I just got an update that on August 30, my case was pending background check clearance. What does this means? All I have in my record is about two driving tickets in the 7 years I had my driver license. Wendy, never even had a ticket while she was here and nothing on her country either.

I'm very glad I didn't withdraw this petition. WE JUST GOT APPROVED!! Yes!!! we made it through this step where no lawyers wanted even to take my money to give it a try. Just had God as my lawyer and surrender to his will.

 

We got RFE on October 24 asking for proof of meeting withing the two years, or explain why if we didn't. I explained why and the hardship I was while raisin our newborn with the limitation to find jobs. I also attached the letter in witch they approved the fee waiver for my Citizenship and some documents about my son being on speech therapy.

 

Soooo.... yes... Another "impossible" case was just APPROVED!! GOD ALMIGHTY APPROVED IT!!!!

One question that is on my mind is since your fiance was in the US before did she have any period of unautherized stay here and did it go over 180 days or over a year?  I do not think she has a ban but I thought it was a good idea to ask.

 

 

She had valid social security number and work permit. The work permit and driver license had to be renewed every year, for over 10 years of constant approvals of this permit. She left within 30 days after her last issued permit expired. Bought her own ticket, instead of being arrested and deported under the enforcement expenses.

 

She was brought by her parents when she was underage.

Again, I'm not sure how to properly file a waiver. What I did was a letter explaining my situation and why I didn't file or travel within two years after she had to leave. Is this letter I added to the package sent with the I-129f considered a waiver, os is there an actual form for this waiver.

I submitted that expedite request a little before I went to Guatemala. It wasn't the porpoise of my call to USCIS, but it came up while talking with the representative. I mentioned that I was on risk of loosing my job over this trip that it ended a week sooner than planned. Here is what I got.

Even assuming that everybody at USCIS and at the embassy oversees the lack of one of the requirements and she gets a visa, what happens if a few years down the road at the AOS or ROC or naturalization stage some immigration officer finally realizes that there was a mistake in the first place?

 

Oh, heheh, humm... wow, what do I say to that? Well thanks for the heads up. I'm prepared for that too now that you mention. I have completely surrender to God's will.

Well on the plus side took some searching but i so remember this happening with another VJ member. Everyone said no way to her also.

 

One thing you have on your side is you at least have met. This isn't a "We never meet we want to skip that part". Hopefully you wrote a good enough waiver to state you case.

Amazing! Thank you so much! I'm digging that post right no and I gotta say that my hopes have been doubled up. Some of their struggle applies to me, and I didn't even know I USCIS would even listen to some details on my hardship after I ended up alone raising a newborn. He was 6 month old without a mother.

 

Now that I remember. A lawyer helped me to become a U.S. Citizen. He saw my struggle and didn't charge me a penny. I owe him so much for this since he even filled for the Citizenship fee waiver. He explained it was a long shot, and many people told me they would make me pay the last penny on that fee. However, I believe and I'm sure that it was God through the person who reviewed the waiver. It was approved.

I won't complain about USCIS petition.

 

Why didn't I waited until after the visit? Back in May I wasn't sure to be able to come up with the travel expenses while raising our son on my own, but I felt like at least trying. I was also told the main porpoise of the requirements was to prove a real and ongoing relationship.

 

Again, I took my own risk and I've been aware of it since the beginning. I wont complain or cry for the money if denied. For my family I think I'd be willing to risk money while trying.

 

Anyway, I'd mention again that impossible case of citizenship that was approved without delays. It could happen to me too.

 

Thanks again for sharing your opinions. This post will either be of hope for some other families going through a similar struggle, or be another example on how things must go.

It is just amazing how after reading the advices here I went to Walmart to print the pictures of my visitation to send them to Texas Service Center. I ran into a friend who asked me about how things were going. Without giving much details, my friend told me he was glad that I already filed. He also told me... and this is the part that pushed my faith even more... he told me: "Put that petition in God's hands. No matter what conditions, difficulties, requirements, problems, or whatever, the case will be processed by God through the immigration department".

Not quite understand, but I know I have a lot more faith in God now at this stage than what I had at the beginning. My faith have not been turned down with the advices provided. I just recognize that can ask God to do as I want, but ask him to understand his will.

 

I expect to be approved. That's the main reason why I don't withdraw now.

