Hello,

 

My husband and I are applying for his IR/CR-1 visa now, but when we met we were both working on a cruise ship.  His job was terminated eventually and his visa at the time, C1/D (crewman) was stamped "cancelled without prejudice" upon leaving the country.  

 

From the travel.state.gov site, the stamp means there should be no restrictions on him applying for another visa, but I know sometimes the interviewing agents can be kind of nasty.  Will they/can they make an issue out of the cancellation of his C1/D visa during interview?  There was nothing criminal about his termination from the company, he simply wasn't conforming to company standards and this particular cruise line provides no official documentation to employees upon dismissal, so there is nothing but my husband's word to back it up.  

We are just wondering if they can/or will make a big deal about it at the interview. We want to be prepared.

My experience, I hvenot added my spouse name in my indian passport. I havenot applied for reissue to add my spouse name. since it is optional i didnt update my passport after marriage. When i went to the passport office for PCC on scheduled time, I was asked for the country for which pcc is required. Since i filled out my spouse name in PCC appointment form, I was asked for marriage certificate, I showed them the marriage certificate(photocopy), but they didnot collect it from me(some office may collect it from u for evidence). Later they printed my PCC in which my name,passport number and my spouse name, USA are reflecting and it says i hve no any criminal records. Dont go to any agents to fil the form, its very simple to do. If u have done with police enquiry when u applied passport, you will get PCC in 40 mins. If u have not done with police enquiry for ur current passport, they wil make u wait til the enquiry is done , in that case it may take 30 to 60 days to get your PCC. Adding spouse name or showing marital status as married in passport are optional. Pls Dont think it wil affect visa process or interview. You can simply say to consulates during interview that u didnot update your passport after wedding . Already one of my friend went to US on CR1 , she didnot add her spouse name in passport. You should be fine as long as u hav marriage certificate and all other evidences for bonafide marriage. No one can ask or do anything for passport stuff. everyone thinking that getting PCC is very hard. I am wondering y all my indians having so many confusions abt PCC. Its very simple guys. 

 

 

Since you applied for i130 and got noa2 , dont touch or update ur passport in the middle of the process. You should have added ur spouse name by applying reissue before u applied i130.

Very true in pointing out that we should keep everything as it was when we submitted the I-130.  Best not to disturb things.

 

I will advise my husband that there should be no problems with his passport the way it is.

Apparently Indian passports have a section where they indicate marital status (US passports don't have this) and he went for his PCC today, but they told him to return with marriage certificate since his status is still listed as unmarried on his passport.  He is now worried that the status not reflecting married will negatively affect his interview.  I've not read of this coming up as an issue, but anyone have any insight?

 

I know in the US, agencies overlook things like that because they know many people don't change the details on government issued docs until it is time to renew (passport, drivers license, etc) since usually it is very costly.  They go by whatever information is listed on the application, form, etc.

 

Should he get it changed?  Will it cause a problem during interview or is it fine as long as he has the marriage certificate and everything else to back it up?

I need some help getting my husband's confidence up before his interview.  No, it hasn't been scheduled yet, but we should be hearing "case complete" any day now.

 

He's had a couple of bad experiences at the US Consulate in Mumbai, so he's feeling really nervous despite my continued reassurances.

 

I've told him that this visa IR-1/CR-1 is all about proving the bona fide relationship and that we have all the evidences they could request.  

 

A little about us:

We met working together on a cruise line and worked together while dating for just over a year, then I went to India on vacation for 3 months and we married at a court ceremony.  We will have been married 2 years come this July. We worked together another 7 months for the cruise line after that and currently have been living together in Mumbai for 1 year.  I will be returning to the US in the next few weeks, so will be re-patriated well before his interview. Unfortunately his parents are not supportive of the marriage (they wanted him to be earning in a good job before marrying, so until we are both soundly employed, they will not give their blessings). As such, they were not present at the marriage ceremony.  My parents ARE supportive,, have chatted with him via Skype many times and cant wait to meet him in person.  They also were not present at the ceremony obviously for financial reasons. We don't own property together, but our names were on the rental agreement for our flat in Mumbai and we are both in the process of adding eachother to our bank accounts.  

