You should shoot for a CR1. The wait to be processed is a tad longer, but your girlfriend/wife reenters the states, she will already have a green card and will not have to do AOS, unlike us K1/K3 unlucky buggers.

I too was in the US under the Visa Waiver Program, then left, then came back in under a student visa. On my G325A, I did not list my boyfriends apartment as my residence for the time I visited on the VWP. My residence was listed as my parents house in Australia. Once I came back on the F-1 visa, I listed my residence as my boyfriend and I's apartment, as I was living there, going to school there etc. Generally, if you are just visiting a country, you don't put it down as a residence, because it's only temporary. If you go somewhere with a work or school visa, you are living there, so write it down.

From when we did the original submission to me being back in the US, it was a little over 5 1/2 months. The extended wait for my return was only down to the fact that I had a return ticket I could use but could not change. If that wasn't the case, I would have been on a plane back a few days after I got my visa!

I have received a letter dated Oct 22, 2009 for the application for the I129F visa for my girlfriend in Thailand. It is being processed in the Calif office. I have checked on the internet and all it says it that the case is "initial review". How long do I need to wait until she can get her visa to come to America?


What letter was this? NOA1 or NOA2? If you tell us this, we can help you more.

I went through California, we filed at the beginning of August, 2009, and I had my visa the middle of December, 2009. However, your milage may vary, as it is different for each case.

My finace rcvd an email today from the Sydney US Consulate letting us know they have rcvd our approved petition and for us to go ahead with downloading the initial instructions for packet 3.

This email was not sent to me, only him. And i have not yet rcvd anything in the mail here in sydney, and also i checked my status on the USCIS website and it has not changed since Feb 22 when our petition got approved.

I have noticed throughout other peoples timelines that they have dates for when the NVC sent their approved petitions, also when the petition has been touched. Where are people finding this information? the USCIS website doesnt tell me if my petition is touch/sent rcvd. It has only done this for NOA1/ADDITIONAL EVIDENCE/NOA2.

Any help much appreciated.

If it's any consolation, the case status for me never changed. It showed the touch that was out approval, but it never changed to say "approval". It probably still says "Initial processing"!

Once your petition has been approved by USCIS, it's up to you to track it through NVC. Once you get NOA2 in the mail, it's pretty safe to assume that NVC has your file, so you can call them, give them your info and find out if it's made it's way to your consulate. The only reason I got the P3 email was because my now-husband gave my email to NVC and they added it to our file.

I don't have the link but I can tell you how I put mine together!

I wouldn't bother with anything fancy, because they are just going to pull it apart and put into a folder of their own. I wrote a cover letter, told them what was in there for them to look at. All the forms went first (With the pictures for the G-325's in small ziplock bags, paperclipped to them), then my evidence. I didn't staple anything, only paperclips. I highlighted or placed post-it notes on anything I wanted to call their attention to. The pictures of us together all went into a larger ziplock bag that was labeled with it's contents. Each photo was labeled on the back with who was in the picture, where it was, and when.

I then had a large bulldog clip to fasten it all together.

As long as you are married before the 90 days are up, then you are fine. Personally, I didn't feel comfortable leaving getting married until right by the deadline, just because we didn't want to AOS after my I-94 expired. We also knew that the LA County Clerk took it's time issuing marriage certificates. We got married three weeks after I entered the US, and filed our AOS three weeks after the wedding. But, when you marry during the 90 days and when you AOS is up to each couple, as there are extenuating circumstances.

It's very hard to get a work visa. As far as I am aware, your prospective employer pretty much has to prove that there is no one in the US that is available to do that job. So if you are something like a specialized surgeon you are a pretty good chance, but for something general, I don't think you will get it. Also remember that you can not adjust status from the Visa Waiver Program. You would still need to go back to Australia to get this visa.

As someone who has been there and done that with the K1, it really does not take that long to get from start to finish. For me, we were engaged April 2009 (in the US), I went back to Australia in June 2009, we filed for the K1 that August. We were approved in the October, had the visa in December, back in the US in January, married in February, filed for AOS in March. Green card in hand May 1. So from the NOA1 for the K1 to getting the Green Card, nine months. We could have done it even faster, but we had our own timeline worked out.

