Make a list of all documents related to your relationship that will satisfy the consul during the interview that your marriage is legit and not just for immigration purpose.
Documents that shows your constant communication is very important, provide as much as you can, it won't hurt anyway.
During the interview, the consul might ask you one type of question formed in different manner not just once, twice or thrice, you must be very consistent, in some cases, one or 2 consuls will do the interview.

Good luck and wish you all the best!!

Your presence is not necessary during the interview, I am from the Philippines but I was in the Middle East during the whole process and my wife cannot travel to that country.
Biometrics will be done in the US embassy on the day of his interview. Good luck!!

No worries, most of your paperworks are already at the embassy during the interview and it has been scrutinized, just bring some copies of those documents just in case.
Bring photos that tell the story of your relationship, having family members on the pictures from both side is a plus. Proof of communication such as letters, cards and so on.

Good luck on your interview!!

IR-1 / CR-1 Spouse Visa Process & ProceduresDo you have to be in USA to file?
CR-1 or K-1 is okay, I suggest try K-1 for it's a bet faster (depend on your case though) compare to CR-1. Both should be filed by you in the US except if you've been living to Costa Rica for a period of time where you can file the petition at the US embassy but I don't thin k you do. You're wife can have a dual citizenship if she desires too and if Costa Rica allows it according to their immigration law but you, as US citizen you can't have a Costa Rican citizenship.

Me and my wife is having some arguement about the filing of my petition here in Saudi Arabia instead of going back to the Philippines, I told her that it can be done here, but she is keep on insisting that it's not possible. I don't want to go back in the Philippines once the petition is being processm, It's because I know it will take more time to get an approval and I can't stay in the Philippines without a job while waiting for the interview and the whole thing to get it done.

Please, if there's someone knows here or have experience just like mine, please let me know, I need to make sure that it's ok to process the petition here in Saudi Arabia instead of going back to the Philippines, besides I know the processing here is a bit faster than in the Philippines.

IR-1 / CR-1 Spouse Visa Process & ProceduresPassport Copy to be Sent
Hello Everyone, I just want to know if it's ok to send the copy of my current Passport to my wife in the States to include with the documents to apply for
CR-1, prior to the correction of my middle name in my next Passport which will be renewed on February 09,2010.

Because since 2001 when I applied to work abroad for my first Passport, I've been using the incorrect middlename, where the first letter is omitted.
My middlename name will be corrected upon renewal on February 2010.

Do I have to include my school records and medical records together with my annotated Birth Certificate and current Passport copy to prove that it's the same person though my middlename is different in my Passport.

My middle name is JUYAMAG but when I took the authenticated one in NSO it turns out that it was UYAMAG.

Good day to all, I find this forum really helpful it's because a lot of questions are being solve and given a clear justifications.

I would like to ask if I can fill-up the DS-230 in advance and send it to my wife in the States, even before we start to process everything.

My wife will file I-130 maybe later in the month of July, because I had a problem with my middle name it took one year for us to begin the processing, I already got my annotated Birth Certificate from National Statistic Office in Manila and send it to my wife in the States yesterday.

Can I fill-up DS-230 forms which I took from the web and send it to my wife now together with the G-325A?
What are the documents I need to send her to file I-130?
Is the G-325A with expiration on May 31,2009 is still ok to be used?

Please help,

Thank You very much!!

That is exactly what I did, while we are waiting for the NOA2. I requested tax transcripts from the previous 3 years from IRS and sent my wife the ds 230 and had her fill out the ds3032 as well and send back to me. Now we are all set for the NVC. good.gif

My wife and I knows each other from 2003, she was intruduced to me by my auntie who is her co-worker and I am working in Saudi Arabia since January 2001. We spent almost 5 years of our relationship without seeing each other. We had the plan to meet each other by 2007 but we didn't because it's hard for her to get a replacement in the Hospital but we made it on June 2008 when I resigned to my previous job in Saudi and that was the first time we saw each other. Due to the time limit for she has only 31 days to stay in the Philippines, we made everything rushed just to get married and also I got my new job in Saudi once again and anytime soon I will be leaving to Saudi. We got married on July 11,2008. July 27 was her return to the States and the date that I will be leaving to Saudi Arabia.

