OK, well I'm in America til end of may so I'll probably be here for when we get out case nr.. I'm an alien fiance, so I'll have my fiance call. So from what I understand we do not get anything else in the mail, we are just supposed to call the nvc in about two weeks, correct? Asking for new case nr. So after we get the number, I call us consulate in my country to schedule interview?

From NOA2, you can reasonably expect your petition to arrive at the NVC in about 2 weeks' time (the last couple weeks, it's taking about 10 working days).  the number to call there is (603) 334-0700.  Be prepared to call several times until you get through, then be on hold for up to (and maybe beyond) 45 minutes.  You can ask for your new case number, and if they have your petition, they'll tell you what it is after verifying you are the petitioner.  (or the beneficiary?  IDK if they give that info out to the beneficiary)  Once you have your case #, you can look it up online at  https://ceac.state.gov/ceac/

 

It seems like every embassy is different with how they go about setting up the interviews.  I'd research yours at  http://www.visajourn...land&cty=Warsaw

I have noticed that a lot of the embassy information is outdated on here.   For example: I have read through the Irish information, and there are documents listed still that are outdated. If that's what you were going by, there's a decent chance it's incorrect.  I'd respectfully suggest that you take a moment to update your embassy's information on here.  I can't wait to do that for Ireland!  :)

The I-134 is an original document.  If you don't want to waste time and money by mailing this to your fiance', then  don't.  Plenty of people have told you that you should do that, or risk AP after the interview.  It's clearly your choice. I look forward to knowing what their decision is after you email and she prints it instead of it being an original document.  :)

Draft a letter title Evolution of Our Relationship.....should be about three pages long.

In this you will provide a summary of how you first met, what you talked about then, how you came to decide to meet in person, describe that meeting, what you talked about after that meeting, when your relationship progressed to talking about a future together, when you decided to pursue the K-1, what you talked about then, what you talked about a future life together in the US, what you talk about now in planning that future.  Throughout this letter refer to specific documents or evidences that bear these out.

 

Most relationships follow a normal progression and your evidence should bear this progression out.

 

We did a very similar letter. I sent it with the original petition.  then for evidence, I made a document using tabs that followed that progression, and enclosed some evidence.  EX: first time we talked on the phone.  I added a page of my phone bill that shows his number and I highlighted it.  The more you point things out to them, making it easier to find, the better, IMHO.  :)

Hi!  first and foremost, congrats on your engagement and welcome to the forum.  :)  Also, I think I can speak for many when I say that I appreciate you filling out a timeline and being so much on the ball.  IF you sent the petition out today, you need to edit your timeline to take off the Texas Service Center.  You won't know this information until you get your NOA1, as EVERYONE sends their petition to TX.  it's not the same thing as filling out the Service Center on your timeline.  Your NOA1 will tell you if it's been sent to California or Texas.  :)

 

Okay... as for a possible RFE for not having his name on the back of his photo:  I stewed over this (and many other possibilities) for a long time.  I still can't tell you if I put our names on the the backs of those pictures.  We got our NOA2 without an RFE in 60 days via the California Service Center.  :)  Things will be fine.  You already included more than you needed for this initial step in the process.  All you need to do now is relax, be patient (I know... NOT EASY!), and wait for the next information from the USCIS.  This forum is a wealth of information.  I feel nearly addicted to the place.  (I say "nearly" because I'm in denial)  ;)  It can do one thing, though, that you need to be watchful of...  You can obtain "information overload" and that in itself can make you worry and stress more.  Realize that we speak as a collective group of people who, like you, are experiencing the K1 process.  I have my suspicions that some on here are actually immigration lawyers; they're SOOOOO informed.  it astounds me.  :rofl:   If you don't want to spend $50 on medication, channel that $$ into pedicures and massages.  those are both GREAT stress relievers.  ;)

Same rule for every country. The rule is not different for Egypt.

 

This is my understanding of the K1 expiration:  IF you medical exam is valid for a year, then you have 6 months from the date of issuance.  IF your medical exam is valid for 6 months, then you have 6 months from the date of your medical exam.  From what I've read, some countries vary on their medical exam validity.  I could definitely be wrong though!

I have a couple questions:  were you actually taken into custody both times and brought to a police station?  Were you able to see on your Police Cert that they are listed?  If listed, have you been able to get actual court documents about each situation (I think you need these if you were actually arrested)? Based on your quote with regards to moral turpitude, it says "Conviction."  You were not convicted, as you say.  If you were never charged, how can they be held against you?  (I may be naively optimistic here!)  On the vwp, does it ask if you were arrested, charged, or convicted?  there are differences, of course.  I think it'll be fine.  But definitely keep us posted!  :)

We did what you are asking about.  I took screenshots of our emails showing the amount in each thread.  But I also then printed out a few each month to show that we talked and what we talked about.   Also, I included things like facebook messages, whatsapp conversations, interpals messages (where we first met online), skype records, etc.  It was all included in a timeline that showed a normal progression of our relationship.  :)

yes, it might.  Here's one suggestion that WILL do some good:  Don't be rude to the people who are trying to respond to your post. That's the best way to alienate someone who may have the answers your looking for, which frankly, seems to be, "nope, no problem.  Omitting information is perfectly fine.  Too inconvenient to do research?  not a worry.  Embassies don't care about silly details like past addresses and jobs."

