I am not sure what is going on with Xoom. Apparently they have had some problems with abuse, as they have recently tightened up the controls on transfers to the Philippines. Over the years I have sent tens of thousands of dollars to my wife and her family using Xoom. The service has always been good. I was kind of disappointed in the new restrictions.

The minimum transfer amount was raised from $25 to $50. They also quit accepting PayPal for transfers to the Philippines.

I am sure that there is more to this than they are telling us. You can read the public details in the Xoom Blog.

[added by edit] I did see some Ebay vendors in the Philippines offering to accept a Xoom transfer as payment for goods. This may be a big part of the problem as Xoom sees it.

The site where I used to consistently find the latest coupon codes say that they have been removed at Xoom's request. Boo Xoom.

Exactly. The wife will still have to pay it, since she is a Philippine citizen, and is travelling out of the country. I have no idea what, if any fees, Hong Kong might charge as a destination or departure city. I have only been there on a stop-over.

You each will have to pay the 750 pesos airport departure fee on the way to the gate after you get your boarding pass. Your fiancée will owe the Philippine citizen travel tax, 1,620 pesos last time that I checked. If you bought her ticket from a Philippine's travel agent or company, then you may have paid it already. Check your receipt. If you purchased her ticket online or in the USA, you probably have not paid it yet. You will need to pay it at the travel tax counter, before falling in line at the airline ticket counter.

There will be nothing to pay in Hong Kong, as it is just a transfer point.

This problem you and others have came across is the direct result of not waiting until after marriage and then getting your SSN card. What is the big hurry for the SSN that can not wait until marriage and then eliminate another trip to the SSN office. :bonk:

The reason that we needed a SSN was for the purpose of getting my wife on my medical insurance. It may be possible without a SSN, but it would certainly be more trouble than making an extra trip to the SS office, at least for us anyway. You also have to have a SSN to get added to a bank account. We wanted a joint account for the AoS interview, which never occurred.

I have read, and still advocate, getting the K-1 beneficiary the SSN about 2 weeks after arriving. If I had it to do over again, I would have gotten her a state ID immediately after that.

Your mileage may vary.

Submit the AoS papers in your MARRIED name. You will then receive your green card in your MARRIED name. You can then take your green card, passport, and marriage certificate to the Social Security office and apply for the name change and to have the work restriction lifted.

When my fiancee and I would visit Manila, I preferred to see the native sights. I figured that my fiancee would have years to see western culture after she moved to America. The only real exception was dinner one night at the Hard Rock in the Glorietta Mall in Makati. My girl didn't really like it that much, it was not her style of food.

Some of the things that we did, and places that we visited, that we both enjoyed:
  • Took a bus to Tagaytay and the Taal Volcano.
  • Shopped in the Divisoria market. It is a huge open air market, but be vigilant for snatchers.
  • Intramuros and Rizal Park (Lunetta). Be sure to carry bottled water and a "face towel". It is very hot and humid.
  • The park in the center of the traffic circle in Quezon City.
  • Baywalk along Roxas Blvd, south of the U.S. Embassy.
  • The flea market at Greenhills Mall.
  • Getting around on the LRT and MRT. Often faster than a taxi, because you go over the crowded streets, not through them.
  • Eating BBQ sticks, fried peanuts, bananacue, fresh fruits, and many other delicious foods from the street vendors.

I filled out the PDF version of the G-325A with all of the information. I then emailed the elctronic to my fiance. She printed it at an internet cafe. She then signed each of the four pages in ink, and mailed them back to me. The longest part of the process was the mail from Tacloban City to me, about 2 weeks. I actually had her print it twice, and sign all eight copies, that way I had a backup if I had to resubmit the K-1 application for any reason.

Everything worked great for us.

Whether your wife changes her name or not is a personal decision, no requirement she does so. However, keep in mind her visa and the green card that follows will be issued in the name on her passport. More to think about :)

The green card and EAD will be issued in whatever name you use on the I-485 and I-765, which SHOULD be whatever married name that you want to take. My wife followed the Filipino custom of moving her father's last name to her middle name, and dropping her mother's maiden name. This has not caused her any problems. She has a social security card issued in her maiden name, we are going to get the name changed on that this week.

Since her green card and social security card are in her married name, she will need to either get a new Philippines passport, or have an addendum noting her marriage and name change. Which one to do depends on the length of time remaining before passport expiration. The passport change has to be done at the Philippine Embassy in Washington D.C. But, there are many consulate offices around the country that can take care of sending your passport to Washington for you. This needs to be done before she can travel internationally. I have read that it is permissible for her to travel with her original passport, providing that she carries a certified copy of our marriage license. But I would prefer not to take that chance.

When entering the NOA1 date in the timeline database, it says "Date I-129F NOA1 (Receipt)", but if you click the help link "finding your NOA date", it shows the issue date on the notice. I had originally entered the date that I received my NOA1 in the mail. Now I am wondering if I am throwing off the statistics.

