Did you have a pneumothorax ?     You also have a scar on the "outside"  ;)from the surgery?  The doctors should know the scar on your lungs in from the surgery.

 

I know little about the TB testing, except what I read here so I will leave that be.

 

It's parapneuomonia pleural effusion. And yes I got a scar outside from the surgery as well. :)

I'm about to go to my medical this week. I have a scarring in my right lung due to chest tube surgery 6 years ago. I'm expecting to undergo the sputum test because of this. 

 

My questions:

 

Will Sputum/Culture tests show positive results only for Active TB? How about for inactive or latent TB?

 

I understand you'd have to undergo 6-9 months treatment if diagnosed with Active TB? Do you have to undergo treatment too for inactive/latent TB?

Actually, they are pretty slow in sending out their emails. So it is better to call them periodically (probably once a week) and find updates on your case status. So in your case the first milestone is if and when they have 'officially' received your case from USCIS. Next, they will assign a Case # and IIN. This could take another month or so (from the case receipt date). At this point you will be able to give them the petitioner and beneficiary (applicant) email IDs. After that you will be able to log in to the CEAC website and complete the remaining transactions there:

1. Fill in the DS-261

2. Pay the AOS Fee

3. Pay the IV Fee

4. Fill in the DS-260

All of this could take another month or so.

 

Thanks for that information. I do have a lawyer, so most of this info will probably go to him, and he has all of our bio information already, but he does not actively follow up with the DOS, something I've found is necessary to make sure you application doesn't get buried or slowed down.

Congratulations on your I-130 petition being approved. Now the NVC process will be so much faster than what you had to go through already. I sometimes wonder how people keep their sanity and go about doing their daily chores and work with this much stress on the back of their mind.

Call NVC about once a week to find out if they have actually received your case.

 

My wife actually cannot handle the stress, and so I do all of the visa processing myself. A way to love your spouse.  ;)

 

Sorry, I have one question: the NVC will not give you an e-mail when they receive your case, only when they assign a case number? Thanks, bkghosh.

Have you e-mailed any of those people yet?? Keep e-mailing them until you get you what you want!! 

 

I'm not saying you shouldn't ping for the case status (you should), but one lawyer has told me that if you e-mail them too often (ie. more than once a month), they could delay your application out of spite or simply block your e-mail address. The reason being: they are people too and can get annoyed, especially if your e-mails are not respectful.

I-130 approved, finally, since early May PD. On average, it looks like similar cases from China on average are getting assigned an NVC case number within 30 days, as some have already noted. Lawyer says within 60 days. Sorry for those still waiting for NOA2, keep finding more ways to connect with your love.

That's terrible, I'm so sorry you had to wait for so long. Do you have an immigration attorney? Believe me, I understand what it means to wait. My wife (then my fiancee) applied for a K-1 visa only to be denied 3 years (or 37 months) later. Our major problem that took the majority of the 37 months was, in fact, the background check. I would recommend that you not wait for them to "do the right thing" because they won't. The USCIS would rather deny (or worse, intentionally stall) 1000 applications to catch the 1 person that was actually trying to defraud the system.

I called USCIS last week and I talked to a very nice lady. She said the system showed her the current time for my application was 6 to 8 months from NOA1. I said thanks, but I didn't believe what she said. I don't trust their system, they say something different every time blink.png

I mean people who are not accustomed to the terms, I-130, NOA2, etc.  I could have said 'regular folks', or what else would you suggest?  When looking at my letter, it is full of these kinds of terms, that I would not expect people who are unfamiliar with the complicated USCIS processes and procedures to know.  That is what I would like to fix, so that the maximum number of people who are not familiar with these things can instantly understand the full letter.  The only reason we know so much about these things - and believe me, I have better things to do than to learn about the intricacies of USCIS's job - is because their poor handling of our cases motivated us to learn about how they work. 

 

It is an American's civic duty to understand how the US government works, as an informed public is the crux of democracy. What we are advocating is the government's failure to process our petitions in a reasonable amount of time and their silence on the progress of Overland Park. We've paid them fees, and they haven't delivered. Since Ms. Blackburn and her staff are not willing to fill us in on the reason for the delay, we have to assume incompetence. The USCIS is NOT administering the immigration system fairly, honestly, and correctly when cases languish in Overland Park, while others are approved at field offices.

The USCIS is NOT treating the citizens it represents with dignity and courtesy when we contact management for answers on Overland Park and get forwarded to Tier 1 customer service who cannot answer such questions.

The USCIS is NOT using ingenuity, resourcefulness, creativity and sound management principles when wait times to approve I-130's are up to 16.6 months from a 3 to 6 month average.

 

IMHO, we should focus on how they are not meeting their objectives rather than simply complain about how long they're taking. I think this would be the most convincing and effective to Ms. Blackburn and those copied. Just my 2 cents.

In a nutshell, each case is different. For example, a petition from a visa waiver country has less conditions than a petition from a totalitarian/communist country, and the visa waiver country will be approved faster simply because there's less work to do on them.