I agree. However, since I don't have the filling fe for the re-file right now I'll let this one go as far as it can until I'm ready to re-file. Trust me, I want here and my son here ASAP. I wish it was tomorrow. I actually called and submitted a expedite request just to make sure I try every single resource. While I was there we had the discussion about getting married to withdraw this petition and start fresh with I-130. But the marriage process on Guatemala takes a month or two. Plus the expenses we couldn't afford, plus coming and put together the money to file the I-130. It was just not possible. It's very frustrating. With the financial limitations we have, I have to make sure they eat on Guatemala, while at the same time I save up money for this whole process.  I resume work on Monday, but I'm hoping to be working two or even three jobs if possible to be able to support them and get the money I need to re-file or whatever the fees I need from now on.

 

So, I'm not waiting to be denied, I'm waiting to be able to afford the re-file.

I do understand where you are coming, but the Bible does say concerning not just taxes and giving to gov't what is their's, but laws that we are to respect the laws of the land. I am trying to undermine your faith in God as I am a Christian as well, but God does want us to obey the laws of the land.

 

That's very true. God want us to obey the laws. I just keep remembering that Jesus made an exception over the laws when they were about to execute a woman who was found being unfaithful. It was the law in those times, but there was also Jesus wanted to teach us all.

 

I feel so much better now that I visited. If it doesn't work on this current petition, it will work for the next try. I also have some credit for another flight I'm considering for November. If denied or withdrawn, I'd also have the option to go get married and file the I-130.

 

Just hoping a denial won't affect a second attempt.

I understand everything you guys are saying. And all advice seem to be the right thing to do. Believe me I won't be upset if I see a denial notice on Monday or any following day that passes without me requesting to withdraw. Some people I know have faith that the adjudicator would be moved positively just like the ones that were involved in processing that impossible case of citizenship I mentioned above.

 

I filled on May 8. How much longer do I have to "waist" to find out the decision of the adjudicator. I'm prepared to re-file if denied, and ready to keep moving forward if approved on NOA2 until they force me to re-file. I believe I can star filling up that I-129F form again now, and withdraw the first one when I'm ready and decided to re-file.

 

If some of you are kind of certain that this case won't pass USCIS and I have the possibility to be adjudicated next week or the following week, I think a couple of weeks wont hurt to waist to see their actual decision. I came back broke from this trip, so it might take me a few weeks to be ready with the filling fee again. So I think it might be smart to just wait to be ready with everything to re-file, before withdrawing the current petition.

 

I'm glad I found this forum. Everybody is very helpful. I really appreciated everyone's honesty on telling me the truth and how things are in reality.

Your petition will be denied. If you wait, you are just prolonging this inevitability. They don't care about whether or not you visited since the filing. Many on VJ have tried your tactic. It never works.

The best thing to do is simply withdraw the petition and refile. Saves a heck of a lot of time than waiting several months for the denial, then refiling and waiting another several months for the approval of the refiling. Withdrawing and refiling now cuts out much of that first wait.

 

UNDERSTOOD. If other have already tried visiting after NOA1, then I gotta think. I still have a lot of hope though.

Do you think that this petition would be denied at interview, not now on NOA2? Are they really heartless people interviewing? Wouldn't they thing that I would re-file? Why would they make me go through all that again for just a few months off the two years requirement. I wasn't a Citizen at that time and I was locked in the country to qualify for citizenship.

 

I know of a case of a guy with a case of a relationship with an under age. He even got her pregnant, and was to the edge of deportation. With lawyers, they fought to stay under permanent resident status. Later he wanted to become a citizen to fix the status of his girlfriend, but no lawyers gave him hope to ever become a U.S. Citizen because of his record. He told the lawyers he wanted to try even if he waists his money on the filing and lawyer's fees. The lawyers refused to take his money, and he decided to file for citizenship on his own and his faith on God. It turned out that his Citizenship came thru within normal processing times, without any extra request of anything. He submitted all details of his records and why he wanted citizenship after going thru with his sentence for being with the under age girl. His now married to the same girl, and have an amazing family who talks to others about Jesus and how God changed his life.

 

I trust everybody experience. If waiting to hear from them will not affect a re-file, I think I want to wait. Just remember my questions here is also for other to learn from my case. Even if I'm wrong. My message is probably to encourage others to put their lives in the hands of God not matter how dark and lost they think they are.