 

My husband is nervous because we don't have pictures from our court ceremony (it lasted less than 5 mins and pics weren't allowed in the judge's chamber) We took a few pics at our hotel afterwards. Also because there are no pics of me with his family (difficult to take pics when the mood of the first & only meeting is not a happy one!) :-(

He also has a prior US C1/D (crew member) visa which was stamped "cancelled without prejudice" because his job with the cruisline was terminated. He is afraid they are going to hold this against him, even though that goes against the very meaning of "without prejudice". Crewmember visas are only issued for the sole purpose of traveling to and from a ship...no job...no visa. No problem?   He also applied for a B2 visa about 6 months after our marriage for the purpose of visiting me and meeting my family.  He was denied and told to apply for a spousal visa. We were not entirely surprised by that denial, though to prove without a doubt that he was going to return to India when he was going to visit his american spouse. 

 

His experience in getting the C1/D visa was also a bad one because the officer asked him for a document from his previous job at the airport in Mumbai, that had he actually followed proper protocol upon quitting his job, he wouldn't have actually even had in his possession...but he luckily still had it and the officer told him to return home, get it and bring it back, otherwise he would deny his visa. (And to think, then I would have never even met him!) Between that incident and the B2 denial he is very nervous especially that they will ask him for some document he didn't prepare or doesn't have.  I told him his confidence is key because even though he knows all the answers to the possible questions, if he seems nervous, they will be able to tell and think he is lying or hiding something.

 

We spent all night reading previous visa denial cases and 221g situations and it helped a little, but I don't know how else to assure him that we have everything in order.  We've made copies of everything we ever submitted at every step along the way and have everything neatly organized in a folder which he will carry, along with even MORE photo proof in addition to that which we already submitted.

 

Any thoughts, votes of confidence, suggestions or words of wisdom I can offer him?

After reading many posts, I am feeling like my supporting evidence is not enough.  I only sent 1 photo and my previous visa to India with stamps.  The photo didn't even have a date.  I have a ton of other stuff I could send, but didn't realize I could have sent it with the I-130 package...directions made it sound optional ("if any"), not an absolute requirement.  I'm realizing my mistake now.  

 

Lots of people have said, "just wait for the RFE", but others have just had their petitions denied outright without ever getting an RFE.  I've seen a few people say it is possible to send documentation after the fact to be added to your file.  Anyone out there succesfully mailed additional documentation without getting an RFE? How would I know where to send it?  My file is confirmed still with NBC.

I have read alot here on the K3 and why not file. Well it seems such a waste and may slow you down more. Because the I-129F gets sent also to NBC. So how will this be better. And since they want the petitions together now you have two sitting their wasting time.

 

Be different if they went to TSC, VSC or CSC. Be nice to see a K3 really do what it was intended but I have yet to see that since 2006.

 

Yes there have been people here on VJ get a K3 but it did nothing for them but save them maybe a few weeks (under a month) of processing.

 

And have seen two people report that the I-129F got all the way to embassy fast but the embassy closed the petition when they saw the I-130 that was still at USCIS some at NVC.

How can an embassy be allowed to close a I-129f petition when they see the I-130 at USCIS still?  That is the only thing which makes a K-3 I-129f valid in a spousal case!  The instructions state the I-130 must still be at USCIS in order to be approved.  If the I-130 is already at NVC, then okay, I understand, that is also explained in the form instructions.  But closing the petition when you are one step away from getting the visa when your I-130 is where it is supposed to be is wrong.  Thats the whole point of the K-3 I-129f for spouses...to shorten the time apart.  An I-130 at USCIS could be there for months and months more!  I hope those people that had that happen are filing an appeal.  That goes against the whole purpose of filing. BS.  I really am starting to hate my government. Stupid agents that don't know the law.  I've seen so many people posting that have asked actual immigration officers about K-3 and been told no, "you're married it doesn't apply to you." I would carry around the printout from the USCIS website to show them how wrong they are.

I recently mailed my amended 2012 tax return (changed to appropriate filing status) to the IRS....now I'm confused as to whether I will receive any correspondence form them in regards to it or how I will know it has been accepted.  And if everything works out ok with it, what will I include in the I-864...the tax transcript PLUS the X form I submitted for the amend?  Should I also have my husband carry the amendment to the interview?  Or do I just order a new transcript and the amendment will be reflected there?

