Your visa app. Is good for 1 year.

Once you get the visa stamp in your passport. You don't have any limitations as to when you can travel, once you enter on that visa you are good to go.

First off, I'd suggest determining how long it is from case complete date to interview date. If it's the average of two months, then you should try to aim for a case complete around July, if you want the visa in September. And to get a CC in July, then you should hold off on sending the IV package until June/early July. I'd suggest sending the AOS package though as that's the package where most people get checklists. Remember, once you get your visa, it's typically valid for 6 months. So, that means, you have about 6 months after getting your visa to use it at a POE. But my time frame is all dependent upon Chile's time frame from CC to interview date. If it's two months like I estimated, then what I listed above should be correct. If it's less or more than 2 months, you'll have to adjust it.

About your question about activating the visa and then returning, it is possible. There are many Canadians that do this. They activate the visa, then return back to Canada to tie up some loose ends (lease, job, school, etc). I'm not sure where the rules are on this though. I'd suggest looking at CBP's site first (US Customers and Border Protection). No, you shouldn't need to go with him. Nope, he doesn't need to stay and wait for the green card or SSN. It could takes weeks to receive that stuff. Just make they're going to an address where someone can safely hold onto it until you both actually move.

Thanks to both!

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - April 2012
Hi everyone! Happy Monday morning....!

I have a question...my husband and I have decided to stall a little bit due to the fact that we'd like to move back to the US in Nov./Dec. We applied early because at that point it was still unclear if we would get auto-expedited because we both live abroad or not (and in fact, we did). So now, what we would ideally like, is to have the visa in the September, so that we can leave at any point between September and Jan/Feb. Considering this, when should we stall? I was thinking of sending in the AOS soon, and then just waiting a month or so to send the DS-230. From sending in the DS-230 to having a visa in our hands, how long is that approximately? When should I send in the DS-230 in order to get the visa by September?

Also, can anyone point me in the right direction of where to read about the "rules" that come with the visa in terms of entering/leaving the US? For example, my hubby (I am the USC and he is the beneficiary) was thinking that if we get the visa too early, he could go to the US, enter with the visa, and then come back to Chile. Then we would actually move to the US 1-2 months later. Is that possible? Would I have to go with him? I thought he had to stay in the US for awhile until he got his greencard and SSN? Or is that not right?

Thanks!

For me, the site says:

The system will not be available between 11:30 p.m. on Thursday, April 12 and 11:30 a.m. EST on Friday, April 13, due to scheduled maintenance. If you are unable to use the system during these hours, please try again later.

So, I'm going to wait another couple of hours and then try to log in.

Hehe :P

I'd suggest sending the original to NVC and keeping a copy for your records.

And pay stubs are optional, so that's fine if your dad doesn't have any.

Thanks!

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - April 2012
Question....does the employment letter I send to the NVC be the original? Or should I save the original for myself and send the copy?

Also, my dad is joint sponsor, he is self employed and way over the threshold for poverty line requirements. He wrote a self-employment letter and will send in tax transcripts, but he doesn't have paystubs. Do you all think that will be fine? He doesn't pay himself regularly, so that why he doesn't have them.

What do you think?

I feel like i want to scream, NVC is driving me crazy 1st i have to wait for the IV invoice to be released on the 13th, so i have been sitting and wasting time. I paid my AOS it moved from in process to paid, and when i called they say they have no records of it being paid and that the site is not functioning properly due to the new prices and i also dont see the money coming out of the account. Operator telling me I might have to do the payment again because the site not working properly and i might not have gone through any at all. What should i do???? I hope they really do release those invoices soon, Pending deployment and paperwork is double stress and unhappiness.

I know it's tough, but try to be patient....the money for my AOS fee came out of my bank account like 5 days after I paid (and when I paid, I received an error message). But finally it got all cleared up on its own. Good luck, I hope it works out soon

You put what ever is on line 22 of your form 1040. (I don't know if it includes foreign income or not)

The rule is; foreign income does not count on AOS if it will not continue in the US.

