We sent it to the non-courier California address...can't remember off the top of my head! Now just waiting for the check to clear!!

My prayers were answered today! My fiance called and said that the NOA1 arrived today!! I was screaming with joy!! I think he suffered some hearing loss through the phone call...or so he says!! So happy!!!!!!!!! I already went online to check my case status and it says last updated January 15, 2009....does that mean a touch?

Well I'm Star and I applied for my AOS June 26th/09. You can see my siggy for how it's been processing
but it seems to be going really fast! Less then 90 days from NOA1 to Interview date.

I just got my EAD card this past friday and applied for my SSN yesterday so hopefully that'll come soon!

I'm originally from Toronto, my husband is from south dakota (big difference!!).
We got married last march! We are planning a big ceremony & reception next June though in Toronto with
all our family & friends. I can't wait for it!

Right now I'm just applying for jobs & preparing my evidence for the interview (i'm way too organized!)

I won't be filing for AOS until October, but that I693 still worries me after reading that, and after reading someone else's AOS interview review. The person did have their I-693 transcribed by Dr. Arnold, but the interviewer questioned why they would get Dr. Arnold to do it when they don't live in Texas, rather in a different state. I believe the person then said, well I did contact some local civil surgeons and this is how much they said they charged, and they also told me I needed to redo the entire medical, and said they would not transcribe. From the review it sounded like the interviewer was more curious about the local civil surgeons than why they got Dr. Arnold to do the transcribing. I wish I could remember which member that was.

In my case I do not think I will risk it, I will get it transcribed, with all the ####### I had to deal with at the K-1 interview, I am betting my case will not get transferred to CSC, rather to my local office and interview assigned. I will contact locally to see how much they charge and whether they will try to rip me off and say redo your entire medical, and document all of that in case if I do have an interview I can say why I used Dr. Arnold.

Speaking of which guys and girls, I cannot remember, how long is the medical you did for K-1 good for?

If you go back and read the Nexus thread, you will see that when I went to my Nexus interview I was highly interrogated about my trips to Cuba prior to even meeting my husband. These trips were in 2004 and 2005, and even though it was a long time ago and I was perfectly legal in entering Cuba as a Canadian citizen, the BP Officer made it VERY clear that as a PR of the USA it is against the law for me to enter Cuba at any time and if I do so, I will be fully prosecuted to the extent of the law.

I already converted the big chunk of my $$, but really I did not have a choice in whether to wait or not at the time. The rate I got yesterday was .9711 @ customhouse which isn't too bad considering todays rate atm .09755. I only lost $12 CAD on the transaction.

So my husband went and attempted to do his taxes today. I told him to file as married but seperated, and apparently the tax prep guy is like, ''NO. YOU HAVE TO FILE SINGLE.'' I told my husband to file single would be a lie, because 1) We're married, and have been since Feb 2009 and 2) It's probably not a good idea to put the wrong martial status with the IRS, especially since the army is paying him extra because I'm a dependent.

I told him to file for a International Tax Number or an Extension. Any suggestions? Thank youu!

Definitely do not let the idiot tax prep guy convince him that he files as single! The military knows he is married and he is getting married pay. I would definitely get him to file for an ITIN for you in the meantime. Do it ASAP so that if the ITIN does not get issued in time (before April 15th) he may be able to file for an extension with proof that he filed for an ITIN for you?

Sorry to be asking this again but I am going to finalize the taxes tonight and need to be 100% sure I am doing it right.

I used ufile.ca and filed as Married and entered my T4, T3, T5 income and then for my spouse I entered the income as $0.00. Do I need to specify his US income on my taxes? The return seems to be too high so I think I might be doing something wrong. Anyone else who was married in 2009, lived in Canada all of 2009 reported spouse's income on their taxes?


I am using Ufile too. If you are eligible to claim the spousal amount (line 303) then your spouse's income must be reported. On the ufile sidebar underneath spousal income information their is a link called Controls. It will ask you "Are you eligible to claim the spousal amount (line 303) on your return? "< select >
-Claim if otherwise eligible
-Do not claim the spousal amount

I entered do not claim the spousal amount and my refund does not change whether I put my spouses income in there converted USD to CAD dollars. My husband has never lived in Canada though, so I suppose it may be different.