I don't think there is anything against scouting for work and seeing what is out there while you are visiting, but I really think it's a waste of time.

When you enter the US under the VWP, make sure you bring HEAPS of evidence showing that you don't intend to stay. Bring the evidence that you have applied for the K1, a letter from your landlord saying that they still live there, letters from your employer saying they expect you back, or enrollment at Uni.

With the EAD, it's pretty much what the others have said. You can apply for it when you AOS, which is what most people do. You can also apply for it when you first enter the country on the K1, but you have to pay to file for it, and since they can take up to three months to be approved and are also tied to your I-94 expiry, it isn't worth it.

My divorce wasn't final yet when we sent in the application (it is now). But they say they have no record of having received the application at all so that wouldn't even be an issue. We explained the situation very clearly on our cover letter as to why we were applying now rather than wait and we told them when it would be finalized and that I would have the papers to bring to the interview and/or to forward to them within a month of sending out the application. We knew it would take longer than that for them to process the application so we weren't too worried about it.

Now my question is "is it possible it got lost in the mail or are they just pulling our chains?" Why say they haven't received it if they are holding on to it because of a different issue? They should have some kind of a record of it, shouldn't they? Should we re-file or just wait?


If and when your package is found, it will be denied outright, because you were not free to marry at the time of filing. It doesn't matter if you are free to marry after you file, because USCIS does not know that. To be blunt, USCIS doesn't really care about personal situations, all that care about is if you satisfy the requirements to be approved.

This just means that USCIS has approved your I-129F petition, and now, this petition will be forwarded to the National Visa Center, and then forwarded to the embassy or consulate in your Fiancee's home country . I don't have pictures, but mine was simple. papers that belonged together were paperclipped together, things that were photocopied that highlighter on what was relevant, the photos of us were in a small ziplock bag, and then I bulldog clipped it all together. Into the USPS envelope it went. No dividers, nothing fancy. USCIS are just going to take it apart and put it in the file the way they want.

What I stated is correct, I stated that they will pay the rate of a USC. If you wish to explain fully and break it down, then that's your choice.
Now, a USC rate can be broken down into two different rates: in-state (resident of that state) or out of state.

There are generally 3 different pay scales for college tution: in-state, out-of state or international. BUT a LPR does not qualify for a USC rate be it in-state (resident of that state) or out of state until they have received their GC.


I have worked in the admissions department of a Californian college and I am very familiar with residency rules.

You were partially correct. The important part to remember with tuition rates is that you do not always qualify for in state tuition when the green card is in hand. US residency does not always automatically mean state residency. There is often a waiting period, and in the meantime, the green card holder must pay out of state fees if they want to go to school. A US citizen can move to another state and still be subjected to out of state tuition. How you stated your answer made it sound like it was an automatic thing.

To the OP - since we don't know what state you are from or the specific school your fiancee wants to attend - you are best to contact the school and see what their rules are and what rates you need to pay. As for being able to attend while on AOS - I don't know the answer to that, because I never came across that when I worked at my college. But, once you have the green card after AOS, you are free to attend wherever you please. Whether you have a two or ten year green card doesn't matter.

Now to be correct, once an LPR obtain their CG, they can attend a secondary education school at the same cost of an USC.


Not entirely correct - A permanent resident or a citizen can attend college or university in a US State and pay resident tuition fees once they become a resident of that state. For example, in California, you must have been a resident of the state for a year and a day before the start of a semester in order to pay resident fees. If you do not qualify, you must pay non resident fees, even if you are a USC. Of course, your milage may vary depending on the state you reside in.

Hello, I am currently studying in the US under an F-1 visa. Me and my boyfriend wish to get married, but we're unsure if we should wait until my F-1 expires (and my studies are done) in two years? Is there any complications to applying for a K-1 when I'm already in the country under an F-1? Or should we just wait to apply until my visa has expired, I've left and am back in my home country.

If we wait, am I allowed to travel in and out of the US under the visa waiver program to visit him, while we wait for an answer about the K-1?

I think I read somewhere that the citizen has to prove financial ability to care for the non-citizen, is this true? My boyfriend is currently also in school still and doesn't work - would this negatively affect our application?

