Hey guys. I applied for J-1 Visa at Beijing Embassy on 19th November, 2013. After my interview the visa officer said that my visa is approved but they need to do further administrative processing and they retained my passport.

 

Since then I kept checking my visa status and passport status. My visa status is the same "Administrative Processing". But I do not understand that why my passport status has been changed from "Your passport is still with the post" to "There is no status update available for the passport number submitted".

 

Can anyone explain, please?

I flew into London the night before my fiancé's appt at the Embassy (ours was a more difficult case, and our lawyer strongly suggested I attend.) I had prepared all of the paperwork, with his immigration lawyer overseeing. When we arrived at the embassy, my name was not on the list for me to go in with him--not sure how! I politely argued that there was some mistake and showed the binder of information I had put together, stated that I was the petitioner, and had flown in from the US the previous night to be there for it. The woman took my passport and information, called inside and was able to put me on the list. We went in and I accompanied him during the interview. Everything went fine, he was approved. We are now married living in the states. So yes, you can go in, just be sure to put your name on that list!, or prepare to be incredibly persuasive.

My fiance has filled out the DS 160 online, and has booked his medical for Nov. 29.  Is that all we have to do for the moment? He has his police cert. I am planning to fly to London to attend the interview with him, bringing along all of our evidence, and am trying to make sure that after the medical, the Embassy receives the results and then mails him a letter with an appointment date? Is there anything aside from the DS160 and medical that needs to be done to get an appointment? Thanks!

They did a similar thing to me. I scheduled delivery for today Monday. I sent it on Friday. In my case was this: "Notice Left (Business Closed)" Saturday. The are supposed to update the information in real time. If they deliver later than 12pm you get your money back. I found out that in that post office they update the delivery status at 4:00pm. I believe that if we go to our local post office between 12pm and 4 pm claiming that our packages wasn't delivered on time, we will get our money back. When I filed my I751 to Vermont, they updated the information of my package in real time how is supposed to be. Yes ok, either way is unethical when you know your package is delivered. But I think is also unethical spend thousands of dollars in have a legal status in this country, while others can have cars, mortgages, drivers licenses, only requiring fake social securities. Sick of pay for the "incompetence" of this government. Is that hard to make an almost impossible to copy social security card with a chip that include your information? They do that all over this planet in develop countries and they don't have this masive frauds that we suffer here. Yes no country is perfect but is beyond ridiculous to have an important piece of paper that even a monkey can reproduce.  A piece of paper that allows you to do everything. Come on...

I have been told by an immigration officer that hurry up and keep requesting my interview for my I751 that is pending. I sent a week and a half ago my N400 and the officer told me that my I751 could delay the process of my N400 and the interview for the I751 have to be done. I don't have any problem with my background checks so, since my I751 file was moved from Vermont to Tampa in June 2013, I think that is a bit ridiculous that I still waiting to get interview. I sent my I751 in October 2, 2012.

I just sent my paperwork for the naturalization, n400. My i751 still pending. I read a lot about the process and only found now that I should sent the GC extension notice. I only sent the copy of my expired greencard as the form instructions and document checklists said. I though that they would know my situation looking at me in whichever database. Did anyone know if my application is gonna be rejected because of that? I though that I could send the missing copy of the GC extension notice. Can I do that or I have to wait to them request it? if they do... I am very frustrated. I expended like a week doing the best application possible and then this. Hope you guys cant tell me something that give me some mind peace. I am very stressed with all this different process. Greetings....

I thought of that, but It's kind of predictable they would answer yes even if it wasn't real. I wasn't trying to be mean or go around publishing stuff, but I thought I'd ask everyone so I get multiple answers from people with experience.

Hundreds of thousands of petitions are processed by hundreds of adjudicators. NO they are not done in order. saying they are is politically correct but impossible. Stop checking the timeline and prepare for your next step. Imagine you walk into a grocery store with 100,000 people and are given a number as you enter. There are 400 cashiers. Do you think if your number is 1234, that you will come out of the store right after 1233 and just before 1235?

A lot of disappointment is caused by unrealistic expectations

What I can tell you, since I have done this, is that when it is approved you will no tbe ready for the next step unless you stop looking at useless online updates and start getting together what you need.