Question regarding my Leaving Canada Return:

I have not attended university since 2007. I have carryover amounts both federally & provincially for tuition, education & textbook amounts. I have done (not printed or mailed yet) my return via Ufile but my non refundable carryover amounts were not prorated, just my personal exemptions for Fed & SK. It looks like this year I can actually use ALL of my carryover amounts because my 2008 income was not high enough.

Do I need to prorate these amounts & input on Ufile based on the date when I left Canada? (09-21-2009) The emigrants guide says JUST the tuition amount can be claimed for the part of the year I was a NR. It also says I can claim tuition, education and textbook amounts for the part of the year I WAS a resident.

I wish I could claim SK tax credits....I have a 10K grad tax exemption unused & SK graduate retention program certificate :crying: Oh well...the price of love! :lol:

My background:

Left Canada Aug 29,09-lived in MB.
Stopped working in Canada Aug 22 09
I did not apply for EI, do not have an RRSP or anything like that.
Didn't work in US for 2009
Received Greencard in 2010
I didn't tell the CRA I was leaving.

My questions:

What forms do I use for Canada and US?
How do I file my provincial taxes? Or do I even do them at all?


Beans- even if you did not work in the US for 2009 as far as I understand it you will still need to declare your CAN income on your 2009 return, my guess would be married filing jointly for you & your husband. Even though you did not receive your GC or a PR until 2010, your husband can still elect for you to be treated as a resident alien for tax purposes. Publication 519 on the IRS website I believe explains it.

The CAN income earned in 2009 for purposes of your US return can be excluded from US taxes by using the Form 2555 Foreign Income Exclusion.

Thank you Kathryn! I was definitely hoping I could still claim tax credits! The emigrants guide is definitely a good read and very helpful! I think I was reading too many guides and getting confused.

Married filing jointly is probably the best option for us, I just wish my former employer in Canada would hurry up & send the T4's! I hope to be able to exclude my income with form 2555. We may have to file for an extension as hubby will be deploying in early march. Unless there is a way for our tax preparer to get started on ours without my employment T4's and i can sign for him with a Power of Attorney? Or some sort of copy of his signature? Anyways we will find out next week what the preparer can do and if any T 4's magically appear in the mail!!!!

I have a question about residency status for my Leaving Canada return. I have been reading income
tax guides, previous threads & playing around with Ufile to see if it fits my needs. So confused.

I became a PR of the United States in December 09. Moved to the US on K 1 visa in September of 09. Obviously spent more than 183 days in Canada. However I cannot be a PR of the US & file as a resident (for tax purposes) in Canada!? Guess I cannot file as a non resident and still get full exemption & tax credits using 90% rule? I had NO canadian or US income after I moved to the US in September.

Is it possible to file as a deemed resident of Canada & it NOT affect my PR status in the USA?

I know I cannot claim SK provincial territorial credits but I worked for 8 months in Canada in 2009 & also cashed out a public employees pension. So the provincial tax still comes into play.

I'm thinking it's too late to file an NR73!

HELP!

It's not something you exclude. Foreign income up to $87600 can be excluded. That's for a whole year in the foreign country. Somewhere TurboTax asked when Nick left UK or maybe it was enter US. Anyway that's because they determine he only was a UK resident about 3/4 of the year. So they use the dates and only give him 75% of that $87,600 exclusion. Not a problem because he only worked 8 months of the year so was only reporting part of a year's salary. So using some hypothetical numbers, lets say Nick earned $40k in the UK. After you finish the substitute W2 and the Form 2555 for foreign income exclusion, the Tax return 1040 will look like this:
Line 7: will include my income plus Nicks $40k
Line 21 Other income: will have written in by TurboTax FORM 2555 and the amount will say -40,000
That's minus so it subtracts it off again.