How come it takes 8 weeks for uscis service center to ship the case to nvc? thats what the rep told me... has anyone experienced waiting this long?

Mine was approved on Dec. 11th, I called USCIS to check that it had been sent and he said "yes, go ahead and call NVC and DON'T let them tell you they haven't gotten it, because they should have." He was super nice.  I called NVC on the 23rd and the guy was nice, said he could see it was being entered into the system and had been received on the 16th.  So I dunno I guess mine went fast.  I was also told 10-20 days for case number....I plan on calling every monday and Friday til I get the #s.

 

And I think if you talk to men, they are nice...the women seem to be witches.

Yes, he can amend it to married, as I suggested.

 

I'm sorry, but this is not so easy as you make it sound.  Its not like "oops, sorry IRS, I made a mistake, please tick the correct box for me."

 

When your spouse lives abroad you have to file them as non-resident alien (NRA), can't e-file, and there are a lot of small twists and turns. My father completed my returns for me while I was working on a cruise ship and he filed me as single.  I'm terrified now that my case will be denied.  I am pretty positive the IRS is not just going to let me "amend" the return to married especially in the case of an NRA spouse.

i just finished getting my NOA2 on december 7th...  i am still waiting for my packet.  Is there anything i should be doing now?  i will have my accountant pull together last 3 months earnings

 

As far as I'm aware its the the last 3 YEARS earnings in the form of tax returns.  Pay stubs are required only for current months.

Ok, so I'm filling out the I-864, and I'm at Part 4 which is information about me, the sponsor.  I've been in India on a spousal visa since last April and intend to stay until we get official word that hubby's interview date has been set.  At which time, I will head back to the states to re-establish domicile and start the job I've been making arrangements for.

 

I'm not going to lie on the I-864 and will put our address in India as my residence, my home in the US as my mailing address and US as my domicile, HOWEVER after reading some other people's past experiences...it sounds like this form is more or less reviewed on the date of interview regardless of the fact that its sent to NVC prior to it.  Should I fill out a new I-864 upon returning to the states for my husband to carry to his interview?  My original plan was to send him the letter of employment, my plane ticket stubs, copy of visa w/exit stamp & photo of me (w/date) in front of our town post office for him to carry to interview to confirm that I have re-established domicile.

 

Is that enough or should I send a new I-864?

Omg!I was waiting for my I130 case# when My husband received a notice yesterday from NVC that
We have received ur I129F approved petition from USCIS,and ur case wil b sent to the US embassy in islamabad,in the meantime ur spouse should visit ceac and fill DS160 to apply for a K visa!
My husband applied for I129F in sept2013.
I130 petition history:
Pd: 6th march
Transferred to Nebraska
NOA2: 13th dec
NVC case received: 11th jan
WHAT SHUD WE DO?? CALL NVC TO ASK FOR I130 CASE# OR FILL THE DS160???







 

Same thing happened to me...I got my I-130 case number assigned about a week later.  The embassy will likely close the I-129f when they get word of the I-130....K3 will probably only get your spouse to the US only slightly earlier than the IR-1/Cr-1 at this point...we're just ignoring the communication re: the I-129f and pursuing the IR-1/Cr-1 visa.

Also, just  a quick question..I don't believe I saw it addressed in posts 1 & 2...just re-read but didn't see it.  The bar-coded cover sheets....are we able to save these documents as like a pdf or something to the computer so we can print it at a later time?  I don't have a printer at home and there for will need to put on a usb stick to have printed off elsewhere.  That is an option, correct?  I can't imagine them MAKING you print immediately with no other choices.  Just double checking, so I can make appropriate plans.

Hi Jilly! I just got the same letter you did about the 129f being forwarded to the embassy. Have you recieved anything else? Has your hubby heard anything from his embassy? I'm a bit confused on what to do. It seems easier to go with the 130 as far as paperwork and so forth. I mean we've waited this long already. What's another month to have everything done. I don't really see it happening that much faster. What are your thoughts?

 

We are just ignoring the I-129f as now the case # has been assigned for the I-130 petition at NVC.  Likely it would only get him here a month earlier now.  He hasn't received any correspondence from the Mumbai Consulate...nor have they replied to my email inquiry regarding whether or not the case will be closed since the I-130 was already approved.  Its my understanding it will basically just disappear after 12 months of inactivity, so we're just gonna focus on the IR-1/CR-1.

