With tax season eagerly awaiting us in 2014, I'm not sure what I should do.  We are at the NVC step and should be finished with it by the end of January or beginning of Feb.  If hubby's interview gets scheduled for March or April, should I just file an extension and wait til he gets his SSN so I can file jointly.  I've heard it takes up to 8 weeks to get an ITIN and in that time he may already have an SSN.

 

Also, we are not yet at the point of submitting the I-864...if they call for it to be submitted in Jan. 2014...I would now need to provide tax returns for 2013, 2012, 2011....but how can I provide returns for 2013 if I haven't yet submitted them or if I file for an extension? Can I still just provide 2012, 2011, 2010? 

 

Oh the joy of doing all this right in the middle of tax season!

I understand being able to attend together makes for a strong case....but in a way it shouldn't matter.  Some embassies (like Mumbai where me & my husband are) simply do not allow it.  And it is absolutely unfair that we do not get that chance to present our case together as a unit like others do, yet are still judged in the same way.  They need to make the rules uniform across the board in order for this to be a fair process.

 

And yes, I've read the sample questions and the embassy interview reviews...I agree that some of the questions contain a lot of ambiguity...which I think is purposeful and sneaky...and so I practice with my husband.  I quiz him on ambiguous questions and explain to him the double meaning if he misses it and we formulate a good response together.  That way, at the time of the interview if a question like that arises, he will already have an idea of how to answers.  I told him not to be afraid to CLARIFY the question...ask the stupid officer what they mean by their ambiguous question. 

 

I wish I could go with him, but instead I will just work with him to prepare him so that at least maybe I will be the voice in his head during the interview.

Ok, so what is the definition of "residing abroad"?  I am a regular US Citizen and a few weeks after filing our I-130, I decided to join my husband in Mumbai as we couldn't stand all the potential time apart. So I am now in India on a year long X visa and in the process of applying for a PIO (Person of Indian Origin) card since we have been married over a year.  The PIO card is good for 15 years and means I won't need a visa anymore to visit.  I originally filed with my US address, but now we maintain an apartment together in India.  Is there any way to get the process expedited now?  I'm also wondering if the new address together would prevent an RFE. 

 

We were just planning to wait it out here, I was living with my parents in the US and they are notifying me of any mail that comes in my name.  But if there is a way to expedite it, we'll take it!  Paying rent is just wasting money!

I also am in the same situation. Received my NOA 1 on March 8th, 2013 and its April 1st, 2013 now and haven't received my hardcopy yet. I'm seeing where it's not too important to have and I rechecked my paperwork and I have the correct address listed. Maybe this is a new paper saving thing they are doing by not sending the NOA 1? I'm worried because I may not receive my NOA 2 if I haven't got my NOA 1 in the mail. I will call this week. My case says also "Initial Review".

In Ukraine, once we got our NVC case number we scheduled the medical exam the next day. All we needed was that case number which they can give you over the phone. Every country is different though.

Ah ok....sorry wasn't trying to pry. I know some people try to send the financial info in with the I-129F thinking it will speed up the process. I wish there was some magical way of doing that. We can only hope for a 5-6 month visa instead of a 9 month to a year Visa

Why are you waiting for his taxes to come back? That info is not needed to submit the I-129F...thats for the NOA2 I believe where you fill out the I-134 (income and job verification)

sunshine55 I spoke with a lawyer and he said the same thing. He told me they know people can have thousands of pages of Skype chats and the consulate won't bother to read any of it. I have all the calls recorded but he told me they won't watch those either...the thing about the video calls it shows where I met her dad and brother and wheres shes met my whole family through Skype. He told me to mention you have these videos and if they want to see them have them ready. It was more the flight stubs, flat or hotel receipts, pictures, and calls. Which I have everything plus some ready to go. I'm hoping 2 times visit with an itinerary showing another trip on March 13th is enough. I go to Ukraine 2 months So I hope I have enough evidence to support our relationship. I've read stories with people having way less and still got a visa. So keeping my fingers crossed.

