You could always make an INFOPASS appointment to have your I-129F form checked the first time before you mail it, if that makes you feel better. If you do take a lawyer, they will be of no help at all during the interview stage, which is where most applications are denied. You will have to read through VJ to get the most accurate advice.

How sure are you about this woman? Are you sure you want to pursue?

The annulment will make things very slow for your next visa application involving this person. It will certainly be held up in document verification and administrative review for a long time. She needs to make sure NSO is updated now, which will take time. I've heard that it can take years.

Been to phil 5 times this year to see her. Its been a loooooog trip back from Manila today..... wonderful place, and so perhap one day I can meet a wonderful person, but I am afraid I am k-1 maxed out even though I have never married or brought anyone over..... If I choose to can I refile for her now that we have honesty (sort of) on the table, or is that high risk since she clearly lied in the original application. A much more likely scenario, lets say I meet someone new in life, can I still do a k-1?

MAY 12, 2008- NVC sent us a letter about the interview and SLEC appointment, interview set to June 12@ 6:30 AM.
JUNE 2 and 6 2008- SLEC.Passed. They got my passport to forward at Interview date. All the forms I fill out during SLEC: I used my MARRIED NAME. I got X-ray envelop and vaccine records from SLEC, what appeared was my MARRIED NAME.
JUNE 12, 2008- INTERVIEW DATE, I SHOWED my school and TIN ID which bears my MAIDEN NAME, the interview letter header displays my MAIDEN NAME anyway, so problem.
During the interview....
Pre-screener: (Handed me the DS-230 to sign). Please check if anything had changed.
(I thought he handed me the forms my husband submitted when he applied for me so my reply was…)
Me: Can I have my MARRIED NAME appear on my VISA? (Regretted that I say this, it makes me feel I was rude asking this)
Pre screener: That would be no problem (s0mething like that).

Consulate (final Interviewee): Oh, so you want your MARRIED name to appear on the VISA?
ME: (nervous) Yes, Ma'm.
Consulate: all right, that's fine. No problem.

When I got the pink slip and white paper (handwritten: AKA: my married name and my maiden name_
I paid DELBROS and DOc verification fee after teh interview and wrote MARRIED NAME on the form.

All was DONE. Got no clue, JULY 9, I received the VISA packet together with Immigration Data Summary: mistakes showed on the AKAs on the Data Summary.
My VISA printed was my MAIDEN NAME not my MARRIED name. It is okay, I don’t mind.
The mistake that is botehring me was on the Immigration Data Summary which depicts wrong AKAs.

I hope timelines I cited will somehow give you an idea of what happened to my VISA.

I read the link about the old woman you quoted, but widow still has to keep her husbands name unless she files a petition somewhere to revert back to her maiden name. Maybe that was the cause of her problem.

I'm still confused and trying to understand your problem. Was it caused by the fact that you changed your name to your husbands name after your I-130 was filed? If that's the case then I can understand why you were requested to do an NBI that included your new name with your husbands name.

My wife has opted not to change her name (for the time being). So I don't understand why they would insist on putting my name on the NBI clearance if that's not ctualy her name and it is only going to cause problems?

Incidentally, I haven't seen an NBI clearance yet. Does it state marital status? That's one thing that certainly needs to be accurate I could imagine.

Please don't panic.

Please understand that the NBI document will be required the time NVC gather/request for evidences, it will not mixed up or what.
What is important is that you get the NBI clearance with all of your wife's name.

Maybe it's different case to case basis but as I told there was an old lady there that was requested to get her NBI togetehr with all of her names.

she got two from two different places

however, I notice it says in small print in the corner that it's not valid without the thumbprint, but the thumbprint is blank!!!

is this normal for them to omit this, or was my wife expected to add the thumbprint herself after leaving the NBI place? that would seem silly to me because then anyones thumbprint could be added!!!

Did you or your wife try going to the NSO in person? You could start with the local office and then go to Manila.

My wife corrected her birth certificate just last year. When I obtained a copy of her birth certficate online, NSO still only provided me with the old uncorrected one, so I'm a bit worried about that.

This is where I'm confused:

My wife paid the DV only 13 days before the interview, so there is no way it could have been done before the interview according to the tested DELBROS timeframes. Therefore, either they decided not to bother with DV on that occasion or they don't always hand out a white slip while awaiting DV.

At the same time, according to DELBROS, my wife's visa is still in process at the embassy, which means it still has not been printed 6 to 7 days after the interview. So that makes me think they must still be waiting for DV...... or something else?

DELBROS did verify that they sent the docs to NSO, although this could have been sent before the interview as a matter of routine given that my wife paid the DV fee.

I guess the only way I can know is to call the embassy to find out what is the cause of the delay.

I hope it is not some other detail they decided to pursue. My wife and myself had an abundance of evidence ready for the interview (millions of emails, wire transfers, photo album, tickets, phone records etc....) but they didn't ask to see any of it. The pre-screener asked if we had photos but then told us to put them away without us even opening the album, since the album would not have fitted through the window. One other thing: my wife also had a recently annotated (corrected) birth certificate, but they didn't ask anything about that either.

