We did consider asking friends but were worried about putting a strain on those friendships, it looks like we don't have to worry about taking that risk, I just wish we had been able to do all this two years ago, he was making good money then, there was no IMBRA, it would have been so much easier.
The wait time has it's plus side, our relationship has been tested over and over, we work together even when everything around us is falling apart.

My USC fiance has been getting disability now for a couple of months, we had hoped this would be temporary but due to some medical complications it now looks like this will be long term.
Is he able to use this income to sponsor me (it is over the poverty guidelines) or do we need a joint sponsor?
I have enough funds myself to get through the initial K1 interview but am worried about later. I believe we can only use my funds as back up once I am included on his tax returns and am concerned that we might miss out due to timing.
A joint sponsor would be next to impossible for us as he only has one relative who could do it and she is totally against our relationship.

How long will you be here? In the old days (last summer) if filing through Vermont one could possibly be approved in just a matter of days.


I'm going to be with him for a total of 6 weeks. I remember the old days too but I don't expect to see them back this soon even though he will be filing through Vermont.

i think it's all dependent upon how much you're willing to risk. when anthony and i were going through the k-1 process, we decided that it wasn't worth the risk of being held back at the POE, and so i traveled to ireland twice during the application process instead.

at his last visit prior to filiing for his k-1, he was held at the POE and questioned, as to why he had been in the US so many times recently, etc...so it made us a little gun shy.

that said, if you do decide to travel to the states while your application is pending, bring proof of your intent to return. you also may wish to consider traveling through Dublin. they have a US port of entry in the Dublin airport. that way, if you were to be turned back, you would still be close to home. :lol:

Thanks for the help, the worst time I had at POE in Philly was on my first trip, that was a longish trip and at that point I couldn't even prove I had a job to come back to. I did think about using Dublin but the cost is prohibitive. My fiance traelling here isn't an aption for the forseeable future as he is recovering from major surgery and he could never cope with a transatlantic flight, he can just about handle car trips as long as they are less than 2 hours.
It may be safer for us to just wait the 3 extra weeks and file as soon as I arrive. We have waited so long already I'm impatient to get moving on this but don't want to risk any complications either.
I count myself lucky that we are going to miss the worst of the IMBRA problems.
I want to minimise risks as we both are looking at being together long term and don't want to do anything to jepordise that.

I'm looking for advice about whether my fiance and I should file the 129F as soon as he gets the copies of everything from me or should we wait until I am there with him.
I'm planning to spend 6 weeks with him in September - October and not sure if it would be easier at POE not to have any record of a K-1 on file or if having filed for a K-1 would be evidence of intent to follow correct legal procedures.
As it is I expect to be able to send him copies of all the documents he needs in the next week to 10 days, delay would only slow our ptetition by a matter of 2 or 3 weeks but at this point I am most worried about getting denied at POE.
I have only visited for one week so far this year but last year had three trips totalling over 3 months in the USA. I plan to bring my lease and an employers letter showing I have a new job to start when I get back to the UK.
What do other people here think?

Do not use any abbreviation or else you can get an RFE for your signature.

This is one that has been bothering me, after almost 3 years of waiting we are just about ready to file for a K1 and I don't know what to do about the signature. I have never signed my name other than just my initials and my last name, if I was to write anything else it wouldn't be my signature, just my name written in longhand.

Just be sure that that statement also comes from you. As the USC petitioner, you are the one filling, not your fiancee. I had David (my SO / USC beneficiary :D ) sign and date every page that was not a government form.

Just to add to what I wrote before. You want to state when, and where you met within the two years. How you traveled, where you stayed, and for how long. This is what to include in the letter of explanation on meetng within the two year period. I added a statement (one sentence) on how we first met, and a sentence stating when I proposed. Sometimes I think they RFE for more information, it's been guessed that they were looking for a statement of those two things. The body of the letter should contain the when, where, and how you met within the two year period. You evidence is to back up the statement.


