IR-1 / CR-1 Spouse Visa Process & ProceduresDivorce Papers
Good day fellow Vjer's,

Will NVC accept the scanned copy of Divorce papers for my wife?
Because she got only one original copy of it.

I am the beneficiary and I'm preparing now the packet for DS-230 to be sent to our atty. I already have my PCC,NBI, Birth Certificate, Passport copy and DS-230 forms, our marriage certificate will be sent by my wife to our atty including her divorce papers separately because I don't have the copies here in Saudi.

Thanks in advance star_smile.gif

If you are pertaining to DS-230 packet and you got all the required documents, send it to your spouse right away, it will save you more time until the time comes that you have to pay AOS and IV bills.

Make sure that you have the exact replica of those papers that you are about to send.

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling the I-130 Petition from outside the US
QUOTE (Ashes @ Oct 1 2009, 07:23 PM) <{POST_SNAPBACK}>
Hi Everyone,

I had originally posted my queries on the DCF forum but putting a new thread up here since I'm not eligible for DCF as I've just found out.

I'm a USC who has been married to my Pakistani husband for almost 4 years. We expect our first child in December. I've been living in Pakistan for almost 15 years now and unfortunately have just found out that I'm NOT eligible for DCF through the US Embassy in Islamabad since I originally entered the country on a visitor's visa when I first came. They've said it doesn't matter how long I've lived here - if I entered on anything besides a work or residency visa, I'm not eligible for DCF through them and would have to file my I-130 petition with the USCIS.

Most of the IR-1 cases I've reading about has the petitioner residing in the US and I've been able to glean very little information on filing a I-130 petition from outside the US. This is what the instructions on the I-130 say about filing outside of the US:

Petitioners residing abroad: If you live in Canada, file your petition at the Vermont Service Center. Exception: If you are a U.S. citizen residing in Canada, and you are petitioning for your spouse, child, or parent, you may file the petition at the nearest U.S. Embassy or consulate, except for those in Quebec City. If you reside elsewhere outside the United States file, your relative petition at the USCIS office overseas or the U.S. Embassy or consulate having jurisdiction over the area where you live. For further information, contact the nearest U.S. Embassy or consulate.
[/b]

My local consulate embassy has told me to contact the USCIS for further information. I've tried calling them but keep getting the runaround on their IVR.

I'd be grateful if anyone can give me ANY sort of input to my questions below:

1. What should I put as the address in the #2 field on the I-130 form which asks for my address? Should I put my Pk one where I'm living or a US one? (I have that as well). I understand this is where they will send all future correspondence.

2. If I do put a Pk one then to which lockbox should I send my petition to?

3. If I put a US address here would this look odd seeing as the last 15 years have been spent in Pk and that would show up on the G-325a where I'm asked to list my past 5 addresses? I will be listing my old US address here as well - where I lived before relocating to Pk.

Thank you again for any input you may have on this.

I wonder how did you spend that 15 years in Pakistan if you came with Tourist Visa only?
Albeit I don't know the law in Pakistan, you must have been deported within those years If you did not obtain Residence Permit or Working Visa. How is that?

And If you are not entitled for DCF, then I think you have to go back to the States and file the petition, but one thing I am not sure if you are allowed to that for you've been living in Pakistan for 15 years and you don't have US domicile, I guess.

Which state do you intend to live in the States?

IR-1 / CR-1 Spouse Visa Process & ProceduresSend DS-230 Direct to NVC Bypassing Our Lawyer
Hey guys,

I'm preparing the DS-230 packet here in Saudi Arabia to be sent to our lawyer but I'm still waiting for the NBI from the Philippines to make i complete.
After seeing the timeline for Shiela&Todd, I was wondering, can I just send the DS-230 packet direct to NVC and bypass our lawyer? or it will cause delay?

Thanks in advance guys!! whistling.gif

Hello everyone,

I just payed by AOS bill. I understand that I must wait 2-3 days to see if the payment has posted or clears. Can anyone tell me what the next step is in the CR1 process?

I will read the guidelines but just thought anyone that has gone through this process may offer some tips. Anyone out there going through the CR1 Visa, Cairo, EGYPT?

Any tips, ideas and/or suggestions will be appreciated.

Thank you.

Liz and Mohamed

Now that you have payed the fee you need to wait until the payment clears and then you can print the coversheet. Once you have the coversheet you need to collect the documents for the AOS packet. These documents include the I-864, letters from employers, paystubs, tax returns and or tax transcripts, and any co sponsor info if applicable. Once you have all the documents you can mail them to the NVC.

You will soon receive your IV bill and you will do the same thing. Pay the bill, print out the coversheet and mail in the supporting documents.

