I heard that the green card can take a month or two.

My wife entered the US through LAX just over a week ago. We went to the local SSA office last week and her SSN is already in the system, although she hasn't received the actual card yet. They printed out a piece of paper with her SSN on it.

Getting married and filing a I-130 is strong evidence that you want to pursue a relationship.

The going rate for layers is about $5000 and they still won't be present at the interview. They claim to help get your paperwork approved at USCIS, but you've already shown that you can do this yourself. Interview preparation can best be learnt from other VJ members.

My advice is that the $5000 you would have spent on a lawyer would be better spent on trips traveling to see your spouse in China! Multiple trips to visit one another carry a lot of weight in establishing a bonafide relationship.

I would only hire a lawyer if I were to run into serious problems or delays with USCIS.

Often, if the medical screening takes longer than expected causing the beneficiary to miss the original interview appointment, they will reschedule the interview.

If there is nothing to cause a delay at the medical, then I don't so why she shouldn't be able to stick with the original interview date.

Maybe medical screening delays are fairly common in her country???

As long as you also provided her name in her native alphabet, it shouldn't be too much of a problem. Delays are likely to take place during the name check regardless of the spelling.

sometimes you can get lucky!

about 6 years ago I once had a very rapid AOS approval in just a couple of months, which was pretty good going for an employment based application (I-140) smile.gif other people I knew had to wait a whole extra 2 years!

then last year my naturalization went fairly fast: application submission to oath ceremony in about 5 and a half months.... smile.gif

unfortunately the I-130 for my wife took a year to be approved..... sad.gif I never did find out why..... there were no delays or issues at the interview smile.gif


I think my having overlapping naturalization, marriage and I-130 and I-129F applications was just too confusing for inexperienced USCIS adjudicators

If they don't like it at the consulate, they can always ask you to make a correction. They can't deny your visa for that. Alternatively, you can just enter "fiance" and "future MIL" in the remaining space above where you have written "petitioner" etc...

If you want to get through NVC rapidly, having to go through a lawyer is going to be more of a hinderance than help. A lawyer is unlikely to be willing to use the short cuts. In fact they will probably come up with some legal mumbo jumbo for advising against their use. What they ideally want is to process your visa with the minimal amount of work on their part.

The immigration officer was an idiot and had just caused you to be confused. Since you have already a green card, definitely don't apply for AOS (USCIS would just eat the fees and then deny the application because you don't need it). The only thing you will need to do is file to remove conditions of residence during the 3 months prior to the expiration of the conditional green card in 2010.

The pink slip is nothing but a payment slip for visa delivery. DO NOT MISCONSTRUE IT AS AN APPROVED VISA. But receiving the pink slip is a good indication that your interview went well. Should there be additional requirements, your pink slip will be given to you together with your white slip which further instructions.

Depends whether or not you were married in 2007. If so you should either file jointly or separately. You should call the IRS help line. If your spouse earns much less than you in her foreign country, you could get a big refund by filing jointly, with or without an ITIN.

I read on some of the other posts that very recently there have been severe backlogs with the document verification (DV) at the USEM in Manila. To relieve the backlog, they've apparently been asking for CENOMAR or CENMAR documents instead. If that's what is required for your case then your wife needs go to the NSO office ASAP in Manila to obtain the relevant document and take it to the USEM. After the CO has reviewed it, she should receive her visa.

In a way your lucky, because this route might be faster than waiting for DV. Many interviewees still don't have their visas after many months because of the DV backlog. Check out the Philippines forum for more information.

If you are unsure about what documents are required, it would be good to call Lorraine or Grace at the USEM to get some clarification ASAP (don't bother with the visa call center). Your spouse maybe didn't understand the situation at the USEM, but you yourself want to remedy this situation as soon as possible.

The benificary called the USE after one week of submitting the documents asked for at VFS Jalandhar. She alled at 10:00 AM.
They told her her visa is approved.

Do not worry. Your wife will get her visa within two weeks.

I had wondered whether it was possible to make a class action lawsuit, for all those stuck in long delays? There has to be a financial amount in dispute of at least $5,000,000 however for this to be possible and someone has to be the lead plaintiff. I guess one could include the filing fee in that if there were at least 5000 VJ petitioners with extended delays? Those whose cases never get processed within the published processing time ought to be entitled to having their petition fee refunded, wouldn't you agree? At least this way there would be an incentive for them not to delay cases without very good reason.

I have to admit that when I first heard the story I immediately imagined marriage fraud scams, having read stories on visa scams. However, if they're holding a party to meet American men who they would plan to spend the rest of their lives with then I have to agree that it's perfectly legitimate. We all make the mistake of jumping to conclusions sometimes. What we don't want is USCIS to jump to conclusions with our own petitions.

The upgrade is done vis the regular USCIS help line. No need to send a fax. They will ask you for the date and number of the certificate by phone.

Normally the upgrade request should be sufficient enough. The fact that your petition was approved suggests to me that the upgrade was processed successfully. You should not have anything to worry about.

Your case should be transferred to NVC, if not already. Just to make absolutely sure of this, you should call NVC and ask whether an IR visa # is immediately available for your relative and whether they will start processing. The first things that need to be done by NVC are the DS-3032 generation and the AOS payment. If these are generated then everything should be OK.

If NVC don't start processing your application soon or tell you that an IR visa number is not available then you have to remind them that you became a US citizen. If they require proof, then you will need to send them a letter (make sure to include all details: case #, names and DOB of petitioner and beneficiary, copy of naturalization certificate). Make sure you request attention by a supervisor at NVC in order to be sure that a silly mistake isn't made by an inexperienced person at NVC.

I became Citizen Sept 26th and I called CSC Sept 28 to upgrade my petition to my husband. When i called CSC they said to wait for 45 days and they will send me a letter regarding the upgrade. You could always make an INFOPASS appointment to have your I-129F form checked the first time before you mail it, if that makes you feel better. If you do take a lawyer, they will be of no help at all during the interview stage, which is where most applications are denied. You will have to read through VJ to get the most accurate advice.