And finally, after we do get married, are we allowed to travel in and out of the country almost immediately after the marriage has taken place? We wish to go to my home country and have a ceremony there as well, since some of my closest relatives are too sick to fly to the US, and then honeymoon elsewhere in Europe.

Sorry for all the questions. I've looked through the stickies and guides but still don't feel enlightened about these questions. ^_^;


I studied on an F1 visa for two and a half years, but we chose for me to go back home and do a K1 instead of my adjusting status. Finances were a big part of that, and also the fact that I had not really been home for nearly three years and I wanted to be with my family before I immigrated. It also meant I go go back home and work full time to save money. Really, we could have adjusted my status, but we would have been flat broke for a while. We also wanted to do a 'proper' wedding, and so we wanted the time the K1 would give us. I'm not going to say that the seven months we were apart didn't suck, because I hated every day of it. But, for us, it worked.

So, if you finish your studies and go back to your home country - yes, you can visit on the VWP. Like anyone else, you must show proof that you will leave before the 90 days are up. Be prepared to be scrutinized at the border, and be prepared to show them all your pending K1 paperwork. I chose not to travel back and forth, mainly to save money. Many people travel while they wait.

Yes, your fiance must prove he can support you by showing he earns at least 125% above the poverty line for that year. If he does not, he must get a co-sponsor. If he cannot meet the needs of the financial support, or can't get a cosponsor, you will be denied.

Once you are granted the K1 visa, and you enter the US and get married, you cannot leave again until either your green card is approved, or you get Advance Parole (which allows you to travel without a green card). If emergencies come up, you can be granted emergency advanced parole. But, be prepared to not be able to leave the US for at least a few months. Once you have the green card or the advance parole, you are free to travel.

In my case, we had a small wedding three weeks after I arrived. My family was able to fly out for it, and it really was a great day. I wasn't able to have a lot of my friends from Australia attend the wedding, but that was a part of the sacrifice of the K1. We also couldn't take our honeymoon right away, but that was okay too, because we could save money up for it.

Really, there is no complication on adjusting from an F1 to a green card based on marriage. There would be if say, you entered the country on the F1 and then a month later, applied to adjust. But that doesn't sound like your situation. If you have the money, I would say marry and adjust. You don't have to go home, you could get married as soon as possible, and then once you have your green card, you don't need to be in school full time anymore, and you can work anywhere you want.

I'd heard elsewhere that immigration doesn't look favorably upon people entering on an F-1 visa and then applying for an adjustment of status?
Only if you did it really soon after entering on the F1. I can't put a quantifiable length of time on it, but if you tried to adjust a month or so after, I think you would have a lot of explaining to do.

I have a different K-1 related question but didn't want to start a new thread. My fella and I have been together for awhile (about a year and a half) and I've been doing a ton of research for a long time now. One of the websites I was reading (http://www.usavisano...-1-fiance-visa/) states:

Applicants who have a communicable disease, or have a dangerous physical or mental disorder; are drug addicts; have committed serious criminal acts, including crimes involving moral turpitude, drug trafficking, and prostitution; are likely to become a public charge; have used fraud or other illegal means to enter the United States; or are ineligible for citizenship, must be refused a visa."

The part I bolded is making me think. I have never used illegal means to enter the United States. I've always entered and left in a legal and timely manner. However, when I was travelling with my boyfriend once, I was denied entry on land because I did not have sufficient ties to Canada or proof that I had a definite return date. Since then I've gone 4 times and all 4 times I went through the secondary inspection and passed. I've also had my Canadian passport stamped on my entry back into Canada just to prove that I did, in fact, return.

I'm worried that the fact that I'm red flagged might be an issue in the K-1 application and that they might reject it. Apparently, and I asked one of the border patrol officers this, if I were to apply for a TN status were I to ever get an appropriate job, and I had all the information they require with job offer in hand, the red-flag wouldn't be a deterrent. So I'm hoping he wasn't lying to me and that it would be the same for a K-1 visa.