Yeah, I know I don't qualify, my dad will be the joint sponsor, but I'm super confused about what to put. In any case it's sort of irrelevant seeing as how I can't sponsor anyways.

Jesus the Holy Christ!!! Going against what I said earlier about not calling up NVC or DOS, I did end up dialing the DOS number, and lo and behold, I get an interview date for May the 9th at 7.30 am. Posted ImagePosted ImagePosted ImagePosted ImagePosted ImagePosted ImagePosted Image

It's only for the IV fee. If you haven't been invoiced yet, you will get invoiced after the 13th with the new fee. so $230.00 fee + $74.00 surcharge= $304.00. Was $404.00
The rest of us that have already been invoiced are outta luck.

Thanks! I am wondering, though, according to this sentence "The National Visa Center will resend the Immigrant Visa Application Processing Fee bill to those individuals who have yet to pay"....it would seem that those that have been invoiced already but don't pay before the 13th, can wait and thus pay $100, no?
lemayzFemaleChile2012-04-09 14:02:00
IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - April 2012

Immigrant Visa fees are decreasing by $100.00 and non-immigrant fees are increasing by $100.00

Seriously? I thought for sure it would be an increase! I just did a few Google searches but can't find any info on this...can someone please tell me what exactly is decreasing? The original app fee? (Unfortunately, if that's what it is, it's too late for most of us...) The IV fee as well? Any other fees decreasing?

Thanks, and congrats again, Sheeshkabelle!

Edit: just found the link... http://travel.state..../info_3905.html

But I'm still a bit confused, does the "discount" only apply to the IV processing fee? Also is it for sure that all people who haven't been invoiced yet will get the new lower fee, or could we still be invoiced for the current fee?

Thanks!

I woke up this morning to some good news. I had an email from SantiagoImmigration@state.gov in reply to an email I sent them last week about divorce certificates in Chile. I sent them a scanned copy of the divorce decree I sent to the NVC to confirm that it was the correct document. The NVC rejected the document last week and issued a checklist for the IV packet. Here is what the email said:

Mr. Rogers:

Thank you for your email. You are right. The divorce decree you are sending is ok. This is how divorce decrees looks like in Chile. It is very strange as the NVC is familiar with the certificates.

We will contact the NVC to confirm that the certificate you are sending is correct.

Sincerely,

Hoping to get case closed for my wife today so she and my step-daughter can get their interviews scheduled in the next few days.

That's great news!! I've had horrible communication with the Santiago Embassy and they haven't been helpful at all, but it's great to see that in your case, they are actually look for solutions. I hope you get it sorted out soon!

I am. Plus I'm tutoring someone at the moment, so hard to stay up on this thread :P

Underneath each person's post, to the right, is a button called 'multiquote'. Hit this button each time you see a post you want to quote. You can continue onto other pages as well, and it'll remember which posts you wanted to reply to. Once you've got everyone (max of 8 posts, by the way), hit the 'add reply' button at the bottom of each page.

You might not get an email about invoices. My husband nor myself ever received any emails about bills being invoiced. Once my husband saw them invoiced, he just paid right away. Which is what you have to do, pay.

It's probably pending with your bank. Don't worry about it. It'll disappear. The bank probably has a certain time in which accounts are updated.

How did your husband realize it was invoiced? Just checking the Payment Portal every day?

I hope you are right and that the charge appears on my statement soon!
lemayzFemaleChile2012-04-05 13:43:00
IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - April 2012

The IV bill will show up like the AOS bill did. You usually get an email the day after it shows as invoiced on the payment portal.

When some people have had that issue there's a number of things gone wrong.
1. didn't use internet explorer, confusing NVC's servers
2. the bank information was put in wrong, so it never reached your bank in the first place
3. NVC messed up

Give it another day or so. If something went wrong it will go from PAID to REJECTED and you will have to pay again. (if it hasn't been debited from your bank, no biggie) IF the money was debited from your account and it shows REJECTED or it keeps showing PAID but the money isn't debited call NVC ASAP!

I don't like those options one bit :crying:
