I cant see any lawyer telling a petitioner that t should be no problem not visiting a 129F beneficiary prior to interview.. sounds like a sure fire denial to me... I see so many people on here that got engaged having never held the future spouse but eventually did before the interview.. thats difficult for me but to say no problem going all the way through the interview with no meeting... wow! sounds like bad lawyer to me...

I assume the attorney talked to in HCM was Marc Ellis. There is no better expert on the peculiarities of the US Consulate in HCM than Marc, as he has been involved in hundreds of cases there. He probably referred you to the law offices of Tran Hai Duc in HCM. They'll help drill your fiancee on some of the questions the CO might ask, but I suggest you help to prepare her in advance. It has become somewhat customary for VJ members with SO's in Vietnam to post the questions their fiancee's were asked in HCM after the interview. Go to the Southeast Asia and Pacific forum and search for the threads.

Some specific things they flag cases for in HCM are:

1. Not enough time between the first meeting and the engagement. This is contrary to local traditions.

2. Only one or two visits to Vietnam, or visits of only a few days each.

3. No engagement ceremony. A "dam hoi" or "dinh hon" engagement ceremony is customary in Vietnam. Have pictures available.

4. No pictures of petitioner with the family of the beneficiary. Engagement and marriage is a family affair in Vietnam.

5. Petitioner knows or was introduced by family of the beneficiary in the US.

6. Beneficiary doesn't know enough about petitioner. Seriously, they may ask her questions that an American wife of 20 years might not know. If the information is in the documents submitted, or on ANY public record the consulate has access to, then your fiancee should know this information.

7. No common language. If you don't speak Vietnamese, and she doesn't speak English, they are going to question the relationship.

None of these things will automatically result in a visa being denied by the consulate, but they should be addressed sufficiently in your documentation.

The CO's in HCM are well known to issue blue slips for additional evidence, and ask for documents which were never asked for in either "official" packet. The two most common are a timeline of your relationship, and a list of the beneficiaries family in the US. Again, look in the Southeast Asia and Pacific subform for specifics on these documents. Have them ready - don't make the CO ask for them.

I want to disagree with you. When you go to submit early the person taking them will check to make sure you have what you need. Yes you are correct if you need to make changes it will delay the process, but.... If you wait until the day they request it then they might give you another blue slip so that they can look over the new paperwork you sent in. I have heard many people say they got a second blue slip and it just said they need time to look over the new evidence and that they will call or notify you when they make a decision and you are to simply just wait for them to contact you. I will tell everyone to make sure they have what they need, and to submit it early. They will not give you the visa early, but you can rest easy knowing that you already have turned it in. I also would say to have 2 copies both notorized and both must be EXACTLY THE SAME, have the person going back on the day they want the evidence there with the second set this is just to make sure that if it were to be miss placed you will still have the info to turn in on the day. If the document(s) being turned in are simple and straight forward then there is no reason to wait, just bring it in and get the pink slip.

Now if it is a timeline that needs to be examined and you want to try and speak with the CO about it, then go at the appointed time and hope that you can speak to the CO. But the timeline should explain everything clearly. If it does not, then maybe a longer delay.

In both cases the CO will look over what is being submitted. If it meets the requirement then you will leave with a pink slip. If it needs to be examined you will get a blue slip for administrative processing.

I got an email back just a little while ago (within the hour) which basically said our case is stilll under review and that the beneficiary would be contacted once the case is reviewed in the order that it was received. It was pretty much generic, but I can tell it is a personal email because of the fact that it was addressed to me, it included my case number, and the resubmission date. Let's hope some good comes out of this administrative processing!!!

Administrative Review and/or Administrative Processing
After Your Visa Interview

Administrative Review: Is when your case is being looked at more closely for accuracy and to make sure all security name and fingerprint checks have cleared and your visa can be adjudicated.

Administrative Processing: Means once you have interviewed it is in security checks for any of these situations: you have had a name hit in one of the many data bases, background checks for fraud, or has missing and incomplete information that must be submitted and the rechecked. Processing is more in depth and then the review process and there is no time limit for this processing to complete. Administrative processing can last a few days or months and in some cases it has endured for years.

What is 221(g)?