I don't have answers to your other questions, but I do have an answer about your question for Ufile.ca U file will automatically prorate your deductions and credits based on the information you enter in the (immigrants &emigrants section of Ufile) I was playing around with Ufile and my personal exemption did go down based on the numbers I inputed in this section:

Emigration from Canada

"If the Canadian-source income you are reporting for the part of the year you were not a resident of Canada is at least 90% of your net world income for that part of the year (or if you had no income from sources inside and outside Canada for that part of the year), you are eligible to claim the full value of deductions and credits on your tax return. Otherwise your deductions and credits must be prorated by the time you resided in Canada. The program will decide if you are eligible for the 90% rule based on the information you enter here. If you leave the following sections blank, the program will assume that you are not eligible for the 90% rule and will prorate your deductions and credits.
Note
If you are claiming full federal non-refundable tax credits, attach a note to your tax return stating your net world income (in Canadian dollars) for the part of the year that you were not a resident of Canada. Show separately the net income you received from sources inside and outside Canada for that part of the year. The CRA cannot allow full federal non-refundable tax credits without this note"

So you cashed in the amount and the CRA took the 25% non-resudent tax? Or are you going to get $6,000 per year for life?


It was a one time payment, I will not be receiving another payment. The payment letter was dated Sept 15, 2009, my parents received it in the mail the day AFTER I left Canada (Sept 21) which was Sept 22, 2009 and was deposited into my bank account that day. I'm hoping I did not screw myself there...

Anyways, the non resident tax was not taken. The public employees pension plan withheld 20% of the almost 6K because of regulations based on the dollar amount in your account when you take the lump sum. 5K & under the plan would have only withheld 10%.

The pension plan also sent me a small payment that apparently did not "post" in time when they did the payment for the lump sum. It was about $170 with 10% tax withheld, unfortunately it was sent October 1, 2009 when I was in the USA. Now I am realizing that the plan should have withheld 25%...How do I fix this with CRA?


Just to add

1) You can try to get some of the non-resident tax back by filing a Section 217 return.
2) Did you cash in the amount while you were still in Canada?
3) The cashing in was a one-time deal?
4) Yes, for EI income earned while in the US, you use the Form 1116 to get a foreign tax credit on the amount taken by Canada. Remember that the first $2,400 is tax free in 2009, even if it is Canadian EI.

What you choose as your leaving Canada date is open to interpretation and there has been no guidance on what they want. Being conservative, I usually take the approach with the least risk, which is the date you left Canada to take up residence in the US. One could argue that you are not technically a resident until you receive the Green Card which is much later. But if CRA finds against you, you will owe for the interim.

What do you mean by lump sum pension. Do you mean cashing in an RRSP?

As to whether you can use the 2225, it is quite clear, if you lived outside the US for 330 out of any consecutive 365 day period, not necessarily a calendar year, you can use it to exclude income for the period you were a non-resident.

The lump sum pension was from an employer plan (matching) in Canada. Is it considered a RRIF? It was around 6K so they automatically deducted 20% income tax.. $$ that I don't believe I can get back from CRA?

I began receiving EI the very last week of 09, I imagine I will get an 09 T4E for that payment.. Do I claim the EI using form 1116?

Does tax home mean just 2009 or any 330+ days in which you lived in foreign country?

I moved to the U.S. Sept 21st, and became a PR "date" 12/14/09. When does Canada treat you as a non resident? Left Canada? Or PR in the USA date?

Still confused how my lump sum pension will be treated as well.

I had my interview yesterday and the visa was approved!! I really don’t have anything to add about the interview itself as my experience was similar to everyone else’s. It was very simple, they didn’t ask many questions at all: how did we meet? what does my fiancé do for a living? have I ever been arrested? and I was asked about the time I was denied entry at the border (lack of ties to Canada); and they didn’t want any of my evidence of an ongoing relationship (other then my updated letter of intent from my fiancé). I do have some bus info for anybody who is flying into Montreal. The airport shuttle bus to downtown costs $16, but you can take the regular city bus for $2.75 (have exact change). The bus stop is right outside the terminal near where you get the tickets for the shuttle bus. Take bus #204 which will stop at a bus terminal not far away, then switch to bus #211. This one will stop right outside the XX metro station where you can then use the same ticket from the bus (it’s valid for 2 hours for connections) to get on the metro to your final destination. It’s not a lot of money to save, but if you’re taking the shuttle/metro anyhow it might be worth while.

It’s such a relief to finally be finished. Good luck to those still waiting, like other people have commented, this really was the easiest part of the process so far.