Have you collected all your transcripts from school? Had them translated? Had them evaluated? The visa is nothing, prepare for LIFE ahead.

FWIW when I out our receipt number in it says "initial review" Alla has been a citizen for more than a year.








Thanks. I was also doing math before I asked. It's just interesting how mine was right outside of a batch that have seen some step forward. ANd yes... they already have school transcript and many other suporting documents already translated. I'm now putting together 2-3 I-134 since I'm visiting her by the end of this month. I want to be prepared as much as I can in case the process goes through while I'm in Guatemla.

I've been modifying the last few digits of my case and see how most cases are in a different stage. Most of them says: "On May 16, 2013, your Alien Registration Number was changed..." OR  "On August 2, 2013, we mailed a notice requesting initial evidence..." Mine says "The I129F PETITION FOR FIANCE(E) was transferred and is now being processed at a USCIS office..." So, are the RFE and the "Alien Registration Number was changed" a more advanced step in the process?

 

How come ALL cases around mine are on these steps but mine?? I checked about 10 receipt numbers before and after mine that starts with "EAC"

Yes she left after no more appeals were allowed. Her father was picked up from work and deported. That's when they call her to go report in person. We did go as they requested and at that time her work permit was on its last weeks. Since her dad never received his last work permit renewal and instead was picked up by immigration, we thought not to even file to renew the work permit. Immigration office also doubted it would be approved since he had the order to process deportation no matter what.

 

I hope this doesn't cause any delays after interview or would like to be prepared for anything.

 

Thanks. Any other advice or idea please feel free. I thought of maybe filing for the waiver even if we don't need it just to make sure is there paid and ready if the try to delay us for it. Sounds kind of crazy but... yeah.. I don't know...

First of course thank you all VJ supportive members.. I'm now preparing for the expenses to come in this journey.

 

My fiance lived in the us with valid social security number and a permission to work and study that she had to renew (and pay for) every year. She did so for about 11 years while applying for a political asylum that was denied. Her parents brought her here when she was a child, and kept on appealing for the asylum until they were allowed any more appeals.

 

Before her last work/study permit expired she was under supervision of the deportation enforcement department. She was told she needed to leave and was given the chance to leave on her own.

 

I'm trying to figure out if we will really need to pay for any unlawful presence waiver, or when would we be requested to file for it. Would the embassy let us know in the package sent to the beneficiary, or that would've been notify to me (the petitioner) before approving our I-129F?

I hope it doesn't happen for you, but in my fiance's case they asked her to show in person again at the embassy this coming Friday. On our first interview they said that everything was ok, but they needed a co-sponsor on form I-864. They received they now they said they still need to ask a few more questions before making the final decision.

Also, and this is just a thought, but why not get married and file the I-130?  I mean, I know that you went through the fiance process, but it is true that it's harder to prove hardship to prove extreme hardship to the USC when the USC is not an immediate relative.  They do take that into consideration when reviewing the waivers.   I understand that there may be reasons you don't want to get married yet, but it's definitely something we were advised to do since we knew we'd need a waiver. 

 

And yes, waivers are taking much longer than the 4-5 months that USCIS has as a target.  Heck, we got an RFE notice, but never received the actual letter and today I received a text saying we're back in initial review.  Our case is from July 2013.

 

WOuld you really recomend to re-petition with I-130? I don't know if this helps with the waivers but we have a son and might have another on the way. I guess it could be a good idea to refile since the waivers are going to take about the same time it will take for the I-130. Well the I-130 might be approved a little sooner, but they might be a little close.

 

So is that really a secure option to file the waivers and marry and file an I-130 while waivers processes?

 

I started and signed up with my lawyer to prepare and file the waivers. He wanted me to go the I-130 route from the beginning, but he didn't mention about forgetting the I-129 and refiling the other. I know my attorney will be open to any suggestion I may have and he would tell me what he think it's best. So I would like to know about cases that have had a hard time with waivers for a fiance and if anybody have had to just marry and refile.

Oh wow. To think that we were so close, and now these waivers. This is going to sound crazy but we wanted to have another baby and we aimed for it. We are just giving the time to find out since on our first interview all we needed was the co-sponsor.

