When I became divorced some yeas ago the Family Court sent me a "Final Divorce Decree", dated and signed by the Judge.

 

I thought that was "proof of divorce" and so sent what I had been sent.

 

Now I find that there is a special form that must be purchased here in NH for $10.  The clerk assured me that was the form that the Manila embassy/consulate wanted.

 

So this is just a heads-up hoping to enlighten others that might fall into the same trap.

 

I image that this has been posted here someplace but neither I nor Juliet never came across it, or perhaps we did and never recognized that I had the wrong form.

 

Now we have to wait another week or two for the form to get there.

 

Though this will give Juliet adequate time to fill an extra suitcase or two with her favorite dried fish.  (For those who might not know those from the Philippines only eat dried fish and rice--well, maybe a banana or coconut on occasion... devil.gif )

 

Do you think I will get an rfe for sending the final divorce decree even though it has the gold seal and signed by the judge when I sent it with the I-129f?   This was the actual copy given by the court to me after my divorce.

Over the past 16 months that me and my fiancee has communicated is basically a mix of facebook, skype and facetime.  My fiancee posted  on her facebook wall the screen shot (via Skype)of me and her over the span of our relationship with loving comments on the side and liked by our friends.  The good thing about facebook is that it shows the date and year it was posted plus our pictures skyping is showing :)  .  For our Skype chat session (which we don't use much since we use the voice part) I use a software called Skypeview log.  It can retrieve all the Skype chat done depending on the range of date and also copy and paste this as html for easy reading.  

 

We have hundreds of chats and I don't think there will be enough time to read all of them . As what have been said before just pick a few;  Quality over quantity.  What I did when I submitted the I-129 was  to include at least twice a month of chats from facebook, some skype sessions with our pics together posted by my fiancee on her or my wall, some email, and some google voice log showing calls I made (we were using google voice early on but became too expensive).

I am not an immigration expert but I thought the whole purpose of the fiance visa is to get marry within 90 days to your USC fiance'  from the time you arrive in the USA. The visa will cease to exist past the 90 days and could be a problem if he reports you to immigration .  I don't know if you can switch visas that easily.  Probably your best bet is to consult with an immigration attorney in this matter if you want to stay .

K-1 Fiance(e) Visa Process & ProceduresGot letter of RFE : questions and suggestions

I got a text notification last week that TSC sent an RFE on our application for K1.  I got the hard copy today and the RFE is that I forgot to answer the Criminality question on the I-129f application Page three Part C question number 2 (see attach RFE letter).

 

1. Do I have to resend just the letter itself answering NO on the space provided, sign it and send it to TSC? or do I tick or put an X on the No?

 

2. Should I just send a copy or the original?

 

3. Assuming this is all that is missing before USCIS makes a decision on  our  I-129f, I want to accompany my fiancee on her interview at USEM but I won't be able to take my vacation until Feb. of next year.. do I delay submitting the RFE until November or  December  or send it now to TSC? It says I have 84 days from receipt to respond to this RFE.   In short what I want to ask is how many months maximum  from the time the I-129f is approve that the interview must be scheduled.

It is a good idea to have a duplicate copies of the docs  you send USCIS but not required.  The letter of intent to marry for both couple must be original.  To avoid any RFE on it, make sure the letters do not look like photocopies.

Just seem odd to me, i have all of the documentation that I went there via plane tickets passport entries etc... but pictures seem to be the best proof..... as it was with her and her family..

 

Did you include the names of all the people in the picture and her relationship to that family member  ? When you presented yourself on those pictures did you write your full names as it appears on your I-129f and G-325a forms?It is definitely odd that they did return the pictures .   Now this worries me coz I sent at least 20  4x6 printed on a photopaper .  I just hope we don't get an rfe.   Good luck and keep us posted.

We received our NOA1 for a K-1 in August and were getting really excited the people filing around the same time as us were receiving their NOA2. Just got an email update today that we're being sent an RFE sad.png I was extremely disappointed! I'm not sure exactly what it's for yet, but it seems that most people receive them for lack of evidence on having personally met in the last 2 years. I sent boarding passes and pictures. I thought there was no way we would get an RFE because of the circumstances under which we met....