 IMHO, an inconsistency with the files will most likely raise an eyebrow.

 

She did answer your question, which was, "do you think they will say anything?"  Her response can be interpreted as, yes, they probably will have questions about it.  You can try to explain why you were "keeping it simple" instead of "keeping it honest." 

 

The good news is when you have your answer, you can report back in a couple months and let everyone know what happened so that people who omit asked-for information will know what repercussions they face.  :)  Good luck!

Hi! I have a question about the affidavit of support requirements. My income for last year meets the 125% requirement, but the previous two years do not. My questions in a nutshell are:

 

1. Will I need a co-sponsor for the I-864? I'm assuming so, as only last year's income was sufficient.

 

2. Will I need a co-sponsor for the I-134? It appears that I only need to prove meeting the requirement for last year, so it appears that I'm fine without a co-sponsor for this?

Regarding the I-134, this is what it says, verbatim, in the packet three information the beneficiary will be sent:  "Evidence of support:  evidence that will show that you and your children, if any, are not likely to become public charges in the United States.  The enclosed information sheet, Evidence which may be presented to meet the public charge provisions of law, lists evidence that may be presented to meet this requirement of law.  If an affidavit of support is to be submitted, I-134, Affidavit of Support, should be used."  

 

I filled out the form and sent this stuff in:  the last 3 pay stubs from my job (I get paid once a month), tax transcripts for the last three years, including 2013, a bank printout showing just my deposits for the last year, and a letter from my employer.  I'm sure it's overkill, but I would rather be over-prepared than under-prepared.

The 160 is the only one you need.

 

 

If the case officer at his interview at the embassy told him TODAY that he needed them, then the DS-160 certainly is NOT the only one you need.  At least not at that embassy.  :(

 

This only concerns me because I worry it'll happen at our embassy too.  :(  However, I think if they're turned in already, or when they are turned in, it should be no issue.

Send in receipts, yes.  We didn't have anything with both our names either, when we met in Dublin.  But HE bought tickets to a hockey game in Belfast, and I bought a jersey while at the game.  I sent both in for proof that we were at least in the same location at the same time.  I assume that was decent evidence, as we didn't get an RFE.  Everything else I sent was proof that I was in Dublin when I said I was, but nothing to prove that we actually met while I was there.  Honestly, if I had known we were going to do this, I'd have insisted on a photo of us holding a newspaper with the date and headline clearly visible.  :rofl:   Good luck!

Oh wow, that sounds awfully frustrating!

I sincerely hope you get it soon. Did you apply for it after receiving the NOA2?

 

It's all very frustrating for me since I need one from a country where I no longer reside, and so it's a much more complicated process.

I just wish I knew exactly what is officially acceptable as "proof" so I could get the process started!

 

It's been very frustrating.  He applied for these items about a month and a half BEFORE we got our NOA2.  Just today, the package with the documents has been tracked from South Africa to Ireland, where he currently resides.  We will finally be good to go for the interview (which is still unscheduled) once he has them delivered to his home. 

 

Him being in another country has been the problem.  he's from South Africa, but has lived in Ireland for several years.  He traveled around the UK for awhile, and we debated whether he should get one from there too, but when his packet 3 arrived from Dublin embassy, it said to get one from each country you've resided in for ONE YEAR or more.  We concluded that the UK police cert was unnecessary.   VJ always says "6 months," but this was not our experience. 

 

They can be gotten from other countries, where you no longer live.  it's just more of a pain.  there have been phone calls, emails, personal visits from his mother to the police in SA to get this done.  And he's paid the fee more than once.  AND had 2 separate copies also mailed to him in the hopes that copies will suffice.  It's been a nightmare, but the only part of this whole process that hasn't gone well, apart from the time separated.   Good luck!

Hi everyone,

 

We have finally received the packet from the Embassy in Buenos Aires and are gathering all the documents to send them. I have run into a problem for the I-134 form, as I lived abroad or the last seven years until about 2 months ago. During this time I didn't file taxes, oops.

 

I read that I'll need the tax returns for the I-864 form, so I will just backfile for the last 3 years and hope there aren't too many fines.

 

My question is then, should I included a letter with the I-134 explaining that I don't have the tax returns, but plan on having them for the I-864?

 

I will be sending a letter from my employer, a bank letter, and pay stubs from the last two months.

 

Would love to see how anyone else handled this!

If you don't owe taxes, there shouldn't be any fines at all.  There wasn't for me when I filed 2010 and 2011 this year.  I got my full refunds.  :)

I know sometimes UCIS website is not reliable but you should get this status after USCIS sent your approved petition to NVC. This is my last status regarding my approved petition.

