IR-1 / CR-1 Spouse Visa Process & ProceduresNBI and Police Clearance
Good day guys, how are you doing all today?

I just want to ask about the PCC and NBI clearances? Did you send the original copies to the NVC?
How about during the interview? which copy are you going to bring? Does the NVC will send those original copies to the Embassy where your interview will occur?

Thanks in advance!! whistling.gif

Salam guys,,

i have Question about filling I-130 in question Number 20 which says

.If your relative's native alphabet is other than Roman letters, write his or her name and foreign address in the native alphabet

is that mean that i need to sign it coz i asked friend who filed and he said he didnt sign any just the G-325a

so i dont know and the USCIS agent says we cant help about that go to the officer bla bla

and i wana ask also if it possible that i can file CR1 and when i get the NOA1 i can send the I-129F and continue my

case in US coz i need it to be faster coz my daughter there and i cant touch her from her birth which was in june till now

so please if any one know how to help i'll appreciate

thank you all in advance

It means to say, since you are arabic, you have to write their names in English, but of course when you fill the forms you have to write everything in English.

IR-1 / CR-1 Spouse Visa Process & ProceduresCR1/IR1 Interview Venue
QUOTE (NiceGuy123 @ Sep 25 2009, 09:00 PM) <{POST_SNAPBACK}>
I got married in July 2009 in Pakistan. My wife is a US citizen. She's applying for I-130 petition. It will take 3-4 months and then I'll file the later application after getting the Visa Number.

I have a confusion about Interview venue. I married in Pakistan but I used to live outside Pakistan for studies since last 3 years. I consult a lawyer in US and he said I must go back to Pakistan for interview. So, I wanted to know where my interview will be held? Pakistan or Outside. would it be possible to change the venue from home country to the country of residence?

need a quick and detailed reply..
Thanks.

I was married in the Philippines but I've been living in Saudi Arabia since 2001, since until now I am staying in Saudi, my interview will be done here.
Fiance Visa cannot be process outside the country of origin.

But our attorney said as of now, I don't need to get those PCC and NBI clearances for it's still early and they might get expired.
How many days from your completion at the USCIS to the NVC until you receive the packet from NVC? Do I have to listen to our Lawyer? unsure.gif

I've been told the NBI clearance is good for at least 6 months. I'd advise getting it it soon. My wife has had to wait a couple of weeks for hers due to the fact that someone with the same first and maiden name (but a different original middle name) has a criminal record. Apparently when that happens, they have to do some additional processing. For the same reason, she also had to get her clearance from the regional office in Cebu, rather than one of the smaller offices.

yes, same thing happened to me..i will have to go and get my clearance tomorrow after 2 weeks because my name was HIT!!!! i was hit in 2003, then in 2007 and now 2009..i think they don't delete records even if you're already cleared..and that's really frustrating!

I see, so you got Hit, good thing I have some namesake but these are all me, because I had my middle name corrected lately.
Thanks guys!!

I am filing I-130 for my husband. DO I send it to the U.S. or to MANILA? HELP!! smile.gif

If you were born in the Philippines and raised there too, How did you become a US citizen? Are you registered in the US or in the Philippines? Do you have a US Passport?

There is this filing that they call DCF or Direct Consular Filing, but there is a certain rules about this one. Try to contact the US Embassy Manila.

IR-1 / CR-1 Spouse Visa Process & ProceduresPls Help - DS 230
DS-230 must be original, some folks sends the DS-230 even before they got the approval from the USCIS.
You're wife should have dowloaded the DS-230 forms in the internet while the case was still in USCIS. In this case you don't have to wait for it. In this case tell your wife to download the forms and fill it up, sign (Part-1 only) and send it to you thru DHL.
Make sure that all documents are original at filled up properly.

Did you have her original NBI Clearance? Birth Certificate?

IR-1 / CR-1 Spouse Visa Process & ProceduresDifferent Mother's Name in Birth and Marriage Certificates
We almost got the same problem Chris&Beth, but they said the only thing that matter was your identity and not about your family.
In my BC, my mother's religion was Roman Catholic but she is a INC, In my BC it's written that she was born in Cebu City, but the fact is, she was born in Surigao Del Sur.