The pre-screener did ask us to come back to the window after the pre-screening when they realized that I was recently naturalized (last year after marrying my wife). But then I informed them that my original US visas were work-based (J1 and H1). Neither my former permanent residence nor naturalization were marriage based. This is something they could also be checking into, but then wouldn't they have given my spouse a white slip if that was the case?

I would like to know also. My wife had her interview on September 16. She was given only a pink slip (no white slip). However, the visa is still in process at the embassy according to www.delbros.com whereas others who had their interview after her already received their visas by the weekend. I'm wondering whether it is DV that is holding things up or something else. They didn't say anything about needing to wait for DV or something else at the USEM.

Other VJ members have been telling me that everything is complete if you only got a pink slip. However, if you did only get a pink slip and are in AR then they must be wrong?

My wife might be in the same boat as you. She got only a pink slip on September 16 but still the visa has not been released to DELBROS.

Just to let others know, my wife received only a pink slip after her interview (no white slip). However I just called the USEM and they state that my wife's case is still being reviewed by the CO. They asked me to check back in 6 weeks if she still hasn't received the visa.

yeah, silly me brought back all of the evidence of proof of relationship with me to the US for safe keeping....... why, I don't know....... it didn't occur to me that she would be going back to the USEM after getting a pink slip.....

even though they never looked at any of this evidence during the k3 interview, I just fedexed it back to her aunt in Manila at a cost of $203!!!

I'm really hoping that all the CO will ask her to do is swear that the information on the DS-230 is accurate and sign and date it, but who knows what might happen

the main difference with the I-130 package is that it already contains some samples of proof of relationship (whereas the I-129F didn't for k3)

plus it also contains information about each time I or a congressman contacted USCIS while the case was pending: I had no idea that would be attached to the file

It seems that we have little choice. My wife should really return to the USEM because I had previously requested an expedite of the CR/I-130 paperwork to catch up with the k3 interview. It seems it could reflect badly on our case if we request an expedite and then change our minds.

If we do decide not to pursue the I-130, I have to send a written letter (fax) to the embassy and then it is up to the consulate officer if they would still permit the k3 visa. Normally, the arrival of the I-130 paperwork at the embassy cancels the k3 visa, although it's not clear to me as to whether this still applies after the interview has taken place. It actually arrived the same day. It's such a grey area that I feel we have no choice but for my wife to return to the USEM.

We were so happy to have had everything done with after the k3 interview on September 16 what with my wife having only received a pink slip. She could have had a visa by now if it wasn't for my prior intervention in requesting an expedite of the I-130 paperwork at NVC.

It's also a pity because we were still in Manila after the k3 interview when the USEM had tried to contact my wife. She couldn't answer any calls because she was in the CFO seminar at that time where cell phones have to be turned off and there was no way for her to know that the missed calls were from the USEM. Return calls to that number cannot be made for some reason. Now she has to fly back to Manila and I won't be with her this time.

According to Lorraine at the USEM, everything seems to be in order and normally she only needs to do the swearing in in front of a consular officer for the CR visa (part II of DS-230). I'm just afraid that something might trigger another interview, which would be unpleasant. My I-130 also contains the letter that was sent from my congressman during the delayed USCIS processing. Hope that doesn't reflect negatively on my case.

Alternatively, if you are in a hurry, you can file for the EAD immediately as soon as your spouse arrives at your home (without filing the AOS which takes more time to prepare), although you would then have to pay the EAD fee.

Some people were able to obtain a temporary 3 month employment authorization stamp in their passport at the POE, although I don't know whether there is formal way to request this, whether it is unique to certain PsOE like JFK or whether it is just a matter of luck (depending on whether the immigration officer is knowledgeable about the subject or in a good mood)?

Maybe some other VJ members might know the answer.

We took a pedicab from the CFO office to PRISM, although I could have walked there faster! They will give you a certificate after you have attended the seminar plus counseling. You will need to go back to CFO with your visa plus certificate to have your passport stamped. They also have a CFO desk in terminal 2 (international part) at the airport.

