K-1 Fiance(e) Visa Process & ProceduresJob problems
Hi all,

Just an update on this situation as it stands. Having sent a letter to the Embassy in London on May 23rd explaining the situation and just checking if they could extend the petition expiry date, I received a letter last week saying "We contacted you regarding the receipt of an approved petition etc etc have not yet heard from you, please get in touch by August 21st." Despite having definitely sent them a letter I'm not going to split hairs as it does at least show via this letter that they did extend the time anyway.

My fiance has just gotten a new job and starts next Monday so we're ready to get the wheels rolling again. Once she has the first couple of payslips, the I134 and the employer letter she's going to send them to me by express mail so I'll have all that by mid August. I just called the embassy on the switchboard number to see about what sort of timeframe we'd be looking at for an interview appointment to become available but the (it must be said) rude lady at the embassy told me they do not discuss that sort of thing on the telephone and I would have to write to say I was "ready for the interview process and they would get back to me in due course."

I'm going to write up a letter just now and send it special delivery (seeing as it seems the first one vanished or is lost in the embassy admin pile) - am I likely to be waiting quite a long time to hear back from them? I've no idea what sort of working time there is for the interviews but I'll need to know asap to book time of work (they are very picky about me giving them 4-6 weeks notice). What sort of wait did any other London Embassy users have before hearing back?

Cheers.

I am sorry that you do not believe this was of any help. If you do not mind, I would appreciate it if you either post the outcome of your experience here after the interview or you can PM me if you do not want it public.

Thanks very much and good luck.

I didn't mean to sound ungrateful at all, I think the fact that each country seems to do this in a different way has muddied the waters somewhat. Plus I hadn't intended to start any heated debates!

Sure, I'll post the outcome up here when I have the interview.

I'm more confused now than I was when I opened the thread, seems this isn't an issue with a set answer! Sorry for kindling an argument, everyone.

Assuming the expiry date on the NOA2 gets extended I'll just show up at the interview with the I-134 and hope for the best!

K-1 Fiance(e) Visa Process & ProceduresJob problems
Hi all, well it's safe to say I wouldn't be able to make it on assets alone - I reckon that by the time I get the interview (lets say August for example) I'll have the equivalent of $8500 or $9000 US in the bank that I can show the interviewer. That then doesn't count the various things I'll have to sell before leaving (such as my car) which will easily take the total over $10'000 - hopefully to more like $12'000. But I know that'll be secondary to her I-134 so we have to see what she can find in the way of work before then.

I wrote to the "Immigrant Visa Branch" at the Embassy a few days back requesting the extension of the NOA2 expiry date. Just waiting to see what the response will be.

K-1 Fiance(e) Visa Process & ProceduresJob problems
Hi all, thanks for the replies. First off, the fact you can simply contact them and ask for an extension of the expiration date is music to my ears, it's probably the easiest way to go. Just out of interest, any idea which phone number and email address is the best to use? The London Embassy website has several listed and I'm not 100% on which applies to my circumstances.

Just another couple of points based on what's been said above:

The interview has not yet been scheduled - I was on the verge of arranging it with the embassy when she lost the job.

The first thing she tried was to find a co-sponsor but not with much luck so far. Her Dad had to stop working due to health problems recently which doesn't help. We'll keep looking though.

Just out of interest, how does the suggested Self-sponsoring work? I estimate that by the time I move over there and get married (we're aiming for October i.e before winter) I'll have savings to bring with me of roughly $12,000 but that includes selling my car and so on. I don't own my flat so can't use that. I also hope to be earning something approaching a part-time wage via Internet Affiliate marketing that I'm working on getting into in my spare time at the moment (I also work a full-time job) so that when I move I should be earning a decent amount from day 1. I had planned to take some proof of the money I'm currently making from this ($300 from Amazon this month for example) to the interview to show I will be earning for myself as soon as I arrive in the States.

Thanks again everyone!

K-1 Fiance(e) Visa Process & ProceduresJob problems
Hi all,

Up until recently everything seemed to be going well with the K1 visa application myself and my fiance had filed. The I-129F was accepted and I had gathered all the forms and certificates and so on in order to get the interview at the embassy sorted. I've even been to London and had the medical and that all went through fine. Unfortunately, just before I was about to get in touch for the interview my fiance lost her job due to department cutbacks. This rendered the I-134 income form obsolete so we put everything on hold while she tries to get another job.

