K-3 Spouse Visa Process & ProceduresUPS Lost my AFFADAVIT!!! Interview Cancelled!
Hi I am beyond pissed off. I sent my Affidavit of Support information, banking statements, etc. to the US Embassy in Belize City on AUGUST 25th on a "2-DAY EXPRESS" [60 bucks], using ****UPS***** First, they claimed that weather problems were causing delays and then after calling them 4 times they finally admitted that they had LOST the package!!!! Not only had they lost it, but they were UNAPOLOGETIC and did not say they would refund my money!

To make matters worse, my husband's interview for last thursday was CANCELLED because they did not have the forms they needed from ME....great....so now they re-scheduled him or next tuesday, but as of TODAY, UPS has STILL not been able to find my package!!!!

**********DO NOT USE UPS FOR IMPORTANT INTERNATIONAL MAIL********* HORRIBLE SERVICE, MEAN PEOPLE, NO REFUNDS!!!

K-3 Spouse Visa Process & ProceduresSTEVEN'S COMING HOME TOMORROW!!! GOT VISA TODAY!!!
Thanks everyone!!! the reunion was AWESOME!!! My mom came with me and I got steven some pretty roses...we were so excited that we never took the "airport photo...welcome to USA" that I had brought my camera for...

i am amazed at how everything has been working out so far...steven is totally at home here and things are incredible...i remember feeling all nervous, thinking, how will he like the USA? but i have no more fears and definitely no regrets....my parents love having a new "son"....we are going to start the next part of the paperwork on monday and in the meanwhile, we are relaxing and doing landscaping for different people around the neighborhood , while we wait for that green card....we are going up to San Francisco tonight to celebrate his homecoming and my b-day...we've rented an awesome hotel room that my friend who works there upgraded to a suite and we are just loving being together 100%...we will post new photos soon! thanks!!! woohoooo!

the craziest part of this adventure is how natural and perfect and smooth everything feels...i thought it might be slightly awkward and admit that i was afraid of letting him finally see my world since I' been living in his world, belize, for so long...but it's really been incredible....i love him so much...

K-3 Spouse Visa Process & ProceduresSTEVEN'S COMING HOME TOMORROW!!! GOT VISA TODAY!!!
WOW i could never believe we would get to this point and we certainly could not have gotten here without all of you guys at VJ--without VJ, we would have been totally left in the dark...thank you sooooo much to everyone for all of your support... we decided to go with the K-3 (even though our CR-1 got approved sooner) and I'm sure i'll be asking questions about the further adjustments soon...but the last thing i'm going to do is bombard him with paperwork on his first day home!

His POINT OF ENTRY is Miami, Florida and from there he arrives in San Francisco (where I live) around 9:00 pm tomorrow! YAAAAAAAY....i'm beyond excited...thanks again everyone!!!! Trust me--its WORTH IT (we almost gave up at one point and we're so glad we stuck it out!)...More details on his interview soon (he interviewed this morning but I've been working so I've not gotten a chance to talk with him more about it).

US Citizenship General DiscussionWhen Do I file for my husband?
My husband received his green card April 20th, 2006...do I file the N-400 3 months before the April 20th date? If so, that would be sending the paperwork in January 20th 2009 -- I remember that I sent in paperwork to remove the conditions on his green card 3 months before his green card date of April 20th, so do I do the same thing for the citizenship paperwork? Thanks

IR-1 / CR-1 Spouse Visa Process & ProceduresJust received I-864

I don't understand. You just finished college. YOu have no job (yet) You live with your parents and they are supporting you. AND YOUR GETTING MARRIED. To a foreigner no less. Geee wiz...my wife gave me the third degree....She was pretty determined to find a guy with a job, and money, and stuff like that. I'd love to know how you managed to find a girl to marry you. YOu must have one hell of a personality. Potential, that's it! Now...once you finish with the I-864, you will need to have some things ready for the consulate/interview. You may want to look at these ahead of time because they can take some time to gather. Good luck to you kids!

