I petitioned for my Filipina wife and her two minor kids in 2006 and was granted a CR1 and 2xCR2s
They joined me in the states.
Things didn't work out, we are now divorced, and they returned to the Philippines before the 2 year renewal was filed.
The conditional visas have expired.
Looking at the instructions for the K1 (I-129F), I note that a waiver is required if 2 or more K1 petitions have ever been filed. The spirit and intent of that would appear to apply to my situation, even though the strict wording does not apply.

Anyone out there been there and done that?

Should I enclose a provisional waiver request with the I-129F, and hope that the reviewing officer understands what the heck I am talking about? Or does that risk opening a can of worms?

No one mails it to a CA address. The best place to send it is where the instructions tell you to. All I-129F petitions are sent to the Dallas Lockbox facility address as stated on this USCIS page for the I-129F > http://www.uscis.gov/i-129f

 

From that intake facility, files are either sent to the California Service Center or the Texas Service Center for processing.

You are in a Catch-22.   (may have to look that up if you don't know what it is)

 

Kuwait won't give the police clearance for the US embassy without a letter from the embassy requesting it.  The embassy won't give you a letter there in Kuwait as you are not doing your visa there (I am gathering you are going back to the Phils for this) so no police clearance.  Is that about it?

 

The US embassy in Manila knows that Kuwait will not issue a police clearance through its consulate there in Manila, they only issue the police clearance in person.  BUT you can't get the letter from the US embassy in Kuwait...  yikes!  

 

That is a catch-22.  laughing.gif

 

Now IF you are doing your visa process in Manila, relax, the US embassy knows you can't get a police clearance from Kuwait so they don't expect you to have it, all will be fine.

 

Gotta love the ways of government!

 

 

Yea i had the same experience with my fiance. She lived in Saudi and she had a hard time getting a police clearance by time she moved back to Philippines she was not able to get a police clearance. I emailed the US embassy in Philippines and they said since she cant obtain a police clearance from Saudi Arabia while in Philippines, she did not need to get a police clearance.

Actually they do, IF your intent were other then the intended purpose of the K-1 visa.   

 

With the embassy and approving visas I think their motto is :  When there is doubt - deny.

I dont mean to be in the middle of your argument but When you file for a k1 VISA they do care of the intent. There is a reason why they make you sign a contract with "Intent to Mary". So therefor this should be an immigrant VISA and nothing else. DS-160 application only has K1 VISA under immgration VISA. But If I'm off topic of your argument sorry, too lazy to read the whole thread. I know this is 2 weeks old.

Hi. My fiancee's interview is set on august 5 but she hasn't completed her vaccinations yet because we are still waiting for her passport. SLEC wont allow her to do the vaccinations without the passport. We had a claim stub for the passport saying it should have been ready by july 24 but then until now they still dont have her passport. I've read that the medical needs to be done at least a week before the interview which is July 29 for our case. Anyone here who has done the medical just a few days before the interview? WIll there be any problem if its not at least a week? We were thinknig of just rescheduling our interview date to a later date but that might really push us out very far.Thanks for any comments...

1. I concur on the Mom's death issue... My Fiancee is somehow convinced that the Embassy is going to check this and cause a problem... Seems like either way the possibility of them checking is very small, but I agree the truth is always the better option.

2. On the signature issue... It seems like a signed scanned copy should be sufficient... But there I go using common sense. I was hoping it might be an easy shortcut and save some time, money and effort.

on question 2, you can just leave it blank for not signing it. That's what I did when i sent it on April 30, got my NOA1 May 23. Cross my finger that it should be OK for not getting RFE, at least I haven't gotten one yet with regard to this matter.

actually the USCIS acknowledges this G-325a issue and put this memorandum HQSCOPS 70/6.2.11 on November 1, 2005.

When I filed for the K-1 visa, I had the g-325s here with the signatures on them. Knowing no better, I sent copies in with the 129F :oops: I received no R.F.E. I cringed while reading others post about getting RFEd for that. If I had it to do again, I wouldn't chance it, have her sign using another color ink, and bear down, so there is no question about it not being an original signature!


don't think your fiancee need to sign it right away when you're ready to send your completed I-129F. I filled out all G-325a forms but left the fiancee signature empty with the USCIS memorandum attached. I did sent mine on April 30, got NOA1 on May 23 with no RFE yet so far.

USCIS acknowledges this problem on HQSCOPS 70/6.2.11 memorandum released on November 1, 2005.