I realize that 1 week is not a big difference, but I am more curious than anything. So...

Which date should I have put? And, if I used the wrong date, should I change it now?

Thanks in advance for some guidance from some who have been around here longer than I have.

I can't see any reason that you would have to go into detail about your whole, admittedly complex, story. My filipina fiancée has not had her interview yet, but from what I have heard they only ask basic questions to make sure that the engagement is sincere. I am assuming that you two have spent enough time together that she will be able to prove that she truly knows and loves you.

Of course none of this will really be important for the I-129F petition. All that is required for the petition is proof that you have met in person at least once within the previous two years. I didn't save any of my boarding passes either. I sent copies of a total of 8 pictures, 4 from each of my two trips to the Philippines, showing us with members of her family. I also copied my passport pages with the entry stamps. In my cover letter, where I listed the contents, I put:

Passport - Donald (showing entry to Philippines)

I figure that it doesn't really matter if I flew or arrived via boat, the passport stamp is better proof of being in the country than a boarding pass anyway. I had no problem getting my petition approved with that proof of meeting in person.

I know you didn't ask for anyone's opinion on your choices, just for the ramifications on your K-1 process. But, it sounds to me like you have considered things carefully and know what you are doing. You are lucky to have each other, I wish you the best of luck!

Just for clarification:

lists the letters from others in the OR section for your evidence of having met in person. If you have met in person, you need to show proof of such. If you have not met in person, and are asking for a waiver of that condition based on cultural or hardship issues, then it lists the letters from parents as possible contributory evidence.

I am assuming that you have met in person. If so, send plenty of proof to USCIS that you have met in person in the past 2 years.

Excellent proof would be your passport stamps showing that you were in the same country at the same time. A few photographs together, labeled as to the date, place, and who is in the picture. Copies of any receipts or boarding passes that you may have, that can help prove that you were both in the same plane, hotel, resort, etc.

I agree that letters from your parents MAY help at the interview, to prove that you have a genuine relationship, but the USCIS is really only interested in you meeting their requirements as to having met, and your intent to marry. The "genuine ongoing relationship" issues will be addressed during the embassy interview.

I submitted our I-129F before I found Visa Journey, so I didn't have the benefit of the excellent guides.

My then fiancée and I had different ideas about what the letter of intent should be. So, I did my thing, and she did hers. Mine was a computer generated statement, much like a legal affidavit, which stated the obvious in paragraph form. My fiancée wrote out a hand written, single spaced, two page mini novel about how we met online, what we did when we met in person, how important I was in her life, and how much she loved me.

I got a kick out of her letter, it was really sweet, especially considering that English is not her first language. I guess neither way was right or wrong. Both letters made it through the USCIS and the Embassy without comment or question. The bottom line is that as long as you are honest, you probably can't go wrong here.

just like all of us time appart is the hard part, married or engaged both are not easy.

just a though what if your partner moves to uk and marries there and you 2 live there? for a while to build capital and then return?

sometimes thinking outside of the box works also.

I have to agree with this for another reason. Since finances are going to be an issue by your own admission, you would probably have trouble with the expense of the K-1 route. After spending the approximately $700-800 USD for the I-129F application, medical, visa application, and other fees, you would then need to have another $1,000 shortly after marriage to apply for adjustment of status.

The CR-1 is cheaper, and easier in the long run. Come here on a tourist visa (VWP), and get married. Be sure to return before your I-94 expires. Once you are home, your husband can apply for the CR-1 visa. The processing times are not so bad anymore.

In a perfect world, it shouldn't matter what country you live in, were born in, or any other aspect of your cultural background. Unfortunately, in immigration, and especially family based immigration, it does matter quite a bit. You have nothing to gain, and a lot to lose, in the usefulness of the responses, by omitting these details. And, if you omit these details, the respondents will typically assume that you are from a high fraud country.

In other words, when asking open ended questions such as "which immigration route if the best for us?", please post as much background information as you can. Such as your country of birth, current residence, and maybe even how you met.

One other point to "ineedmylover", you stated that you had an "aunt and an uncle which will support me and my finance financially". Unless your relatives are U.S. residents, they can not legally co-sponsor your immigration. They may contribute all they want, but the USCIS will not consider such support to meet the requirements of financial obligation.

I am getting mixed messages from the original poster, first: "We really love each other and cant afford the traveling."

Then later: "Thanks for your reply friend, Its not the cost we are worry about its the requirements."

Regardless of which visa route you pursue, K-1 or CR-1, at least one visit will have to occur between your fiance and yourself. She doesn't necessarily have to travel to your country, you could meet in a neutral country. Or, depending on which country that you live in, you could get a tourist visa and meet her here in the U.S. During that visit, you could get married, return home, your then wife could start the process for a CR-1 visa. If you prefer the more expensive K-1 route, don't get married yet, your still fiance would start the K-1 process.