What a sarcastic, ####### of a response! very judgmental...it seemed to be addressed to the original poster, but since i am in his/her same situation, i feel offended. I have been in school and while I did work, it did not meet the affidavit requirements--does that make me a bad person for getting married? Meanwhile, my husband works his a$$ off in Belize but gets paid a wage that he could never support me by if we lived in the US...does that make him a BOY instead of a MAN? By the way, might I mention, that only in USA and western cultures, is it so TABOOOOO for parents to be supporting their kid! Uh, in central america where my husband is from, parenthood doesn't stop at age 18 honey...and it is so wonderful to have such supportive family...

Waivers (I-601 and I-212) and Administrative Processes (221g)Waiver question
I am so sorry to hear that you two were denied the K-1 visa. That must be such a disappointment. It sounds like you have already decided to take it in stride and look into other options. I commend you for your strength and commitment to the relationship. I wish you the best of luck and I hope you find a more reasonable route to be together.

Did they actually give him a specific reason he was denied? And, if you don't mind me asking, had he entered the US illegally before and that is the big issue or is it legal difficulties that occured in the past within Panama? I only ask because I am close friends with a couple who are facing a similar situation. She is a US citizen, he is from a foreign country and the two tried for a K3 visa and were basically told that he could come back in 6 months to a year to consider the case. She is trying to prove the same things you were advised to do.....it is a huge pain but they are still optimistic that they can eventually get the visa. I am so sorry for the difficulties. This must be a hard time for you and I do wish you success.

One thing that you didn't mention regarding JFK and your experience arriving........did your fiance get her temporary work permit?

Thanks for sharing your experience. My fiance arrives in a week and I know he is really going through a lot right now. I agree that it is such a bittersweet experience. We have waited and worked so hard to get to this next phase of our realtionship and yet he has to say goodbye to all of his family and closest friends......I wish you the best of luck!

US Embassy and Consulate DiscussionSpanish or English at Interview?
My fiance speaks English very well (except for some pretty common grammatical errors) but I have heard that the employees at the Consulate also speak Spanish. Does it matter in the least whether his K-1 interview is conducted in Spanish or English? I have heard that some of the consulars have pretty poor Spanish so in that case it seems like it may be just as well for my fiance to request that the interview take place in English. Any thoughts?

One week till the interview..........Yipppeeeeeeeeeeeeeeeeeeeeee!!!!!!!!!!!!!! star_smile.gif

US Embassy and Consulate DiscussionHow early did you arrive to the Consulate on the interview date?
My fiance's interview is one week from today and I am getting very nervous as well. His interview is at 12:00 and he is planning to arrive an hour early. From what I have been reading he is expecting to be there for somewhere around 3 hours.

Relax as much as you can, eat something that morning and just try to have faith that this craziness is almost over. Good luck. I am sure things will go fine but I know it is nearly impossible not to freak out!

K-1 Fiance(e) Visa Case Filing and Progress ReportsHow to find others who filed near you?
Hi CourtandGrey,

I am still figuring out this site so it has taken me a while to figure all the features out. Anyway......we have very similar situations so I am constantly checking in on you and the other people waiting on fiance visas for their costa rican sweethearts. I thought I would fill you in a little more on my situation:

Jose and I met while I was working and studying with other graduate students during the summer of 2005. I have returned to Costa Rica about 10 times since then and lived with him the last two summers. He has tried for a tourist visa because I really felt it was important for him to meet all of my extended family and friends but he was denied a tourist visa. We are super in love, super committed and we were not going to let that stand in our way of continuing our relationship. We have continued to talk almost every night, email often and are now closer than ever to getting his visa and getting married.

We submitted our application in October 2007 at the California Service Center. Somehow we got approval in February 2008. This is faster than most timelines were reflecting it would take so I don't want to mislead you into thinking it will only be four months but........in our case, it was so there is hop and apparently some people have good luck every now and then. After we got approval it went to the NVC very quickly and was down at the CR consulate within about 2 weeks. Jose (my fiance) picked up his packet, gathered his work and had one of his medical appointments today and has one tomorrow. Monday he is calling for his interview date. I will let you know when he has his interview, how it goes, what they ask, etc. etc.

I know this is an extremely difficult process. Jose and I have been together nearly 3 years and he has yet to see where I live or meet my friends and extended family. Thankfully, he met my parents and my sister (who all flew to Costa Rica) but he has never seen our apartment where we will be living, etc. etc. It is scary, exciting, nerve-wracking and crazy-making all at once.

