You don't mention any evidence of having met in person during the past two years. This is critical. Be specific about just what evidence of meeting is included.


The only evidence of meeting I have are boarding passes from a trip to visit his family in 2007, hotel receipts and gas receipts from a trip to visit his family in 2008, I never received any passport stamps..I am assuming because I am from Canada, I was on F-1 visa up until May 2008. We also lived together for almost 1 year and had a lease agreement with both our names on it, but have not included in the package as of yet.

Same forms as everyone else but USCIS does have a hotline specifically for military & if you are being deployed or are in a unit that has a strong possibility of being deployed you can apply for an expedited petition (with a good chance of approval).

That would be a good idea but in the event that he doesn't come back as soon as we'd like, could we change the interview date? He is going to be in Kuwait for 6 months to a year. So I don't want to send it off if the dates will be whacked. I heard that once I get the VISA I have 6 months to use it then I have 90 days to marry. Hm..well, we'll figure out what to do once we find out how long he'll be away for. (:

I believe you can, you would just have to send a letter explaining the situation, possibly with some supporting documents from your fiance extending his deployment. I have heard Vancouver is pretty accomodating/easy to deal with.

I have heard that too! My fiance could have been deployed to Guam, I think he wanted to go, but anyways, and he and his coworkers said its a fun place to go! When he was deployed elsewhere to an island he had a LONG layover in Kuwait which sucked apparently, but they were probably not allowed off the base! I remember him calling me from there and I bawlled the whole phone call!! Anyways, best of luck!

Hey there! You sound like me 6 months ago when I first started researching this long process! Just read the guides and come over the Canada forum for some more regional advice if you would like! In one of your posts it says that you are employed, this doesn't matter as they look at the USC income for sponsoring purposes. What I will advise you on though is that there is associated costs that will have to be paid in Canada when it comes time to have your interview. Paying for the immigration medical (200-300), paying the visa fee (131) and travel and lodging expenses if you have to travel far to the consulate (either Vancouver or Montreal). Then of course wedding costs and all that jazz depending on if you have a civil ceremony. Once you are married you apply for AOS (greencard) and that will cost you $1010.

You may have to stay in Canada until the form is approved...you CAN VISIT.... but it gets tricker at the POE as you have to have enough proof of ties to Canada to prove somehow that you plan on coming back to Canada to await the processing of the visa. There have been some people denied, but I would say just because we are from Canada and do not need a tourist visa, (nor do we get our passport stamped most of the time) to visit it makes things a little bit easier. Its all about Proof of ties and the immigration offical.

(cmon over to the Canada forum if you want to know more about EI) Our guest list will be max of 80-100....how many will show...probably about 40-50, but one never knows!

We are going to try to use as much as the 6 months allowed with the VISA in hand before entry for planning, and then get married within 2 weeks after arrival. My plan is to visit in the next few months to scout out some venues and approximate availability...(pending the POE) so that once we are approved we can ask the venues availability and start putting down deposits.

Take a look at the guides and they will have more detailed information. Like the other poster said keep records of your contact for proof of ongoing relationship at the interview, and before your 2008 tax return is submitted keep a copy of it along with W-2 and call the IRS for your tax transcript. We didn't set a wedding date until we knew the NVC had received our petition and also sent it to Vancouver for the rest of the process. Again you can end up in additional processing even at the consulate level so one never knows. Our date is for October of this year, so this gives us plenty of time between interview and the POE. I hope to have my interview near the end of May and not do POE until September. Again like someone else said we let family know tentatively what the date was and not to make any final plans until after I receive approval in Vancouver. Both of our venues are reschedulable and we do not forfeit the deposit, invitations and such not be printed until after the interview. It is doable, depending on what your fiance and yourself plan to do after receiving the Visa as you have 6 months to activate it.

If I stayed in the US with out starting work in Canada the company can not hold my position at work and I would be unemployed.


My objectives

- I want to marry my girlfriend that I live with and have been dating a few years and I want us together as much as possible
- To be legal to work in the US as soon as possible
- I want to take the new position offered to me as a company employee


From what I can tell I’m in a position where I can apply for a K1, K3 or CR-1. I really don’t know what would be the best.