Ok i think Im going to leave the answer as "YES" and let the consulate sort it out. Just because I didn't use the tour aspect, I think they will say it's still a marriage broker I just didn't utilize that option to meet my girl. I'd rather deal with blah blah blah for 20 minutes then be denied by not telling the truth. I just got my girls info in the mail today so will be submitting my K1 next week. I'll keep you guys updated on the outcome. Thanks everyone for the information. Just when I think I have all basis covered another question comes up with no easy answer. That's what VJ is for! Man this is confusing. I paid to chat with her for 20 minutes then we set up a dinner date and exchanged information. That simple. I didn't do a tour which AnastasiaDate says they do background checks on all tour members. I'd rather put it on the I-129F, then to not, only to find out Anastasia is in fact a Marriage Broker...by definition, even though I didn't use it for such purposes. Elena's Models is exactly the same as AnastasiaDate. If they are complying with the IMBRA I think that would qualify them as being an IMB. If not, why comply? To me it reads as if AnastasiaDate is acting "In good faith" to prevent scams and abuse but not an IMB, they just follow the rules to hype their site up. I'd rather get asked a billion questions about an IMB and bring a printout of the Anastasia IMBRA I posted earlier. Then let the consulate decide since its very vague. I want their site to say "We are an International Marriage Broker" in plain English but it doesn't say that at all...only they are an internet dating site. Because they have all this IMBRA stuff on their site it's making me very confused. I think better safe than sorry then them calling me a liar and my girl gets rejected for her visa over stupidity.

This looks like they comply with the IMBRA....if they aren't a marriage broker, which they never say THEY ARE a marriage broker...only an internet dating site. So I'm baffled and want to be correct on my I-129F. I don't think it would matter if I left the information in box #19.

Thanks baron555! I keep trying to tell my girl that its normal for men to go through an agency. To be honest when I decided I wanted a Russian or Ukraine girl I had no clue where to begin looking. I tried yahoo chat but its all computer generated messages just like it was 10 years ago so I found AnastasiaDate about 11 years ago and just looked around. Its on the pricey side so I didn't take it serious until last year when I can afford to use it. Of course there are any other ways now that I'm hearing about being cheaper but I went with what I knew. But that question #19 sticks in me and my girls head and we're hoping it doesn't hinder trying for a Visa...as for the marriages it will be USA first then Ukraine later on. Getting the Visa is more important at the moment.

Vanessa&Tony - Ok AnastasiaDate arranges tours to other countries but only to meet women who could become a potential wife. I opted not to go this route as they look "weird in every way". But you pay to chat or email, etc. I chatted with her for a full 20 minutes before agreeing to meet for dinner and got all the Skype, phone numbers etc after that.

As for her being a scammer. Hardly...this one anyways. The original girl I went to go meet was definitely one. Always complained of no money, always going out and buying things with "no money"...all that. When I went to go spend 5 days with her..different flats, I paid for everything. She had many places she wanted to see and go out to eat at. None expensive. But after 2 days all she kept talking about was how I wasn't like a Ukraine man and told me this was not going to work out...fair enough...still had a great time. I met my current girl the last day I was there. She never ask for money. I've met her whole family, shes met mine. Says she will sign a prenup, I always stay in the same flat with her. Shes quit the agency. Told me all the ins and out of how the agency worked. I've met a lot of Ukraine women now and 95% are in it for money. My girl seems to not care at all other than being in love and wanting a family. I want the same. We keep in constant contact all day everyday. She knows my schedule I know hers. We have over 2000 pages of Skype conversations and I have no clue on how many calls...too many to count. When I was in Ukraine she didn't go anywhere or do anything but take care of me, cook, clean, and more cleaning and cooking. Age difference isn't great...only 9 years I'm 36 shes 27. I don't see any red flags. The sweetest girl you can ever meet. The first girl I could tell within a month something wasn't right. I suspicion was correct. Trust me...I've done all the testing I possibly can with my current girl and I have tried to find red flags and theres none. Shes truly the perfect woman in my eyes.

Ok Mrs. Childs I have read most of that before. The second part of the IMBRA was helpful too. I already had question 19 filled out. My girl doesn't have a criminal history so I'm suspecting it won't be a problem. My concern is the amount of negative press and scams from AnastasiaDate.com website.

Harpa Timsah I've informed her lying is not the way to go that our USCIS, I'm sure, are very clever people. This is not even an option I'm considering.

Brc - We want to do 2 weddings, one in USA and one in Ukraine. That way both of our families get to share in the experience. I've been told by many that getting married in Ukraine first can prolong any Visa for close to 2 years. Like everyone, we want this process to go as fast as possible. We've gathered the paperwork up for 2 months now and finally have everything! I'm up for submitting the K1 and Im not near as worried about meeting on AnastasiaDate.com as my girl is. I can't blame her as she has given me the dirty low down on how the site really works. It's 99% used for girls to make money for the business and themselves. AnastasiaDate has a very bad rep as I'm lucky to have a found a great girl from it but that wasn't without meeting others first and realizing the scams involved. Just glad I didn't spend $10k-$20k like you hear some pay. I was fortunate to find her on my first trip after meeting another girl that did not work out. Getting married in Ukraine isn't out of any question. All stories I read where people get denied a Visa its because of something or another was wrong. We're doing everything correct and have a ton of proof to back up our relationship.