Agree, Alaskafan has done some good work here. Can I weigh in on the strategy? I think we can take Ms. Blackburn's silence to our e-mails to be either (1) a bad sign that the USCIS is not on target and she is covering up the slip or (2) employee policy to forward all e-mails to customer service instead of answering directly. Either way, we will not get an answer from her. However, I don't think it's such a bad idea to send it to her anyways and copy to the AILA, the White House, etc. as Alaskafan is already suggesting. In the event that she really does give a hoot about these issues and has the resources to help, it can at least make the issue more visible/clear to her to make better decisions regarding our I-130s.

DeltaGal, had an NOA1 date of 4/29, and got NOA2 at the end of September. Does that count?

Both had NOA1 and NOA2 from Lee's Summit.

Interesting.  I checked out your profile feed and saw three I-130 approvals noting Lee's Summit.  There are more I-130 approvals on VJ in recent weeks, though.  Not a lot, but more than three.  You might be right that Overland Park hasn't started adjudicating I-130s yet.  I don't recall seeing an NBC/Overland Park approval as of now.  Maybe, just maybe, there's a large team there, and when they start, the adjudications will fly.  That's what we hope.

 

Sorry, I'm not as ontop of it as I'd like (work and all). If you know of any more that aren't on the list and know where their petitions were adjudicated at, feel free to add. That would be very helpful, thanks! :) My goal was to determine who started out at Overland Park, where they ended up getting adjudicated and when.

so now the word is overland park is holding I-130s and not adjudicating them? doesn't that conflict with the ALIA meeting notes that is floating around here?

 

Given the worst case timeline and that they're not mistaken about their own schedule, division 8 just started adjudicating cases on 9/30. So, we should be seeing decisions coming in from Overland Park, right? April filers said that pre-adjudications (basically incoming quality inspection) have already started and some completed to go into adjudication. It's just a waiting game at the moment. I'm hoping that we're not looking at a worldpeace2013 situation, ... another six months from today? Seems a bit far fetched, but it is another data point to consider.

 

I have been following up with those who have recently had a decision, and so far, all of the decisions in the recent weeks have been from those with NOA1's from Lee's Summit. (I'm keeping a running list in my profile feed) AFAIK, nobody with an NOA1 from Overland Park actually has had a decision yet.

Blueberry do you think everyone's petitions are still being sent to Lee's Summit because of the MSC in front of the receipt number, even though it says Overland Park on the address? I ask because another member mentioned this might be the case.

 

Earlier this week, USCIS told me my case wasn't transferred to Lee's Summit. My USCIS address was and is Overland Park, and my receipt number starts with MSC.

 

 

 

Never even crossed my mind...  

That's probable, I guess. Although unlikely, in my opinion. Why would they put the OP address then?

 

The NBC/Kansas itself is operational already. Just not fully.. 

Or maybe it is already, we just don't know about it.

Hi Simeon is the USCIS affected by the gov't shutdown? I hope not:(( just a thought=)

 

USCIS Tier 1 told me no, but that's just about as good as asking for an opinion on the VJ forums. smile.png We paid for the fees that supposedly fund this operation, so the USCIS should not be affected. If the USCIS has to interface with other government departments, that may be a different story. We do not know for sure what they're doing in their background check. An April Filer indicated that, through an infopass appointment, apps first go through a pre-adjudication (ie. do you have all the proper docs?), then go into the final adjudication process. At least, this part of the process is not affected. The officer didn't indicate when the pre-adjudication was done, just that it was done.

What's the USCIS Office Address in the lower left corner of your NOA1? Did your application get transferred?

 

 

And also USCIS told my husband due to shutdown...the processing will take slow...

I called the USCIS on Monday, and they said we are not affected by the shutdown. We paid for them to process our applications from our application fees!

Just curious, what makes you think you'll get the NOA2 by November? If so, that's really fast coming from a May filer given the hugely long processing times of I-130s right now. I hope you get it!

Jmack confirmed that NOA2 was from Lee's Summit (NOA1=4/1). Delta didn't give me any indication that the case was transferred anywhere else. I suppose there is a chance that the case could've been transferred to KS without Delta knowing. Is that common for NBC(MO) to transfer cases to another location? I thought that was more the exception than the rule?

As an update to this...
 

 

Citizenship and Immigration Services  ? U.S. Citizenship and Immigration services continues to operate. Applications, forms, wait times, and more remain available online (except for E-Verify).

 

It looks like we're still OK. USCIS will remain open. This is due in part to the fact that our visa fees are funding the operation.

 

 

Are any of these NOA2s from Overland Park?

 

deltagal said the NOA2 was from Lee's Summit, doesn't know if the case was transferred to a local office. Not sure about Jmack yet, but I will report back if I do find out anything.

Initial thought was, 'NBC hasn't even begun functioning how could there be a 'shutdown?' It's already 'shutdown!' tongue.png

I don't know how true that is, however, I have googled and come across a recent article posted 5 days ago. Here's the link for inquiring minds.

I know, I can barely stomach it myself. In the last government shutdown, all non-essential functions of government (including visa processing) was shutdown for 3 weeks. So, I'm not really holding my breath. :P
