Hello, I am USC and recently get the NOA2 notice(Notice date: 4/4/2013). Currently, I am trying to get the NVC case number and invoice number in order to submit the I-864 before April 15.
As time approaching, I think I would need to submit I-864 after 4/15. But I am not sure what is the best way to take care the 2012 tax return.

I already extended my 2012 tax return since I want to wait until my wife comes to US and get the SSN so that I can file MFJ to get back some money(several thousand dollars).

My question is following:

Which way is better to submit last three year tax return?
1. Submit 2012(with extension), 2011, 2010, (probably include 2009)
2. Submit 2012(single), 2011, 2010
Amend the 2012 tax return when my wife comes to US.

My CPA told me it may be not good to amend the 2012 tax return especially I change the martial status from Single to Married.
I think her opinion is based on the tax point of view.

For the solution #1, some other VJ member said it is ok to submit the extension.
But I am not sure if my reason of extension is strong enough: want to file MFJ and get some money back.

Which way is better for me, or is there better way for me?

so bring a new ds-230 into the IV Unit on interview day, with the updated address, trade the Vice Consul fella the old one for the new one.

They'll use what's in the new one, but you have to remind them.

Thank you so much! so it's not also true from i heard that issuing of green card  whether  a temporary or permanent one is not base on the date of approval of the visa. Because they are telling even if I delay my entrance in the US, i would still be receiving the 2 year green card instead of the 10 year because our marriage is still less than 2 years at the time of my approval. :)

My visa has been approved 2 months before our wedding anniversary. So what happen now to the conditional status of my visa as it will be less than 90 days already which is required by the INS to file for the petition in lifting my conditional status?  or can i postpone my entry to the US and wait until the wedding anniversary be finish? will that automatically give me a permanent resident status? please help..thank you

Finally we got approved! Just got the alert a few minues ago. Bad news is,we're dealing with a bad "sorta" break up for two weeks now (because of all this waiting). Mixed emotions at the moment. I wanna celebrate but I'm still hanging at the moment. smile.png I haven't told him yet, I don't know if he knows we're approved. I don't know if he'll call. This just sucks.

Yes you'll get a notification once they receive it. We got a notification that they received our reply on the 17th.

Think it is the certified copy from the courthouse that you need.  Take it it is the US petitioner that is being asked for their divorce papers?  I am not 100% sure but maybe the courthouse that dealt with your papers would know exactly what you need

 

Yeah I'm thinking maybe they need the original documents because we only sent in scanned copies of the decree and the annotated marriage certificate. All these terminologies they use is so confusing. blink.png

Hi guys,

We got the hardcopy of the RFE today and I'm a bit confused. Any ideas on what they need? We did send in the final decree of my annulment when we filed so we don't understand what they mean by this. What's a CDLI endorsement? Where do I get these documents? I got the final decree from the court and also submitted annotated marriage certificate from NSO.

 

 

Marriage Termination: Submit a legible copy of the final annulment decree that shows proof of filing issued by the National Statistics Office that terminated the prior marriage between XXX and XXX. The requested copy must be issued with a "CDLI endorsement" (Court Documents and Legal Instruments). This endorsement shows any amendments to the original document from marriages, annulments, name changes etc. Unless a CDLI copy is requested, the requester will receive the unamended or original copy of the document.

Woke up today with an update from the Fiance. We got an RFE! Our case has been finally touched, so that's good news. Now waiting for the hard copy to see what this RFE is about. I have a strong feeling it is about the intent to marry letter because we didn't send one.

 

We don't know if ours was touched because we sent an email both to congress (Mike Honda) and senate (Barbara Boxer) and called in yesterday and spoke to a level 2 officer which filed a service request. Or maybe it was just our time to be processed.

 

But I'm in high spirits now even with the RFE. dancin5hr.gif

Congratulations, I think you were the one in my watched group!  Does your case number end in 265? biggrin.png

 

You're the only one of 25 or so approved today that I'm watching (that's not VJ people, but rather "real" people direct from USCIS dashboard), so huge congratulations on being the lucky first!