I just spoke to someone was on hold for almost 30 min he was so rude and just sorry we don't have your case yet u have to wait 8 weeks.... Oh really because I waited 10 months for an approval why not just wait another 8 weeks right... So rude!

 

I know, almost everyone I've spoken to at NVC seemed like they would rather be doing something else...complete with sighs of annoyance and tones that imply I am clearly annoying them.  And I always try to sound happy and peppy when I speak to them. :-(

Is anyone else not able to get through to customer support at NVC today?  Its 9:45am EST on Friday and I get the message "Thank you for calling the National Visa Center. Assistance regarding an immigrant visa petition is not available at this time. If you wish to speak to a customer service representative please call back at a later time."    #######?  WHAT later time?  Obviously not a snow storm since its not the "in-climate weather" message.  

 

I know MLK day is Monday...are they taking a 4 day weekend?!?  If so, thats ridiculous...NVC employees have the greatest gig ever...cushioned federal holidays AND snow days.

Ok, I'm a little confused as to what I should do now.  My husband I filed our I-130 and then after seeing how long the waiting times were we filed the I-129F about 6 months in.  Both were approved by USCIS and then I got a notice that the I-129F was "unapproved" and back in "initial review"...I called to inquire and USCIS tier 2 said "i have no idea what they are doing, sorry".  So I left it at that.  Proceed to wait for the I-130 to reach NVC.

 

I have confirmed many times that my case has been received by NVC, just waiting on case number.  Today, I get a letter in the mail that NVC has received my I-129F and has forwarded it to the embassy in Mumbai!!!  #######??  And that he can go head and apply for the K-3 visa. blink.png  

 

Now I have no idea what I should do?  Will I still eventually get the case number for the I-130 for the IR-1/CR-1?  I know the K-3 is more expensive in the long run, but not by a ton if my calculations are correct in totaling the costs for both paths completely.  I know he won't be able to work right away if he comes on K-3.  Is he more likely to get approved for the K-3 or the IR-1/Cr-1 at interview?  

 

What happens if we just ignore the letter from NVC regarding the I-129F and just focus on the I-130?  I'm sooooo confused now!

 I put $0 for my income because im a full time student. my dad is sponsoring.

 

they said i need to send in a letter stating that im a full time student unemployed...thats all.

 

I am not a full time student, but my income will be $0 as I am unemployed, but I am ineligible for benefits. My Father is sponsoring. Are they going to request a letter about my unemployment as well?  I can't imagine what I would put.  I've just been in India for 8 months being a housewife and plan to return to the US in a month to find a job.  If they want some proof of unemployment I'd rather start trying to arrange it now, than get a checklist.

Called NVC today to check to see if I had a case # yet and the lady seemed exasperated and it was only 7:30a! poor people.  She said no number yet, but that I really should allow about 30-40 days now because they were off half the week last wee due to snow storms. :-(  

 

Lets hope for no more snow storms for New Hampshire, otherwise things are gonna slow to a crawl!....a SLOWER crawl.

Yeah, me neither.  I put my name, DOB & SSN on any attachments and the number in the form to which they corresponded, but never the Case number.  I don't recall reading that anywhere!  Where did this info come from?  Why would the case number be necessary if they were all mailed together?

I have decided that waiting for "case complete" or (god forbid) checklists...is a worse wait than the 8 month USCIS wait I had. :-(  At least when I was waiting in that stage I kept busy by reading the NVC forums and getting things organized for the next step.  Now that everything is submitted I don't know what to do with myself!  Its only been a week since everything was received and it feels like 20 days!

 

This will be the longest 30 days of my life I think.  The only good thing is that there are no more federal holidays to contend with until May and hopefully we will be approved long before then...now I just pray the weather starts cooperating! :-/

So I'm pretty happy at the pace that NVC is moving so far.  I just double checking though....I know since you send originals of the marriage & birth cert in the IV civil docs packet, that they get returned at the interview.  However, we are planning to side-load with our Bona Fides evidence since we didn't do it during the I-130 process....if we provide originals of items there like photos, letters, ticket stubs, etc....they get returned as well, correct? 