We didn't spend much time with each other during our stay in the Philippines, do you think it will be a problem during the application of my petition? unsure.gif

Hi don't worry you'll be fine at the interview. In my case we've known each other for 1 year and 1 month then he came to visit me spent 19 days on the third day he proposed to me and got married after we got our marriage licensed. Three days after our civil wedding he left back to the US, just last june 26 had my interview for cr1 had no problem and got approved. Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresPassport Copy to be Sent
Hello everyone,

Most of the timeline i saw in this forum took only 2 months before the petition get approved in NVC, and by the time your papers are forwarded to USCIS you need to be ready to submit the next set of documents, including the Passport's biographical data of the intending immigrant.

I have a descripancy with my middle name in my passport, because when I took my first passport in 2001, it turns out that the first letter of my middle name is not written. Due to time limit for I got my job abroad, I decided to carry on and applied for my passport and used the incorrect middle name.

When I got married my middle name was still unchanged, we just managed to provide some evidence to show the correct spelling of my middle name.
I filed for petition of correction under Republic Act 9048, and it was approved and received the annotated Birth Certificate last June 22,2009.

Until now I'm using that middle name in my current passport which will be expired on February 2010, but my wife might file I-130 by this coming month when she receives my Birth Certificate and signed G-325A.

Upon inquiry in the Phiippine Embassy in Riyadh, Saudi Arabia they told me that before they can change my middle name,Birth Certificate must be sent to the Department of Foreign Affairs Manila for authentication process before any amendment will take effect.

What if the time comes that I need to submit the Biographical data of my passport? Can I send the copy of my current passport which is the middle name is still incorrect along with some supporting documents, such as school records, certificates and medical records.

Will they accept it? or it might cause the delay of the processingor might get denied?

Please Help.. unsure.gif

Hey guys, I'm having hard time to understand the fact about getting a Police Clearance in places where you live for at least 12 months after turning 16.
I've been here in Saudi Arabia sinece January 2001.

When I asked the US Embassy in Riyadh, they told that if my petition will be processed in Manila, there is no need to obtain Police Clearance from Saudi Arabia.

But I noticed some of the members here are not citizen of that certain country but still they obtained Police Clearance.

If I will go back to the Philippines and process the petition do I have to get Police Clearance from Saudi Arabia?

However, you have a deadline to get married on a fiance visa.

Yes, I know.

But, the problem is that we just got engaged. and right now, he is in Saudi Arabia and, i am in USA. If we get married by phone, or through postal mail, or through an attorney....will uscis accept that as proof of marriage?

[b]As far as I know, they will not accept this kind of marriage, you and your fiance must be present during the ceremony. try to visit US Embassy website in Pakistan.

IR-1 / CR-1 Spouse Visa Process & ProceduresHiring A Lawyer
QUOTE (Dan & Juan @ Jul 11 2009, 02:34 AM) <{POST_SNAPBACK}>
My advice is based on my choice.
I hired a lawyer, I delayed filing for a month until i could gather things and look online and what not. My situation is that i hired a lawyer to be a lawyer not a secretary, I am not going to pay a lawyer hundreds of dollars to gather information and fill out forms, however i did a lot of the work myself and had her review and she prepared my I-130 packet to send in, and it was exactly what was required. i might have made a little different choice and front loaded, but I didn't mind doing the secretary work as long as she checked and checked and told me what to correct. If my case needs some lawyer advice she is there and knows my case, but if it sails through I didn't pay a lot of money for her advice, and I would certainly pay in the future if I need her. i think it is not necessary to have a lawyer to fill out clerical forms, and the guides here are very thorough and correct, but every guide and everyone on VJ does not know your situtaion only you do, so take the advice, but i would also at least talk to a qualified experienced immigration family attorney, it is usually free consultation.

Well, thank you very much indeed, I guess, i'll just let my wife consult her lawyer, besides no matter what we do, still we are prone to commit mistakes. Thanks every one.. kicking.gif

I dont think we should file the i-130 before he gets here in case the immigration officer gives him a hard time. (He has a B1/B2) Can I file for his CR-1 as soon as he gets here or is he not able to be in the country at all while filing?

Also what forms can I send with the i-130? G-325A for both of us, I know. But can I send the I-485 as well. I have all documents needed so I would like to file as much a I can together if possible.

Thanks

While reading some reviews in this forum, I think you can't file for Cr-1 Visa while he is in the States for tourist visa.
But if he is in the States for K visa or fiance visa, I think you can file for adjustment of status 90 days before your second year wedding anniversary, but i'm not sure.