I had an autoimmune disorder, called GBS (Guillain Barre Syndrome) and i got a tracheostomy (i was on a respirator for quite some time) because of it. It happened 3 years ago but im all good now. Also, this disorder is not contagious at all. I was just wondering if it would affect my chances of passing the medical exam? I have no health problems right now and the GBS is a once in a life time thing only but it still worries me. Thank you everyone!

 

During my medical exam, the doctor asked about my previous hospitalization, if I undergone a surgery before, checked my body for marks/ scars,etc.

My previous congresswoman (They changed the districts couple of yrs back) helped enquire about my case at USCIS and her office was very helpful. Some people haven't seen any positive result after contacting their legislators as well. I don't see any downside in requesting your legislator's help in making an enquiry about your case at USCIS.

Depends on the NVC case number. If your case number starts with BMB its Mumbai. Its true that they don't allow the petitioner inside the consulate at Mumbai and i was there with my wife in the line on Feb 3rd during her interview outside the consulate. They did not let me in and allow only the beneficiary/applicant.

Congratulations on getting the visa for your wife. We kind of have the same background. Both of us were divorced as well.

 

Its strange that my wife has her interview in New Delhi. I thought it would be Bombay coz Hyderabad has its IV center as Bombay.

 

Did your wife had to get another PCC before the interview ( from the commissioner ) or the PCC in the NVC stage is enough ?

Thanks. When i asked the NVC rep about Mumbai being the location for interview than New Delhi, she told me that the location of the interview is based on distance from Applicant's home address. So in our case wife lives in chennai and mumbai is closer than Newdelhi. It made sense. Same logic does not apply to your case so i have no idea why it is NewDelhi for your wife. 

 

Wife got her PCC from the passport office for NVC in October 2013. Even though the I/L did not say to get a new PCC(from the passport office) for her interview on Feb 2014, i asked her to get another one so that she has a latest copy for her interview(Just in case). She did get one around Jan 15th and apparently no docs(PCC, Evidence) were asked during her VISA interview.

It should not take that long. How did your wife apply and at which passport office?  Typically you fix an appointment at http://passportindia...ne/pccOnlineApp and generally after one week you take your ID and go to the passport office and get the PCC.

Buddy, I know the difference between Police Clearance and Passport clearance. I have myself taken out a police clearance twice ( once from RPO and once from the NY consulate )  and they stamped the passport. i dont know why they dont follow a universal protocol everywhere.

All Right and to me the stamping on the passport means nothing and you don't send a copy of it to NVC or give it at the interview and pretty much the letter is what is needed. One other reason asking my wife to get a new one in Jan before the interview. is that we got CC on Dec5th and couple of days later got a checklist for PCC by email. When i called NVC i got different response and one was that its a false one and they have it on file and second one was to bring the latest one to the interview. I/L did not mention about bringing the latest copy of PCC and asked my wife to get it anyway.

Let me explain what I did just to clear the confusion for others. The passport office will provide the police clearance certificate for Indian citizens living in India.

Yes I sen't the PCC given by passport office (I got 2 copies) along with a copy of the stamp in my passport to NVC. (The stamp may not be needed to be sent to NVC but was done at the passport offices where I went and might have been an additional step to prevent fraud and a double verification step if needed, at least in Hyderabad PSK).

Hey Vkrishn, just to clarify. There is such thing as stamp in the passport when you take PCC from passport office. I had my passport stamped with a clearance and date stamp along with two copies of the letter. At least this is true in Hyderabad.

 

 

That has to be the passport clearance certificate. Did you take a copy of that passport page and send it to NVC? I doubt that. They might give you a stamp in the passport (Chennai passport office did not) but I don't think it has anything to do with Police Clearance certificate (which is the letter and that is what you should have sent to NVC and taken to the interview).

I think I myself got the answer to my question. When PCC is granted, the stamp the passport. If that date is more than a year old, then a new PCC is needed. At the consulate if one shows the date on the stamp and if its less than a year, entry will be allowed otherwise no.

 

Guys correct me if i am wrong.

PCC from the passport office is just a piece of paper that basically says so and so does not have any issues/criminals cases and so forth. You are confusing Police Clearance certificate with Passport Clearance Certificate (this is not needed for NVC or during the interview). there is no stamp given in the passport for Police Clearance Certificate from the passport office. 

 

Police clearance certificate from the passport office is all that is needed and they give you two originals. I agree with the 6 month/1yr validity thingy and just to be sure i asked my wife to get PCC in Jan 2014 again. She was given two originals similar to what she got in Oct 2013 that was submitted to NVC. 

