Anyone out there who has first time POE experience for a CR visa? Does my spouse with a conditional residence go through the same immigration lane as permanent residents and citizens and will they detain and interview her when she has a CR visa?

The fastest way is to fill out and print the DS-3032 online and mail it next day delivery. It will beat the email version by at least a week. By more if you already have the DS-3032 filled out in advance. Emails sit in the inbox for 2-3 weeks before receiving attention. Just depends on whether you want to make the NVC processing fast or easy.

Despite of the long flight, I was too excited to feel the tiredness yet. But I know it would take a few days to adjust to the time difference and get over the jetlag.

After claiming the baggage, I was not sure whether to line up at the visitor or US citizen/resident line. A woman officer was there to help direct people, she pointed to the visitor line when I showed her the brown envelope and asked where should I go.

Both the visitor and US citizen/resident lines were equally long but were moving at a fast pace. I stayed in line for about 10-15 minutes and then was directed to a separate section for processing. Two other people were there, it took a few minutes for my name to be called. The officer asked whether I speak English and when did we get married. That were the only two questions he asked before he took my fingerprint, had me signed twice on a form and then said we were done and I could proceed to the custom clearance.

The custom clearance was easy, they didn't even open my baggage, just ran them through the machine and I was good to go. I was out at the arrival hall at 3.05 p.m, 35 minutes after arrival. My husband was not there yet as we thought it will take a while to get out. But, didn't have to wait long, he appeared shortly, before I have a chance to get the coins out to give him a call. :-)

No need for pay stubs or letters from employer, unless you want to the reviewer to have to spend more time wading through documents.

It certainly helped in my case for me to be present.

I went to the window of the prescreener with my Filipina wife. She answered all of the questions. When the prescreener asked about the proof of delbros payment, my wife had forgotten that she had that and I was able to remind her in front of the prescreener that she had in fact paid that and that it was in her folder. The prescreener asked her how many times I had visited (which was 8 times including my current trip there). Because I was there in person they didn't ask to see any proof.

At one point the prescreener wondered about my previous immigration history, and asked us to return to the window. I'm a recently naturalized US citizen. My wife doesn't know the gritty details of which precise dates and visas I originally entered the US with, so I was able to provide an answer to that question. I guess they wanted to check that I hadn't naturalized based in marriage?

When my wife had her interview with the CO, I barely had time to sit down before he stated that he needed to ask my wife questions alone. He asked if I was the husband before asking me to leave. Hence he knew I was there, even if he didn't feel the need to ask me questions. My wife had ample evidence (photos, emails, wire transfers, tickets, etc.) but she wasn't asked to show any of it. She had a short interview and received a pink slip afterwards. They also skipped the document verification (DV). There is no way that the DV could have been processed what with us having paid that too close to the interview date. Also, her birth certificate was recently amended (annotated), and for sure the NSO records had not yet been updated, which could in principal have led to delays. The NSO officer had told her to cancel the interview the day before when she visited their office to check on the records! We didn't follow their advice and everything was fine.

The birth certificate of the beneficiary is normally sent to NVC along with the DS-230 after the I-130 has been approved. It doesn't need to be submitted with the I-130 application.

thanks cathy. i was tryin to be firm at my husband at this time coz he might miss something. i was the one who fill up the form and print it out, i also fill out and print the affidavits as well and send it to my husband so that his parents will just sign it and notarize it.

I had an equally horrendous wait. It turned out there was absolutely nothing wrong with my case. No RFEs or anything. My wife had an easy interview and got her visa with no problems. I think I was just unlucky to get a dimwit adjudicator at USCIS. You should definitely contact your congressman just to find out what is happening with your case.

The time it takes depends on luck more than anything else: whether your adjudicator is efficient or not and their level of experience with immigration matters. If you're lucky it could take a month to be approved. If you're unlucky it could take over a year. Be prepared!

The EAD renewal ought to be free if filed with a I-485.

On the positive side, since you waited so long, your wife will qualify for a 10 year green card rather than a 2 year conditional one. The I-485 application plus accompanying forms should then be the last time you ever have to deal with USCIS!

Hi there, can you explain what is meant by "new start date." Does this mean that you gained nothing by sending in your I130 prior to citizenship. The reason I ask is that I'm in the same boat. I mailed my I130 in July, became a citizen at the end of August, but it seems (by the way things are going) that I should have waited until I was a citizen before mailing in my I130. I didn't upgrade my I130 until November unfortunately because at first I thought that mailing the I129F would be sufficient. It should be obvious right! No, but nothing is obvious from what you seem to be saying.

Anyway, I've called CSC several times now since December using the RFE trick (keep asking the same question about my returned 129F check and innocently asking if it was causing a problem with the I130 which seems to be gathering a lot of dust somewhere) and have been told several times since December that my application is "about to be reviewed." However, nothing has happened. Tow weeks ago I called the general help line to request action, given that my I130 is more than 30 days over due. They said that the date for taking action on that request was May 2. Lets see if anything happens.