1) Is there a way to make it so when I try to print the G-325A and I-129F that each of the boxes doesn't have that greyish-blue looking color filled in. I think it is making my printed copy too light and I don't know how to fix that.
2) On I-129F Cover page... the sample frequently says... (Petitioner) or (Beneficiary). Is that exactly what I write or do I put our names in place of Petitioner and Beneficiary?
3) Can everything be dated about 30 days ago or is there a timeframe they have to be dated and then sent. I.e. Dated within last 2 weeks, 1 month etc when USCIS receives everything?
4) Does it matter whether we sign in black or blue
5) Does it matter whether we use black or blue when writing our names on the back of passport photos
6) In the "How did you meet"... instead of attaching an extra sheet. I simply wrote in the box that we met 5 years ago online and then face to face for the first time in July 2006. I rented an apartment there for 3 months to be with her and then have traveled there to see her 3-5 times per year over the last 5 years. See "Proof of meeting and ongoing relationship documents" for exact dates.

And then in the "Proof of meeting and ongoing relationship" area of my packet I have a word document of every date of entry and departure into her country, all pages of my "new" passport showing stamps etc- (3 years old as I lost my old one), all the itineraries and boarding passes I could find (about 75% of them), 4-5 pictures over the last 5 years... 1 each year, and lastly call logs from my phone over the last 5 years. Is that ok for the "How did you meet" question or do I really need to send an extra letter for that? Proof of meeting and ongoing relationship info sufficient?
7) My birth certificate specifically says... Warning: It is illegal to duplicate this copy.... so I should duplicate it and send it in, correct? Also the back of my birth certificate is blank, so should I just put a blank page behind the duplicated front page and write on it "Back of Birth Certificate is blank."

Hopefully that is all the questions. Wow, this really is a process.

I'll try and answer the questions I have answers to, based on what my husband and I did for our K1 petition.

Instead of Petitioner and Beneficiary, we put our own, full, names.
We dated everything on the actual date we did the forms, because we did then a few days before sending them.
We signed in black. I can't remember not if it matters. We never got an RFE for writing in black.
I used black pen (felt tip so to not indent the pictures) on the photos, both passport and the photos of us having met.

For the "how we met question" we answered in direct relation to the stipulation of the criteria of having met in the two years prior to filing. They really don't care about anything before that.

As for proof of having met....we showed about five pictures of us, a copy of our rental agreement that was two years old at the time, and passport stamps and boarding passes from me flying back and forth. We also had boarding passes from us both flying together within the US. We also showed emails between us during the two year time period, as well as phone records. You don't need to show all five years worth, it's overkill, and just more weight to have to send.

I just copied the front of both of our birth certificates. I assume that the illegal to copy stipulation is to stop people from making fakes? Because during your life you need to make copies of you birth certificate and other similar documents all the time to prove identity.


Anyways, thats the short version of what we did. Applied August 2009, Visa approved December 2009, no RFE's :)

True, it's not another "marriage" but people renew their vows all the time. To them, their marriage is the first ceremony, but their wedding will be the second one.

Sorry, the editor died on me!

First of all, the K3 visa is being phased out, instead you would be going for a CR1 visa, which means once the visa is in your spouses hand and they enter the United States, they have an automatic green card and there is no need to Adjust Status like a K1 would. A big positive, in my opinion, because Adjusting Status costs a lot of money and involves a lot of waiting around, unable to work or anything like that.

Like many other people have mentioned, you cannot secure a K1 visa and then get married. However, what many people do on the K1 is get married at the local courthouse to make everything legal, file for Adjustment of Status, and once they have money saved or their green card, have a 'proper' wedding in the US, or go back to the home country and have one their.

Unfortunately, going through the process of immigration is not a comfortable experience. Regardless of what visa path you take, there is a lot of waiting involved while being apart. You have to give up a lot of information about yourselves and you relationship to convince both USCIS and the Consulate that your relationship is legitimate. You have to part with some serious cash. You, as the US Citizen, have to prove that you have make enough money to provide for your future spouse, and if not, have a family member co-sponsor them also. As you said, you don't feel comfortable marrying someone without knowing they will be granted entry into the United States. That is a feeling you are going to have to get over, because every single one of us has had to deal with that.

For my husband and I, the K1 was the best route for us. We have been dating since I was 18, and did long distance for a long time. I did live with him for over two years on a student visa, so we could have married before I left last June and filed for a CR1, but we didn't want to elope and I wanted a 'proper' wedding. It does involve spending more money overall, but since we could afford to, we went for it. Here we are happily married.