So my girl calls me up about 3am NY time and is completely worried about us having met through a marriage broker...ie. Anastasia.com. She is reading stories on Ukraine and Russian forums where most girls are getting denied Visas due to being found on one of these sites. If anyone knows anything about these sites, your chances of finding a good, honest, quality girl is very slim. It is full of scammers, fake profiles, and girls who chat to make money for a living. Obviously the USCIS knows this. My girl said she would even sign a prenup to prove shes not in it for any money. Her and I are in love and I'll be making my 3rd trip to Ukraine in a few weeks. I wasn't worried about it but shes getting me worried now because it specifically ask on line #19 Please provide any information if you met through a marriage broker. I don't think this would be signaled out for nothing. She wants to not mention it but our Skype conversations are flooded with talking about it and I told her a sure fire way to get denied is to lie....just say we meet through a marriage broker, provide all the correct paperwork and keep our fingers crossed. She afraid we will get rejected on that basis alone and recommends getting married in Ukraine first. I told her by the time we can plan a wedding and I get back over to Ukraine, after this upcoming trip in a few weeks, it will prolong any sort of Visa because we will still have to wait 6-9 months. I'm suggesting we do the K1 Visa and see what happens. By the time of her interview I will have seen her 4 times over a week each time....I need some help in this from people who have met their girl through a marriage broker. I think only a few countries do this widespread...Ukraine and Russia being two of them. I need something to tell her to calm her down. Shes reading a percentage of 50% rejection rate on girls from marriage brokers....that's not good in my eyes. I told her that many factors can cause someone to get rejected such as income requirements, incorrect paperwork, not enough proof of relationship, maybe even ages of the the couple (ie, girl is 18 and man is 60+) I know the marriage brokers have a bad rep because girls only chat to make money and never have any intention of finding a foreign man. Its a billion dollar industry in Ukraine. So I need some recommendations before I submit this K1 next week...thanks

Gmedia,....you are very correct my friend. I just found out last night myself from Elena....her Ukraine Passport does have both Russian/In the back, and Ukraine shown in the front of this document with her picture attached. I hope this is all CSC needs. We  were informed by a lady who translates documents in Odessa, this is the norm with many Ukraine applications with K1 Visa's. The Russian/Ukraine difference in spelling is a common issue. I am having her Russian Birth Certificate Translated to Ukraine, and then to English. Even though it is not a picture document. Just to reaffirm the spelling difference. This is very unfortunate so many Ukraine ladies born before 1991(Old Russia Birth Certificates) probably deal with this issue. Heads up on this Ukraine K1 Applicants,.....

 

This is what my girl had. She had her normal passport then went and got her travel passport before we did the K1 Visa, this is what shows her name that we used. Resubmit the changes and I think you will be straight....don't forget to write her full name in Russian in the space "Other names used in different languages" This links the two names to the same person.

Here is my FRE from CSC. "The spelling of my fiancée name" My Elena was born in Russia/Ukraine in 1979, so she has a Russian birth certificate, her first name is spelled "ELENA". In 1991, the Ukraine separated from Russia, her name on all documents then became Ukraine spelling "OLENA". CSC wants evidence, in some photo identification manner with each name. "Basically prove that Elena and Olena is the same person. No such photo evidence exist to prove she was Elena,....she was 1-12 years old at the time. Only a birth certificate, CSC seems to want more. Many others here have had to have this problem. PLEASE HELP!!!!!!

 

I didn't get any RFE but I ran into this problem too and at the last minutes changed all of our documents to reflect the Ukrainian spelling. My girl is ???? but on her passport it reads Iuliia. So we changed all the documents to read the funny Iuliia name and then in the box where it says "Please write any other name in different languages she may use" In this spot I put ???? (Russian). We are obviously still waiting. It's been almost 3 months now and no change in our K1 Visa Status yet. So if she has a passport or birth certificate use those names...all the documents have to match. I've never spelled my girls name Iuliia EVER! But for Western Union and Visa documents I have to. She herself even goes by the Russian spelling. I hope you get this fixed so you can move on.

3. POLICE CERTIFICATES: Applicants aged 16 years and older must submit a police certificate from the 
country of nationality and the country of residence at the time of visa application, if the applicant has resided there for 
six months or more. (For example, an 18 year old Russian citizen residing in Ukraine must present a police certificate 
both from Russia and Ukraine).
Fiancée visa applicants must present a police certificate from all countries where they resided for 6 months or more 
after the age of 16, including the republics of the former USSR.
A police certificate must also be obtained from the police authorities of any place where the applicant has been 
arrested for any reason, regardless of how long he or she lived there. Police certificates must cover the entire period of 
the applicant's residence in any area. A certificate issued by the police authorities where the applicant now resides 
must be of recent date when presented to the consular officer. The term "police certificate" as used in this paragraph 
means a certification by appropriate police authorities stating what their records show concerning each applicant, 
including all arrests, the reasons for the arrests, and the disposition of each case of which there is a record. In Ukraine 
the certificate must be obtained in the oblast centers from the Departments of Information Technology at the 
Ministry of Internal Affairs. The police certificate is valid for ONE YEAR
All police records issued for visa applicants who have changed their names need to bear all the names applicants have 
used. These include maiden names and names from previous marriages. If the name was obtained through means other 
than marriage or divorce, it should be listed on the police certificate as well. Certificates issued solely under the 
applicant?s current name will not be accepted.