The main problem with this is that the I-129F acceptance has an expiration date of the 17th of June on it. Even if she was to get a job tomorrow (wishful thinking) there isn't enough time before then to get a new I-134, employer letter and 3 payslips sent over so I'm not going to have everything in time for then. So, the advice I'm looking for: should I arrange an interview and go down with what I have (basically everything other than the I-134, payslips and employer letter. I have her last two tax returns) and hope they don't just rip it all up for not being complete or should I ask if we can get more time?

Any help would be appreciated, we're starting to get a bit worried. Thanks!

K-1 Fiance(e) Visa Process & ProceduresConfused
Hi all,

I received a letter from the London Embassy when they received my accepted I-129F petition from NVC but far from being the "packet 3" I expected, it's just a letter stating that they had received the application and I now needed to "complete the appropriate forms and collect required documents. A detailed explanation can be found at: http://london.usemba...a/iv/iv_15.html "

Now, I assume I have to print off the "checklist" etc to send back to them (as the letter I got was one page of A4 - no forms) but the link above has since been changed! The only thing I can find on their website that I assume is correct is http://london.usemba..._documents.html but it doesn't have links to all those forms I understand I need! Can someone point me in the direction of where I can print off the "checklist" and the D-whatever forms I need to have printed so I can send it all back and get an interview?

Thanks!

I think he wants more $$ for the K3 the Adjustment.

Very good point. good.gif Lawyers LOVE K-3, they can charge more for filling out more paperwork.

Since the lawyer directly stated there would be no additional fee to file, I'd trust him on that. AOS paperwork is the same either way.

The one advantage of going ahead with getting married is NO AOS. You start over with the I-130. I wouldn't bother with the K3 if you're in the UK. We filed for both, but I have my CR1 visa and the K3 is still pending (probably admin cancelled). With the I-130/CR1 you won't have anything more to do until removing conditions. However it did take 9 months to process everything, and we are considered pretty quick. Even though you get married here unless your Fiancee has been resident here on the appropriate residency visa (leave to remain) for longer than 6 months she can't file directly through the consulate. She will have to file the I-130 with USCIS in either California or Vermont, which is where most of the waiting will be. You can file as soon as you have your marriage certificate though, which we got the same day we filed it (ie the day after the wedding).

Your decision really depends on what is more important. Being together fastest no matter the cost, or minimal amount of hassle. Also if you get married here in the UK your Fiancee will need to apply for a marriage visitor visa (should only take about a week if she's not planning to stay longer than 6 months, or about a month otherwise). The K1 may save you a couple of months over the I-130/CR1, but you will still have a lot of money to pay and restrictions on what you can do until your AOS is processed. Also the time until you can start counting for citizenship is delayed until you have residency, so that's about an extra year or so with AOS, but starts the day you arrive if on CR1.

Either way only the two of you can decide what way to go.

Good luck

Lyn

All I will say is good luck! When are you planning to go back?? I can't see that your K1 will be processed before June - sorry to be harsh.

Thanks, it's ok, we were just shocked that they were processing K1 visas from March 2007, it really does seem ridiculous but we are coming to terms with it now I suppose. I was planning on going back in March, was hoping to stay for a couple of months at least. I was reading the stuff about needing to take documentation to show intent to return to the UK but this will be a problem for me as I do not technically have a job just now as I work online for myself , just finished college in Jun 08 and I stay at my Dad's house in the UK.

Did you say you were refused entry before?

Hello,

I asked this question on somebody elses thread but though I'd start a new topic as this might be easier. I have spent about 154 days in the US in 2008 under the visa waiver program (came back for 2 weeks in between) and we got engaged in November. I am back in Scotland now and my girlfriend is getting ready to send off the K1 package on Monday. We were planning to get married on 26th June 2009 but this doesn't seem realistic having read a lot on this very helpful forum. Can anyone tell me whether or not I am able to still travel to the US to visit my Fiancee while the K1 process is underway and how long can I stay for in total over 2009? Obviously I don't want to affect the K1 process but I've only been back 1 day and missing her already!!!

Any help would be much appreciated. unsure.gif

Looks like I made the newbie mistake of asking the most common question which is already answered on the website!!! I have had an answer on this on another thread, apologies for the time-wasting!!!!! blush.gif

K-1 Fiance(e) Visa Process & Proceduresproof of income

I'm at my wit's end. My partner is currently here in the UK with me visiting for 6 months so obviously has no income therefore cannot provide proof of income. I was intending on living off my savings of several thousand pounds plus we have been promised support from both my parents here in UK and his parents back in NE until we marry and I get work permit. We also have offer of somewhere free to live as a friend of his family owns an appartment she doesn't use. Obviously he would get a job once he goes back. I know I would have enough to live off for at least 12months on purely savings as our only essential outgoings would be food. Is it worth me even trying for my K-1 or should I just accept the fact that it's a non starter. We are options and the desperation is getting unbearable.

could have maybe found a lawyer willing to help with the co-sponsor application.....wish me luck!!!!!!!!!!