I think this is pretty much covered by the statement my other half wrote, he wrote a short piece basically covering the evidence we do have. Where we could we included pictures showing us with other people and the names of those people as well as other evidence we were in those places. He did include the two points you mention thankfully :)

Perhaps I got it wrong, I thought the phone bills, emails etc were needed to prove an ongoing relationship rather than having met.
I can find some of these here although my other halfs filing system is basically throw it all in a heap. Lucky I can still operate on UK time even though I am in the USA, I think I am in for a long night.

I'm visiting my other half right now and we have been putting our I-129F package together. This is my 5th visit over the last 2 years.
I have copied the boarding cards I still had from previous flights as well as ticket reciepts where I still have them. I added those little slips you get from the the Dept of Homeland Security when you leave the country to show more evidence of me actually being in the country and leaving. I only have one hotel reciept which only has my name, not his, I have a couple of bank statements showing withdrawals made when visiting him and some tickets from a couple of shows we went to.
All but one visit is backed up with pictures, I've printed these onto photo card with a textbox beside each one saying who is in the picture, where and when it was taken. We don't have original prints of any of these pictures as we share all our pictures using a computer and some have been printed for the first time. None of the pictures have been date stamped, I turned off that function in my camera ages ago and forgot how to turn it back on.

Will this be enough do you think?

It's clear enough where to sign on the I-129F and the G325A, my other half also signed the supplement to Q18 saying how and where we met. We have both singed our letters of intent. The rest of the papers are evidence of meeting or copies of documents, shouls these also be signed and dated?

Sorry to be asking such stupid questions but we have waited years now to be able to file this and I am terrified of any delays caused by our action or inaction having wasted so much time due to things outwith our control.

With a UK address the county is unimportant, you must give the correct postal town and the correct postcode, as with the house number this is all the Royal Mail needs to deliver to that address, I live in the UK and we just sent our I-129F. What you need to be sure of is his postal town as that can be different from the town he lives in. I live in a small village but for mailing purposes my address uses the name of the nearest town.

It's just a blue sheet of paper. Nothing's entered formally into the system so you don't get a case number, just a rejection. If you look at the Vermont Service Center's site, they explain what the stamp is:

"Applications are stamped with the time and date of physical receipt, not the time and date they are actually opened. Mail with fees enclosed is routed immediately to mail assembly. Cases that are filed prematurely (before the applicant was eligible or met the legal criteria) or that were filed on an outdated form are prepared for manual rejection at this point. Cases lacking proper signature or correct fee are identified for system rejection."

So the stamp is 'Ooh, looky, another application.' and the blue letter is 'Oops, take a mulligan.'


Thank you , this explains what I needed to know, we had sent everything in exactly as asked, sadly some numpty who opened the package decided we had used photocopies of signatures and not originals. This time we sent the package back having printed the forms on thinner paper and used a blue pen to sign everything, hopefully is they think we just printed the signatures in blue they will see that the pen almost went through the paper in places. They clearly rejected the whole package erroneously but better to give them what they want than try telling them they made a mistake.

The blue form has no A# or reciept # on there but it does have the 5 digit number that was handwritten over the stamp.

I have problem in filling out G-325A. I am using Adobe Acrobat to fill out the form and when i have the form printed out, i found out that some letters in the same word were missing. For example: "September" would be turned like this "Septem" after printing it and "ber" was lost. And my question is that am i allowed to use my black ink pen to fill in the missing letter?

We had similar problems as sometimes the words were too long for the space allowed in the text boxes, I simply typed those answers in Word and then reduced the font size, 8pt was usually enough. When I then copied and pasted this back into the G-325A it fitted fine and printed well.

Just checked our petition online to find it was touched yesterday. I would love to belive the good people at the Vermont Service Centre are so dedicated to speeding all our visa applications that they are working on Sundays.
Realistically I suppose it's good evidence that updates online are batch processed during quiet times.
Two touches now within as many weeks, I know it's not long since we sent the petition but if they are looking at it I wish they would make up their minds what to do about it.