In short:

 

So I just came from visiting my fiance and left Christopher (our son) with her for some time with his mother. He was 6 months old the last time she held him before this visitation. He's now 3 years old and I reunited him with his mother last week. It was a very emotional event for us at the airport after so long of dealing against so many barriers for our family. I'd like to know if I should send the proof of this travel to the service center that is processing my case now. I kind of want to send it with a copy of my NOA1 and the transfer notice, even if some say it might not make it to my case's file.

 

With more details:

I'd to share some insights about our I-129F, and I'm open to any feed back. Even if you believe we wouldn't be approved. I trust God what's best for us more than what I trust the lawyers who gave me no hope on this case. I hope my case can be of help and reference to others. So...

We didn't meet within the two years prior the submission of the I-129F due to financial limitations, and me waiting to become a U.S. Citizen. I was a permanent resident when she had to buy her ticket to leave upon the request of the immigration services, and you know the I-129F is only for a U.S. petitioner. Financial limitation was primarily for me being a "single parent" raising our newborn. Lawyers and many other people said that I would be denied due to this requirement of meeting within 2 years, but I have a lot of faith in God that the adjudicator of my case will understand our situation and see that we are a real family with a strong relationship that keep fighting for our reunion. Basically, I've put God as my lawyer and sent the I-129F with a lot of prayers.

So I submitted the this I-129F as soon as I became a U.S. Citizen, just to get things moving while I could afford to travel with our son Christopher. I just went and spent a week with her and we had the best week on our lives since she had to leave. Would this visitation count positively to qualify us of meeting all requirements for the I-129F? I'd like to know how many think this case would be denied and how many think it might be approved. I was suggested to get married on this visitation and withdraw the I-129F to start a I-130 from scratch, but we had so much trust in God and we are so close to NOA2 that we decided to wait. 



 

Anyway, I'm already considering on booking another flight to Guatemala on November. It will be either to go with her to go with her to the interview and come back with together with my son, or to go get married and submit a I-130 to keep the fight going. I trust God will do what's best for us. All I know is I won't give up to my family.

 

So... i just visited 3 months after NOA1. Should I send proof of this visitation to be added to my case at the office processing my case? I will because I trust in God. I'm hoping some one could learn from my case.

I read the guidelines and sample DS-156, but our case is a little different. I hope there is another example here in VJ that could be similar to our case.

I'm the petitioner. She lived here for several years while applying for political asylum. During the process her family (parents and sister) were issued valid social security numbers and work/study permit year after year. The asylum was denied, but they kept renewing work permit while appealing. Suddenly, her father was picked up from work and deported. Thanks for the words Nawlinshoney. It's been a hard separation, but we haven't give up. Good that you mention about having proof of paying for that departing ticket. I definitely want to take it to the interview. We have submitted the DS-160, and will be taking a written statement with the boarding pass and invoice that we paid for the tickets.

 

As of right now, my only option to petition for her was the fiance I-129. We do have a child together, but we aren't legally married yet. We do refer to each other as husband and wife. I have all arrangements made already to be with her at the interview. I have a lot of trust in God he will do what's best for our family and will let me come back with her and our son to the states all together shortly after the interview day. I trust I won't need to file for something other than this current petition. God has already proven his power on our case.

 

Put your case in God's hands. I see you have your interview on next month. My fiance's interview is in two weeks!

As I explained in before on other posts, my fiance was brought here by her parents when she was under age. They applied for political asylum, and were given social security numbers and work permit while the asylum process. Unfortunately, the asylum was denied and they were told to leave. They kept appealing for years, but at the end they picked up her dad from work. They contacted her to go report in person at a Deportation Enforcement Office, and we showed up. From there she was put under supervision while prepare to leave and gave us some time since we had a new born. She had to report in person every 30 days, until finally bought her own ticket and left. 

 

1. Does any of this means she was refused a U.S. Visa, or been refused admission to the United States, or withdrawn your application for admission at the port of entry?

 

2. Since we purchased her departing ticket, does she still count as deported? She left a about 2-3 month after her last work permit expired.

 

3. Would she use the same social security number she had when she was under work authorization? We are trying to figure out if we are going to be able to have our wedding on February 14. I know it's too close, but we aren't planing on a big wedding since budget is limited.

Would this  be a problem? I have two employers and they both gave me the letter I needed for this form. Non of them have letter head. They said they didn't have any letter head sheets or logo to put on letters. However, they did include contact information in case the embassy want's to verify. 