We were both employed on the same cruise ship for a year. We were in the same place everyday for a year! How can you need an RFE?! You don't get more proof than that!

Is it possible they're sending us an RFE for something else??

 

It could be for anything.  I got an RFE September 30.  I received the hardcopy a week later.  Turned out I forgot to answer the criminality question on the I-129f application form !  Until you get the the letter of RFE from USCIS,  it could be about anything.  Don't worry too much.  One good thing is your case is being worked upon .  Once you have submitted the evidence they want and satisfied their inquiry, you're not that far off from an approval.

I used LBC air to send her documents.  Don't know if there is an LBC in Florida.  But you can also use FEDEX or DHL.  Took about 5 days from NJ to  Davao City Philippines.  Cost me around $40 .

I am assuming he got an email, text or checked the status on USCIS website about your case that TSC is requesting further evidence to continue with the petition.  Until he gets a letter from them it is hard to know what they need.  We got an RFE too  for not answering one question on the I-129F application.  Two weeks after we submitted the request, the petition was approved. The good news is your petition is being processed and once you submit what they want, they can make a decision on your case.  Good luck.

So im just finalizing my I-129F papers and ive come to a halt regarding the dreaded None or N/A questions, after reading many posts about which is better and how they both have slightly different meanings, some say you shouldnt leave boxes blank at all. I then found some information on the instructions for the I-129F that i overlooked previously where it states;

 

''Answer all questions fully and accurately. if an item is not applicable or the answer is none, leave the space blank''

 

Straight from the USCIS form that expires in 2016, should i go with leaving the boxes blank as i am told to or do i fill the boxes to the best of my ability as a lot of VJ posters have stated to do so?

With that latest form you just leave the space blank if the answer is none or not applicable.  Just be careful with Part 3 question 2.  That cannot be left blank .You must tick the applicable box.  When I filled out the I-129f form I left it purposely blank .  We ended up getting an RFE for that one and delayed our approval for about 3 weeks.  Good luck.

I got an email from the uscis saying that additional evidence is required !? I know I have to wait for the letter.
But my question is when I send the passport I only send the first page and two other pages showing the visa entry stamps , now should I have send all the passport pages so they know it's my picture !??? Or it could be something else ? I did not send photo but we did big party and I have pics ! I also send them the ring recipet . I went to Egypt two time in less than 4 month and I have stampes to prove it . ..........??? Just so worried and concern anyone like my case

 

It is hard to speculate what the RFE is about without the letter from USCIS.  We got an RFE too for me forgetting to check a box on the I-129f... that delayed our approval by 3 weeks!  The good thing is your case is being processed and it won't be long now before it is approve once you satisfy the RFE.  As for the passport I sent every page of it .  Good luck.

Oh, and one other question.  On the I-129F Supplement page I needed to have a few things on it.  There wasn't room for my fiancee's address, so I had to include that twice, and then I have 34 a. regarding how we met.  My question is if I should put all of the supplemental answers for this form on one page or should I put the part of how we met in person on a separate page by itself?

 

This is how I did ours...  on  34a I typed: First meeting xx-xx-xxxx.  Second meeting xx-xx-xxxx.  See attach paper marked as I-129f.  Then on the attach paper I dated it and explained how and when we met as well as how our relationship started.  Then I signed it at the end.  Just a small paragraph .

Hi everyone.  I'll start out by saying again how great this forum is.  I have tried to call the help-line and as I'm sure many of you know, it's not much help at all!  Almost impossible to even talk to a person. 

 

I have a question as I work on the I-129F and showing proof of the ongoing relationship.  We have communicated daily mostly via Viber (an app that allows chat and calls), Facebook, and Skype.  My question is, what is the best way to show proof of that?  After exporting the conversations and call history from Facebook, Viber and Skype, and editing them to be a smaller print and in two columns, I still have nearly 500 pages of conversations.  Should I print that and send it all?  I'm thinking that might be a detriment since I know we want to make it as convenient as possible for the people that approve things, but does anyone have any insight as to how I would want to handle this? 

 

Also, if we really are only able to communicate online and through calls and video, are there other things I might be missing to show that we have an ongoing relationship?  I could show the few conversations I've had with her siblings, and receipts from gifts I've sent her if those would help.