I wish you all the best of luck. If you ever have questions, feel free to comment on my page (lunabean) and I will write back. Espero que nos hablamos muy pronto y todo salga muy bien por ti y su amor. -Melissa

K-1 Fiance(e) Visa Case Filing and Progress ReportsWhere are the October filers who filed at CSC?
debbylyn,

Thanks for your response.....it is sort of lonely being a CSC filer from October. I think somehow Jose and I got extremely lucky because our NOA2 happened after only four months and yet the USCIS website is still reflects that they were only processing September petitions on March 15th. I don't quite understand the madness but I am certainly thankful and appreciative that somehow we got our petition approved sooner than expected.

Thanks for the good wishes for the interview! I am having a hard time concentrating on anything these days and counting the minutes till Jose goes for his interview. Logically, I know things should work out but I am still super nervous and won't be able to relax until I hear the good news. Jose and I haven't seen eachother for over 4 months....it is awful! It is hard to believe that after nearly 3 years of a long distance relationship we may finally be done with all the waiting. I will let you know how it goes.

K-1 Fiance(e) Visa Case Filing and Progress ReportsWhere are the October filers who filed at CSC?
Hello,

I only found this great website a month ago.....if only I had known about it ealier so much of this agonizing process would have been easier. I filed my I-129F in mid October '07 at the California Service Center.

Are there many people out there who filed in California who already have had their K-1 visa approved? If the foreign fiance has arrived in the U.S. I would love to hear how the transition has gone.

Good luck to all!!

well I guess they have no reason to do that because your fiance is an american and she or he has got right to do marry whoever they want so as long as relationship is ok why there would be a problem??

K-1 Fiance(e) Visa Case Filing and Progress ReportsWhere are the stats on K1 visa DENIALS???
I am still figuring out all the features of this site and exploring but I can't find any stats that explain just how many people are actually denied from getting their K-1 visa (after the I-129 has been approved).

It seems like most people get the visa with just one interview and a small handful of people have to go back for a second interview but I am sure some people must be denied, right?

Where can I find info on the denial rate?

I am just curious. I know that my fiance and I have all we need but I am still rather nervous. I thought reading some statistics about just how many people are actually approved would help. wacko.gif

K-1 Fiance(e) Visa Case Filing and Progress Reportsgrrrrrrrrr i need to talk about that
I know the waiting can be agonizing. One thing that helped me was getting a rough idea of when I might hear some good news and then I added on some time so that my estimate was very conservative. Of course, I was hoping I would hear something sooner, but having a conservative estimate helped me avoid going too neurotic during the long wait. I also tried my best not to check the USCIS "processing times" until the 20th of the month because if I ended up just raising my blood pressure if I started checking every five minutes starting on the 15th. I learned pretty quickly that the stats don't go up right away and aren't usually changed until around the 22. Another thing that helped me during the wait was staying busy. Even now, as I wait for my fiance's interview date I am just trying to keep super busy so I don't make myself sick with worry, waiting and want. "This too shall pass" and it will be worth it! I hope this helps someone....I just thought I would share some advice from my own experience of waiting. AND, by the way, I know I did get lucky and some people have to wait far longer than my fiance and I had to. Believe me, I am so appreciative and I understand my good fortune. I know not everyone is so lucky but hold on, hang in there and keep the faith!!!!!

K-1 Fiance(e) Visa Case Filing and Progress Reportsvery upset about CSC
I remember reading a blog written by a former processor that contacting a senator or congressman could be helpful and speed things along but the advice was to wait until your petition has been with USCIS longer than the posted processing times. When I checked the USCIS website it appears as though the are just barely getting going on the middle October dates so I would try to hang in there at least a couple weeks.

My thought is that it will mean more to the Senator if you can honestly say that your case has already taken over 6 months to be processed. Then the Senator will know it is urgent and maybe be more apt to respond. I do think they hear from a lot of people so they might prioritize people's cases based on the amount of time the couple has been waiting.