 

265 is also in my watchlist in my USCIS portfolio and saw it got approved today. 10 more I-129F WAC numbers and that's ours. rolleyes.gif  I hope we early November filers get our approvals these coming days to come.

Hi Everyone!! I'm Amber. I've been snooping on here for awhile now but never posted, sorry! I got my NOA1 txt on Nov 6th! I gave them a call today because I'm getting impatient. They told me VSC is still working on Oct 1st filers so it looks like we have a while to go still sad.png We planned on getting married August 10th so I doubt that is going to happen sad.png

 

Hi Amber! I feel you. We too are getting impatient. My fiancé called USCIS earlier today too and insisted to be passed on to a Level 2 officer. We got a service request and will hear from them within 2-3 weeks. Try to call again and be assertive on asking to be passed on to a level 2 officer.

The 7 approvals probably has something to do with the fact that for most people the first thing that comes to mind at 2am when you recieve an email is not to go online and update a timeline for other people to see. Also 7 approvals a day is not slow and last weeks average of around 30 approvals per day is not normal and probably never has been. Two approvals a week is slow on the otherhand, but is fairly standard for CSC over the last 5 months.
 

 

Yeah I hope more members update their timeline later.. I guess I just got really excited for the past two weeks hoping CSC would keep approving the same amount of applications everyday, 7 approvals now seem slow for me. :) But it's just the start of the week, there's still more time left this week. I really wish they get to touch early November filers this week. :)

Yeah, that was the only red flag I can think of and the main reason why I wrote this letter. From what you have been advising, it looks like this letter is not necessary then. All the information about what my wife and I have been doing/staying are more like supplemental information for the case. We all have other documentations to prove it and we will include them with our filling.

I'm not sure how to understand your situation. You were saying you registered (registered where?) a year before you had a wedding? By registering, did you have wedding rites or was it a court or city hall wedding?

Thank you for your reply. We registered our marriage at a civil court (owned by the government) in my wife's hometown. The marriage certificate is officially signed by the government body in my wife's country so I am sure there's no problem with it.
I am writing this letter because I am not sure whether USCIS will have any problem with us having our wedding ceremonies 1 year after we were registered.
Would really appreciate if you guys could provide some advice for my situation.

I really need your advice on my I-130 prepared for my wife (alien spouse). The thing is that my wife and I actually got married 1 year after we were registered due to some weird customs in my wife's hometown. I am writing an explanation letter to the USCIS to explain this and I would really appreciate if you could help me by reading it and providing some feedbacks.

Please kindly note that TXTXTX is the current country that my wife and I are living in and YZYZYZ is my wife's original country. I omitted them due to some privacy concerns and I hope you understand.

I, (Petitioner’s Name), would like to use this letter as a chance to clarify a couple of things on our I-130 Petition for Alien Relative and to inform you of our future plans together.

First of all, I would like to explain why the date on our marriage certificate (XX/XX/2011) and our actual wedding dates (XX/XX/2012 in (my wife’s hometown)) are 1 year apart. Originally, we wanted to have our wedding shortly after we were registered in 2011. However, according to the traditions in my wife’s hometown where the wedding date is normally chosen based on the broom’s and the bride’s birthdays and birth years, the year 2011 was not a good year for our marriage ceremonies. Unfortunately, we found out about this custom only after we were registered and we regretfully had to postpone our wedding ceremonies to 1 year later.

In addition, in 2011, since my wife was still working toward her Bachelor degree in YZYZYZ, we decided against applying I-130 at that time for my wife to move to the United States with me.

In September 2011, I moved to TXTXTX and started working for XXXXX Company in order to stay closer to my wife. After my wife completed all her coursework at her university, she moved to TXTXTX in October 2011 and started living with me while working on her thesis for her graduation in 2012. During the period from October 2011 to June 2012, my wife flew back and forth between YZYZYZ and TXTXTX to work on her thesis. In July 2012, after completing her thesis and all the graduation requirements, she started working full time in TXTXTX. In November 2012, we flew back to YZYZYZ for our wedding ceremonies and came back to TXTXTX in December 2012. At the present, we are living together and both working in TXTXTX.