Because I can’t stay the 90 day’s it sounds like I will have to go to Canada. I would have loved the AOS but it doesn’t look like an option. I may or may not get married prior to that depending on what would keep us together more. I would like to marry before leaving but I may not if a fiancé visa would be quicker.

I have heard many different times for the various visas and am getting conflicting reports from attorneys I have talked to. I spoke with two attorneys about CR-1’s. One attorney is telling me 6 months and the other is telling me about 12 months. One is telling me I can visit the US while I wait the other says I cannot.


Everyone here is so kind and knowledgeable. Any advice or help would be greatly appreciated.


There have been Canadians on this forum who have adjusted from TN status. Check out the Canadian regional forum for more information. If you got married before your TN expired and sent in the AOS paperwork, you also apply for work authorization (I-765) if you choose. Once you send in the AOS paperwork you would get an appointment letter to go for biometrics and usually within 90 days an EAD will be granted.

When was your check cashed? Your NOA1 may still be in the mail depending how fast it gets to your location. In our situation it took 4 weeks to get the NOA1 in the mail, 3 weeks since we had sent it before the NOA1 was issued, but in our situation the check was not cashed until AFTER we received in the NOA1 in the mail. Check to see the back of the cleared check and see if there is a case number that will start with WAC or EAC.

I visited my fiance after the NOA2 was issued, it sure was a nice reunion present! lol! anyways, just make sure you bring proof of ties to Canada, such as lease, employment letter. I was never asked for it the last time I went through airportcustoms, but its Murphy's law if you don't have ties they will ask for them. My previous visits were all land borders and I got more grief there. The VJ Canada Wiki has some advice on visiting while K-1 is pending.

It is advisable not to have wedding plans because you never know how long your NOA2 might take. But also your case could get held up in Additional Processing at NVC or at the consulate. We would take our chances with getting AP at the consulate after the interview. ( I just realized its 4 weeks away! Eeeek!)

We decided that we could not wait any longer to make plans as there would be nothing available so short notice in our price range. We just booked our church and our venue at the beginning of April. We waited to find out that NVC had sent our case to Vancouver. I made sure to ask though if in case the date that we booked needs to be changed, would we lose our deposit? They both said no. As long as you reschedule with the same venues. I am also in the process of looking for a photographer, and I did find one that we like and has our date and as is rescheduable as long as the date rescheduled is available.

We also felt like this was our wedding and it only happens once, and we wanted it to be in front of as many friends and family that could come. This is also why we left around 4 months between the issuance of the visa (knocks on wood*) and when i intend to do POE. I know many people who just want to be able to come to the US and do it right away after they have the visa in your hand, it just depends on YOUR situation, relationship and priorities when it comes to getting married.

Keeping busy is the best advice... as long as I am doing something it help the time fly... Perhaps try to find things to do to make life easier for your fiance before she arrives... find a store with similar cuisine, find places where she can enjoy her hobbies... etc...

I have to say that so far I am happy with USCIS. We waited for alot less time than we expected, but not complaining! I feel like though that the online case status system needs to be improved because my I-129F was approved in March, but it still says "received and pending." There are people who have called USCIS and received NOA2's and the customer service agents are baffled when they see received and pending and the caller is saying they already received their NOA2. What I am not happy about is the length of time people have waited due to security checks and FBI name checks, probably out of USCIS control. It makes me sad to hear of cases like Sara's, some idiot at USCIS did not sent out and RFE and her case sat collecting dust, absolutely grounds for reprimand! Anyways, thats my opinion.