These are just my own thoughts. You can take them or leave them. I know waiting is easier said than done. I wish you the best of luck.....HANG IN THERE and STAY STRONG!!!
lunabeanFemaleCosta Rica2008-04-24 00:00:00
K-1 Fiance(e) Visa Case Filing and Progress ReportsK-1 finally filed today! :)
So I have some positives to share and some negatives:

On the upside, my fiance and I were one of the couples who got lucky. We filied in CSC and I we were expecting about a 6 month wait for our petition to be approved (or longer because we had heard horror stories) but it only took four months! Now, we are just barely over 6 months since filing and my fiance has his interview next week. If all goes well he will arrive in before 7 months since filing. So......I always say, expect the worst but hope for the best.

On the downside, while you very well may be able to get married in December, if you are hoping for a huge extravagant type ceremony that requires a lot of planning and non-refundable deposits then that is too big a risk to take. It will only make the already stressful wait more agonizing and put more pressure on you during an already pressure-filled situation.

I wish you and your fiance the best of luck. I am not a patient person either and this has been a trying process but a lifetime of happiness with someone is well worth the months of waiting that this requires. Good luck!

K-1 Fiance(e) Visa Case Filing and Progress ReportsANOTHER K1 APPROVAL!!!!!!!!!!
At 1:08pm I got the phone call. My fiance, Jose, went into the US embassy at approximately 12:00 feeling nervous, anxious and like he wanted to vomit. Two hours later he left the embassy with a smile on his face!!!! He was approved! After knowing each other nearly 3 years he will finally have the opportunity to come to the US, meet all my friends, and we can begin building our life here together. I am at work right now and am still just sitting here....at first I was shocked, then I started crying, then I started laughing, then co-workers were giving me hugs, then I began making phone calls and now I am just sort of in a daze.

This is crazy!!! I want to thank the VJ community for all the support and for answering all my random questions. A special shout out goes to the 'kid' (you know who you are). You will never know how much reassurance you and your fiance gave Jose and I!

I will be posting a full review on the CR review page soon. I am sure I will start in with a whole bunch of "next step" questions but for now a huge hurdle is behind us.

K-1 Fiance(e) Visa Case Filing and Progress ReportsEmployment letter
I think it is important to document two things: 1. That you are employed (and I imagine your supervisor is a perfect person to do this) and 2. How often and how much you get paid. For this second part I think it would be best to have something from the HR department that states whether you are a regular, full time, part time, or seasonal employee and what your salary is. This helps bolster your argument that you are financially sound.

K-1 Fiance(e) Visa Case Filing and Progress ReportsHelp needed
Your fiance does not need to be at the K-1 interview. I did not go to my fiance's interview and he was approved for the K1 visa, no problem. It is not a requirement! That said, I do think it shows very strong evidence of a relationship if he does go, so, if you are concerned at all that you lack sufficient evidence of a relationship and/or it is not too inconveinant for him to go then it will only make it that much easier.

About the financial evidence......have him get all that they are asking for. It is not very hard to get bank statements and ask his HR department for recent pay stubs. At the interview stage they may never even ask to look at all this stuff but they do require it and you should have all bases covered.

Good luck to you!!!

K-1 Fiance(e) Visa Case Filing and Progress ReportsCali wait time
Honestly, if I were you I would change the wedding date only because I might have a full on anxiety/panic attack in the process of waiting with such pressure. The wait is already stressful enough as it is and having a wedding date and out of town visitors and people making plans, etc. etc. would put me over the edge. That is just my take on it.....only you can know how much you want to count on everything going smoothly and how well you handle the wait.

I agree with what others wrote....it hasn't actually been too long of a wait considering you filed at CSC. Granted it may feel like an eternity, but, you have to remember that USCIS is reporting that CSC is only now working on filers from October 07. You can get lucky, my fiance and I were approved in four months and we filed at CSC but even with the quick approval we are now coming up on 7 months since filing and he hasn't arrived.

I suggest you look at timelines really careful and develop a realistic expectation of when you can start expecting news. Also, check out others from the Dominican Republic forum so you have an idea of how quickly things move once the petition is forwarded to the consulate. That may make it easier to decide what to do about the Chapel. Good luck and hang in there!!!!!

K-1 Fiance(e) Visa Case Filing and Progress Reportsoh people plz plz pray for us
I am sorry this is so difficult and stressful on you and your relationship. I have two suggestions. You can do whatever you like with them.