 

I like to scrapbook, so I would hate to lose some of those items! :-(  I know those are "soft" evidences, we are also including some "hard" evidence too, joint banking statements, co-habitation rental agreements, etc...thats the boring stuff I'm not worried about...but the sentimental stuff, I have a hard time sending off in the mail.

You won't get denied if you filled a question wrong. You'll just be put into AP until you fix it.

 

And you're supposed to use the exact amount from the tax return/transcript, whether you filed jointly or not. In cases where you file jointly, you're supposed to include W2s with the transcripts to show individual income.

 

If you're not sure, just bring a form to the interview with that question left blank and go over it with them, looking at the tax information, and they should help you fix it.

Ok, so even if my Dad, as the Joint Sponsor files a joint tax return with my mom, we still use Line 22 from the return in that 13a1 even though we are using ONLY his income to meet the sponsorship guidelines?  And that is supported by including the W2s?  Which he actually already provided. I'm just making sure I understand what you're saying.

 

If thats the case, then simple fix!

 

BTW, I'm glad you got your new job, but I'm very happy I got to be here to get the full benefit of your knowledge and wisdom before you leave us! :-)

:joy: Case Complete!!!!

 

BUT...a big gigantic BUT.....  

 

With a checklist to bring ANOTHER new I-864 from my joint sponsor to the Interview date.

 

Called and confirmed that yes the case is complete and waiting for an interview to be scheduled.  Also clarified the problems with the joint sponsor's I-864, but after speaking with my Dad (joint sponsor) I'm even more confused.

 

The checklist says the problem is that the number in 13a1 doesn't match the number from Line 22 on his tax return.  My Dad is upset because he said NO, it never will match because he and my mom file a joint return.  He was using just HIS income from W2s and tax return to avoid my mom having to fill out the I-864a.  Mind you, he followed the same procedure for entering totals for all the years, 2013, 2012, & 2011.  But apparently they are only looking at 2013, since the numbers from the other years don't match his return either.

 

SOOOOO....is there anyway around it, or is my mom going to have to file an I-864a?  Can my Dad (joint sponsor) call NVC to ask questions?  We are very confused now and want to make sure we get it right, since the next time the form is seen will be at the interview....if its wrong, its gonna be a 221g or a denial!!!

does anybody have been in a situation...where your spouse works on a cruiseline with a U.S. port? i would just like to ask how to answer the question on DS 260 application where they ask for dates arrived and departed the US? Do we based it on the date stamps on his passport?

Yes, my spouse and I both worked for a cruiseline. And yes, for that part of the Ds-260 we just used the physical stamps with dates.  I'm not sure how it works exactly, but I think there must be some sort of understanding that with a C1-D visa, the crew member is not actually leaving and entering the US every time the ship goes out for a cruise.  Because the only time we actually go through immigration again is when we sign-off. 

 

I haven't got word yet that our DS-260 was approved, but should be soon....I'll let you know if they have a problem with the dates. :-)

Anyone here waiting for Case to be Completed at NVC?

We are still waiting...just called yesterday and they said our AOS checklist response was entered into the system, but not yet reviewed.  Really hoping to hear those magic words in 2-3 weeks (which seems to be the norm for checklist review)...and not 30 days!

 

Hubby's birthday is in 3 weeks so that would be a nice present for him!

but it was 3 questions that requires 1 answer.. will it affect my approval if i got denied from tourist visa?

My husband was also denied a tourist visa which we had to mention.  We don't think it will affect the case negatively seeing as though he was denied because we were already married and they felt he was an immigration risk.  The officer at the interview told him he need to apply for a spousal visa...which is what we are doing.  So hopefully no problem.

Totally freaked out . Went to Passport seva Kendra to get PCC before checklist ,officer told me you can't have it right now as you have to re issue your passport to amend your wife''s name on it. I dint know this before nor my agent told me. I m in the middle of NVC process paid AOS bill waiting for IV to pay but now so pissed off . Have to apply for new passport whole procedure gonna 1 n half month. Can't believe my agent dint informed me whole things gonna delay case for a mnth

Sent you a private message about this as well, but my husband basically stood there and convinced the officer that getting the new passport would take much longer than the visa process and that it had to be completed in a specific time.  The officer told him to come back the next day with our original marriage certificate.

He did not need to re-schedule or pay the appointment fees again...just brought the same receipt.

