Just to mention my fiance said no, but explained that she had scheduled the medical exam for the "X" date and she expect to receive the vaccination and documentation required on that day. We had no problems at all on that.

125 percent is for I-864

 

As for what the poverty line is in numbers, hell if I know. But I'm sure it's far higher than government numbers.  30K a year is practically poverty to me in the U.S. with rising costs.

125 percent above poverty line, I think. The I-134 is less 'strict' then the other one that needs to be done for AOS, I-864.

He did not not accrue any unlawful presence even though he was out of status, according to our immigration attorney. Had he stayed longer than the date on his i94, then it would have been a problem. Yes, he did something wrong without really realizing it. I'm hoping this won't be an issue. I suppose all he can do is answer the questions truthfully if asked at the interview and hope the K1 doesn't get denied.

I'm posting this question on here because so many people seem to be very knowledgeable on this site, and I want to make sure that my fiance and I don't encounter any problems.  We have received our NOA2, booked medical, completed the DS 160 and are just waiting for our appointment date for our K1. Here is my concern:

 

Last December, my fiance left the US to go back to England to see his family for the holidays.  Upon landing in the US, he was questioned, and found to be inadmissible to the US on the grounds that his E2 visa was no longer valid.  He had sold his initial business and purchased another, but failed to let anyone know. Basically he violated the terms of his visa.  He was denied entry and they allowed him to withdraw his application for admission, which is good--he did not receive a ban.  The officers told him he could apply for another visa such as the K1. On his visa in his passport, they stamped "CANCELLED WITH PREJUDICE" From my understanding, that means that he did something wrong (obviously) to warrant the cancellation of the E2 visa. Will this affect him being approved for the K1 visa at the embassy?

My fiancé was denied entry to the US using his previous visa. He is currently in the US on the K1. They did ask some questions about it (I went to the interview with him) but it got approved. Its easy to worry after hearing of denials but as long as you have everything in order, follow the rules with what they require, and can prove your relationship then you'll be fine. It's hard because it feels like the process never ends but soon enough you'll be together and all the worry and stress you experienced feels silly. :-)

Same here. I just checked using the phone line and it works. My status changed yesterday to waiting for the oath ceremony! Now I'm wondering how long they take to send you a letter with the date. I am changing my name and the officer told me that they do a ceremony once a month in Tampa.

I've been searching to find experiences and I'm having trouble finding any. I've booked a flight to the uk to bring my fiance back with me to visit my family in florida. We would prefer to not wait on the k-1 process. Just thinking with all the illegals in the country already what are the consequences to marrying her at the courthouse and filing for a AOS afterwards? Would they send her back immediately or would we be able to stay together while the process went thru?

I see that she should return to the uk while the I-130 is in process.... I'm just looking for personal experiences/

La prueba que tengo es una copia del pasaporte de mi prometida. ¿Debo tener yo el pasaporte original de mi prometida?

 

Podrias dar mas datos de tu peticion? por lo general la prueba de ciudadania de la persona que te pide la necesitas cuando mandan la peticion. No estoy muy seguro de que te la pidan en la entrevista.

My case is still at NVC according to that link. I already got my case number. I'm guessing we'll need to wait until they get it at the embassy for them to send that letter to my fiance. I'll have her call them to see if we have any options. The only open appointments were for January 31. I didn't even bother to check for open appointments for march or later. I jumped and grabbed that in Jan. I hope that doesn't bring up any issues with the medical and whenever they receive the case on their hands.

Hello and thank you all VJ members! Thanks God this website exist with so many helpful members...

 

I just want to make sure I'm not doing something wrong here by going to fast. i went to the embassy's website and payed the visa fee ($240) last Monday, and today I was able to schedule the appointment. During the payment and scheduling I was never asked for my case number, but all info on my fiance like passport number and contact information. Was I supposed to wait until the case reached Guatemala? My case was received by NVC last Monday. Would I be notified when the case leaves to Guatemala?

 

My fiance made her medical appointment for January 17. She was told that she needed to bring the embassy's appointment papers with the case number on it. We aren't sure if they were talking about the appointment confirmation sheet I got on my email since it doesn't have the case number. Or maybe is a letter from the embassy that would have the case number?

I didn't wait for the embassy to contact me to schedule the interview for my beneficiary. I didn't even wait for them to receive the package. As soon as I got the case number from NVC, I went to the embassy's website and followed the instructions to pay the visa fee and schedule the appointment. It would all be attached to the beneficiary's passport, but you want to make sure you keep your payment receipt and all that. After making that payment, I was able to schedule the interview. I got the interview confirmation sheet, way before the embassy received the case. It was not a problem.

 

Research on your embassy's instructions for paying the visa fee and scheduling. Hope it helps a little...