Like you said, you are young, and by the looks of it, you have a few years before making a decision. My advice is to both start saving money now. Start gathering evidence now - keeping plane tickets, saving chat logs, letters sent to each other, photos together, anything you can think of that will prove that you are a couple and intend to marry. The more you have, the more you help eiminate the risk of denial. Read this website until you can't take it any more. The tabs along the top of this site have all the information you need. There are forums on here that relate to specific areas of the world, read them too so you know what you have to deal with relating to Uganda. And ask questions! We are more than happy to answer them.

Hello,

While I was always told to never count my chicks before they hatch, this is a serious issue and so I would like to find out as much as I can as soon as I can. I'm not even engaged yet and my boyfriend and I have only been together for two years; we're only 18. In any event, we're currently visiting for 3 months (thanks to a lucky break I got with my university) and if our relationship is strong enough to last until fall '12 when I visit again, we're considering then getting engaged and if/when I visit for the third or fourth time (after K1 approval), getting married.

We're both very young and inexperienced, I know. If you could spare me and take my question seriously I'd definitely appreciate it.

At this point, since we've obviously discussed it, we've both agreed (at least for now) that if our relationship lasts these tests of being apart for years at a time, we would want to get married in his home country. That said, the idea of getting married and then applying for a K3 visa isn't appealing to either of us. I, for one, would not at all feel comfortable ever marrying someone without knowing they then had full permission to migrate to the U.S. Not only that, but getting married and then having to spend more months-years apart until we gained K-3 approval would be horrible.

So, we're wondering if we can go through with the K1 process as described but, instead of coming to the U.S. once he gets approval to marry me, marrying in his country and then coming to the U.S. I know that everyday Americans get married in other countries all of the time and, when following procedure and filing the paperwork to ensure the U.S. recognizes the marriage, end up with few problems. Is this something we too could look into if/when the time comes?

I thought that once the visa has been issued, it can't be revoked? And then, if the beneficiary comes to the States, you just don't marry them? And if they stay in the states, they will then be under deportations orders? A lot a question marks, I know.

Got my interview letter today, December 18 in Chatsworth, CA. Kind of surprised that it's not in downtown LA but also glad because it's less of a drive! Wheeee!!

 

Also I am super stoked because....we are expecting our first baby in May and this means I'll be a Citizen well before baby gets here! Let's hope that I can keep pregnancy brain at bay during the test, haha!

I am confused. 

 

The document checklist mentions the items below, why are plp sending in tax transcripts and leases and bank statements?

 
1. A photocopy of both sides of your Permanent Resident Card 
2. 2 identical color photographs, with your name and Alien Registration Number (A-Number) written lightly in pencil on the back 
of each photo. 
3. A check or money order for the application fee and the biometrics services fee for fingerprinting, as stated in the M-479, 
Current Naturalization Fees, 
 
If you are applying for naturalization on the basis of marriage to a U.S. citizen, send the following 4 items:
1.  Evidence that your spouse has been a U.S. citizen for the last 3 years:
a.         Birth certificate (if your spouse never lost citizenship since birth); or
b.         Certificate of Naturalization; or
c.         Certificate of Citizenship; or
d.          The inside of the front cover and signature page of your spouse?s current U.S. passport; or
e.          Form FS-240, Report of Birth Abroad of a Citizen of the United States of America; and
2. Your current marriage certificate; and
3. Proof of termination of all prior marriages of your spouse (divorce decree(s), annulment(s), or death certificate(s)); and
4. Documents referring to you and your spouse:
a.          Tax returns, bank accounts, leases, mortgages, or birth certificates of children; or
b.           Internal Revenue Service (IRS)-certified copies of the income tax forms that you both filed for the past 3 years; or
c.           An IRS tax return transcript for the last 3 years.
 
We were only planning on sending: 
my Certificate of Naturalization;
marriage certificate
tax return transcript for the last 3 years
 
 
 
Should we send more stuff??
 
 

 

I read that to mean that you need to send as much as you can from that particular line of direction - "Tax returns, bank accounts, leases, mortgages, or birth certificates of children". We sent tax returns, a selection of bank statements, and our lease. We don't have any children yet, so I couldn't sent that yet. Better to send it all now than get an RFE.