 

So what happens here now? The approved I-129F expires next month. Would it need an extension or what's the process now that we have these waivers?

I see. I'm glad I on this forum and appreciate all the advice. I notice you specifically suggest a waiver attorney. I've been working with James Martin who has helped my case very much. He told me from the beginning (three years ago) that we should be expecting and preparing for two waivers, and that's exactly what happened. Does "waivers attorneys" have an extra qualification/degree for these type of cases over a regular immigration attorney? Yeah here is where they had some confusion on their status here in the U.S. They were actually denied way before 2010. I will need to ask her again, but I think the asylum was denied after they renewed the work authorization for the second time. What they did was to appeal, and continued to renew the work authorization. Since the work authorization was always approved, they thought they had a legal status here. Crazy thing, but yeah. I don't know if it was a miss communication between their lawyer or what, but to her family they were ok by renewing their status here every year. The way they were thinking was that they were appealing so they don't take that work authorization from them. How ever it happened or what ever was going on, it was very confused to them that every time they sent the papers to renew their work authorization card it always returned approved. Until the last one on 2010 was denied to her father. We choose not to try to renew it since we thought her's would be denied as well.

 

Thanks God on her last interview they gave her a paper that says that she es already eligible to file both waivers. She told me she saw many other cases that were not eligible at all, and other had to wait even up to 10m years to be eligible to file the waivers.

 

Thanks again. This is a very complicated case and hard to put all the pieces together since she can't really remember much of what was going on.

Explain what you mean by child and valid work permit.  What class of visa where her parents on and when did she leave ( at what  age ? )  

 

She was brought here when she was almost 11 years old. Not sure if that changes anything, but at that age she was under her parents commands. They entered illegally, running from danger on Guatemala. Her father was in the military and refused to participate in some kind of movement that threatened to kill him and his family. I don't know the details on this, but he applied for Political Asylum the same year they entered. While that was processing, they all qualified to have Work Authorization Card, Social Security Number/Card, and even driver licenses. They had to renew these work authorization cards every year. On 2010 her dad was denied when he tried to renew it for 2011. He was picked up from work by deportation officers. They then called Wendy (my fiance) to go report in person. When we went to report in person as they requested, her 2010 work authorization card was still valid. It expired towards the end of October 2010, and she left on January 2011. She was 22 years old when she went back to her country.

 

She is calling the embassy tomorrow morning to see if they would explain whats the period they are giving the ban for being illegal for a year or more. This week I'll have a meeting with our attorney to start working on these waivers. I really appreciate all the help and advice here and want to continue to know what you guys know from your experiences.

thanks all for the input. There is something we don't understand and it's the 212(a)(9)(B)(II) for being ilegal in the U.S. for a year or more. She was brought by her parents as a child in 2000, and received valid social security and work permit a few months after. Not after a year. After that her family renewed the work permit timely on every year for 10 consecutive years. She left about about two months after her last work permit expired. So where is that "one year or more" of being illegal in the U.S.? They said they researched with USCIS and found she had these two bans. We brought all original work authorization cards except for two that were missing. For one of them we have the confirmation letter from USCIS that they received the application.

 

I'm wondering if that's what they are calling the one year or more of being illegal here. I really thought it was just a "pay these waivers and you should be good" type of thing. Do i need to extend the NOA2? How do I do this? I don't even know where to start... =(

 

Oh, another thing. I bought her the departing ticket and she left on her own. We reported in person as requested by deportation officers and she was left to leave on her on. Unfortunately, Spirit Airlines cannot find me the receipt for that flight that I only have the confirmation number printed in the boarding pass. The boarding pass has kind of whited out since it was so long ago.

My fiance was told that she need two waivers: I-601 and I-212. The grounds are Section 212(a)(9)(A)(ii) and Section 212(a)(9)(B)(II). Thanks God in the paper also says she is already eligible to file both waivers. She was told these waivers can take up to 6 months to process, and I'm concern that our NOA2 expires on March 24. That's next month.

 

I really don't know where to begging with these waivers alone, and I don't even know if I would need to extend my approved petition. I'm hoping some one can point me in the right direction. Would she also need to bring new police records and any other document that might expire by the time the waiver is adjudicated? What about the medical exam? Does it expires?