 

One thing you could argue is that the expiration dates for your current passport have already been entered into the system for the visa and you cannot make any changes...getting a new passport would mean information would not match and cause problems. 

 

Come on, if there is one thing I've learned while living in India for a year, its that you can talk your way out of anything. :-)

And we've run into plenty of government types in the process of trying to get my own Indian visa extension.

 

Stay calm and work through it.

I am hoping its just a false check list. I am really interested in knowing why was it generated b/c my parents did the same as well. I believe you should call NVC ASAP. I havent recieved civil docs from my parents yet, but I think my father said that they gave him a paper as well as stamped his passport, did you send a copy of both papers. Again, I havent seen what my parents have, so thsi is just a guess.

 

I called NVC and the lady told me there is nothing to respond to...just that this often gets generated prior to IV being reviewed as a reminder that it is required or a reminder that it may need to be updated before the interview.

 

She said it was because they are waiting for my AOS checklist response and will review the IV package after that response is received.

 

I am going to call again today though to see if I get the same answer.

Ok here we go again, another checklist...this time for the IV Package.  I know I've seen someone post this exact thing, but doing a VJ search only yields results from 2010 & 2011.  I can't find the one that was on the monthly threads here.

Indian Police Clearance Certificates should be obtained as follows:
? All Indian IV applicants aged 16 and above, residing in India, should obtain police

My husband's original (plus 1 copy) PCC was included in the IV Package we sent. It was obtained from the Passport Seva Kendra. It is not local police.  It is dated Dec. 19, 2013.  So it is not more than 6 months old.
 
Is this a false checklist? Should I call them? Why would they issue this if the PCC was included in the package?

This was in regards to my father's (joint sponsor) I-864.  I thought I was going to have an arguing point because he only submitted 2010, 11 & 12 tax transcripts....But, Going back through the items he added to the package, I notice that he included his 2013 W2s.  ARGH! DAD!!!!  I should've caught it, but oh well.  So now they see he earned but didn't submit tax returns meaning they think he didn't file.  He actual is in the process of filing right now I believe.
 
If I call up and tell them he is currently filing, will they waive the need for the written letter about why he didn't file? Since he is in fact filing?  In which case, they just need the 2013 tax transcript.  Also, will they maybe go ahead and say I can have my husband carry it to the interview instead of resubmitting? Or can I try to convince them to let me do that? Otherwise we have to wait for him to finish filing, then for the transcript to be ordered and mailed THEN mail the whole I-864 again. :-(  
 
If they let my husband carry it to the interview, how do I get them to go back to reviewing my case since I wouldn't be mailing anything back to them?

. Hi just how died u get pcc from India on first place because I heard that you won't get pcc until you get checklist from NVC n it will delay your wait times? N if you got your pcc then how? Can you tell me

 

Apparently PCC procedures in India depend on what state you are in.  For Maharashtra (mumbai) it was super easy...my husband booked his appointment on the Passport Seva website, went to the location with his passport and a copy of the NOA2 from USCIS and was issued the PCC on the same day.  I feel really bad for everyone from the other states that have such extended wait times and delays.  You should probably just call up your closest PSK and find out what is required.

I'm updating my I-864 for my husband to carry to his interview in May.  I was in India the first time I submitted, but have no re-domiciled to the US.  So I am updating that part.  

 

But my question is in the income.  I just got hired in a temporary position for the next 6 months, I start in a few days.  I will change the status to "currently employed as:....." But then what do I do for current individual income?  I just have an employment letter and form stating my rate of pay.  It is only an hourly position as it is a temporary position.  Should I just calculate my hourly rate times 40hr week times 4 weeks times 6 months?

 

Or do I fill it out based on my status in 2013 since those are the taxes I just recently filed?

When I talked to NVC this morning about the I-864 my husband has to carry to the interview I asked about interview date and they guy said "more than likely, May"...but "call back in the middle of the month to see if he's been scheduled for May."

 

MIDDLE OF THE MONTH?! wth?

 

I hope that's just them overestimating to get us off their backs. :-(

Yes they said my income doesn't match. Do you know what line it is in the 1040?

My joint sponsors I-864 section 6 income also doesn't match in 13.a.1....they said it needs to match Line 22 from the 1040.  We have to bring the corrected form to the interview.