You don't need to submit the proof of ongoing relationship at this stage but it does not hurt to front load your petition especially if the beneficiary is from a country where there is a high rate of visa fraud.  For the I-129f stage all USCIS is asking is proof of meeting within the last two years.

 

If you are submitting Facebook or Skype chats, don't submit everything.  Hand picked a few, those that shows a loving relationship between both of you.  Other things you can submit are gift receipts, email logs, pictures of you together (including pics of you and her family),  greeting cards.  Good luck.

my petiton was approved on last october 21 and it was said that as soon as my petiton approved they will sent it to NVC..but until now it hasnt written in my case if they sent it already or not...

Welcome! Give it some time from the time the petitioner receives the hard copy of the NOA2 approval.  Call the NVC number found here : http://visaconnectio...ilippines.com/# . CSC seems slow at forwarding the papers to NVC from what  I have read in this forum.  My cousin who also filed a petition for K1 and has the I-129f processed by CSC  just got the MNL number last week after 5 weeks of waiting.

I won't be able to provide a letter from my employer. I will send a letter from my union hall showing my good standing for our work list and my position ( journeyman). I meet all the requirements. I have 4 yrs of tax transcripts. plus pay stubs from current year. Will this cause any problems?? Also. I just received my nvc case number over the phone and my packet is in route to embassy. the Word files were ok for USCIS though, we got approved 

 

Chats are only one of the secondary evidences of an ongoing relationship.  USCIS might approved of it but in the consulate level, from what I have read in this forum, it is a different ballgame.  They seem to scrutinize evidences  more and they have the last say whether to issue the visa or not.  IMO the interview is where the preparation is critical. However as long as you have a genuine relationship you should be OK :) .

We are also preparing for my fiancee's interview.  What I did was to print screen the chat so that it will show the date and time of our chats. We have thousands of facebook chats so I just chose like 3 different days, about 6 pages per month.

Hey guys I just received an RFE and its not a big deal I just forgot to answer question about my criminal history on Part 3. Information question # 2 in my I-129F. I also received a sheet in which it states to answer "YES" or "NO" to that question and my signature. The instruction sheet does not mention to have the page from I-129F so I just wanted to know do i need a page from the I-129F form or just the sheet that I was mailed from USCIS? 

 

I got the same RFE.  You dont need to submit the I-129F.  All I did was send a copy of the letter they sent and check NO as my answer (or whichever is applicable in your case.).

We used the new version of I-129f  and on the USCIS site there's an instruction on how to fill out the new form. Well it says that if your answer on any of the questions' N/A or "NOne" leave the space blank. We are about to send our packet today but confuse if we  leave  a lot of blanks!!!!My fiancee wants to follow the USCIS instruction .Now I'm worried because im reading in here that the number 1 rule in filling out forms is to never leave blanks!!!!Should we leave it blanks or put N/A to all the boxes that are not applicable ?

 

I used the new I-129f too to petition for my fiancee.  I hope we don't get a  RFE for leaving questions that are N/A or None blank (just following the form's instruction).

As per instruction of the form I-129f downloaded from USCIS website it says if the question is not applicable leave it blank.  However be careful of the question on Part 3 question number 2 about the criminality question.  I got an RFE for leaving it blank.  That has to be answered with a Yes or No answer.

As long as you can legally marry, you can file for the K1 after divorce. There are no set rules when to file it . I filed 6 months after my divorce was finalized. We had no issue during the process and my fiancee visa was approved recently.

As already been said the USCIS stage (I129f) only requires that you met your fiancee within the last 2 years. The proof of ongoing relationship will be needed more towards the interview phase. My experienced may or may not be applicable with yours since no two cases are alike. When I filed for my fiancee K1 visa I did include proof of ongoing relationship since I was filing at a high fraud embassy and have some potential red flags. I submitted photos, relevant facebook and skype chats , plane boarding passes for the travel we made together, receipt and photos of Valentine gift I sent her and a few email. I was present during my fiancee's interview and witness how the consul did not even bother asked for any evidences that we brought at the embassy . All he did was look at the original documents / proof I submitted and asked my fiancee a few questions from those. No photos or chat logs were asked. I guess he was satisfied what I submitted during the 129f phase. YMMV!