 

Thanks God for this website. I really hope some one can give me some advice on how I should go with this whole waiver thing. I see that many consider that these forms should be prepared by an attorney, and some have done it themselves. I really don't know what to do I'd really appreciate any help and advice on all this.

The letter says "The petition is approved and forwarded to the listed consulate."  Does that mean it already went to the NVC in NH or that it's going there?

I am about to send form I-129F. Part 2 section 3 of the form requires a mailing address for my fiancé. She lives in a very rural area of Dominican Republic and does not have a mailing address. I have seen where she lives when I met her family and I honestly don't seen anywhere local to her where mail can be delivered except the little town of Gaspar Hernandez.

I called the visa center here in the United States and they said to mark the section N/A and See separate pages attached to Quote "Tell the U.S. embassy the procedure for sending my fiancé mail and notifications about her medical exam and visa appointment".

Here is my question. Since I don't know anything about the Dominican postal service what would be the best procedure for the U.S. embassy to send my fiancé mail? Or should I just leave our phone numbers so the embassy or I can inform her that she has mail or information for her to pick up and can she go to the U.S. Embassy in Santo Domingo to pick up the mail and information?

She couldn't get her passport because her birth certificate was not valid.

 

It looks like this is less likely to happen anyway. She tells me she will fix her birth certificate but I am giving her one month to do it and will cut this loose if she doesn't accomplish this task.

Thank you very much for the advice. The visa was not her Idea, it was mine. She doesn't seem to know much about the process as I have to tell her to specifically do everything. She has not prepared for this at all, although she has agreed to it. I have been to her home and met her family. The money I sent her is for a specific purpose for transportation and fees associated with fixing her papers. I still don't know if we will get married but I plan on visiting her again in one month.

She does not need to have u present to get a dominican passport but she does have to have all her documents in order such as her birth certificate "inextensa" and has to be legalized by the "procaduria" and has to have the proper stamps on it.... and her cedula has to be curent and match the info on the birthcertificate....and yes eveything in DR requires a line and a long wait....running around to different places bc no one seems to know the right answer and 10 ppl will tell u 20 different things....and money....its all about money....so if she is not aware of the process she must go through she needs to find someone over there that can help.her and point her in the right direction and especially someone she can trust so she or yourself are not taken advantage of....now the police certificate and medicals do not need to be done until wayyy later so dont go crazy doin all this bc all that has to be current....one step.at a time bc she wont need her passport till later either....

It sound like she miss understood me when I told her what the plan was. I said to her I would work on the visa here So she could enter the United States while she works on getting her passport. It sound like she took that as she needs to acquire both making the process more complicated than it really is. She said today that she just needs 1 more document and they will give her the passport. Well we shall see. If she doesn't have it soon I am going to get very suspicious. I just don't understand why she would screw me over but I am beginning to think it may be the case.

Ok I will tell her. She is not tech savy. I really don't think she knows what she is doing and It seems like I would have to come down there and do it for her. Good evening, I am a U.S. Citizen living in Sarasota Florida. In August I went to the Dominican Republic on vacation. After 6 days of my two week tour of the country I met a beautiful young lady and was immediately attracted. We fell in love during the 2nd week of my vacation and she cried when I had to leave. I told her we could keep in touch and I bought her a cell phone so she could call and text me.

After talking on the phone and sending text we decided to get engaged.

I sent her money so she could get her Dominican Passport while I work on the K-1 visa. She said she had to go and get a medical examination and obtain a certificate of good conduct from the Departamento de Policia.

Here is the problem. Today she texted me that she was standing in line at the Passport Office in Puerto Plata. After waiting several hours she said that they told her I had to be there with her in order for them to give the passport to her.

I have never heard of such a thing in my life. As far as I knew as long as she met the requirements and paid the fee she should be able to get a passport. A citizen of the Dominican Republic should be able to get a Dominican Passport without the presence of an American Citizen. Am I wrong about assuming this?

This doesn't make any since to me. I plan on going back down in December anyway but I just wanted her to have this done before I Mailed in the I-129F. I am beginning to have doubts that she knows what she is doing or they are informing her incorrectly. Maybe she went to the wrong office or is confusing the Visa with the passport. I really don't know.