The 221(g) is a section of the US Immigration and Nationality Act, which is used when the embassy or consulate are unable to take immediate action on a visa case. In rare cases, when additional processing is required, the suspense category used in that case is 221(g) while the additional processing takes place. For example, sometimes the applicant has failed to bring in the correct documentation, has incomplete information or in some cases the embassy wants a co sponsor before they will issue the visa or health reasons are all reasons a 221(g) is issued. In the Middle East/African/ Asian countries these applicants are scrutinized and screened more intensely and thus they have to wait out longer security or fraud investigations until all verifications for security or suspected fraud come back cleared.

The 221(g) forms vary from consulate/embassy and you can get one or more forms after your interview. They vary in color as well as the way they are written whereas some are brief and some are detailed. In most cases they say to contact the consulate/embassy after 45 days. Be aware that the 45 days means business days (no weekends or holidays) and in some parts of the world the processing times are longer than 45 days. Always, try and check for others that are going through the same consulate and see what the average processing time is for the majority of the applicants.

My wife resumit document requeted on 08/6/09 very thing was ok and they ask a lot question she was respond as well incluce they keep all the pictures after that they give blue slip and say that go home wait they call and let wife know

i took off about a month and a half from work for vacation and here is what i did in vietnam. i am from the states and she is from vietnam.

july 1th 2009 - went to ho chi minh city to the united states consulate and sign a paper. forgot what it's called but all i had to do was pay about $30 united states cash, they wont take viet money, and said "i swear" that was that. waited well over an hour just to get up there and say two words and went to the water park. (p.s i dont recommend having coffee at the cafe across the street, they charge outragously just for a small glass of coffee)

july 4th 2009 - got married

july 9th 2009 - went and got our physicals, medical check, etc.

july 10th 2009 - went to the place called suu thu phap in soc trang and did a lot of paperwork. hand them my passport and she hand them her birth certs etc along with our medical stuff. signed a bunch of paperwork and she even said my signature wasnt consistant. geeezzz these folks are crazy about signatures.

july 20th - got our police clearance and went straight to the suu thu phap (i really hate this place) for our interviews. they ask simple question such as when/where/how we met. how much i make here at home, parents name, who intro used, and did any of our parents forced us to marry. no of course.

aug. 2nd 2009 - got dressed up. no tux for me but had a tailor cut me 2 pairs of pants and white shirts. i should have gotten more for work here because they are really nice. as for my wife she wore a white traditional vietnam dress. they took us to the room where we had our interview and gave us a marriage cert.

that's my story. now im working on my cr-1 with a million questions.

Yeah, I know it is better than a denial, but my god, if I was worried about fraud, I would not suspect a teacher that has been teaching at the same school for 6 straight years now, not to mention that I have been with my same company since 2001. I think that other VJ'er was me. My ex is in the can for probation violation (failing to report) on drug charges. She'll probably get out by the time Phuong has her interview. I actually hope not, since I can provide proof of her residence as long as she's in prison. How do you prove the residence of an addict who disappears for weeks at a time?

I don't think it matters what your fiance/spouse does for a living in VN. The odds of a school teacher being a fraud are probably just as high as anyone else.

I'm also beginning to wonder if HCM doesn't work on a quota system. For example, maybe they assume that 90% of applications are fraudulent, so they are determined to shoot down 90% with the hope that most of the ones they deny were frauds and most of the ones they approved were legitimate. I can't find any other way to explain why someone with a relatively weak case would get approved one month, while someone with a much stronger case would get denied the following month. If your case happens to come through the consulate in a month with a high proportion of strong cases, then your chances of getting denied just went up significantly. In other words, your chances might be dependent on the strength of your case relative to the strength of the other cases being processed at the same time, and not necessarily on it's strength when viewed independently. If this is true then it doesn't change the tactics we have to use to help our SO's get approved, but it does mean that there is no predefined threshold we have to reach in order to get approved because that threshold would constantly be changing.

I think the prudent course is to never assume you've addressed your red flags enough, never assume you've provided enough evidence, and always assume that a denial awaits at the next step in the process and plan for your next move.

It's a generic AP blue slip. They're not asking for any additional evidence or documents, and they don't expect him to address it. The blue slip basically just says they need additional time to process it. As Scott says, probably going to the fraud detection unit.