Remember most of your parent's concerns will be the same no matter where you fiance is from, you are young, you have your whole life in front of you now so why tie yourself down now, how long have you known him, how well do you really know him. You need to be able to answer these as well as the worries they will have about you being so far away. As for the distance, remind them how easy it is to travel the world now. They may be very concerned that if things go wrong they will be too far away to help you. Be ready to eexplain how you will deal with helping yourself including being able to just jump on a plane and come back if you have to.
Love on it's own isn't usually a good enough reason to parents to justify what you are doing, to them you will always be their little girl, that's normal and if they didn't have questions about your decision they wouldn't be very good parents.
Be prepared to explain to them about why you and your fiance have chosen to make a life together in the USA instead of the UK. Make sure you know what kind of job opportunities are available to you when you move. Show them that you have made a reasoned decision to move and are not just jumping into marriage.
If they still don't agree with your decision it will be harder to go ahead without their support but not impossible.
Good luck with talking to them and please do make sure you talk to them before you file any paperwork, even if they are not involved in your decision to marry your fiance they still deserve to know before you actually do anything.

Hello,

It would seem that VCS and the NVS in NH have their act together. My NOA1 mailed 10/3/2006, NOA2 mailed 10/18/2006 and a letter mailed 10/23/2006 from NVS informed me that, "Within a week the petition will be forwarded to the appropriate visa-issuing post where your visa interview will take place."

A case number for GUANGZHOU, China was also assigned to my case.

Does this seem normal?
Does the "within a week" in the above paragraph really mean a week?

This week we spoke to an attourney who made gave us a scenario that we didnt expect, and are not sure how realistic it might be for us. The attourney said that I could come over the US on the Visa Waiver programme, and if we got married after a certain amount of time, we could go to them, and they could file a petition for my permanent stay. Being as we were getting prepared to apply for the fiance Visa, this came as a shock, as realistically all we would need to prepare for is the attourney fee's etc, before we went through with this. Has anybody else had this suggested to them before? Does it sound realistic? I'm thinking of the possibility that if I over-stay on the Visa Waiver programme, that it would jeopardise my future trips to see her.

My fiance and I talked with an immigration lawyer earlier this month when I was visiting him. The lawyer told us that it was possible to marry on a visa waiver but adjusting status would be more difficult as I had a history of visiting him using a visa waiver. He siad the previous visits could be used as proof of immigration fraud.

If he was advised not to visit again for 3 or 4 months and has left it for 7 then it shouldn't be such a problem.
Do remember even with a visa the immigration officer ar the POE has the final say over whether to admit anyone.
Dublin is a POE for the USA so if you are worried he could get a flight that connects via Dublin, that way if he is refused home is not so far away.

Gary, you say your K1 has been approved but then that you have just recieved your forms and checklist from the Embassy. I'm not sure if your approval is really your K1 or if it's just I-129F approval.
If your K-1 has been approved and you have a visa then you can't visit the US, entering will activate your visa and you will have to marry and apply for AOS ect.
If your approval is just the I-129F then you can try to visit the US using the visa waiver programme. You will need proof of your ties to the UK, a letter from an employer saying when you are expected back would help as would details of bank accounts. If you have an appointment to go for interview at the US Consulate this might also help to prove you intend to return to the UK.

Remember there is no guarantee you will be allowed entry to the US and be prepared for the possibility of being sent back at your own expense. Some members here have managed to visit during the process. It's a gamble.

If you didn't have immigrant intent when you entered the US you should be able to just marry and file for adjustment of status. The difficulty with doing it this way is that you would have to prove lack of immigrant intent, I'm not sure what the burden of proof is but you would have to show very strong ties to Canada and a lot more than just a return ticket.

I was in the US when we filed on the visa waiver programme. We just answered that I was there and gave the date my stay expired as the date of my return flight. We had no problems with this and in fact he got an approval email the day after I got back to the UK.
I did make a point of keeping the slip of paper from the machine at the airport where you scan your passport before you leave as I saw it as being good proof that I left on the day we said I would. We also used a pile of these as proof of previous meetings.

In looking at the USCIS website the Laguna Niguel Center's timeline states that they are just now processing packets from April, 2006. the processing dates given on the service centre websites give a "worst possible scenario". Processing has speeded up recently so it should be much less than they are suggesting. The point of the dates on the website is to protect themselves from complaints as if there is a delay they can say they are still within the published times.
It's a good idea to start filling in your timeline here then it will be easy for you to compare how long other petitions are taking.