And the worst part is, My middle name starts with letter J but when I got my NSO copy it was U. In my certified copy of BC they just put letter J to make my middle name correct, but they didn't inform the Civil registrar, until I found out in the year 2000 when I got my first passport and obtain a copy of my BC at NSO,my middle name was incorrect because at that time I was like 20 years old and I didn't know that much about these stuff, all I know is I'm going to work abroad I didn't know it wil cause me troubles and I used that name since 2000 up to June this year. I went back to the Philippines to amend my middle name before we filed I-130 and it was approved.

I think you will be fine but it will be more ok if you will consult some people who really knows about these thing.

Thank you guys for your inputs, I must respect each and every opinions you gave and they are truly helpful of recognizing my self as well. Somehow, the only concer I have is the "TIME" and the way my wife letting the atty do the tasks alone is giving me this feeling of she doesn't care that much with our case.

Just like Abby and Sheryl, I must agree with thier inputs, that's what I am trying to say. I have my work here in Saudi Arabia, though the weekend doesn't match with the weekends in the States, I have to file for vacation at least 1 day or more I f I need to process something, especially if I need to go to Riyadh.

I am working hard to make everything goes smoothly as possible to be with her as soon as possible but somehow, I don't feel that way towards her.

Yeah, it does kind of sound like you are bugging her too much about it... she sounds rather confused and overwhelmed by the process and it's understandable to be afraid of making mistakes. Just think of that as proof of how much she loves you...she doesn't want to screw up the process of getting to keep you here. We also opted for an attorney for this same reason.

Okay, so it looks like you've been in the immigration process for a while now, so you KNOW the government is gonna take months or years to approves stuff anyway, so, like, don't freak out over two or three days. Unless you are coming up on a deadline of some sort, just relax a bit. Two or three weeks may be a big deal, two or three days is not. Maybe you could offer to take her cash and go get a money order and send it off or something? But don't destroy the love you have by sweating the small stuff and nagging about it all the time....

Thanks for your qoute there Mefrie. Maybe you are right, what is 3 to 5 days delay considering we've waited for almost 1 and a half year before we filed our I-130.

Thanks!!

IR-1 / CR-1 Spouse Visa Process & ProceduresAm I Giving Her Hard time
Hey guys, I just wanna consult something from all of you, my wife is my petitioner we are currently in the NVC process right now.
We are using attorney because she said she don't have time to file all the required documents and she is afraid to make mistakes, from the very first time I told her that it's very easy, just like the guys here at VJ, I Sent her all the required links for guide to see all the necessary informations that I found here in VJ but it seems like she just ignored those links and she doesn't even give me any feedbacks.
I consulted some of the guys here and they all told me the same answer that lawyer in not necessary and in some cases it will delay your case, but she insisted and I let her do things she wants.

Now, the NVC sents the AOS bill and IV Application Processing Fee to our atty on Oct. 5, and I asked my wife who will pay the amount? and she said, she will be the one who will pay, then I gave her the link on how to pay online but she refuses to pay online because she said it's not safe. I told her most of the applicants are paying online and there is no problem but still she doesn't want it, I told her to call the Atty. and let the atty pay the bills and we will just pay her back, she agreed with me.

Two days after our conversation, she haven't contacted the Atty. the reason she gave me was she is very busy.
She told me again last night that she will try to call our atty. on Friday.
Three days passed and we haven't done anything with the bills, I mean, Three days is a big deal because we already wasted it.

Sometimes, I am thinking that she doesn't care that much to make the whole process be expedited.
What do you think guys, Am I pushing her too much?
Do I really just have to accept the fact that she is a very busy woman and doesn't have time with our papers? wacko.gif

It's been 2 months already and mine hasn't been received at NVC yet despite multiple calls to USCIS and their assurance they'll do it.
Their official line is that it might take up to 90 days to send an approved petition to NVC.

90 days? Are they out of their mind? I hope they aren't actually walking the files from CSC to New Hamshire (NVC)..Hope they know there are FEDEX and UPS options out there..

LOL...I was in a hurry too after we got approved at the USCIS, and after 5 days our file still haven't got at the NVC, when I checked Google Earth, I saw how far is California to the NVC office, so I just wait for another days, perhaps the delay would be on the carrier side.

There is no assurance for how long it will take, but for some cases, if you are looking for some Timelines here in VJ you will get an idea, however this are still case to case basis.

You cannot request to expedite your interview date but according to some individuals if your husband or fiance is a member of the military, they might give you special attention.