I agree with what Tahoma said.  Although it is not required and your miles may vary, front loading especially when going thru Manila embassy will be the safest bet.  When my wife (my fiancee then) was interviewed at the embassy ( I accompanied her and can here the questions), the consul asked questions based on what I sent them on the initial 129F.

I got an RFE for not completing the criminality question of the I-129f (page 3 part C question 2).  I want to mail this RFE as soon as possible but I am not so clear how to answer it.  It says to indicate a Yes or a No answer.   It looks like I have to either place a check mark or an X mark on the provided space but I want to make sure I do it the right way. Or do I write NO on it?  Has anyone been on the same situation before?  Thanks in advance.

Congratulations :)  .  Finally they shipped it!  But wow why it took  so long.  Call within a week or so. NVC has to processed it and assign you a number.  I noticed the day I called NVC when they rec'd the files and  have the MNL number, I was asked  for the beneficiary's name and d.o.b as well as the petitioner's. Before that, each time I call them they asked me what it says on the NOA2 letter.   Keep us updated. Good luck.

I guess it depends on the availability of interview slots in consulates because until now even though we are from tsc and noa2 october 24 our case was not shipped to nvc as well.

 

 I just booked my fiancee's interview at USEM online. Right now earliest available date is Jan 28 ( 4 slots available).  I also saw whole month of February as well as March available.  The dates I chose and the day  I finally decided to schedule has about 20 slots open. I don't know if these available days just opened up and that means you will get your MNL # soon. :)

All you have to do now is wait for the case number from NVC.  USCIS will send another update that they have send the approved petition to NVC.  Once you have the MNL number, pay for the $240 (Philippine peso equivalent) fee at a BPI bank in the Philippines.  Within 4 hours of payment you or your fiancee can schedule online for the interview.  She can also start her medical at St Lukes once she have a confirmed interview date and fillout the DS160 form.  For more info follow the guide here : http://visaconnectio...ilippines.com/#  Good luck.

Hi everyone! Wanna ask some question regarding K1 Visa. My Fiance/Bf got a Letter from National Visa Center with case number. Was this means I could pay Visa Processing Fee and Could schedule for my Medical Exam? But haven't get any Notice of Action yet, I'm so confused. What are difference of National Visa Center case number and Notice of Action 2 with case number are they the same? Shall I bring the original copy of my Fiance Divorce Decree on my interview or only the photocopy/xerox copy of His Divorce Decree? Please, help me find the answers. May God Bless us all!

PhilippinesNOA2 and beyond questions

Hello everyone. First time posting under the Philippines forum and hopefully this is the right place for my questions.  I received the hard copy of our NOA1 yesterday.  According to our timeline, estimated approval is between last week of November to December (assuming no RFEs) of this year.  I know the road ahead for the visa has just begun but I just want to plan ahead.

 

After reading the forum, some people were being denied  visa at the Consulate level even with tons of proof of ongoing relationship.    I have decided to go with my fiancee during her interview and I think this will be the best proof to show a true relationship.  Unfortunately my job will only allow me to take three weeks vacation and I can stretch it to a month.  However I need to leave some vacation days for our wedding.  

 

These are my questions:

 

1. From the time of Noa2 approval how long before we can schedule an interview with the  USEM? What is the average wait?

 

2. How many weeks should the medical be schedule prior to the interview?

 

3. I don't think my fiancee has any records of vaccination, will this add days to the medical or can the vaccination be done in one day?

 

4.When her visa is approve by USEM, how many days before we get it?

 

5. Do you think three weeks is enough to have all of these (including the CFO) done that she can fly with me to the US?

PhilippinesLONG DISTANCE RELATIONSHIP

LDR is definitely a challenge but doable.  We have been doing this for the last 16 mos and it is not fun not to be physically with your love one. We started with facebook chat, then Skype, Tango... and since Nov. of last year Facetime and chat  exclusively via Facebook.  We still use Skype but we find Facetime to be convenient.  She can call me when Im on my break or lunch time at work and we chat..  Lol I think our average chat time everyday is at least 6 hours .   We dont run out of things to talk about since I grew up in the same province as she is from and I can relate still to most things from my old hometown.  

 

With LDR constant communication, trust and more communication are a must to keep the relationship going. Just cannot wait to be with my babe again :) .