Well thats everything filled out and almost ready to go. Did it ourselves and boy are we proud. Followed all the VJ guides and I must admit it was easier than we thought...maybe bit too easy which is worrying. Getting passport photos taken today then copying the whole lot and away it will go to Nicks mother who is adding in a copy (by the way does this need to be certified?) of his birth certificate and she is getting a money order to pay for it as they wont accept my UK checks and nick doesn't have any here in scotland with him to send. Then she is sending it onwards. ETA Nebraska Service Center.......3rd-5th July. Hopefully filed before charge goes up.....fingers and toes crossed.

Obviously as Nick is here in Scotland with me and not in work we were wondering if we should include a wee statement saying that we already have found co-sponsors for the support issue and that he is intending to find work when he returns to Nebraska in December. Was just wonder if anyone thinks it would be a good idea, we know the support issue doesn't really kick in until the I134 but if it may help our case to mention that we have thought about and discussed the financial side of things.

K-1 Fiance(e) Visa Process & ProceduresAttorney Recommended ?

Hello, I recently spent a month in Minsk, Belarus with my fiancee...and I wanted to know if anyone recommends getting a attorney who specializes with K-1 visas or is it better to just do all the paperwork myself. Any suggestions and/or recomendations would be greatly appreciated. Thank you for your time and support in this matter.

a couple of days ago I was in the same dilemma and the kind people here on VJ gave me great advice. I ended up doing my paperwork myself and it wasn't as hard as I was expecting (should that worry me) it was time consuming more than anything. Each case is as individual as the people. It depends on what makes you more comfortable. We took great comfort in knowing EXACTLY what was going on the form and being able to double check and triple check them. My forms went off in the mail this morning and it felt good, great infact. Now the long wait begins along with much hoping and praying. Hoping to be there for my birthday on 27th Jan, though I think thats bing a bit too hopeful. Good Luck to you.

Earlier today I called the USCIS for an update on my case, and it will be 90days this October 3rd since we filed it, she said if there is no update on our case by October 3rd, call them back and they will do some sort of thing to the case.

I forgot what it was called or what happens, but that is what she said.

Has anyone else heard of this before?
It is my first time hearing about it

ok you really need to let me know what happens....I'm only few days later than you. I'm not getting hopes up though, kinda getting used to waiting and kinda growing fond of the company I get from the wee black cloud that follows me everywhere!

K-1 Fiance(e) Visa Process & ProceduresI am a college student, does that affect me applying for a K1?
I'm in a kind of similar situation. My US fiance has been in Scotland with me so has not been working. Prior to this he was a student. I am using a member of his family as my co-sponsor. The only thing I'm panicing about is the fact that as he's never earned enough to file taxes he never has and some embassies (london very much so recently) seen to be obsessed with getting tax returns. I am also showing that I have around $12-13,000 worth of savings to live off. We are getting a free appartment from the same family member until we find our feet which we are also using towards support stuff as we won't need to worry about rent!

Rebeccajo. I tend to agree with you. I believe something like this came up in a thread months ago when we discussing reasons why Cuban requests seemed to get faster treatment for NOA2's. Cuban's tend to get their NOA2's faster due to the amount of time it takes on the other side. So I believe this is indeed normal for cuba.

By all means call your rep if you feel the need to but maybe do some digging for info first. I'll try to dig out the thread that this came up in.

I wish you success in the rest of your journey.

I was lucky, Nick spent alot of time here in Scotland with me. We both find the seperation tough after so long together. I'm now at the point I'm waiting for my packet 3, my medical is booked for jan 11th. It's a nightmare that they wont let us here in Scotland go to Edinburgh consulate or have our medical up here. Means 2 fairly costly trips to London.
It is a really long process made even longer by delays and poor planning for the influx of pre fee increase cases. Hopefully I'll have my interview date by the time I have my medical and we'll be able to see the light at the end of the tunnel!

my packet was smaller than most people I talked to. It covered all the bases but didn't include as much bulk as some people. It was so much smaller than other peoples I was almost certain I'd get an RFE...I didn't and approved within the average time.

To most people at USCIS I know it sounds harsh but we are all just numbers.

We did consider asking friends but were worried about putting a strain on those friendships, it looks like we don't have to worry about taking that risk, I just wish we had been able to do all this two years ago, he was making good money then, there was no IMBRA, it would have been so much easier.