I know this has been asked a million times but I see different things here and there. I hear police reports are good for 6 months some say 1 year. I can find a definite answer to this. Please help. I'm sorry if this has been posted elsewhere. This is what I found on the Ukraine Embassy/Consulate:

 

 Additional Info? TRANSLATIONS: Documents in English, Ukrainian or Russian do not need to be translated. When you arrive for the interview, you MUST present all the original documents accompanied by an English translation, which is produced by a certified translator, only if the document is not in English, Ukrainian or Russian. After the interview, all originals except the medical examination report will be returned to you. The consular officer has the right to request translation of any submitted document.
PASSPORTS BY COURIER: The Consular Section uses a delivery services to return passports
All documents are valid 12 months?? from the date of issuance. Better check this one out. The US Embassy told us that the local police check report was valid only for 6 months after the date of issue.
Cost of K1 visa has gone up to $350.00 payable at the consulars office in USD. USD exchange rate at embassy was 8.30 to 1 USD, best to get your $ before.

 

I made it big and bold so you can see. The consulate page supplied here is even confused. Our police report is 7 months old and our interview is next week so needing to find out if we need to order new ones (takes 2 days) so we have them ready for the interview. Any help is greatly appreciated. Thanks

K-1 Fiance(e) Visa Process & Proceduresname spelled wrong on birth certificate

I spelt my girls middle name wrong on the documents. You have to bring in your passport to your interview and I think they will be more interested in that over your birth certificate because to get a passport you use your birth certificate. Not sure how it will play out but from what my girl said about her interview is that they just browsed over the paperwork really quick. Was more interested in the DS-156, DS-156k, DS-230, and I-134. The rest was just flipped through to see if it was there. I know that doesn't really help you much but I know they are really going by my girls passport over her birth certificate. From what she told me is that most of the paperwork she brought in was given back to her and they only kept the main documents I listed earlier and her passport.I'll have to double check with her to see if they gave the birth certificate back or not.

Hi all - I lodged a service call yesterday. Filed on 11th September and transferred to NSC on 26th Feb. have heard nothing since..  I saw on a board today several people from November were approved at the NSC - doesn't make sense to me at all...


Been having the same issue and did the same thing...very frustrating

That's interesting you say that about the address because when I first spoke with the Tier 1 rep, he said that he was able to do the service request but when it got time for me to give him the zip code, he said he couldn't because it was a Mexican address. Then, at the end of the conversation with the Tier 2 rep, she was trying to advise me that with a Mexican address, I might not receive anything in the future (ei. RFE). I was hesitant to give my U.S. address because I didn't want anything with our case to get messed up. When we originally filed the I-130, I didn't use my U.S. address at all because I wanted to show them that I am living with my spouse here in Mexico. :/


I put in different addresses for mailing and residential because I wanted to make sure they knew I was going to come back to the states. The main correspondence address is the attorney's though

So all you did was call back a second time and they made a service request with no problems?


I had to call another day because I'm in such an odd timezone they were already closed. The guy wasn't happy about it but he did it. Oh, you said you were in Mexico? Make sure you give them a us address, he said they can't do service requests for international addresses. I used my 'residential' address since I still legally live in the US, I'm just on holiday...for 13-14 months xD

Okay, so I'm a little ticked off. I just called the USCIS costumer service number and after waiting almost 2 hours to speak to a Tier 2 representative (couldn't use the call back feature because I'm calling from Mexico), the girl tried to tell me that we were NOT outside of the "normal" processing times because we were transferred to NSC 30 days ago and the timeframe for NSC is 5 months. What a load of #######! I told her, "so you mean to tell me that because our case was transferred 5 months after the original date, the timeframe starts over again?" She told me no, that's not how it works and that she still would not be able to process a service request for me. I really don't even feel like calling back and waiting another 2 hours to see if someone else will tell me something different. :(


Someone told me the same thing, but I did eventually get my service report in. If you want to be able to get a call back, use a Skype number, not too expensive and they can use it on the call back

Anyone had the following error while trying to file for an e-request:

  • "Routing could not be determined due to an invalid receipt number"
I know the number is definitely correct: MSC + 10#.... :(

I did, I finally just had to call USCIS
