IR-1 / CR-1 Spouse Visa Process & ProceduresTime related question - Married to an American abroad
DCF would be the best way to go IF you are intending to live and settle in the USA. If you are intending to stay where you are, then your green card would probably be revoked since you are not having residence in the usa. If you want to visit the USA for a temporary stay, then you have to get a tourist visa. All you will need to do is show strong ties to your home country (such as letter from employer, leases, bank accounts, etc.) and you shouldn't have a problem getting a toursit visa.
DCF is a great process, and I just finished it myself, but please wait until you are actually ready to move to the USA before you start that, or you could end up in trouble:)

There is no point in refiling for the K-3 you still have the CR1, and right now they have a fraud marker against you. They will not issue a visa until this is resolved. This interview was for the CR1, correct? It sounds to me like you had no evidence of a real relationship. You didn't save any history? Why would they believe you? You need to place yourself in their shoes. If you had a case that you had to decide on, and the couple can't even prove they talk to each other often, would you believe them? This is the reason they asked you questions that you could not answer. They just plain don't believe you. You must understand, the consulate isn't trying to prove that your relationship is real, they are trying to prove that it isn't real. You must keep that in mind, and make sure you are prepared to show it is real.

Your not totally lost, but you had better get busy and start saving your history NOW! This will go back to the USCIS and they will send you (after several months) a Notice of Intent to Revoke. Your wife will need to respond. At that point she had better have tons of evidence of a valid relationship or they will revoke the petition. Just plan on another year or more, it isn't quick or easy.

Thankx alot morocco for the reply, I have provided every single thing I had, EMAILS, PHONE BILLS, PHOTOS, MSN CHAT, now I dont have anything else to prove...I dont know what else they want to know.
Anayway...you are right that there is no need to start another K3, I will wait and will see where this will endup....

Thankx alot....

Folks Count me as well, my vote is with you

Hi folks, last week they again called me for the interview and after interogating me almost 30 minutes they refused my case and said that they are going to send my case back to USCIS and also got all my submitted evidence and documents back along with the same horrible blue sheet 221(g) mentioned reason "Recomandation revokation" something like this.

They asked me again lots of personal questions yes no doubt few of them I missed but I answered most of questions.

Anyway can anybody guide me what to do next, can my wife file a new case or it is over...? what to do ....

I dont know what type of evidence they require, she said, all the emails you provided to us is one sent by your wife to you, there is not email evidence you sent to her when I said that we never send to many mails to each other and specially I never keep the history in my mail box and when ever I need to talk to her I dont send her mail, I always a phone call and have some chat, I gave them my telephone bills. I gave them what ever I had to prove that our relationship is real.

She asked me my wife's previous husbands COMPLETE NAMES their date of births and how long she married with them( I mean these types of questions are really really beyond the case, why should one will know his/her privious life may be he/she is not interested what ever has happenend before)

anyway the above questions were just few of those horrible quesitons I have been asked.

I mean I am in a big mess, upset as well dont know what to do...

One of friend suggested me to apply for K3 again any other suggestions please welcome....

GOOD LUCK TO YOu...

IR-1 / CR-1 Spouse Visa Process & ProceduresWho else got 81807(DS-230)
Hi, I just want to know is there anybody else who has been asked to fill DS-230 form, actually we applied for K3 first where our I-129 rejected but luckily our I-130 approved, I got the choice of agent form also and after that my wife got some other forms in which she was told that this was the last documents after that we will send your case to overseas where I am living, but again they sent my wife DS-230, just curious how many forms are left and is that a normal procedure or some mistakes we have done in following the process.

Thanks and best regards

IR-1 / CR-1 Spouse Visa Process & ProceduresName issue
Folks, my I-129 applications refused due to some unknown reason but my I-130 app got approved and went everything fine then we received DS-230 form after I-130 approved and submitted that one also, now everything has been done, my wife in states got a notice to supply my documents metioned below.
  • Police Certificate
  • Birth Certificate
  • Biographic copy of my passport
Q1:
Now I just figured out that on my Passport my father name is Chaudhry Abid Ali Aslam where as while filing the G-325 and DS-230 I by mistake put only Abid Ali Aslam and forgot to put Chaudhry(actually we never use chaudhry name normally and this is the reason I missed my father's first name basically its just a cast but obviously is the part of his name), so plz tell me what should I do, coz when they will see the copy of my passport having my father name Chaudhry Abid Ali Aslam might cause the problem, plz guide me as what should I do to cope this situation.