Infopass at CSC is not convenient for me since I live in NM. Did you manage to learn anything interesting from that experience.

The POE was uneventful... only queuing for 30 minutes. The officer wondered what the CFO stickers and stamps were about in her passport and was surprised that she was already married at a young age.

Glad we got the CR visa. Now we can forget about USCIS for 2 years.

Sounds to me like he should avoid going back to his home country at this time, since then he would have to file I-130/I-129F applications and be separated from his wife for a long time.

He should make sure that he is eligible for the waiver and then file concurrent I-130/I-485 (if that is still allowed) applications after marrying. It's better of the marriage and I-130/I-485 applications are filed before the J1 visa expires in order to maintain a good track record with USCIS.

He might have to make it clear to immigration officials at some point that the J1 visa wasn't obtained before he had intentions of marrying.

In some countries the k3 and CR/IR medical requirements are standardized to be the same and require vaccinations. If you're unable to find any previous records then it just means you'll have to receive many shots at the medical and perhaps might not be able to take all of them on the same day. Might be a good idea to start getting some now before the medical. It would be advisable to schedule the medical as soon as possible in advance of the interview.

The last appraisal value will do (one was probably made when you bought the house). Then you need to include what you owe in mortgage etc... with some proof (i.e. mortgage account to back it up).

A CD is essentially a bank account and could be included along with the other bank accounts. It's up to you whether you include 401k's etc, if it's needed to help your situation. You will probably need to provide evidence if you decide to include it, in case such evidence is asked for at the interview. However, this is only likely to be asked for if your salary by itself isn't sufficient to meet the requirements.

Even though Switzerland is part of the visa waiver program, you can still apply for a tourist visa at the consulate. At least that way your situation will be reviewed by consulate officials and the boarder immigration officers will be more likely to respect their decision, if you're lucky enough to have a positive one. That doesn't guarantee entry of course. The immigration officers can always deny entry to people with visas if they believe that it was obtained fraudulently. However, having an actual visa that was not obtained fraudulently puts you in a stronger position than having nothing at all.

Many years ago my former wife was often taken aside and questioned extensively by immigration officials in Atlanta (that was before we were married) because she was making so many trips to the US to visit me (I was on an H1 visa at the time). She was from Belgium which was and still is part of the visa waiver program. This immigration harassment no longer happened once she obtained a tourist visa from the USEM in Brussels valid for 10 years.

Are you saying when a K1 or K3 is pending on an applicant, US airport custom will know this fact when they check her passport and can possibly deny entry? Remember Switzerland and its citizen are exempt on getting tourist visa. They can get in and out without a formal visa. Thanks

Since it's not normally included in the original I-130 submission, USCIS and NVC will just assume they don't have it. Once the package arrives at NVC and it's time for the DS-230 to be sent, you could always ask them to search amongst the I-130 documents.

However, if the police clearance expires before NVC requests it, you will have to get another one anyway. At this time it would be good for you to find out for what length of time they are current before expiring to give you some idea of what to expect.

Hello guys,

It's been 4 weeks since my last interview at the USEM and so far wala pa ring result. My husband keep on calling the embassy once a week and for the last 3 weeks all the USEM told him was my case is still under AR. But when he called yesterday they said my case has been passed on to another Reviewer last Oct. 17 for the last review and it will take a weeks to be finished.

I don't know kung ano iisipin ko sa sinabi ng USEM if it was a good sign or not so good. unsure.gif
I hope someone here could share their thoughts about it. helpsmilie.gif

Might be a good idea to include a cover letter stating that you have already sent the DS-230 but forgot to include the civil documents.

If you're applying for a k3 visa, that means that you currently reside in Canada, right? Any claimed official residence in the US that extends beyond the time allowed by whatever visa you had may raise a red flag.

Do they have a tracking number or some other confirmation of delivery that they can provide you?

Otherwise they have to be willing to resend it if it is lost or possibly send it to an alternative address. Maybe you should also verify that there isn't an error in the address they have on file at the embassy.

Make sure the visa application forms have your married name there. That's the information they use for generating the visa.

Make sure NBI clearances include all names used and previously used.

An expedite usually requires some sort of special circumstances: e.g. pregnancy, military service, imminent death, etc. so I'm surprised to hear that this was recommended by a USCIS telephone operator for a case that is less than 30 days over the standard processing time. Usually they recommend a service request once the petition is 30 or more days beyond the processing time.

If your BIL is going to file for AOS while in the US, he should definitely not pay the $400 IV fee. That's only if he wants to return to his home company to obtain his immigrant visa at the consulate.

Thanks guys for the replies. Yes BIL stands for my brother in law. I need to go through that link cuz i am not sure what AOS means etc. I believe my sister and BIL have paid the initial fees for the I130 but I think now we have to pay some additional $400 fees.

I don't have the exact timeline but they were married in jan 2006, papers were filed either in feb or march of 2006. he was interviewed in nov 06 and just arrived here this month.