If you do AOS and cancel the K-1 petition it will save you $$ in the longrun. I know that $1010 up front right now seems like a lot, but its the $$ you will have to pay once the she is over on the K-1 and adjusting status. The $$ to fly back to the Ukraine, pay visa fees, police reports, medical. AOS in the US there will still be a medical exam to pay for of course. 3-4 months just to get the K-1 visa from now, where with AOS 3-4 months you could have the AP and EAD in hand and be closer to getting the GC. But again it all depends on your situation and your priorities and of course how long your fiance has had the F-1 visa and what your intent was when he/she came to the U.S. on the visa. Being that you petitioned for K-1, maybe you can prove that the intent was not to use another visa to adjust status, it all depends on what your situation is, I am definitely not advocating the misuse of F-1 or visa fraud.

Well, what options did we have? You mean AOS? We couldn't do it because it would require presence here in US throughout the process which wasn't possible. It's too late for that now - K1 is already submitted. Or can it be cancelled and AOS would be faster? He has B1 and F1 now and can be in US for quite some time, but wouldn't it be too many concurrent applications?


If your fiance is already in the U.S. with an F-1 visa then yes you can marry and file for AOS, and you can skip getting another visa, JUST to marry and file AOS. How long has your fiance been in the US on the F-1? If your fiance just came to the US recently on the F-1, then you file AOS they might smell fraud, I read somewhere about the 30/60/90 day rule somewhere for persons adjusting on the VWP or adjusting from other visas.

Your fiance does not need to stay in the U.S. until the GC arrives, unless your fiance has previously overstayed in the U.S. if it is possible to not visit the Ukraine for 3-4 months then you guys can wait until the AP document is processed, which is the current processing time, along with the EAD, while you wait for the GC.

As far as the concurrent applications, I would assume the petitioner would need to withdraw the I-129F before sending in the I-130, 485, 1765 and 131 package.

Danu, Tim and Joyce and Nik +Heather all had great advice! Ditto to what they said! Your case may end up in AP at the consulate level as well, it all depends. Wait until you have the NOA2 AND you have contacted NVC to confirm that they have received your petition AND forwarded it to the consulate. Once approved for your visa you do have 6 months to enter the country. So say 3 months from NVC to get an interview date, plus another 6 months to wait out thats almost 9 months that you have to be able to plan something.

In my case thats exactly what we did, wait to book and put deposits down for the church and reception until after NVC had sent the petition to Vancouver, didn't put any more deposits down (photography, DJ) until after the interview, didn't send out invites until last month. We got lucky as the last time I visited him it was right after the NOA2, so I was able to look at the venues with him. Notified family members/friends of the tentative date and when I would notify them that its official, to book airline tickets or travel plans. Both the church and reception place said we would not have to eat our deposit if the date got changed, as long as we rescheduled with them for a later available date.

The downside to all of this, is that in my situation it added to the wait of seeing of fiance. Since K-1 is one time entry only I could not just visit him after May 27th. I won't see him until mid-Sept. It will be the longest we have gone without seeing each other, 6 months, but it will be so worth it in the end.

I can definitely relate to all you here! I would definitely fall into the obsessed catagory! When people ask me about the process I used to try to explain everything, now its short and to the point! I had one of my fiances friends ask me "Is there like a college class you take on that stuff"? Im like uh no, just by being on VJ, reading the guides and learning from others! I think I was blabbing about the sponsorship and social security stuff. Anyways, its getting harder to contain myself and not become more of a nutcase than I was waiting for the NOA2, waiting for the interview which is at the end of the month is harder! A lot of the boutique shops basically require you to order each dress, which is then MADE just for YOU. At David's they sell you one off the rack. They assured me that part of the price was a final "bead check" sort of inspection where they would repair any wear and tear due to others trying it on. The best thing about this store is that they have a selection of several dresses (more than 10!!) available in all sizes even up to 24!


For those of you who have started trying on/buying them, what are your opinions on veils? I feel silly even when I only have the one that just goes down the back on (won't even try one that goes over my face too!...Mother says it is just one of the trade mark bride accessories, silly or not.


Like I said before, I am not a fan of David's Bridal. I bought my dress at a boutique, and I really wouldn't want to buy a dress a million other girls had tried on. I like that mine was made for me and is only going to be worn by me haha.