Personally, if I were in your shoes, I would go ahead and get married first, and go the CR-1 route. It is cheaper, and probably a little easier. Especially if you are from a high fraud country.

If you are self-employed, and making what you claim, then you should be filing quarterly tax payments with the IRS. I would include copies of the latest along with your other "proof" of income. This is probably the best "outside" evidence that you could show to back up your income claims. It will be your responsibility to convince the CO at the Manila embassy that you meet the income requirements to sponsor a K-1 beneficiary.

I agree with option 2 above. Assuming that she has a round-trip ticket. Go ahead and have her use her ticket, and the VWP, to visit you. Get married while she is here. You can either plan it out, and she can declare her intentions at POE, or you can leave the even unscheduled, and decide to do it if it still feels right after you see each other again ;-).

Claire returns home before her entry permit expires, and you start the CR-1 process as soon as you can afford the fee. When she enters the next time, with the CR-1 visa, there will be no need for the Adjustment of Status step, and no waiting for a work permit, etc.

If the ticket is one-way, check with your airline. Most will let you cancel it, and keep the credit for up to a year. When you want to use the credit, you then have to pay a fee, up to $200, but then you can apply 100% of your original purchase price. But check with your carrier for the details. She will probably not be allowed to enter on the VWP with a one-way ticket.

This is a real issue. She will not be allowed out of the airport without at least a Japanese transit visa. I doubt that it is worth going to the trouble for a layover. It would probably be cheaper to get a different flight schedule.

Once when I, a U.S. citizen, was flying to Manila, I had to change planes in Beijing. My incoming flight arrived at the international terminal, but my connecting flight departed from the domestic terminal. The Chinese customs agents were not going to let me out of the international airport terminal without a valid visa to China. I had to request a supervisor, and it took almost 15 minutes for me to get permission to go my connecting gate.

I looked through other similar topics and could not find any specifics about this particular issue. Our K1 was approved last week. My fiancee and our daughter are traveling from Manila to NYC on 5/26. The itinerary includes a 15+ hour layover in Tokyo. I rented a hotel room so they can get some sleep. I'm concerned that immigration may have a rule about beneficiaries entering a country on their way to the U.S. The interviewer asked questions about my fiancee visiting other countries during the interview which leads me to believe they have concern about beneficiaries entering foreign countries prior to entering the U.S.

Does anyone know if this is an issue? Should my fiancee just find the most comfortable bench in the airport for 15 hours to be safe?

Thank you, and congratulations to you and all the others who are finally getting good news!

We could not sign up for any notifications, since USCIS never entered our information into the customer facing web site. The EAD numbers from both our NOA-1 and ASC appointment letters were never in the system. I looked often. So we just waited patiently. Today, we got the approval letter in our mailbox. We expect the card will arrive in a few weeks.

It is great that VSC seems to be moving again. Analyn will be applying for citizenship in a few months.

Congrats Donald-n-Analyn! Did you sign up for the text messages or just get the letter in the post? I got an update yesterday that my card was already picked up by USPS so should be with me any day now.

if anyone hasn't done it yet, I highly recommend the text message notifications (even though I have gotten a lot of them the last night or so!)

I attended my fiancée's interview in Manila. The Embassy may be closer in operation to yours than some others. I was glad that I went, and I stayed until Ana got her visa and could return with me, but I am not sure whether it mattered in our case. But, I am positive that it didn't hurt. Considering how much love, time, and money that we already had invested, I decided that I wanted to be there. But then again, I might just be a control freak wink.gif
  1. I was asked if I knew any of her native language, and how to say "Good morning". I passed that test.
  2. I was allowed up to the pre-screener window, but not into the interview room with the Consular Officer.
  3. In my opinion it probably helps. After all, it is hard to question the validity of the relationship when the petitioner is there.
  4. Casual dress. A pair of Columbia slacks and a collared polo shirt.

If you are still working on getting your visa, then this is the wrong forum to ask in. This forum is for people who already have a visa, and then have changes in their circumstances that complicate their immigration case.

I assume that you are talking about an embassy interview. The embassies in different countries have different operating procedures and standards. Your best best for advice would be to ask this question in the MENA regional forum.

I agree with the two other posters. Transcripts are the way to go, and are actually preferred by USCIS. The IRS will even fax them to you if you call the automated number. But seriously, it only takes a week to get them in the mail after requesting them via the IRS web site.

If you want the transcripts you can order them online for free from the IRS website. Took about a week to get them in the mail. If your sending the actual tax return you need all pages including W2 and any 1099s etc.



My tax return for last year was over 40 pages. Much easier to send the transcripts. You can order them online to be mailed to you and in the time you read this post you can be done with one year, honest.