 

So she had PCC from Oct 2013 (Original) and two originals from the one from Jan 2014. She took these to the interview and wasn't asked anything anyway.

Step 1

Obtain your Police Clearance Certificate from the Regional Passport Office (The validity of the PCC is one year from the date of issue. Bring the new PCC if the one you have submitted has already expired.) Also note that if you have lived in any foreign country for more than a year after reaching the age of 16 years, you are also required to submit the PCC from that country.

Note: Without the Indian police clearance certificate, you will not be allowed entry into U.S. Embassy New Delhi or U.S. Consulate Mumbai on your interview date.  If you do not have your police clearance certificate in time, you will need to reschedule your appointment for a later date.

 

Does that mean that the applicant does not have to take another PCC if the one submitted to NVC is still valid ?

 

Normally PCC is valid for 1 year ( Its another story that some people say 6 months )

It also says without PCC, applicant wont be allowed in the consulate. Now if the PCC submitted to NVC is still valid and current, how the heck are we supposed to show it before interview, if we have already submitted it to NVC.

 

This new process has left me totally confused.
 

 

When you get your PCC, you are given two originals. One goes to the NVC and other can be carried to the consulate on Interview day.

Totally wrong with respect to the fingerprinting advise! . Please make sure you know the information correctly before you venture out to give it to others! 

 

 

Wife had her interview on Feb 3rd 2014 and i was there with her. First and foremost you need to register and create a profile on https://cgifederal.s...h&country=India.

 

Second once you are done creating the profile, you need to schedule for fingerprinting and biometrics at any of the OFC centers located here based on where your wife is located by logging in to that website. In our case wife was at chennai and had her fingerprints done at chennai location center but her VISA interview was at mumbai. Your wife needs to take her DS260 confirmation page to the OFC center(http://www.ustraveld.../in-loc-ofc.asp) and make sure she gets a stamp from OFC on that Ds260 confirmation page and that is the evidence that she got her fingerprint done at OFC center. This is extremely important and security at the consulate will not let your wife in without the DS260 confirmation page with OFC stamp and I/L. 

 

On the day of my wife's interview another elderly couple who were in the Immigrant visa line to get in to the consulate were DENIED ENTRY because they did not take the fingerprint/biometrics at VAC locations before coming for the VISA interview. I don't know if they got their interview rescheduled but anyway don't make that mistake! 

 

 

Steps:-

 

1) Create a profile at https://cgifederal.s...h&country=India

2) log in and schedule your fingerprinting/biometrics. 

3) Get your fingerprint/biometrics and make sure you get the stamp from the OFC center on DS260 confirmation page. Keep that safe since you need to show that and I/L on the VISA interview day at the consulate to get in. 

4) Get your medicals done

5) Attend VISA interview.

Most important: Make sure your husband gets the OFC stamp on DS260 confirmation page when he goes for fingerprinting at OFC/VAC. They would do that anyway when he gets his fingerprinting done but always good to double check.Your husband would need this to enter the consulate (at least thats what they checked on wife's case and i was next to her) and give it to the Indian woman in the first counter that he will go to. 

 

I am not sure if they will ask him of your 2013 W-2(Even though you would be filing by April 15th of this yr) and a copy of it could be handy. Your presence will make a difference anyway. Don't worry it will be smooth and easy.

I am Mrs ============ i am sad to informed that my husband interview was denied and about to be revoked back to the USCIS despite the fact he answered every questions been asked,we do love each other and our marriage is real and bonafied every member of our family in the states and Nigeria sworn affidavits and receipts on both our names for items purchased in Nigeria and the States we have bonafied evidence of marriage..Emails from home and work,Chat Logs,Facebook,Text Messages,Call records,Life insurance together,Joint bank account here in the states and in Nigeria bunches of pictures before and after marriage with friends and families e.t.c but mostly all this evidence was not checked by consular that interviewed my husband and it was very sad,i couldn't make it to Nigeria since our marriage because we are in financial difficulties because my father was sick and had to take care of him but unfortunately he died January 10th 2013 and my husband job is not presently doing well in Nigeria,i wanted to come December to be with my husband and family and also to witness his interview but i couldn't released at work due to heavy load at the prison at the beginning of the year but i have contacted my Superior at work and forcefully request for a permission to be off work and come over to Nigeria to meet my husband and give us a second interview and we could both answer necessarily question to show our love and bonafied marriage...kindly keep our petition file at the embassy and give us another interview date and i will be arriving to Nigeria early before the second interview with my husband
I would be glad for our request to be considered