Q2:
They asked my birth certificate which is in URDU coz I am from Pakistan, can I submit my birth certificate issued and attested by Pakistan embassy in Saudi Arabia basis on the orignal verifying that info is correct and everything is ok.

Seeking for the suggestions, plz help...thankx....

Philippinestipping government workers
Government employees are being paid for their jobs, giving them anything to make a speedy process is a derogatory action.
You might think it is just a part of being generous in some ways but other people will not think the same way.
Albeit it is a trend in some countries, including the Philippines where bribery is a rampant trend to make everything easy, still, it is inappropriate to tolerate such actions. mad.gif mad.gif mad.gif

I was just wondering how long it takes to get your NBI clearance and CENOMAR in the Philippines. My Fiancee's K-1 application is going through much faster than anticipated and I want to make sure we Have everthing ready for her interview.

Thank you

hi there...for NBI, releasing will be same date of application..if she applies in the morning, she gets it in the afternoon unless her name is on hit status ( another person bearing same name like ur fiancee with a case ), she will get the clearance after a week.. thats the SOP...my married name was also on hit... yes.gif

for the CENOMAR, in my city, releasing is after 5 working days.

One week for NBI with namesake? what the!! and 5 days for CENOMAR?

If she doesn't have HIT, it means namesake, she will get within an hour or two but if she has, she will come back the following day.
CENOMAR, it depends with the volume of people at NSO, I got mine after 5 hours of waiting.

I love that TV series. Good questions you got there, I'm thinking the same way too because I'm sure I can't find job for just a matter of month, it will take time I guess to find a job, especially at this time that America is in recession.
I'm thinking of helping my wife in everything I could. I'll do the household chores and I'll let her rest when she gets home and she doesn't need to worry about anything in the apartment.

I bet that you've been working most of your adult life.... so I guess better enjoy the long vacation.... and pamper your wife... once you started to work.... you're gonna miss the long vacation...

Cool!! how did you know that? I started working when I was 17 years old and I came here in Saudi Arabia when I was 20. This is my second company to work with after spending 7 years with the previous one.

Yeah, you are right, when you don't have work you want to work, when you got the work, you want to be on vacation.
I guess it's a part of not being satisfied with life.

How long does it take? Because I sent my DS-230 packet thru Express Mail Service here in Saudi Arabia on Oct.25 but until now the package is still not arrive in the US. I am worried that its lost. I hope not.

Thanks for any inputs. unsure.gif

I used to send mails to my wife thru PO but I only used registered mail. In my experiences, registered mail normally takes 2-3 weeks but there was one time it took more than that. I guess, the problem was I did not put USA on the recipient's address. I used one time the EMS in sending SPA docs, and it also took more than a week, but not more than 2 weeks. I think one problem also in Saudi Post is that there tracking (you can track online in their website) is within Saudi Arabia only. Good luck anyway!

Local Civil Registrar where you were born cannot correct or amend every error on your BC.
RA-9048 allows local civil registry to amend names with obvious typhographical error or the name is causing him/her embarassment because of the given name are having some inappropriate meaning in this modern time.

Why your parents registered you for the second time? They should have just file a petition for correction in your local court to amend the error.
Anyway, you can't do anything but to file a correction in court. I had my middle name amended last March this year and I got approved on April 13 2009. I got my new BC sometime on June but it was corrected thru the local civil registrar in Bicol because it covered in RA-9048.

I hope everything will be alright with, you should have done something for that long time ago before the processing begins.

You are talking about the Legal Capacity to marry, you can have it on the same day. My wife and I went to the Embassy early in the moring and just a couple of hours she got her Legal Capacity.

Yes, there will be a 10 day waiting for there are sort of posting and wait if someone will claim that your wife were married before in the Philippines. You are going to take some seminars as well.

Once you both get to the Philippines everyone in her family will help to facilitate your wedding. It's not a big deal.

As far as I know, there will be no problem if you are going to get married again in the Philippines, but try to double check and ask some people who are aware with the system.

In the Philippines you can marry your wife as many as you like. That is why some men, they tell their future wife that they are going to marry her in each and every church in the country.