#1. Call your Congressperson or your Senator and inform them once again that your petition is beyond the timeline posted on USCIS. Sometimes it pays to keep calling and be assertive.

#2. You need to take care of yourself and make your own physical and mental health a priority. Whether that means seeing a counselor, talking to a trusted friend, meditating, working out, taking a couple days off work or whatever...only you will know. I just think this process can make almost anyone crazy and unfortunately it will still be a while before you see your fiance so, in the meantime, you need to figure out a way to stay healthy during the long wait. It will help you, help your be strong for your partner, and keep your relationship in a more stable/healthy state.

K-1 Fiance(e) Visa Case Filing and Progress ReportsJanuary Filers at the CSC - How are you doing?
I am wishing everyone the best of luck on their speedy approvals. I always remind people to expect the worst and hope for the best, that way you will be delighted when and if your petition is approved earlier than expected. If you expect the approval too soon then the wait becomes all the more agonizing and drawn out. I am not trying to be negative in the least, so I hope my message isn't taken that way. I am trying to assist those people who may still have a long wait ahead of them I filed in October in CSC and I guess somehow I was fortunate because my petition was approved and yet I see that many, many people who filed in October are still waiting. I was thinking our petition would take a good six months so I honestly didn't check timelines too often and I think the time went faster that way (I know, easier said than done).

Good luck to all of you. I guess all this waiting goes along with the saying "what doesn't kill you only makes you stronger". The waiting, fees, and all the other hoops to jump through seem unfair but once you are together, in the same country, sharing and enjoying eachother's company, you can begin a new phase of life with your fiance knowing that your relationship survived a very difficult and trying process and you should be proud of yourselves for hanging in there!
Best wishes!!

K-1 Fiance(e) Visa Process & ProceduresQuestion Concerning The K - 1 Visa
Mountain Man,

Your question makes more sense to me now. I didn't know that you hadn't met in person yet so I figured that if you wanted to save time and get the ball rolling you could just mail the forms to her and send them in ASAP. Now I know a little more of your situation. You have gotten some good advice on this thread.....you have to wait to sign the forms until after you have met in person and then yes, you could just have her sign them while you are there so that your I-129 packet can go in the mail as soon as you get back.

Good luck, lunabean

K-1 Fiance(e) Visa Process & ProceduresQuestion Concerning The K - 1 Visa
I am a little confused. Have you met her before? If you haven't met her in person before then I would probably wait and have her sign the forms after your trip. You could always mail them to her. I suppose you could have proposed to her even if you haven't met but one of the clear guidelines is that you have met in person, etc. If this will be the only trip to meet her before you file it seems like you need to have a lot of email evidence/phone calls and maybe even regular mail so why don't you just mail the forms later. Maybe I am unclear on your question.....I don't really know what you are asking.

What a great website.

I'm filling out the G-325As to submit with the I-129F, the ultimate goal being the K-1 visa for my fiancee. In both the residence history and employment history sections of my fiancee's G-325A, there are too many entries in the past 5 years to fit in the space provided. From hanging out on the site and some forum searches, I understand I will need to attach a sheet providing the complete answer.

I just want the details of what this means. Most importantly, should I attach four copies of the extra sheet, one for each page of the G-325A, as this poster suggested? Or just one?

Beyond that, what's the best way to attach the extra sheet? Paper clip, staple, etc? Where in the packet should I place it?

Thanks kindly-
Jonathan

K-1 Fiance(e) Visa Case Filing and Progress ReportsIs our wedding date safe?
Thank you truly everyone for their advice! I totally understand that it is risky to assume we will have the visa by July, but my main question is that in the event our I-129F is not approved yet, there is nothing stopping my fiance from 1) coming to the US under a tourist visa in July so 2) we can have a party and confess our love to each other surrounded by friends and family but NOT obtain a marriage license? Then he goes home waits for the process to complete, comes back, and we go to the Court or Vegas to legally marry? I guess it sounds silly and backwards, trust me the most important thing is to get married to the man I love, but I'm also a girl who has dreamed of her wedding since she was little and I don't want to throw the wedding we have already planned away because of a snail's pace government and a tiny 90 day window...
