondering about question 11 on the form where it asks what kind of contribution will be provided. My father-in-law (the original sponsor) has already stated that he will be providing room and board. Should our new sponsor state that their contribution would just be any further support necessary?

I just had my interview at the embassy in London. Due to our sponsor not making enough money and the interviewer deeming his assets and our savings as insufficient we've had the visa suspended. Everything could be salvaged if we can find another sponsor and send the I-134 with my passport to the embassy. However, the only person we know of who could possibly do this is a close family friend.

I've notice on the website for the London embassy it asks for two or more from a list of proofs and going by that we only have one. I'm clutching at straws because I just received the completed I-134 today and the bank info is from an online statement, not from an officer of the bank as stated on the guidlines.

No, but I recommend getting tax transcripts for past 3 years, they are free, and prove the numbers on the 1040.

Well, after having the visa suspended at the interview (pending an I-134 being provided by someone meeting the minimum requirements), we finally had the I-134 and supporting documents of a very good family friend of ours collected by SMS on Friday morning. Now for the excruciating wait!

I'm told it can take 10-15 days for the visa and passport (or a sad lonely passport) to be returned. We want to move in July and need to leave our jobs to have time to get everything in order. Does anyone know a way to speed up the process? I've read of one person contacting their senator but for some reason that strikes me as something which might annoy the embassy. Any ideas?

P.S Is it usually the interviewing embassy official who finalizes the visa in these cases?

Hi folks, Im just looking for some feelback about something regarding the I-134. My fiance has only started working at a job in the US recently and the amount that he is earning will not be over the amount needed to be a sponser. He did work over here in the UK while he studied here. But, he does have money in a bank account which is well over the amount that is needed. To be a sponser do you need to be earning money over the minimum requirement, or is it ok to have it in a bank account? I just want to put my mind at ease! Thanks x

Hi everyone, I hope someone can help me with this. I have my K1 interview coming up in 2 weeks time in London, UK. At the moment, I am currently staying with my family before I leave for the states, so I am not going to be at the address where my packet 3 and 4 were sent. I was just wondering does anyone know if it is possible to have to have the visa sent out to a different address if you provide them with the address on the day? Otherwise I will have to get my flat mates to send the visa over to me, and I just want to have it in my hands as quickly as possible!! Thanks in advance for any replies! Karen xo