Philippinesk3 interview experience as written by my wife
I just had my interview last Tuesday September 16, 2008 and it went fine.
I had my husband with me since the Sundayand we had piles of evidences like album of pictures, very thick copies of emails, copies of wire transfers and so much that it took us 2 bags to carry jst in case the consul would going to ask us evidences that proves that our relationship was real. We arrived in the embassy at 5:40 am and stayed on the very right side of the Philippine embassy which is near to the public comfort room because we are very early coz out interview is 7 am. We qued there and waited til the guard told us to go to the white tent and there are already many who cued there even in a very early time so make sure to go there as early as you could and show my appointment letter and they also let my husband get inside and as get inside we again sit down in a wooden chair and cue again until everyone get inside to the embassy and had checked our bags and also checked if we had any electronic devices with us which we did not brought with us because if we did we will be denied to get inside.
As we proceed going to the Non-Immigrant and Immigrant Unit there are already many people in there and we saw some numbers shown in front of us and some small units.
We sat in a blue chair and one lady announced that we need to prepare our appointment letter, 2 copies of 156, 2 copies 157 and making sure that you had your pictures attached on the DS and filled all the blanks in there. And the guard asked us if who are applicants of the 7 am and raised our hands and he let us cue to a small booth that can be immidiately seen when getting inside to the Immigrant Unit. A lady checked my papers and gave it back to me and when it was my turn the lady gave me a small slip which composed of 4 numbers and i get back to my sit.
Afterwards my number is already called by a lady and let me proceed to unit 16 for the finger printing. And after that went back to my sit again. Waited for a longer time to be called for the pre-interview and we havent had breakfast yet because me and my husband was very tensed and excited at the same time that we forgot to eat but at least there is a part of the place that sales drink and some Goldilocks product and some junk foods for a snackand we only got water. My husband was more tense that i do,hehe. And my number appeared and i proceed to window 25 and a lady in there asked me questions like:
Whats your name?
Whats your husband's name?
Whats the nationality of your husband?
How many times does your husband come in the Philippines?
When was your wedding?
Where did you had your wedding?
Do you know that your husband had a wife before?
(my husband was divorced before)
How many times had he divorced?
Have any children?
Do you know what his work?
What kind of work does he have?
And the lady asked me to show my NBI clearance, Marriage Certificate, Birth Certificate, Delbros receipt, ITR as of 2007.
When the lady was asking me i was very focused that i always had an eye contact when i answered her, smiles after answering to overcome my nervousness and i was thankful because my husband was there with me which is a strong factor of an evidence of having a real relationship. The lady asked us to sit again and after 10 minutes sitting my number appeared and proceed to the room 28. Me and my husband went inside and we found a foreign man sitting in front of us busy typing on his computer. He faced us and he told my husband to go out and if he need to asked something to my husband he will just tell him. The man was quite serious that i was very tense, i was very ready with my evidences just in case. He started asking me:
What was your name?
How long were your relationship with your husband?
Whats his job and what kind of job he had?
What do does he do in his job?
How many times did you met?
Whats your age?
Do you know your husbands age?
Does he have any children?
Do you have any children?
And he proceed on typing in his computer and checking my files with him, i was praying that very moment that the interview has to end,hehehe. Which it did! The interview was very fast and i was even expecting that the consul would going to ask me any evidences to prove our relationship but he did not.

I went out to the room and told my husband that the interview was already finished. Weve waited again to the blue chair and my name was called on the releasing window and i was the 3rd on the row that is being told, the first one was given a white slip and a pink slip coz she was asked to give an ITR but she havent produced one and the second was given a pink slip and i got a pink slip too! I asked the guy who gave me a pink slip if how would i know if my visa is approved or not and he told me that if i was given a pink slip that was the time i would know? Im confused! But i still proceed to the Delbros to pay the delivery of the visa??? My husband was confused too..
We went out to the embassy and hoping that i was approve!!!

Philippinesconversion of k3 to CR at USEM done
First I was too anxious to sleep, wondering why my wife had disappeared for 4 hours inside the embassy (out of phone range): now I'm too excited to sleep.

Mostly she was just waiting around, computer not able to open file problems, lunch in starbucks across the road, etc....

The good news is that she didn't have to redo the interview. The k3 interview counts towards the CR visa. However, she had to redo the fingerprints since the fingerprints are different for k3 and CR visas.

She did have to swear in front of a consul, however, which by chance happened to be the same guy as before in a different room, hehe. Really by chance I think because he was surprised to see her again also.

All the effort to rush the I-130 through NVC in under a month was worth it in the end. No need to worry about I-485.

Lets hope there are no post interview mess ups!

I was referring to situations in some countries where a marriage is a business contract between parents. That probably doesn't happen too often in the Philippines, but I wonder how the immigration process deals with it when it does. Just out of pure curiosity.

I do not think it should be assumed they are arranged marriages. as for the examples given, these situations probably do not apply to the majority of applicants.
applicant #1 . it's a requirement of the Fiance Visa to have met in the prior two years of filing the 129-f. it's not mentioned if a waiver was obtained to this requirement. they are very hard to get...
applicant #2 there is no mention of what evidence of ongoing and genuine relationship was submitted.

applicants # 4 & 5. It can take many years to petition a relative from the Philippines. Manila is a high fraud Embassy. a situation like this could come under more scrutiny. again, there is no mention of what evidence of ongoing and genuine relationship was submitted.

anyone in these situations should make sure to submit plenty of evidence of ongoing and genuine relationship.

It should normally take a couple of weeks to reach the embassy after approval, with a brief layover at NVC.

Once your case is approved, call NVC and ask to speak to an operator.

"No record on file" is the best thing the NBI clearance can state. It stated that each time my wife obtained an NBI clearance before her interview.

If the NBI clearance says "No derogatory record," it could raise a red flag at the embassy and they will request more information as to exactly what the records show, which will cause delays.

In order to get a very detailed NBI clearance, you need to go and commit some crimes and wait for them to be entered into the system.

Dear, no records on file simply means you are a first timer in getting the NBI Clearance. Don't worry, try to get another one for Travel Abroad and that should reflect "NO DEROGATORY RECORD"