How do you pretend to live with an immigrant if you are tired of having immigrants serve you on their jobs. I also wonder if your beneficiary still want to be with you after this attitude.

IF (again.. IF) that employee really screwed up with that answer, I don't think that the "mistake" was because he/she was an immigrant.

Our interview went well, I think. We were very scared since the oficer asked us to sit and wait for her to analize our case. She said our case was very complicated. She then called us and said that everything was ok, but we needed another affidavit.

 

She didnt take my current paystubs to prove my current income. As I explained before, I didn´t make much on 2013 and was also missing a w2 for that year that I haven´t receive from my employer. So she asked for a co-sponsor. She gave us instructions to fill the form I-864 and send it in with her passport. However, when I go to the website where we are suppoused to find a link that says ¨Solicitud Pendiente de Procesos Adicionales¨(Pending aditional Process), what we see is that it says that the embassy still have possesion of our passport...??? My fiance have the passport! She told us to send it with the I864.

 

Anyway... I will be giving more details later about the interview and updates on our case. Does anybody know how long they take to approve the visa after they receive the recuested affidavit?

I to am having trouble with the Guatemalan Embassy, I made enough, but for some reason they still asked for another sponsorship, but my lawyer thinks that I was just at the bar, not above, so we updated all the information and added my assets...My case is also in the hands of god, February 25th is our new interview date.. :/  Im praying, but this time I will be present with him, so I am hoping I can assure them that everything will be ok..and I will take care of every thing. smile.png good luck  .

 

I wish you the best in God's hands. I would consider bringing a back up sponsor on form I-864 that would qualify with the 2013 tax year. I currently make way more than the requirement, but last year I didn't make the same. Better be safe I'd say.

So my fiance went to this second interview, but she was not asked any question. She was told that they researched with USCIS and found out she needs to pay to waivers: I-601 and I-212.

 

I only hope this is the last missing piece to put my family together.

Yeah we are very unsure of what they want to ask, and it was such a short notice for me to buy a flight again to be there with her. I can't just ask for another time off to my employers right now.

 

I really hope it turns our ok. I hope they don't stress about the two years requirement. Hopefully it is just very simple questions they forgot to ask on our first intervew.

I believe the complications the CO was talking about were related to my fiance being previously in the states with valid social security and all that. The CO has the letter I sent USCIS explaining our case when they sent me the RFE. In the interview she was asked more questions about her previous trip to U.S. than our relationship. The CO stopped with these questions when she realized my fiance was brought to the states as a child. That's when the CO said she wanted to analyze the case carefully.

 

We could see her going through the papers from the waiting area. The CO took the time to read the newspaper story that she already had before we came to the interview. She also went through all the documents that were given to my fiance while she was under supervision by the deportation enforcement. On most of these documents, employment authorization cards we presented in original, her driver license, original social security card, and other communications from immigration services, the CO seemed to be verifying something in the computer. The CO also called another woman who I thought was a supervisor, and they were both kind of analyzing. By the look on their faces I thought very negatively about our case, until they started looking at our pictures. They started laughing and in some pictures they would stop like if they actually like them.

 

This is when they called and said everything check out ok, with the exception of the affidavit. And while she was filling out the 221g she asked us how we met. She also asked how many times I've been in Guatemala since my fiance left the states, and I said two times since she left. Inside of me I said two including the one for the interview. She didn't ask about the two years previous to the I-129F since she had that on the packaged, I think.

 

So I would think if that's the problem, there isn't nothing to ask, but to deny the visa since they already know. Plus if that was the problem I would also think that they would ask her to bring proof of visitation within that period. I lawyer I talked about our first interview he was surprise that they didn't ask her to file a unlawful presence waiver or any other penalty type of fine.

So my and my fiance were at the interview on January 31. The CO told us at one point to seat while she analyze our case carefully. She said the case was a little complicated. We waited, but then she said that everything was find and that there were no doubts about our relationship. She said the only missing piece was that in my affidavit I didn't make enough on 2013. She said that I do make more than enough with the current employers, but she still needed an affidavit that made enough last year.  The CO also said that I don't have to be there anymore, that my fiance can finish the rest of the process after submitting the requested I-864.

 

I came back to the states and sent a co-sponsor (my dad) with form I-864. They received it last Monday, and called her today to come in this Friday 14 to the embassy. My fiance asked if she needed to bring any documents, they said no. They said they have everything they need including her passport that was sent with the new co-sponsor as they requested. My fiance asked if it was approved or what was happening, and they said they don't know yet. They said they need to ask some questions and depending on how that goes they will determine if she is approved or not.

 

Any body have gone through something like this on this journey?? We don't know what to expect or what they missed to ask. Please share your thoughts.