 

Would this be a problem? Also, these jobs are fairly recent. One since September 2013, the other since November 2013. I make more than the minimum required from each job on its own. Would these jobs being so recent also be a problem?

 

I know in 2012 I didn't make the minimum required, and I'm still waiting on one more W2 form from an employer in 2013. Those years I had my son and was very limited to work. Since I went to Guatemala and left our son with his mother (beneficiary), I came back to focus on work for the family. Would they be looking at what I make now more than the previous years, or should I take a co-sponsor just in case? The co-sponsor would then be my dad who has filled affidavit for other two current petitions in the family.

I didn't have to refile. Sorry. But I was told you can re-file right after denial. I believe you may include your denial letter, but there is also a question in the I-129F where you enter information about a previous petition.

I got the RFE letter now and they are only asking for the proof of meeting within the two years requirement, and some fields in the forms I left blank. Like whenever I had to indicate the name of any current or previous husband/wife on my and my fiance. Either of us have ever been married, and I should've indicated NONE on those fields. Now they need an statement on that.

Now, I writing a letter to explain my situation and why it was not possible for me to meet with her on the required period. The problem is that I did visit her a few months after my NOA1. Should I mention this trip, even if it doesn't count for them?

Thanks, I know it's a long shot but I have my trust in God and he would put my family together the way he has planned.

Many of you have already suggested on another of my posts that I should just withdraw my current petition and refile to save time. At that time I didn't have the filling fees for the second I-129F and decided not to make any moves until I was ready for plan B. It's been over 5 months on Initial Review, and I called USCIS. The representative submitted an inquiry since it was past the processing time, he said and gave me the confirmation or inquiry tracking number.

I didn't know about VJ when I sent my petition, and now I've discovered that some of the most important documents weren't sent. I paid a notary with "experience" on this forms. He explained that USCIS will then ask me for what they need. I read the instructions but was crazy enough to trust some one with "experience". Well here are the documents I later found here to always trigger a RFE and are missing on my petition:

1. Form G325a in original filled and signed by the beneficiary.
2. Intent to marry from Both of us.
3. Proof of having met in past two years. He said we could be waived on this requirement since we have a child and I had to wait for my citizenship to be able to file. Heheh....

So anyway I know I will get RFE, and some of you will say I'd be denied on NOA2. So I would like to know what would be the best route now. I just happened to read here on VJ that a withdrawal can take up to 6 months before I can refile. Is this correct? If so, should I just wait to see if denied on NOA2 to refile right after? What if I withdraw this I-129F, and go get married in the next 3 months or so to file a I-130? This last options might be extremely hard for the budget.

I'd appreciate any advice. My 3-years old son is with his mom on Guatemala. We need to apply for an extended tourist stay within the next two months since he is a U.S. Citizen. Not sure if this piece of information helps on any way.

Interesting. They only asked to submit I-864 on the yellow 221g form. Nothing about I-134. All questions on I-134 are included and more detailed in I-864, I belive.

 

I just checked the visa/case status on CEAC and is says REFUSED!!??

 

Is this normal?? I hope so until I submit the requested documents.

K-1 Fiance(e) Visa Process & ProceduresConfused on I-864 for Co-sponsor requested at k-1 interview

Long story short, I didn't qualify for to sponsor my fiance. They looked more at my last year's income rather than my current income on pay stubs and employer letters. I was also missing a W2 form that just happened to receive yesterday. Even with that W2 of 2013 and the ones already at the embassy, I didn't make enough on 2013 to sponsor my fiance on my own. Then then asked me to submit a I-864 witch my dad is filling for me.

 

My confusion is on part 1 of this I-864 form. Would my dad be the ONLY JOINT SPONSOR or would he be THE SECOND OF TWO SPONSORS since the embassy have my I-134?

 

Does anybody has an idea of how long they usually take to issue the visa or reply to us once they receive the requested documents on 221g?

Si loco eso fue lo que me paso a mi. I make enough right now, but since I haven't file the taxes for 2013 they didn't accept my recent pay stubs as proof of current income. I was still waiting for one more w2 for 2013 and I got it a few days after the interview. I'm now sending what they asked for.

Kind of. The officer said everything was good, but we needed another affidavit of support. We got a 221g, but it was not related to your question on this post.
