To answer the original posters question, people are correct. 5 months is the guideline right now (it has been less in the past, but loads shift throughout the year). Just relax and you will get it soon :) June filers are currently getting their NOA2's at the CSC, so you shouldn't be too far behind. Best of luck!

here is my point: I 130 leads to a complete green card for your spouse with a timeline about 12 months.
I 129 leads to only a temporary visa for your spouse with a timeline of about 7 months not
to mention more $$$.
When you do the math it comes out that the K 1 visa is kind of lame, that's why I would go I 130 if I had to do it all over again. I heard some I 130s get processed much sooner than the I 129s. The longer they stretch the timeline for the I 129, the less sense it makes.


yeah, can see your point - the money seem better with the i 130 - but - we didnt want to be married and apart - we've been living together for 3 years, in different countries working together, so being separated while engaged then getting together for our big day would be better for us, than trying to plan the wedding and visa app, then getting married, then 'see ya!'

knowing that when we get together we get to do last few wedding things, then get married (YAY) and get a flat together, is the thing that is making the process bearable....

thanks to those of you who have let me know that this waiting game is the norm...

and to those of you who seem annoyed about me asking if it's the norm, obviously, i have looked at as much info as i can, but a time line or a rough idea on a web page is no way near as informative or comforting as hearing from real people who have experienced this, so please, don't get pissed that i may be asking a question that you already know the answer to.

we're all in the same boat of being separated from our loved ones and someone taking time to reply nastily to a question they could easily ignore doesn't help anyone.

i think we can all agree that info on every website differs from every other website and there are no definite answers so getting as many diffeent answers means that i can see (the tiniest!) glimmer of light at the end of the (heartbreakingly difficult) tunnel!

you are still within the 5 month mark and unfortunately they are avg about 5months if not more this time of year. So just relax you will hear from them soon. good luck the rest of the way. Also the california svc center will not be contacting you about the interview they will notify you of your NOA2. you wont get any interview details or info until after your receive your NOA2. :)

getting involved with this site is quite reassuring, knowing others are going through / have sucessfully gone through this ordeal!

My American fiance and I have been waiting since July 16th when we got our first NOA, and having filed with California, and their average time being 5 months, we thought we should have heard from them by now.

Can anyone else tell me their experience in regards to time between NOA 1and 2? I was hoping they'd contact us about an interview etc but so far, nothing.

The conflict comes from two things. One, USCIS has nothing to do with VISA issuance so nothing they say relative to their purpose in the K-1 process has anything to do with consulates.

Most consulates DO NOT require an "affidavit of support" meaning an I-134 or I-864 but DO require that you prove that your fiancee will not become a public charge. The I-134 affadavit of support is a handy way to meet your obligation BUT the form is not required per se.

DO NOT go into a K-1 interview without the ability to prove you can support your fiance(e)


yes, absolutely, no way am i going to the interview without EVERYTHING!!!

I have lots of proof that i can support myself ready, and now it is my fiance's turn to get all his stuff ready to prove he can support me, as he's the applicant

I wanted to know if the form itself was required, as we've been living / working together abroad for the last 5 years, so he doesn't have tax returns etc from the USA and have been trying to figure out how to prove his ability to support me, without the 'normal' things most people have!

we've applied for the w2 form which seems to be the form you complete if you dont have tax returns, but i've read that at least one year of tax returns is obligatory, so not sure where to go from here - i dread the thought of being in the interview and they say 'no' to a form or document and then i dont get the 'pink slip'

any info from those who've not been in the USA form the last few years before their application would be much appreciated - he's been in the us, in ca for 5 months now, working, but other than that, his last employment in the US was at college, about 6 years ago!

cool - thanks - that is what i thought, but when i found conflicting info i thought i'd check in case it was correct - i have read so much about so many aspects of the visa that it is just a jumble in my head...

They will ask for the I-134 at the interview. They will most likely not approve your visa without it. They need to see you can be supported before they let you in on the K-1 visa. You will also have to file the official I-864 Affadavit of Support when you adjust status.

sorry if this question has been asked a thousand times before - i know there are a number affidavit related questions here and i have read all i can about it, BUT, i found (somewhere online - i'm not sure where now, but somewhere that seemed like it knew what it was talking about) this -

"Affidavit of Support For Fiancé(e), Spouse, or Child as a “K” Nonimmigrant
If your relative is either a “K-1” fiancé(e), a “K-3” spouse, or a “K-2” or “K-4” child of fiancé(e) or spouse, you do not need to submit an affidavit of support at the time you file your Form I-129F petition. Instead, you should submit an affidavit of support at the time that your fiancé(e), spouse, or child adjusts status to permanent resident after coming to the United States."

i am wondering if anyone has experienced the interview at an embassy - london in particular as that's where i'll interview - and NOT been asked for their petitioner's affidavit of support?

i have many documents about my financial status, letters form bank , accountant, broker which shows i can suport myself whilst waiting for change of status after marriage and my fiance is getting his together to send to me, but now i wonder if it's required for the INTERVIEW, or if we can present them only at the time of CHANGE OF STATUS??

any info would be much appreciated

hi

does anyone have the number for the visa 'helpline' - not USCIS or NVC, but a number for in the UK?

i had it and have lost it and cannot get it anywhere! It's premium line, costs £1.20 a minute, but they are able to definitively answer queries - not about specific applications but about filling in the forms and what is needed - i called querying police checks and the guy was super helpful and knew the answer immediately

Help a dafty who lost the number....

I have applied K1 visa but my interview letter doesn't say anything like above,,its just date and time. my interview in 23rd jan, london


hmm that's interesting.

we decided to take photocopies of everything submitted to them (just to be safe), personal 'stories' and some photos. plus passport, photos, entrance letter..

our lawyer says they only recently changed their policy to requiring 'original' versions of stuff, and that we shouldnt need the originals of the financial information.

Hi there,

This place looks really useful and i've read some of your threads about what happens on the interview day, advice on the interview itelf and so-on..

but i still have a question about what to take.

My wife is American, i'm from the UK.
The letter says - i must bring any documents that:

- were requested and weren't submitted ( as far as i know all were submitted, no further requests )
- bring medical examination results ( as far as i know the knightsbridge doctors sen the embassy these, i have no copy )
- bring two photos - OK NP
- I1864 was filled but income tax extension was NOT used in lieu of a tax return ( so no need to bring that )
- Passport

- and it also says to 'note even tho the applicant may have provided the NVC with a copy of the document you must bring the original to the interview' ..

I have provided all the documents that were required, and they have already received original copies of birth, marriage, court records, police certificate.

looking at the letter's list of items requested and the items marked 'Y' (requested document has been received) as opposed to 'O' (for original document received) the only things they dont have originals of but have copies of are: the application parts 1&2, and the financial evidence.

sooo, what do i take?

passport, 2 photos and.. ? maybe originals of bank statements?


anything else?
our lawyer told us to bing some proof of our relationship, 'our story' and photos..