I also have my veil...it HAS the layer to go over your face, but I am not doing that. I just wanna wear one lol. It will probably come off after the ceremony smile.gif

I wish I had your self control to not obsess over VJ. I admire you.


Well I have to disagree with you both on Davids Bridal tongue.gif (respectfully though). I went to every bridal store in my hometown and could not find anything that I really like, everything had waaay too much beading, or was too simple. I went to DB this past weekend and found the dress of my dreams! It has just enough beading to make it sparkle, but not too overpowering! It fit me almost perfectly!

As far as veils, I also purchased a fingertip veil from DB that has dangling crystals on the bottom, it is gorgeous! When the consultant put on a blusher veil I just really did not like the look of the veil covering my face! She also told me that I didn't have to wear it but before my father gives me away I just give him the blusher veil and ask him to put it over my first born child's bassonette. It's a really old tradition that I had never heard of, but I am still thinking about doing, but didn't purchase it at DB. I also did not like the look of a fingertip veil and a cathedral length veil which would just be worn for the ceremony, just wasn't my style.

Are you guys wearing a headpiece with your veil? I found a tiara at DB that can turned into a necklace! All I have to do is cut the wire on the tiara and the ends of the tiara already have the clasps to be a necklace! I can wear it on our anniversary or a special occasion!

I need more self control, this process is turning me into a basket case! laughing.gif

I felt the same way about dresses! Have you tried looking online? That's what I did, and when I saw the one I wanted, believe me, I knew. I called every single store in the mid-west that carries that designer in order to find the dress. The ONLY one was actually in the town next to where I go to school! And now, it's in my closet smile.gif Are you doing dress shopping in Canada too? or just US? DO you have any sort of idea of what you want? Actually, I think I have heard that there are some designers that WILL mix and match dresses for you?? But I forget which ones those are now...

I had a dream we got our NOA2 haha. Too bad I had to wake up from that! And it was after 40 something days. Even in the dream, I felt like something was wrong about that haha. I also dreamt I'd gotten touched..I guess I should go look haha.


I have been shopping in Canada but have not found anything that looks right! At least now that I have been shopping I know what style looks good and what doesn't. I have a few bookmarked that I like, but there is one special dress that I keep coming back to that I cannot order online! I am going to the USA this weekend and really hoping I find that dress! Prices are so much lower in the U.S.

I really want to set a date for the wedding so I can start planning more in depth, but am so SCARED that if I do I won't be approved in time!! Maybe its pessimistic, maybe its glass half empty, but I guess you just never know!

I keep having dreams too, but not about an NOA2! About being pregnant! I probably watch too much TLC! LOL!

Me too! I am disregarding what the timeline says! On the new list I am at 232 or something like that the old one goes by date sent and mine was december 20th...my NOA1 wasn't dated until January 14th.

Side note: Just went bridal dress shopping...finished all the dress shops in the city...so overwhelming! Found a few nice dresses but not sure if they are the "one." I can't wait to go the Davids Bridal!!

249: RFE AND Background Checks
126: RFE (43 days to reply)

Throw all those out (or assume you'll be faster with your RFE) and the average goes back down to around 90 days!! Of course, maybe you'll be unlucky enough that you or your fiance's name will come up with a name check as being the same name as some dastardly character (speculation of cause!), and you'll get stuck in checks too.



Luckily, my fiance has a really uncommon name so I am hoping nothing will come up!


My fiance tells me everything will be fine, he's talked to his commanders and they tell him everything will be okay, But I am still worried because he has a TS security clearance and I am wondering what kind of red flags might pop up due to that? Me going through more extensive background check? I already had to get interviewed as a reference in order for him to get his clearance, along with his friends and family members. *sigh*

I am really praying it will be around 90 days but at the same time preparing myself to be possibly waiting alot longer!

Yes that's what I am predicting as well, around 90 days. I agree with you that the last two approvals skewed the timelines and I don't see how May-June prediction is possible with the increase in Approximate Processing Dates for Common Forms- I-129F CSC from October 27,2008 to Novemeber 19, 2008.

Now I just pray that CSC will keep on with that pace and I do not end up security checks!