I didn't get this update on my USCIS status (I just checked it to make sure), and my fiance has his visa in hand already.   I would definitely contact the NVC AND USCIS again.  At this point, you need it remedied because your time on your approval is ticking away.  :(  I'm sorry this has happened.  :(

Hi all,

 

I applied for the first part of the K-1 visa at the start of April of this year. We are being processed at the Texas Service Center. After reading some of the other posts on here I am worried that the first part of this process at TSC is going to take far longer than expected. If all goes according to the estimated processing time on USCIS website of 5 months, then I am hoping that my fiance will have his visa in hand by end of October/early November. 

 

 Being home for Christmas is a very important item for him and would be heart breaking if he is unable to be there because of admin details over here. 

 

If he has his K1 visa in hand before Christmas, he has 6 months to use it.  Your timeline seems way too risky to think that he will be able to legally go home for Christmas if he comes here Oct/Nov.  it would make more logical sense to delay until after the holidays rather than play AP roulette.  Just my $.02

When my fiance went to his interview in Dublin, they kept both his and his son's original birth certificates and told him that he'd need to get new ones for his own records.  Is that normal?!  Living in Ireland, no problem.  He had another for his son that very same day.  But his is from South Africa, and is a nightmare to get!  Does he have any options for getting his original back?  His date of entry to the US is July 25.  Can he take his packet back and ask for them to give his back and take a copy of it for their records?  Can he ask for it back at POE when he gives them the envelop?  Can he possibly get it back during his AOS interview?  I see that the AOS application merely asks for a copy of his birth cert.  Is there another time in the process that he'll need an original?  If not, we can get him one when we go visit South Africa next year.  But if he needs it sooner rather that later, we'd like to know!

I just asked him, and he said it took about a month, and he had it sent to his mom's house.  He's now waiting for her to send it to him and there is worry over the postal strike.  :-/  The military records were the bigger problem.  He had the "lost in the post" back in mid-March.  Hopefully, he'll get them in the next week so he can send in his readiness form.

I can't wait!!  We're planning for next March/April.  :)  And they're coming here for our wedding in October. 

 

As for his paperwork:  he had to get a Police cert, which he processed through the SA embassy in Dublin.  He also needed to get his military records, and those were supposed to have posted about mid-March. He never received them.  His mom has been on the phone with various people; he has been on the phone with various people.  Finally, (and I can't believe this!!  It shows just how different countries are from one another) his mom was able to talk to someone who offered to let her come over to their HOUSE and pick up his paperwork.  :o   I couldn't believe it.  Now he's just waiting for all of it from her to arrive in the mail, and we are good to go!  His medical is this Wednesday.  :D  The police clearance has taken over a month and a half.  But he IS out of the country, so I am thinking that's the biggest issue.

HI SAgirl.  My fiance is also a South African. He's currently living in Ireland, but we are having to wait on getting his documents from SA in order to schedule his interview.  Good thinking getting it well in advance.  :)   Being apart sucks.  HUGE.  But the wait is worth it.  One good thing is it looks like once you get to the consulate stage, it'll fairly quick; South Africa isn't as difficult as other African countries to get through.  There WILL come a time when this is all behind you and you're together.  I am starting to understand the internet issues in SA.  I've never met my future family in person, but we have talked and skyped and it's not a regular thing, sadly.  One thing that I try to do weekly is send my fiance a hand-written letter.  I know he'll get it within about 10 days and the surprise in the mail comforts him as much as it does me to write it.  Of course, feel free to vent here; we know what you're going through, and we are a pretty supportive group.  I'd also suggest joining the March TSC group on here.  They REALLY know what you're going through.  ((((((hugs))))))

Many thanks to all the answers and the reason being we only.just met (in person) is money and job wise, I work full time and it's hard to get time of work as I'm always on call. I would be moving in 2015 thanks everyone.

 

that time frame makes much more sense! I'm sorry I didn't understand you meant 2015.  Your timeline is totally doable.  :)  congrats on your engagement.

Hi first of all I'd like to say this website is brilliant and I don't know what I'd do without it! Thanks, secondly I have been with my us fiancee for a year and a half now and we met for the first time a week ago, we get along so well and I.proposed on the final night of being.there! And I plan on moving over to get married. Basically I'm asking.as she won't have a permanent address until November so I.would like to know if she files the i129 (I will be.living near St Paul! So I'm not sure where it will get send to) if it's send it november is.there a good chance I'll be able to get married in mid august as that's what's planned! This being July 1st, and you wanting to get married (here in the USA?) by mid-August, a K1 visa will definitely NOT work.  A month and a half is too little time.  You can come over, get married, then go back to your country to do a spousal visa though.

I only have experience with the embassy in Manila, and they wanted (and kept!) originals from my fiancee, her Birth Certificate, CENOMAR (certificate of no marriage), NBI Police clearance, and they kept my original signed I-134. We tried to give copies of the BC but CO wouldn't accept a copy.

 

 

 

this has also happened to my fiance in Ireland.  they kept his original birth certificate and told him he'd need to order a new one.  From South Africa.  What a total pain. :(  As for the I-134, it needs an original signature, as everyone else has said.  :)  Good luck to your fiance at her interview! :)