Looking forward, we would like to settle down in the U.S. and plan to have our first child in 2014-2015. We also would like to live closer to my parents so that we can take care of them better. We sincerely hope that our wishes will be granted so that we can reunite with our family in the States.

. What is certificate of marriageability? Nowhere in our petition, we refer to each other husband wife. He also states in how we met section that we did not get married. We are together over 8 years. He states that we did not get married cause he lost his job and that is the truth. He also states that he filed for fiancee visa after I left US and after he got a job. I think we are ok. Overanalyzing

 

A certificate of marriageability (or marriageability affidavit) is required for some countries. It basically states that in an official form that you are single and not married. Or if you were married, that you are now divorced. I remember submitting one for my K-1 application. I would check with an attorney about whether or not this is required for you. Below is what a quick Google search brought up for me:

Turkish Marriage Procedures 
(As of February 2014) 
 
All marriages in Turkey must be performed according to the civil marriage code of Turkey. Religious ceremonies 
have no legal effect. US military personnel are reminded to obtain permission to marry from their commanding 
officers. 
 
Below are the steps to be followed: 
 
1. Execute an affidavit of marriageability (bekarlik belgesi) at the Consulate General, Istanbul. You will need to 
present your passport and divorce decree (if you have a previous marriage). Then have this affidavit certified 
at the legal office of the governor (Valilik Hukuk Isleri, Cagaloglu). 
 
2. The affidavit should be taken to the marriage bureau (Evlendirme Dairesi) having jurisdiction over the place of 
residence of the Turkish party (see list) and marriage application forms should be picked up from the marriage 
bureau. The American party must submit a passport and six photos. If one of the parties is Turkish, an 
ikametgah ilmuhaberi from the village elder (muhtar) may be required. 
 
3. Complete the following forms from the marriage bureau: 
Statement of Marriage (Evlenme Beyannamesi), Census Card Sample (Nufus Cuzdani Ornegi), Marriageability 
Document (Evlenme Ehliyet Belgesi) and Marriage Statistical Form (Evlenme Istatistik Formu). The Turkish 
party may be required to provide a certified birth registration document from the census office where the father 
is registered. 
 
A medical examination is optional: each party has the right to demand that the other undergo a medical 
examination. 
 
4. After completion, all the appropriate forms are to be turned in to the marriage bureau and a 
 marriage date is to be scheduled at the marriage bureau. 
 
If you wish the marriage ceremony to take place outside the marriage bureau and outside office hours, you 
should tell the marriage officer. Transportation expenses of the marriage officer and his assistant to the place 
of the ceremony and their return home should be paid at the time of their departure from the ceremony. 
 
5. Spouses of United States citizens are entitled to immigrate to the United States if not 
 otherwise ineligible. If your future husband or wife is not an American citizen or 
 permanent resident and if you plan to reside in the U.S., the foreign spouse will need an 
 immigrant visa to enter the U.S. The American must file a petition (Form I-130) on behalf 
 of the foreign spouse. This cannot be done until after the marriage. Please contact the 
 immigrant visa unit during information hours for instructions regarding the filing of an 
 immigrant visa petition for your spouse.

Hi everybody, so i was going over the i 129 f petition that my fiancee sent. We are waiting for our NOA2. As i was going over our whatsapp conversations that my fiancee sent, i saw a sentence that my fiancee said as " I will work on the marriage." But by marriage, he is referring to fiancee petition. And nowhere in other conversations, we refer to each other as husband or wife. Still do you guys think this " I will work on the marriage" sentence will cause us to get scrutinized or even be rejected by CO thinking we are already married? . We certainly are not. I am going to the interview in Turkey. Am I thinking too much? Please help

 

I think you should not have sent them all of your chat logs. It will probably delay your case. They would not take the risk of skipping over any incriminating lines in your chat logs. When dealing with government, always provide only what is asked for in the most concise way possible, nothing more, and nothing less. Did you submit any evidences like a certificate of marriageability?
