Tier2 is a person higher than the 1st person you speak with when you call the 800 no. I called a week before and was given an inquiry number so I do not have to wait on the phone for a long time. They said

Tier2 officer will give me a call. But no one did for 5days so I called again and gave them the inquiry no. they gave me the first time. This time, they asked me to wait, so I waited 2-1/2 hrs on hold. Was worth the wait because the person who answered the phone was actually looking at my 2 petitions. Was told the petition for my husband and stepson were both together and very active as of that moment. She said that my files were on somebody's  desk August 13 and so far so good. She gave me a 6wks wait for a decision which is a normal time she said for somebody to work on if the case has no problem. So yeah, I am holding on to her words that by late Sept to 1st wk Oct, there will be some kind of movement from "Intitial review to Decision". If nothing happens, I guess I have to call them again.

I called USCIS today and talked to a Tier2 officer after 2-1/2hrs on waiting on the line. She told me that both my husband and stepson's files are actively being worked on and has been assigned since Aug.13. Finally my files are on somebody's desk. She also told me that it normally takes 6wks for them to process a case so she mentioned that I may have a decision by late Sept. That's good news, at least I know that my files are not somewhere in limbo...My priority date is Feb.28, 2013.

Does anyone here know if embassy in Manila allows the petitioner to come with the spouse on his interview? I am planning to travel to Manila on his interview, for support. It'll be nice if I can be beside him on his interview...

My name is Ana, and my husband is also waiting for his petition in Manila. Our priority date is 2/28/13. Anyway, my husband could probably help you with that since he has a nice, comfortable car to drive around town. If interested, pls. email me at carmij71@yahoo.com. Yeah, he's reliable, friendly and knows the area very well. If your fiancée does not have a reliable car or knows someone who can drive you around, I will not recommend you driving by yourself (I will not even drive myself  and I grew up there). There's no GPS and it is just too risky for any foreigner.

yes, we have the same case. But my husband and my stepson's petition was filed in Feb. We are still waiting for a decision. I've called several times, only to be told to wait. As I can see, they are still processing some from January and still a lot in February. Hopefully get mine soon coz' waiting is such a torture. If yours was filed after April 30, your paperworks were probably sent to the new office in Overland, for a stand alone I-130. The purpose for that is to make it processed in a normal time w/c is 6-9mos. Whatever is left at Missouri right now, were supposed to be processed by the end of this month (keeping my fingers crossed).  Be proactive, by calling and involving your state official. And when you call the 800 no., alsways ask for a Tier2 officer.

K-1 Fiance(e) Visa Case Filing and Progress ReportsHere is what happened at our INFO PASS. U will be shocked!!
  • Just want to share with you my niece's experience just very recently with "rfe". She had the same thing happened, she called for a month regarding the RFE letter that was supposed to be mailed to her but never came. She went and travelled 130 miles for an infopass appointment but nothing came out of it. She was told that it was mailed again for the 3rd time but  it did not arrive. Very frustrated coz' she was told that until she respond to the RFE letter everything will be put on hold. After 2 mos of waiting, she and her husband moved and had to do a change of address. Guess what? as soon as the address was changed in the system, the "RFE" status disappeared and went back to "Initial Review". No one at USCIS can explain the sudden changed but was told it could be just a "glitch" in the system.

I have mine mailed in a separate packet. On each form, you should have put their name on form I-130, section D "other information".#1. You will be receiving 2 different receipts.

Is your wife here in the US or still in the Phils.? If she is in the Philippines, then your file should have been processed in Missouri then once approved, they will send it to National Visa Center for visa then from there, they will forward it to the embassy in the Phils. where she will be scheduled for interview.  Now if she is here in the states, then they will go to the local field office for processing. Try to call the 800 in your receipt and ask for a Tier 2 officer, don't settle for just the customer service coz' they have all kinds of answer that who knows where it's coming from. You've got to seek help from a lawyer or your congressman if the later was the case. Goodluck...

I am a Jan.22nd 2013 filer I called a tier 2 a few weeks back and they told me

my papers had been transferred to the Atlanta field office. I made an infopass

and went there to check on them and the guy asked me how long it had been

since I filed and I told him. He then asked for my receipt number and told me

he would pull my file only to come back 20 minutes later to tell me that they

don't have my file that apparently it has been lost. My question is does anyone

know how to call the NBC so I could call and see if its there. We are in our 9th

month of waiting and it looks like its all been for nothing unless I can locate

where my papers really are because no one at any kind of office seems to

want to help. I also found out if your in the military they don't have to wait

nearly as long as the rest of us in which I find unfair.

Hi guys,

I made a mistake my husband was inadmissible under section 212a(6)©(i) and not (ii). His order of removal was under section 235(b)(1). Sorry I was confused by the (x)mark on his paperworks, That makes a lot of difference now. I did a lot of reading the last 2days and it looks like it will not be as serious as (ii) is, we may be not be required to file a waiver since his bar is done in 2012 (as per I-212 instruction 2nd page).  I hope I am not mistaken here, but I can see a light at the end of the tunnel. At the same time, it's not over till it's over...

Not sure why you quoted me because I didn't have the question, but it is waiverable, only for non immigrant visas. That being said, it's clear that we didn't get the whole story and I still think the OP has to prepare for the worst.

Thanks for all the input Yes, I did some research just recently on this case. I kind of wonder about that because according to my husband, he did not claim to be a US citizen during that ordeal. They found him overstaying in his first visit for 3 mos and somehow accused him of working during his stay. He told me he just wanted to get out of that situation because they were interrogating him for straight 10 hours. That's why he said yes so he can get out of there. I know that was a stupid move but it's over and done already. And the officer told him because he was very cooperative he will give him only 5yr ban instead of 10. So guys I know this may be a problem on our interview day, but is this really going to be a long shot for us?

Has he gone to the interview yet? The CO at his embassy will issue

a paper to apply for waiver if he needs one, If he does get a lawyer

to handle the waiver, its not just a form it will need briefs & evidences

he may need I 601 for overstay

No, we are still waiting for an interview, we just got approved 3 days ago. This is what I'm afraid of. Waited too long for the approval and now the possibility of more waiting because of that issue that happened so many years ago is just to much to think right now. So even if we waited out that ban, do we still need that waiver? We are hoping that the CO will be very understanding on this for us. Is there any way we can get off that?

He was not admitted at the point of entry in San Francisco. That was his 3rd entry to the US.  They found him overstaying on his 1st visit. We wait out the ban before I petition him hoping there wouldn't be any problem on him coming over again. He was on a tourist visa then and now he is an approved immigrant petition (I-130). So what do you guys think? any input here? I'd like to be ready just in case....

Hi Vj friends,

My husband's petition (I-130) was just approved recently after over 10mos of waiting. He was on a 5 yr ban from 2008 -2013. We waited until his ban was over before I filed the petition. We are now waiting for his interview date in Manila. I am wondering if we will need a waiver for his previous ban? Any ideas here will be highly appreciated. Thank you friends...