Based from my experience, Yes, you're able to finish it in NVC by December if you are hoing to do it by your own, the lawyer is making everything delay.

Some PCC does not contain expiration date, just like here in Saudi Arabia when they issue a PCC the only date that will appear is the issuance date. However, most of the PCC expires within 6 months.

We have this fellow, a Pakistan origin but he is here in Saudi, he had some problem with this PCC here in Saudi because there is no expiration date, but that's the way it is, Saudi Arabia is not providing expiration date on their PCC. His wife called their Congressman at they got out in that situation just within 4 hour after talking with the Congressman.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230 Package Question
QUOTE (Wyatt's Torch @ Oct 15 2009, 10:34 PM) <{POST_SNAPBACK}>
I'm finding that the problem with reading all of the copious information regarding immigration in a short span of time leads to a LOT of second-guessing...

As mentioned in another thread, the NVC received the I-130 case yesterday. I called and arranged for the DS-2032 etc. to be sent via email, so I'll be expecting that in the next few days.

In the interim, my question is this: once I get all of the materials for the DS-230 squared away (which will be soon), do I send it to my wife, who will be the designated agent, or do I send it to NVC? If it's the former, does she simply send it on to the NVC? I've read through various guides and wikis, but I'm not quite clear on all of the NVC steps (the splitting of the flowchart seems to be confusing me). Thanks in advance for any clarification!

Exactly what I have in mind, the only difference is that our agent is a lawyer.
That is why I'm a bit confused if I will send the DS-230 packet direct to NVC or I will send it to our attorney. unsure.gif

Yes!! Original or certified copy.

Actually No, the DS-230 pertains to the Beneficiarys info, not the petitioners, but you made need the petitioners divorce decres at the interview. Check on Lings short cuts, no mention of divorce decree for petitioner for the DS-230 packet.

That is what I thought. DS230 pertains to beneficiery. Although it doesn't hurt to include my (petitioner's) divorcee decree, i don't want to confuse things.
Just send what is required. I checked Ling's short cut and it says divorcee decree (but doesn't say beneficiary or petitioner)..

The DS-230 pertains to the beneficiary, its all their information, and documents. Nothing on the Petitioner there. Not even a signature for the Petitoner required for DS-230 form.

One last thing, Im the petitioner, I was divorced, I did NOT send my divorce decree with the DS-230 for my husband the beneficary, and I finished NVC and have a interview. Now does that answer your question???

she is correct. the USC should've already sent it in with the I-130, so don't need to send it again. just keep a copy handy if it somehow disappears on its way to the embassy/consulate

At USCIS you can send a photocopy, but in NVC you are required to submit original copies.
Checked the website for travel.state.gov, a copy of either petitioner or beneficiary must submit their original Divorce Decree for this will be submitted to the US Embassy where the interview will occur. However, for assurance during the interview you have to bring another original copy of it for NVC might lost it during the whole process.

Wyatt's torch - the medical cannot be scheduled until the interview has been assigned and you have a letter from NVC - for Canada at least

Good luck.

Yup, it's true, here in Saudi Arabia when I called the authorized Hospital, they told me that it's only good for 3 months.
In the Philippines, the medical is good for 6 months.

No they will not provide anything to the beneficiary. They will just send a letter, previously known as "Packet 3". Packet 3 will contain two links:

Link to get all the forms DS-230 etc.
Link for the medical.

Once you have got your case number the beneficiary can go ahead and complete the medical.

Does NVC still sends DS-230 packet to the beneficiary?
Because when I printed the cover sheet from the online payment site, there's a instructions that you have to folow the link given in the same page.

Just curious, and also, during the interview do I still have to provide those original documents submitted to NVC? like PCC,NBI,MC and BC.

Thanks

Guys, Our attorney is still waiting for my DS-230 packet from Saudi before sending the AOS packet to NVC. I wonder why, as far as what I read here in VJ, the AOS packet can be sent first and it's not necessary to be together with the DS-230, right?

We are wasting tooooooooooo much time with NVC process. because of these scenarios.

First, our atty will fill up and collect all documents needed, then after filling up those forms she will send them back to my wife for review nad correction, then my wife will send it back to her, then send them to NVC. I think this is a huge waste of time.

Make a list of all documents related to your relationship that will satisfy the consul during the interview that your marriage is legit and not just for immigration purpose.
Documents that shows your constant communication is very important, provide as much as you can, it won't hurt anyway.
During the interview, the consul might ask you one type of question formed in different manner not just once, twice or thrice, you must be very consistent, in some cases, one or 2 consuls will do the interview.

Good luck and wish you all the best!!
